building a better bay area for a safe and secure future, this is abc 7 news. >> we have breaking news in the santa clara county this morning. some residents have been evacuated as a fire burns close to homes near morgan hill. you're looking at a live picture from our crew on the scene. it has been a busy weekend for crews across the bay area, with dozens of fires, some caused by fireworks. good morning, everyone. it is sunday, july 5th. thanks for joining us. i'm liz kreutz. we have a lot to get to with the fires overnight, but first, let's start with a quick look at the weather. because of course that is going to impact these fires. lisa? >> yes, liz, the sea breeze picking up later today. from the fireworks, we certainly have a lot of haze in the atmosphere. air quality has not been great, because high pressure trapped that pollution to the surface,

and as you look at the rock there, you can see how hazy it is. there is no marine layer. that is just poor air quality. 57 in the city. it is 59 in oakland. 55 in mountain view. 59 in san jose, with 53 in pacifica. walnut creek looks better over into the east bay but things will clear out as we get some mixing and the winds pick up throughout the day. 50 in santa rosa. 55 in napa. low 60s by the delta with the light wind. 65 in concord. we're warmer this morning, anywhere from a degree to about nine degrees warmer. that's going to translate into another warm day today around the bay and inland with 80s to low to mid-90s returning, and we'll look at that cool coast, that sea breeze picking up, and the fog expanding later on tonight. liz? >> all right, lisa, thank you. we want to get back to the breaking news in the south bay, where a brush fire is prompting evacuations near anderson lake, this is east of morgan hill. again in santa clara county. here is our live look there, this is being called the park

fire, and now that the sun is coming up, you can see the smoke there, still some flames burning in the distance, and this is supposed to be some pretty tough terrain that these firefighters are working through right now to fight this fire. cal fire says at least 40 acres burned, as of 1:00 this morning so we are awaiting another s update from them. we'll see if it's burned more at this point and morgan hill police say ten homes have been evacuated. they do not expect the fire to threaten any more homes. east dunn road before anderson lake is closed. keep that in mind if you are traveling through this area. cal fire says to avoid that area if you can. no word yet on the cause of this fire. contra costa county firefighters had a busy holiday responding to dozens of fires, this is fire in bay point, crews are working to put out the flames on wharf drive, as fireworks go off in

the background. it's unclear what started this fire. 16 fires were caused by fireworks last night in the span of five hours. our news director said she's in oakland, that they were hearing fireworks going off until 3:30 this morning. here in san francisco, around 4:30 this morning, from our station on the embarcadero, we could hear some illegal fireworks going off, very loud, sounded very close, so really, this has been happening all through the night. in all, there were 67 total fires here in the east bay, including ten structure fires and 27 vegetation fires. there is some good news, though, no homes were lost and no one was hurt. abc 7 news reporter ansar hassan has more from pittsburg. >> reporter: firefighters were quick to contain a fire burning near classrooms at delta view elementary in pittsburg. firefighters say it was started by illegal fireworks. >> i know it's a holiday but they need to be careful.

because this is our school. this is our neighborhood, so we want them to be careful. >> reporter: contra costa count y fire officials say they ramped up fire crews, working with multiple agencies for what they're expecting to be a very busy fourth of july. >> we will respond to probably 20 to 30 or more fires just here in the east portion of our county tonight. our resources are stretched thin. it's not even dark and we've responded to three fireworks caused fires. >> typically the highway 4 corridor through pittsburg and antioch is typically busier for us and our fire district. >> reporter: it's also a saturday night, with so many people stuck home because of covid-19 and no public fireworks, chief brouchard says it's led to an increase in people using illegal fireworks. >> with the noticeable uptick in fireworks usage, unfortunately it feels like it's in every city, in every community that we serve. >> reporter: pittsburg, ansar

hassan, abc 7 news. san francisco firefighters were busy all night as well responding to more than 20 fires. one happened at mclaren park in visitacion valley and another near the old site of candlestick park and hunter's point. it's not clear if either fire was caused by fireworks. the department staffed extra firefighters this weekend to handle the influx of calls. those fires come hours after a grass fire in san francisco's bay view that was caused by fireworks. photos show where flames scorched the ground here and fire spread to two acres before crews were able to get it under control. fire department's warnings certainly didn't stop people from setting off illegal fireworks last night. this is video from the bay view area, which shows colorful bursts lighting up the sky, not far from power lines either. that is concerning. here is a time lapsed video of the illegal fireworks in san jose. if you didn't know better, you would almost think that these

