loss of a beloved husband, father, veteran and correction officer. 55 year-old died this mortganin after a long battle with covid-19. the first guard at the prison to die from the virus. we spoke with his family today and has this story from san jose. >> he's a good man. we're devastated. >> family and friends mourn the lsz of 55 year-old sergeant. who died at this hospital sunday morning. a long time corrections officer. >> everything i have is because of him. and all the good positive tv he brought. >> her dad was an army vet and started working when he was just 21 years old. the covid-19 pandemic caused a mass out break inside the prison. 24 inmates dead, 2,000 infected.

she was worried for her dads safety. >> i was scared he would get sick and this would happen. >> the family says he tested positive for covid-19 in late june. he was admitted to the hospital on july 2. they contracted the virus but recovered. the acting warden said he demonstrated unwaivering commitment and bravery every day during the devastating pandemic. his memory is carried on in the hearts of all the men and women. who battle the deadly virus. >> i know it's being more reactive than proactive. and i hope that they continue to get their stuff together and properly handle this. >> friends and coworkers have been standing vigil in the parking lot. visitors not allowed inside. >> to be here in the parking lot

and just feeling. letting them know we're here. >> the family wants the public to know covid-19 is real. and people need to protect themselves. >> this is effecting people. it's killing people. people are dying. it needs to be taken seriously. >> her dad knew the risk of the job. but was dedicated to his duty. gilbert and his wife had been married 29 years. they were getting ready to celebrate 30 years end of the month. >> california reported more than 8,300 new cases of the coronavirus today. that's well above the seven day average of 6,400 and maybe due to the state clearing a backlog. it's not clear if the guard is one of the deaths. the positiveivity rate edged up slightly. the benchmark is 8%. >> the school year starts tomorrow in oakland and right

now there's no deal between teachers and the school district on a distance learning school model. the teachers union says two main sticking points involve the request for small group instruction including substitute teachers and flexible workday schedules. >> we're waiting and hoping the district brings a significant meaningful proposal. and we can come to an agreement today. so that we can start the school year on a positive note. >> neither side will provide details about the start of school will look like for students. educators will follow the union teaching plan. >> the city of santa clara partnered to provide free covid-19 testing on certain dates at the central park library. the first date is this wednesday 10:00 a.m. appointments required and you

can sign up online. site will test only people who don't have covid-19 symptoms. and should receive results within three to seven testing will be offered august 12 and 26. plus september 23 and 30th. >> the united states is topped more than 5 million confirmed coronavirus cases. that is the most in the world. there's debate on capitol hill over president trump executive order and his plan to extend benefits to millions of unemployed americans. the moves could be unconstitutional. >> the united states now with 5 million confirmed cases and more than 162,000 deaths from coronavirus. the pandemic throwing the ecnomy into crisis. millions of unemployed americans have been relying on the $600 payment. a benefit that expired on july 31. talks to extend the payments

that's not the case. >> that's inaccurate. there's no reduction to those benefits and the president made that clear. >> senate minority leader calling the orders unworkable. >> most states will take months to implement it. it's brand new. it's put together with spit and paste. >> the president top economic adviser disagrees. >> states process the federal benefits before. so i don't see a reason why it's all that difficult. >> the question of whether states can afford to chip in 25% of the $400 benefit. >> the answer is i don't know yet. i think what will happen is congress needs to get back in and negotiate. >> so far, no word yet on whether trump administration officials and democratic leadership will resume negotiations. >> in the south bay a man faces charges accused of ramming his suv through a security gate at the jail.

police say 51 year-old slammed an suv through the gate and drove into the lower level of the parking structure. you can see the damage. deputies say he kicked a deputy in the incident around 4:00 a.m. he was booked on battery on a police officer and felony vandalism. >> firefighters from both sides of the rushed to put out a big fire over night. there was a lot of activity in the neighborhood. at around tennessee street and broad way after midnight. fire consumed a shed. damaged a printing press facility and threatened two homes. firefighters helped crews put out the flames. the cause is under investigation. >> rolling at last. the long awaited public transportation project in the east bay that is finally been put into service. >> and earthquake wake up a part of the united states that rarely
