. it will probably unfortunately get worse before it gets better. something i don't like saying about things but that's the way it is. we're asking everybody that, when you are not able to socially distance, wear a mask, get a mask. whether you like the mask or not, they have an impact. they'll have an effect and we need everything we can get. >> president trump encouraging americans to wear masks in a coronavirus briefing today at the white house. good afternoon and thank you for joining us. >> we'll have more on that briefing in a few minutes. but first today, the battle or the back to school battle? a lawsuit has been filed against governor newsom who is calling for schools to reopen this fall. melanie woodrow has the story. >> reporter: many california parents are scrambling to create pandemic pods and micro schools so their children can learn remotely this fall with other

children and either a hired tutor or a apparently taking turns. this after what was a challenging spring semester for most. >> all of these children we saw in the spring semester this year were failed by the state of california in its educational plans. >> reporter: the attorney has filed a lawsuit against governor newsom calling for governor schools to reopen this fall. >> that's not a decision that the state can or should make. >> reporter: she is advocating for parent and teacher choice. she's an rnc committee woman for california. she insists politics are not at play here saying she has spoken with parents and teachers across party lines who say distance learning doesn't work. >> even parents with the motor motivated and academically successful children reported depression, anxiety, withdrawal, behavioral issues, a lack of motivation. >> she said her son has a team when he returns to school. >> special education students, it is dangerous and profound

when their students are cut off. >> reporter: this person who created a facebook group, members recognize not all families have the sail means. >> there are a lot of issues of inequity that come up that are absolutely terrible. >> reporter: dylan said she hoped not to have to file this lawsuit and points to the success of recent litigation. >> in response to our lawsuits, the governor of california and the state have in some cases worked with us. in other cases unilaterally gone and changed the orders. >> reporter: abc7 news. >> meanwhile, parents in pleasanton not happy with the full time distance option that they're being offered. that requires middle and high school students to be enrolled in a completely different program than what they would normally get in their home school. >> we are here asking the district to provide a full distance learning option. >> reporter: he's a apparently of a grade 9 student.

he's protesting in front of the pleasanton office. by this friday, he has to make a choice for his child that he doesn't like at all. either sign her up for a hybrid model where she learns in person part time and at home the rest of the time or what is called the flex academy, a brand new system built by the district to carry out their full time distance learning option. but with different teachers and a different critical little. the district says it is the best they can do right now. >> right now we cannot responsibly say that we can offer every high school course that is offered through our traditional comprehensive high schools in through the flex academy. >> reporter: what some pleasanton parents of middle and high school parents want is what elementary schools are getting. full time distance learning with the same class and the same teacher. the district says it is too hard and too expensive to expect their teachers to hold classes online and in person at the same

time for their older students and that is why they created flex academy. >> i don't have an option. they are pushing me into one of the options that they're providing. >> reporter: these parents say they've collected about 700 signatures from parents who feel that flex academy isn't a good enough option. >> we hope and know that flex academy will be just another layer of high quality education that's available for our pare s parents. but yes. we understand the frustration, stress and angst. you were c berkeley classes will be taught online. they are also prepared for other modes of instruction when it is safe to do so. lab classes and other hands-on learning experience there's likely resume in-person sessions before other courses do. you can check out the state's

mask. i feel this way. anything that can potentially help, and that can certainly potentially help, is a good thing. i have no problem, i carry it. i wear it. you saw me wearing it a number of times and i'll continue. >> president trump also said his administration is working notice and day with capitol hill to advance the next economic relief package. as we mentioned the united states nearing 4 million total cases although many of them have since recovered. the central for disease control says that the number of infections from march to may is probably ten times higher than official estimates. in marin county, the board of supervisors voted into law a now measure to toughen enforcement of people wearing masks. they will cite and fine if necessary as much as $1,000 per person and $10,000 for a business. by the time abc7 news reporter wayne freedman hit the streets

today, that had already taken effect. >> reporter: we've reached the point where it seems everyone is getting a little testy, when these two guys clashed on fourth street in san rafael, they probably didn't know that because neither wore a mask, they were already breaking a new law. >> this is the reaction factor. we're seeing more and more transmission across the region. >> reporter: as of this morning, marin county joined the list of communities that will cite people or businesses for not wearing masks even outside. >> i have it with me. i have it in my car. >> reporter: almost 2300 cases in marin county. 36 deaths. ma ridge is on the state watch list. the county says even after it goes off that list, this policy will remain in effect. >> we need to take this seriously. we're losing control of transmission in our communities. >> reporter: some people have already done so. in novato, matt evans, his wife and three kids all wore masks while walking down. >> this is a small thing we can

were given masks. >> when they got the infection, 81% of those on the cruise ship who developed the infection did not have any symptoms. over the asymptomatic rate was much higher. that idea that you can survive without masking, the rate for asymptomatic is good for the person. not having symptoms means not having symptoms. you are not sick. you are not in the hospital. if we have more asymptomatic infection and that cause immune, that will show it down even more. >> she is so authoring a report on this to be published in the "journal of american medicine." we learned more about how sfo is being impacted by covid-19. right now it serves about 10,000 outbound passengers each day. that come pairs to about 88,000 per day during july of last 84. the airport's director expressed his concerns to a plan proposed by the city supervisor.