are professional fireworks, there's so many of them. we've heard reports of about a dozen small brush fires in the city of san jose, but it's not certain that those are related to fireworks. so a very active weekend. with almost every fourth of july celebration canceled in the bay area, gilroy was the only official show in the area. abc 7 news reporter kris reyes was there and tells us why this year's celebration is so important to that community. >> reporter: any other year this annual tradition of lighting up the skies would have been one of many celebrations all over the bay area but we already know this year is unlike any other. notice the masks, the social distancing in the crowd. >> >> they're not planning to go there. we're planning to stay there in the car. >> reporter: the city of gilroy went ahead with their fireworks show to boost morale. it's been a tough year for the city. in addition to dealing with covid-19 closures and cancellations, it's also still healing from the hooting at the gilroy garlic festival last year that killed three people and injured dozens.

>> i think it's a great idea. i think morgan hill should have had theirs, too. >> we couldn't do fireworks in our town and this is like not as busy as santa cruz. >> we're trying to stay away from everyone, wearing masks when we're close to people so i think that would be okay. >> reporter: this is literally the only show in town. this year the parade was canceled, the pandemic turning gilroy's downtown into a ghost town. this is what it looked like, shuttered stores, barely anyone around. still at this fireworks stand, optimism. they're raising funds for a local school and fireworks sold out fast. >> we have a lot of new residents here in gilroy that are coming to get fireworks because they're trying to give their children some more memories and make it a little bit more special for them while we're still in quarantine. >> reporter: this year's fireworks launch from gilroy high school is higher than last year, to give people the chance to spread out, so that homes within two and a half miles could see them. >> we're gilroy strong. we're making a comeback.

carolina. two people are dead and eight others are hurt after a shooting at a nightclub near greenville. the sheriff's office says deputies responded to a disturbance at a club called lavish lounge around 2:00 this morning. they called for backup when they heard gunfire. no one was immediately taken into custody. the coronavirus pandemic changed the way many americans are celebrating the fourth of july weekend. across the country, health officials are encouraging people to stay home as cases continue to rise. abc news reporter christine sloan has the details. >> reporter: independence day festivities were drastically scaled down due to the ongoing coronavirus pandemic. in our nation's capital, president trump hosted a celebration on the south lawn of the white house. social distancing wasn't enforced and not everyone was wearing a mask. during his remarks, trump said his administration has tested 40 million people so far. >> we've made a lot of progress, our strategy is moving along well.

it goes out in one area and rears back its ugly face in another area. >> reporter: beaches that would normally be packed for the holiday closed in california, texas, and florida. >> we have to follow these rules but definitely here the beach with the young crowd, it's a good idea. >> reporter: however, some decided to forego social distancing. scenes like this, hundreds of boaters forming an island on minnesota's lake minnetonka, and lake of the ozarks, concerning health officials. with cases increasing in 39 states, nationwide 80% of fireworks displays are canceled. the daily nationwide death toll and the mortality rate have been on the decline, but deaths are rising in 14 states and hospitalizations are up in 27, christine sloan, abc news, new york.

as professional sports gets back to business, a growing number of players and staff are testing positive for coronavirus. alex prichet has more. >> reporter: one of biggest nascars biggest stars test positive for covid-19. legendary champion jimmie johnson learned he and his wife have the vir us. >> we're trying to be as healthy as we can but on the homefront with our kids, you know, we're heartbroken right now to see the fear in their eyes. >> reporter: johnson's diagnosis highlights an ongoing program. how to restart sports keeping athletes healthy. major league baseball teams reported for spring training for a shortened season while announcing 31 players tested positive for the virus. all-star mike trout not hiding his anxiety. >> honestly, still don't feel comfortable. obviously with the baby coming, there's a lot of stuff going through my mind right now, my wife's mind, my family. >> reporter: the nba is trying to return to action later this month.

