be catastrophic for homelessness, covid-19 spread, turn a recession into a great depression. >> high stakes vote on evictions. if it fails, millions of renters who can't pay could be forced out of their homes. thanks for joining us, dion lim. >> i'm dan ashley. the clock is really ticking on emergency bill to block evictions for millions in california. current ban expires midnight. state senate passed ban an hour ago, waiting on the assembly to send it to the governor. luz pena. >> reporter: the clock is ticking. if emergency bill is not approved by midnight, millions of californians could be evicted as soon as tuesday. >> today's the deadline, it's very important, very needed. >> reporter: owes four months of rent, holding on to this emergency bill that could extend eviction protections five more months. worst fear is to be homeless. h.

>> my daughter and -- it's for me really stress. i don't have a job, i lost my job almost six months ago. and i don't know what to do. >> reporter: spends her days applying for jobs and updating resume but 1st of ever month has to make a decision between rent and feeding her 14-year-old daughter. >> food. >> reporter: reality of at least 4 million californians according to assembly member reported being housing insecure. bill was introduced by him, and needs 2/3 of each house of the legislature to pass. >> these issues are incredibly difficult and the crisis is we have millions of californians not able to pay some portion of rent for months. >> reporter: advocates are glad there's a proposal on the table but concerned not everyone will

be able to pay. >> there's protections for evictions, one thing. i think the necessity of having to pay 25% of your income works for some people. for other people it's impossible. >> reporter: on the other hand, property owners see this as a compromise. >> also provides a safety net mechanism to ensure that rental property owners keep some income. >> reporter: if approved, tenants are still responsible for backup rent and could be in danger of evictions all over again. luz pena, abc7 news. there are a few significant coronavirus headlines. latest numbers. united states officially topped 6 million cases, most in the world. california has more than 700,000 confirmed cases. most in the united states. but state's positivity rate is falling. seven day at 4.9%.

bay area along with santa cruz county have reportedly nearly 87,000 cases of covid-19. new color coding system goes into effect today, giving some businesses go ahead to reopen. key on the left side, yellow about as good as it gets. spread is minimal. orange is moderate, red is substantial, purple is widespread. most bay area counties are purple. napa and san francisco are red. new system means hair salons and malls can go indoor operations you assuming the county approves. stephanie sierra found many business owners are still anxiously waiting to hear back when they can welcome customers. >> reporter: we heard from mayor london breed today, she will be making an announcement tomorrow

to explain when certain businesses can operate indoors. business owners are desperate for any direction at this point. they've had to operate at limited capacity nearly six months now. business owners we spoke to here at pier 39 have it better than most, the outdoor patio at wipeout is pretty much full, but hundreds of others do not have that luxury. inside san francisco's old mission, owner is barely makes ends meet. >> we need to reopen. we need to reopen. you know. i don't know how else to say it. this is -- i feel at this point it's illusion of safety. >> reporter: shop nestled in between two restaurants. says 11 feet of curbside space allows maximum of two chairs outside. >> unrealistic. i have barbers behind on rent and mortgages, that have family

members and kids to take care of, feed. including myself. and doesn't make sense at this point. it's not realistic. >> reporter: not realistic, nor enough to make a living. he's already out $80,000. >> it's getting out of hand at this point. it's just been a struggle, borrowing money from family and friends. >> reporter: shares the same struggle. owns four restaurants along pier 39, including wipeout and fog harbor fish house. >> each day is different, guidelines change every day. wrote 150-page manual how to operate in these times and been changing it weekly. yes, it's been challenging but we were ready for the challenge. >> reporter: mayor london breed will announce green light tomorrow. but doesn't want to move too quickly and have to pull back like a month ago. >> it was one of the worst days of my life to have to tell

contain the fires, still weeks if not months of work ahead. work that often goes unnoticed but is so vital in preventing erosion and landslides and keeping the waterways clean. followed crews as they worked to repair damage from scu lightning complex. >> reporter: in hills southeast of livermore, remains of the scu lightning complex, second largest fire in california history just two weeks ago ravaging the area. 60% contained, fewer firefighters and more crews like these. >> heros to zeros. heroes stop the fires and zeros come in afterwards to fix it. >> reporter: fire repa speclist, thankless but important. pagame done to

fight the fire. >> repairing the lines that might have potential. >> reporter: video of clearing out brush pushed to the side to create a fire line. also fixed fencing on ranches they may have had to tear down. all this charred land, roughly 50 miles of dozier line that needs to be repaired. they've been coming through. repairs happening at all three lightning complexes burning around the bay area but size of the scu makes it even more complicated. >> yesterday i flew the fire and looked at how many dozier lines there are, couldn't fathom how many lines there is. >> reporter: fast, before the rain. >> had a big mud slide afterward due to heavy rain that occurred. primary goal is prevent that.

in santa clara county, a bribery investigation surrounding sheriff laurie smith's election took a surprising turn. one of the defendants pleaded guilty, signaling intent to work with authorities. chris nguyen from san jose. >> reporter: at hall of justice, a major development after central figure in bribery and conspiracy case connected to

re-election bid pleaded guilty in his arraignment monday morning. >> this is effort on our office to make sure the public business is conducted ethically and appropriately. >> reporter: rosen says cooperating with prosecutors. counts could be downgraded to misdemeanors. among five defendants accused of brokering a deal for concealed carry weapons permits in exchange for $90,000 in donations to independent committee that supported the sheriff's most recent re-election. also indicted, local attorneys, weapons manufacturer and captain james jensen, all pleaded not guilty to the charges.

spoke with shum's attorney who filed a motion to disqualify the district attorney's office from trying the case, saying was a friend and confidant for him over the years. >> there's no way that the district attorney's office can view this octobbjectively. >> reporter: grand jury transcripts from earlier this month indicate she and her undersheriff both took the 5th, refusing to answer questions about the case. sheriff has not been charged with a crime, district attorney says the investigation is far from over. >> there will be more individuals charged with crimes in coming weeks. >> reporter: in san jose, chris nguyen, abc7 news. just learned driver has died