first this week there was a tense war of words between president trump and mayor libby schaaf over reports to send federal troops to oakland. then overnight the mayor's house was vandalized with graffiti. >> reporter: defun opd, blood on your hands, all spray painted outmayor libby schaaf's oakland home overnight. witnesses say 30 to 40 people dressed in black and wearing masks shot projectiles and shot off fireworks around 2:00 a.m. >> i know there is a lot of rest and i sympathize but this was jarring and it felt like to another level. >> i think what it shows is will bey schaaf's policies is encouraging criminals to flee from authorities is not working for the people of her city i'm

sorry that her house was attacked like that. americans should be able the feel safe in their homes but as a leader she needs to do better. >> reporter: this week president trump threatened to send federal troops like did he in oakland. >> i don't need law enforcement in oakland. i need testing. i need personal protective equipment. >> they met to defend the mayor. they believe sending in troops is unconstitutional. >> they're under attack with trump's federalized troops going into and invading our cities. >> he's trying to silence them while trying to may to his right wing base. >> the stand-off continues. mayor schaaf issued a statement about the vandalism. she said attacking the home of a privately elected official does not advance democracy.

leslie brinkley. abc7 news. california is one of the states suing the trump administration over new rules they say could hurt the environment. they argue the environmental protection agency's guidelines make it harder to review block or put limitations on federally permitted water projects. california's attorney says it undermines the clean water act. here michael finney with a long at the headlines. hi, michael. [ silence ] >> apple has unveiled plans to be completely carbon neutral by the year 2030. that includes worldwide supply chains and product life styles. that's actually life cycles, i should say. it's pretty amazing. today's announcement means by 2030, every apple product sold will have a net zero climate

impact. part of pall's plans includes relying on renewable energy projects. the cupertino tech giant has helped create it. they will use a special robot to disassemble phones so parts can be recycled. shoppers hoping to get a jump on the holidays will have to wait a little longer this year. walmart says it will cleem its stores closed on thanksgiving day. walmart says the store closure is a thank you to employees who have worked throughout the current pandemic. stores will operate during the normal hours on the day before thanksgiving. plans for black friday have not yet been announced. amazon prime members will have to wait longer for their big discount shopping day. it happens annually. amazon has pushed prime day to later in the year. usually the date would have been announced last month in june and take place sometime in mid july.

another warning that the state could continue with reopening plans and hospitalizations continue to rise. >> unfortunately, our reopening has been treated as a green light tole to resume normal life. many of us recognize that we, as we have covid-19 with us, we will be living a different sort of reality in life.

that things like masks and physical distancing, we now need to use our dimmer switch to ensure that we get transmission rates under control. >> last week, governor newsom ordered bars and other businesses to close across the state swells gyms and hair salons. it might be four to five weeks before rates start to steadily decline because of that move. today california hit a milestone. 400,000 covid-19 cases. joining us now, doctor, where are we compared to the nation at large? we're closing down again. you look around the country. states like florida, their cases are surging but they're like, we're good, we're fine. nothing to see here. >> which the politicalization of this virus has to end. california seem to be taking on a different tone which are still

contested about whether or not they should have a mask mandate. focusing on our state approaching 401,000 cases. our test positivity rate. we would love to see it go down people need to remember about 40% of our cases are coming out of last county. it really comes down to county by county, looking at where the hot spots are. >> how about testing delays? we were looking online yesterday and we're seeing no appointments at all available in some locations. then if you can get a test, then maybe it takes seven to ten days to get results. and then they're basically useless. >> absolutely. the testing kind of cries are driving me insane.

you have some saying we need not only more testing but more fish testing. point of care testing which is correct. we want to know that tests will be accurate but also deliver quick results. then you keep hearing from the white house presser, only celebrating our total number of tests. now if you're waiting seven, ten, 14 days to get a test result, that completely disma dismantles everything about contact tracing. what are you supposed to do? are you going to shelter in place without knowing? the average person is not going to. we need to focus on that. sometimes the point of care tests aren't accurate. so instead of hook at our total number of tests, we need to be focusing on where they are and get funting where we need to be. >> we've seen the federal government may not be willing to jump in and help certain states

that are having delays in testing. >> i think it is. >> we have a little delay. go ahead. >> if you look at the actual issue, and you look at, are we going to create tests where you don't need reagents, that would be a point of care testing. or are you going to get labs more resources. that would be a great conversation. i don't want to play politics but i feel like there needs to be more pressure placed on where the funding is coming from. we want to capture silent cases. we ned to put more funding into faster test results. >> let's talk about oxford university. they seem to have had a break through in testing. how fast might we see distribution on a large scale? >> we're far from ideal right now. according to all the projections, we should see a

viable vaccine by the end of the year. even as early as september. that doesn't mean worldwide distribution. for that it will probably be, if everything goes right, at some point, next year. once it becomes available, chances are it will go to higher risk populations or people who have been in contact with coronavirus. so people still need to hang tight and realize, we need to focus on everything we know we should be doing and hopefully some treatments will come out that buy us time before a vaccine is available at your local drugstore. >> all right. as a medical professional, i imagine it has to drive you crazy when you look at what's napping other countries around the world. successfully containing the virus while we're going backwards. people won't wear their masks. a positive sign at least, a small one today with president trump saying at the news conference that he's encouraging people to actually wear masks. do you think that could be a turning point for the u.s.? >> i think it could be a turning

with the recent calls to boycott go ymp a foods, talk of boycotts are on the rise. are they really that effective? 38% of consumers are currently boycotting at least one company. this is from come pair cards.com. number one reason from that 38% involved in a boycott, disagreements about politics. second is disagreements with the company's social stance, on social issues, and the third is the belief that the company is mistreating its employees. 57% of respondents said boycotts are an effective way to bring about change. i've never thought about actively boycotting a company. some companies provide poor service. have you ever thought about a boycott? >> i've thought about it. i can't recall if i've ever double it. i may have in the past. we speak with our pocket books. if we're upset with something,