starting at 10:00 this morning. guillen is a ft. hood army specialist, missing since april. her family believes her remains were found this past week. they say guillen disappeared after she told them she was sexually harassed by a superior but didn't report it out of fear of retaliation. california congresswoman jackie speier is calling for an investigation. federal prosecutors have charged 22-year-old cessry aguilar in connection to the case, accused of helping another soldier get rid of guillen's body. the other soldier who was a suspect killed himself when confronted by authorities. new details about a story in the south bay. a restaurant in morgan hill serving customers outside for a month now is ordered by the state to stop, and that order could affect every restaurant in santa clara county. abc 7 news reporter deon lim got the county's response. >> i have no idea why the state abc is doing this. >> reporter: these dramatic surveillance pictures provided

by dan mccrany, the owner of la dera grill show members of alcohol beverage control abruptly shutting the restaurant down friday night. >> we were visited by two armed officers, everyone was worried. >> reporter: the closure caused confusion and outrage at the restaurant which had been open for outdoor dining since june 5th. the police chief saying abc told him the county did not have approval from the state for dining outdoors. morgan hill city attorney vowing to find a solution. >> we want to do the right thing. we think we are doing the right thing and if we're not doing the right thing, somebody needs to tell us what we're doing wrong. >> reporter: while no citations were issued, abc informed us they visited numerous establishments and explained santa clara county had not received variance to open and was technically in violation of california's stay-at-home orders. >> i was up 'til 2:30 in the morning, reading everything

governor newsom has published, everything that i could find on the net, i see nothing that would be a directive that we could no longer have outside dining. >> reporter: the owner of the grill says this is yet another blow to his business, after losing half a million dollars since shelter-in-place orders began. they defied abc orders and say they'll continue until otherwise stated by governor newsom. >> i find this reprehensible and i'm not going to comply unless i get a clear directive. >> reporter: deon lim, abc 7 news. >> santa clara county had been allowing outdoor dining for the past month. the county responded to us in a statement saying in part "the county's application for a variance was not approved by the state. the county is in continued conversations with the california department of public health regarding its application." adding to the confusion, the county did apply earlier this week for a different variance that would have allowed the reopening of hair salons, nail salons and gyms. a woman seen on surveillance video appearing to intentionally cough on a 1-year-old at the san

jose yoga land the woman has been fired. the oak grove school district confirmed to abc 7 news the woman in that video is no longer an employee. she was seen here on video walking over to the baby's stroller, pulling down her mask and then coughing. police say it appeared to be some sort of dispute over social distancing. at last check the woman had not been arrested. tensions are running high in martinez, where a black lives matter mural was defaced. the words black lives matter were painted in front of the contra costa county courthouse yesterday and one of the artists tells abc 7 news the mural is a direct response to white power flyers found in martinez early last week, but just an hour after it was painted on the street, another group covered it up with black paint, while shouting "all lives matter." >> i think that this is an indication of how much power white supremacy actually has, the fact that even having something on the street for one hour, they couldn't even

tolerate that. it was such a threat to have anybody else's concerns represented by the city and represented by the community. >> the artists were able to fix the mural. the "martinez news gazette" reports police are investigating the incident. another check of the weather with meteorologist lisa argen. hey, lisa >> hey there, liz. we didn't have any official fireworks but we certainly have the remnants of that with the haze out there. the pollution has really been up to moderate to unhealthy levels throughout the morning hours due to the lid on the atmosphere, the area of high pressure. you can see the haze behind me. it's certainly not a pretty sight out there, and we don't have the marine layer. light wind. once we have the mixing, the lid will be lifted on the atmosphere while the pollutants here that are trapped underunderneath the area of high pressure and we'll see better air quality but this is what we have this morning here and with that, temperatures are warmer. so it's a bit hazy and not so great out there right now.

56 in the city. 59 in oakland. mountain view is at 55. san jose 59. low 50s on the coast and in gilroy. here is a look at the golden gate bridge. winds will come back today from the northwest so the relative humidity not too much of a concern, but they will be from breezy to gusty at times. increasing throughout your monday. mid-50s in napa, with low 50s up to the north, and mid-60s over in concord. 61 in livermore. 54 here. santa cruz going for a high of 79. our beach hazard statement for dangerous conditions, the winds up to 20, 23 miles an hour later on today here in santa cruz. so a clear with haze this morning, the warm weather returns around the bay, and inland, and looking at a cooling trend as we get going into the week ahead, as the system to the north allows for our marine layer to expand and those winds to come back. here is a look at the current wave height, seven to eight feet.

stinson and around santa cruz, this lasts until 8:00. here is a look at the marine layer. it comes back throughout the overnight hours, waking up to patchy fog and throughout the afternoon. it sits along the san mateo coast, the marin county coast allowing for the numbers to come down, maybe eight degrees or so. the breeze throughout the afternoon today, 6:00. gusty winds at the coast, and the lighting up through the overnight hours. look what happens into your monday afternoon. we've got the winds with us into our inland valleys, up to about 25, maybe 30 miles an hour, and that high is dipping back into the 80s for your monday inland. 77 in oakland today. it will be 84 in napa, so the warmth will be with us from walnut creek to danville, and pleasanton with low 90s, mid-90s out by the delta. about the same in the south bay with mid 80s and in the north bay, warm one for santa rosa at 92. 83 in san rafael and those winds here in san francisco.

