suspended because the kocounty d not applied for a variance. outdoor dining was still happening at ole waffle house. but they were not happy >> we're cutting back on outdoor dining. for us servers and bartenders out there, it's back to trying to depend on the government. >> it's absolute chaos. >> reporter: he had just reopened his outdoor patio and is now removing most of the tables. >> i can tell you this, our leadership here, incompetent. >> reporter: other cities are choosing to defy the order. the city of hayward tweeted the closure of downtown streets this afternoon and evening to allow ing f asoor dining and shopping livermore and dublin won't remove outdoor dining either. alameda county saidn a statement, we are moving toward obtaining a variance from the state and a letter for support for the variance is on the

agenda for next week's board of supervisor's meeting. >> i may relocate my businesses. i may run for mayor, i don't know. but we need a change. >> reporter: so lots of people clearly upset tonight. city of oakland will honor the new rule but says they will not enforce it. city of berkley, applying for a variance on its own. so it can be in accordance with the state. cornell bernard, abc 7 news. other coronavirus updates from across the bay area today, contra costa county revealed it has an 8% positive test rate, that's the highest in the bay area. the county says it's now requiring people to wear masks while dining outdoors. parking at lake merritt is being reduced. sonoma county is on the watch

list. indoor dining and other activities can be rolled back as soon as monday, and in santa clara county, gyms and personal care facilities will be able to reopen on monday san francisco zoo has been given permission to oen next week. the number of total case has increased to more than 312,000. the positivity rate, an indicator of community spread is continuing to trend upward over the past two weeks. also trending upward in the same period, the number of people hospitalized. that number now stands at 6,357. today president trump visited walter reed medical center in maryland to meet veterans and health care workers battling coronavirus and wore a mask for the first time publicly. it comes as across the country cases of covid-19 continue to rise. in two more states, governors
