building a better bay area for a safe and secure future. this is abc7 news. two dozen inmates at san quentin prison have died from covid-19. today we learned a guard who spent his entire career there is the first staff member to die from the disease. hello, thank you for joining us. i'm eric thomas. >> and i'm dion lim. a south bay family now mourning the loss of a beloved husband, father, veteran, and longtime corrections officer. 55-year-old gilbert polanco died this morning after a long battle with covid-19. polanco is the first guard at san quentin prison to die from the virus. abc7 news spoke with the family today. cornell barnard is live in san jose. just so heartbreaking. >> it is a heartbreaking story, dion. his family says he wascovirus f

corrections officer will live on. >> he is a good man. we're all devastated. >> family and friends mourning the loss of 55-year-old sergeant gilbert polanco who died at this san jose hospital sunday morning. he was a longtime corrections officer at san quentin prison. >> everything i have is, like, because of him and all the good, positivity he brought and all the hard work he's done. >> his daughter says her dad was an army veteran and started working at san quentin when he was just 21 years old. the covid pandemic caused a mass outbreak inside the prison. 24 inmates dead, 2,000 inmates infected. she was worried for her dad's safety. >> i was scared that he would get sick and this would happen. >> the family says gilbert polanco tested positive for covid-19 in late june. he was admitted to the hospital

on july 2nd. the daughter and the mom also contracted the virus but recovered. the wander of the prison said the sargent demonstrated unwavering commitment and bravery every day during this devastating pandemic. his memory is carried on in the hearts of all the men and women who continue to battle this deadly virus at san quentin. >> i know that san quentin is being more reactive than proactive currently, and i hope that they continue to get their stuff together and -- so they can properly handle this. >> friends and coworkers have been standing vigil in the hospital parking lot for polanco. visitors not allowed inside. >> just to be here in the parking lot and just -- just feeling, just letting him and her know that we're here. >> the polanco family wants the public to know covid is real and people need to protect themselves. >> this is affecting people.

it's killing people. people are dying and it needs to be taken very seriously. >> the daughter says her dad knew the risks of his job but it was very dedicated to his dutiesment gilbert his wife, patricia, were married 29 years. they were celebrating their 30th anniversary at the end of this month. cornell barnard, abc7 news. california reported more than 8,300 new cases of coronavirus today. that's well above the seven-day average of about 6,400 and may be due to the state clearing a backlog. there are 104 deaths and it's not clear if the guard from san quentin is one of them. the positivity rate edged back up slightly to 5.7%. california's benchmark is 8%. the school year starts tomorrow in oakland. right now there's no deal between teachers and the school district on a distance learning school model. the teachers union says two main

sticking points involved small group instruction, including the use of substitute teachers and flexible workday schedules. >> we're waiting and hoping that the district brings a significant, meaningful proposal and we can come to an agreement today so that we can start the school year on a positive note. >> neither side will provide details about what the start of school will look like for students, citing ongoing negotiations f. no agreement is reached by tomorrow morning, the teachers union says educators will follow the union's teaching plan. the city of santa clara has partnered with santa clara county to provide free covid-19 testing on certain dates at the central park library. the first date is wednesday ata you can sign up online now. the site will test only people who do not have covid-19 symptoms. you should receive results back

within three to seven days. testing will also be offered august 12th and 26th, plus september 23rd and 30th. the united states has topped more than 5 million confirmed coronavirus cases, which is the most now in the world. there is now debate on capitol hill over president trump's executive orders and his plan to extend benefits to millions of unemployed americans. some experts say the moves could be unconstitutional. abc news's deidre bolton had the story. >> the united states now with 5 million confirmed cases and more than 162,000 deaths from coronavirus. the pandemic throwing the economy into crisis. medical schools of unemployed americans have been relying on the $600 a week supplemental federal unemployment payments a benefit that expired july 31st. talks on capitol hill to extend those payments collapsed on friday. >>, therefore, i'm taking executive action. we've had it. >> on saturday president trump

eskivel rammed into the gate. he kicked a deputy at 4:00 this morning. he was booked on charges of battery on a police officer and felony vandalism. no one was hurt. firefighters from of the car kquinas strait put o a fire after midnight. the fire consumed a a shed. the cause is still under investigation. rolling at last. the long awaited public transportation project in the east bay that has finally been put into service. and an earthquake wakes up a part of the u.s. that rarely sees or even feels any kind of seismic activity.

a soldier accused of her murder fatally shot himself as police were closing in. there's an effort to get everyone counted for the census. several asian-american advocacy groups focused on san francisco's chinatown to reach out to older residents, undocumented immigrants, and those who may have a language barrier. overall the city is lagging by the rest of the bay area by ten percentage points. >> our time frame is more compressed and doing census work in the time of covid is very challenge. we have not only until september 30th, we were given until october 31st. and so it is a little bit challenging. >> lots of work to do. the group wants to get everyone signed up before they begin knocking on doors. the effort will continue every weekend through the end of september. in the east bay ac transit is ushering in a new era. it launched its first bus rapid transit route today a project

older than 5 must wear a mask. also the museum placed their outdoor exhibits far apart while workers performed frequent cleanings. tickets must be purchased in advance and for now only members are allowed to visit. but starting august 22nd it will be back open to the general public. an earthquake shook up part of the nation that's not used to quakes. early today a 5.1 magnitude earthquake hit near sparta, north carolina. seismologists say it's the strongest quake to shake north carolina since 1926. that security video showing the shaking near 40 miles from the epicenter. there are reports of houses shifting off their foundation, but thankfully nobody was hurt. drew tuma certainly knows this. when you go through an earthquake for the first time, it can be extremely jarring, especially for folks in north carolina who aren't used to it. >> right. that's an unusually strong earthquake, something they

haven't seen in more than a century, but thankfully the damage was limited. nonetheless pretty rare to see that on the east coast. back here at home, guys, we're talking about fog. that is very typically for august. it's fogust around here and has been with us throughout the day and the weekend. live doppler 7 along with satellite showing you our marine layer along the coastline right now. tonight our marine layer will expand larger than last night, creating foggier conditions for many of us overnight tonight. live from the tam cam right now, you can see the finger of fog going through the golden gate bridge right now. again, the fog will become more expansive over the next couple of hours. it's cooling of you san francisco by about two degrees, but that's the outlier. everything else it is a warmer afternoon compared to yesterday by about 5 degrees. in santa rosa, concord, 7 degrees warmer. look at the numbers away from the coast and that marine air. it is a warm afternoon.