spectacular featured a musical score from the new york fill r philharmonic and appearance by john legend. a series of displays ran throughout the week so that new yorkers in each borough could get their own show. macy's never gave a time or location but announced a general vicinity just before showtime. the secretive displays were designed to cut down on crowds and help eliminate the spread of covid-19. you can see there, up in the corner is the one at the empire state building. pretty cool to see that. still to come on "abc 7 mornings," demanding justice for elijah mcclain. protesters taking to the streets after newly released selfies show police officers appearing to re-enact a choke hold used on mcclain. first another big fourth of july event hosted by president trump. trump, as we mentioned. celebrate despite warnings to stay at home.

i am not even one iota concerned about getting the coronavirus. >> reporter: despite warnings from d.c.'s mayor to stay home. >> we want to send a message to our residents to enjoy the fourth of july, to celebrate according to our guidance, and to do it at home. >> reporter: the president just back from mt. rushmore. ♪ come to america >> reporter: he delivered a divisive speech railing against the toppling of controversial monuments. >> our nation is witnessing a merciless campaign to wipe out our history, erase our values and indoctrinate our children. >> reporter: protesters gathering at the park gates. ♪ about 3,700 people crowded the amphitheater, sitting inches apart. no social distancing, few masks in sight. the president only briefly touched on the virus, which he has said repeatedly might just disappear.

news it is spreading in his inner circle. kimberly guilfoyle, donald trump jr.'s girlfriend and top campaign fund-raising official, testing positive for covid-19 in south dakota ahead of the event. in the statement, the campaign's fund-raising committee said guilfoy guilfoyle, who is asymptomatic was immediately isolated to limit any exposure and as a precaution will cancel all upcoming events adding donald trump jr. tested negative but as a precaution is also self-isolating. the couple did not travel on "air force one" or come into contact with the president. two weeks ago guilfoyle spoke at the president's rally in tulsa, seen here without a mask. >> how are we doing, oklahoma? >> reporter: several campaign staffers and members of the secret service testing positive there, too. rachael scott, abc news, washington. california is calling on labs to process coronavirus tests faster for people who are high risk, including those in hospitals, nursing homes or

long-term care facilities as well as inmates as prisons and jails. health experts want to prioritize results for the groups because they are most likely to spread the virus to others. quicker turnaround times could help doctors isolate sick patients faster and make better treatment decisions. another death row inmate died in the coronavirus outbreak at san quentin state prison. dwayne carey died at an outside hospital from what the department of corrections said it from complications likely due to covid-19. carey was sentenced to death in 1996 for a murder in los angeles county. he is the third death row inmate to die in two days. five died in the outbreak that has seen nearly 1,400 prisoners get infected. in san francisco's michelin star french bistro issing a au revoir. it is closing its doors until next year. so it's not a full good-bye, just a see you later.

owner dominique krenn offered meal kits when the pandemic again and the instagram coast says the kitchen will be used the rest of the year to feed the hungry. protesters gathered in colorado for the second night in a row demanding justice for elijah mcclain, an unarmed black man who died in police custody. newly released selfies show police officers appearing to re-enact the type of neck hold used on mcclain during a violent takedown last year. abc news reporter stephanie ramos has the details. >> reporter: demonstrators in colorado demanding justice for 23-year-old elijah mcclain. protesters facing off with police outside the station in aurora. outrage boiling over amid a new scandal rocking the department. officers erica marrero and kyle dietrich fired and officer jaron jones resigning over the selfies, smiling and simulating the choke hold used on mcclain, taken two months after the massage therapist's death. >> it is a crime against humanity and decency. >> reporter: mcclain was walking

home last august after buying iced tea at a convenience store, when someone called 11 911 to report him as suspicious. officers later putting him in a choke hold as he begged for his life. mcclain died days later at the hospital. police say during the confrontation with officers, mcclain tried to grab officer jason rosenblatt's gun. months later when rosenblatt received this picture in a text message, he replied "ha, ha." he, too, was fired friday. none of the officers have been charged in mcclain's death. colorado's attorney general is now investigating. stephanie ramos, abc news, new york. protesters in baltimore have torn down a statue there of christopher columbus. you can see the video here, a cell phone video. there the statue goes. the person who took the video says at least 300 people were there taking part in yesterday's protest. when they took the statue down, it broke into several pieces. there might be someone there carrying a portion of it.

"hamilton" the film has been getting rave reviews from fans less than three days since its release. no surprise. rotten tomatoes has given it a 99% and metacritic rated the film a 91 so far. disney plus is the parent company of abc 7 and disney plus debuted the broadway musical on friday, perfect for a holiday weekend indoors, tells the story are america's founding father, alexander hamilton. it won 11 tony awards when it debuted on broadway about five years ago, and now you don't need an expensive ticket to see why. >> not only do you feel like you're in the audience and seeing it from the best angles possible at any given moment but you also feel like you're with people on stage at certain moments and i think that's what's so incredibly special about this experience. >> the film runs 161 minutes and there is even a one-minute intermission timer. it's sad with broadway closed down, lisa, through the

>> well, usually on the fourth of july plenty of baseball games across major league baseball but not this year, but summer camp is here and both bay area teams in action on saturday. we'll start on the east side of the bay with the a's, taking the field at the coliseum for their first summer camp workout, they're getting ready for the 2020 season. plenty of reasons to be excited about this team. they've won 97 games in back-to-back years with wild card game appearances. now it's trying to get back to the new normal. >> baseball is a routine oriented business and the quicker we can find routines, i think the easier it will be for us to deal with it. >> we are a perennially slow starting team but our record in august and september has been exceptional. so it's just whichever side you want to get. our biggest thing now is getting through the next couple of weeks and making sure that everyone stays healthy. all right, day two of giants summer camp workouts with regular season games still about

that means higher relative humidity. so we're not talking about a dry wind but we need the atmosphere to clean itself out. with the fireworks, all that pollutants, the very small, tiny particles trappe at the surface, and the wind will clean things out throughout the day today. we're looking at northwesterly winds up to 20 miles an hour, maybe 30 miles an hour closer to the city, and the breeze will be lighter in our inland valleys but that does change as we get into your monday, and that marine layer is going to transport that cooler marine air, bringing the temperatures down at least six to eight degrees for some of you tomorrow. today, very little change. notice no low clouds or fog to speak of, all the way down the coast and we've got two systems kind of anchoring in between the bay area. this high to the south and east of us, which is going to expand next weekend, this brings the heat in a trough in the pacific northwest and in response to this trough, we get a return of the marine layer and steady onshore flow.

run out of paid sick days. abc 7 news reporter lyanne melendez looks closer at what teachers could face. >> reporter: when a teacher calls in sick, the first consideration is who will take their place. >> my primary concern before covid in terms of calling in sick was that high likely hood there would be no substitute available to cover my class. >> reporter: olivia utevik gets ten paid sick days a year. teachers can roll them over. if they contract covid-19 they have to quarantine for at least 14 days. >> i think unlimited sick days during this time is going to be critical. we cannot have any staff members feeling pressured to come to work if they're feeling any symptoms. >> reporter: right now, school districts like oakland unified are negotiating with the teachers union new terms specific to covid-19. school districts would not comment on what they are proposing. the question is, where will districts find the extra money

for any added paid sick days? >> the educators shouldn't have to pay for it with their sick days. the school district should not have to bear the front of it but the state and federal government should have a pool that we can draw from, in case that occurs. >> reporter: more troubling is if a teacher goes into extended sick leave, a 1976 law says half of their salary would go to pay for a substitute. that's because public school teachers in california don't pay into the state disability insurance program. lawmakers in sacramento are looking into making changes to that 44-year-old law. vermont senator bernie sanders called the law another example of a fundamentally broken system. in san francisco, lyanne melendez, abc 7 news. coming up next, if you're looking to help others out during covid-19, spend some time on the peninsula today. we'll have the fund-raising efforts, a car wash that's going to be hosted this entire month.

a san bruno car wash is transforming all in the name of charity. the shell and car wash is now the headquarters of the relief orah ma. drivers and residents are invited to enjoy a dunk tank, bubble arts and live music t will happen every weekend of this month and 15% of all proceeds will benefit covid-19 response efforts, along with local orphanages and schools. today shell has donated more than $350,000 for social impact causes. before we go an update on the brush fire we've been following all morning. the park fire, cal fire says 100 acres have now burned in the anderson lake area, this is east of morgan hill. so we had been saying 40 acres for all morning. we've just goten this update from cal fire. it's now 100 acres. police say ten homes along finl finley ridge road were evacuated
