kumasi already said it was. maybe reggie will hear me and let me know later. we have the potential for unhealthy air and record setting spare the air alert day. let's take a look and go up to the north bay. you can see around u green and yellow as we go through the bay and into the south bay where we're also green and yellow. so, here's a look at san jose where we have that cleaner air and 58 degrees. temperatures in the mid to upper 50s. the same. temperatures this afternoon almost exactly the same place we were yesterday. 60s at the coast. 70s around the bay and 80s inland. here's reggie with more news. >> it's definitely better this morning smoke wise, thank you, mike. now, let's look at the strong earthquake that struck off the coast of northern chile overnight. a preliminary magnitude of 6.8.

all right. people felt it far from the epicenter, 800 miles north and 400 miles south in the capital of santiago. at least ten aftershocks were reported. the chilean navy says no tsunami threat. some minor damage and mudslides. san francisco mayor london breed is hinting of a big announcement this morning regarding the city's reopening plans. personal services like hair salons, barbershops and nail salons have approval to open outdoors today. business owners are desperate to open after operating in a limited capacity now for six months. the owner of the old mission shop is barely making ends i don't know how else to say it. i have barbers that are, you know, behind on rent. behind on mortgages. barbers that have family members. you know and kids that they have to take care of. kids they have to feed, including myself. >> well, another business owner

who has four restaurants along pier 39 says just having outdoor dining is not cutting it. mayor o g give an update. also today, state health and human services secretary dr. mark ghaly is expected to give an update. last week he explained how the new tiered system works for school who look to move forward with in-person learning. barbershops and malls to allow customers inside. sonoma, marin, san mateo, santa clara, napa all rolled back restrictions yesterday. they compared the wait to being in a boxing match. >> this is like being down in the last round and just using dth ro your strength to get up

covid. they're afraid they're going to get sick and die. and that is in no small part because of you. >> we have to stop this horrible left wing ideology that seems to be permeating our country and basically its weakness. weakness on behalf of democrat politicians. >> biden also argued that the president mishandled the civil unrest triggered by police shootings of black people. in a recent interview with fox news police defended police officers who use deadly force saying sometimes they, quote, choke. and compared an officer firing on a suspect to a golfer who misses a shot. developing news this morning, containment is increasing in the three big fires that are burning right now in california. the scu lightning complex in parts of the east and south bay, it's 60% contained this morning. over 383,000 acres have burned. alameda county is no longer

under evacuation orders. the lnu lightning complex in the north bay is 66% contained. more than 375,000 acres have burned in that fire. and some of the evacuation orders have been reduced to warnings in napa county. lastly, the czu lightning complex in parts of the peninsula and santa cruz, it's just over 40% contained. over 85,000 acres have burned. cal fire says the priority at this point is getting people back into their homes. but first you have to make sure it's safe. crews are now focused on clearing out damaged trees so they don't fall. cal fire is reminding homeowners to check for hot spots on their property when they get back. fema is offering a financial assistance program to help displaced wildfire victims. this is a $500 one-time payment you don't have to pay it back. anyone who has been impacted severely by the wildfires can apply, including people in napa, san mateo, santa cruz, solano and sonoma counties.

part of critical needs assistance program but you need to know the deadline. you have to apply by september 5 5th. you can find more information about how you can do that on our website at abc7news.com. the rush is on to restore reusable water after the czu fire melted miles of pipeline. this happened in the area surrounding a stretch of highway 9. cities include brookdale, ben lomond and felton. the district says the infrastructure was installed above ground built to withstand earthquakes and mudslides. >> who engineered that product and decided not to bury it, not a good idea, obviously. because we're all going to hurt from it. >> a do not drink, do not boil notice has been sent to residents north of brookdale. contractors are working to restore 4.5 million gallons of

water that was lost. a protest in the east bay over the removal of an old tree. pleasanton officials say the eucalyptus at lions wayside park needs to go because it's a safety hazard. abc7 news reporter amy hollyfield live in pleasanton with more on that. >> reggie, it's a huge tree. take a look. this will take a while to take this down. the city says this tree cannot be saved and it needs to come down before it starts falling down. possibly on people. they say it's just too dangerous to leave it here. some concerned residents say not so fast. we are hearing they plan to show up here this morning to protest. here is a picture of the tree in the daylight. this eucalyptus tree is at lions wayside park in pleasanton. the city says it is infected with a sulfur fungus and there is nothing they can do to treat it. locals estimate it's about 150 years old making it one of the oldest trees in pleasanton. and some are upset that it is coming down and they don't feel like the city properly notified

people. the city posted about the tree's removal on social media. some have said they will be here this morning to protest that might turn into a good-bye party for the tree. the city has said they plan to take it down today. live in pleasanton, amy hollyfield, abc7 news. >> yeah, that is tough because we saw with laura and with that derecho through iowa that falling trees tend to harm and kill people and we have our own wind events coming up in the latter parts of this month and then into october when those diablos kick in. hate to lose that tree. 55 in lafayette to 63 in antioch. partly cloudy skies in our east bay valleys. mid 50s to low 60s. 55 to about 62. just about everywhere under increasing clouds. let's take a look at your smoke forecast and you can see today it does split just a little bit as the winds pick up slightly this afternoon. and even tomorrow morning we wake up to the possibility of

some smoke hanging around. but notice it becomes thinner as we head to wednesday afternoon and thursday we'll wake up with the least amount of smoke this week. that is a good trend moving forward. that is why today is probably our last possible spare the air day. south bay. in the 60s through 10:00 with sunshine. touch the 80s for a couple hours this afternoon from 1:00 to 5:00. down in the 70s and 60s during the evening hours. north bay in the 80s for a couple hours from 2:00 to 5:00. 67 if you're heading out this evening. east bay valleys warmest will be in the 80s from about 1:00 all the way through 6:00. temperatures pretty close to average today. we're about 10 to 20 degrees warmer and hundreds coming this weekend. ular first, let's turn it over to jobina and look at the commute. hi, jobina. >> hi, mike, thank you. hundreds. all right. good morning, everyone. i have good news to report for

their traveling parties tested positive for covid-19. this morning they're self-isolating in houston. number six. i do have some positive news for your commute. we have no major blocking issues on our roadways right now as we take a live look outside showing you san jose and 101 looking good there. and number seven. protesters want to stop the city of pleasanton from cutting down this tree today. this is one of the oldest trees in the city, but officials say that the fungus infected eucalyptus cannot be saved and it needs to come down before it starts to fall down. in the race to discover a covid-19 vaccine, the fda chief said he is considering approving one before it even goes through normal clinical trials. this is not the first time the government used special emergency powers during a crisis. here's abc7 news anchor dan ashley. the tragic attacks of september 11th may seem to have little in common with the

covid-19 crisis, but 9/11 and the serious anthrax attacks that followed triggered a wave of emergency laws that yield critical power today. >> considerable concern in the bush administration that we would be attacked again. >> reporter: retired ken bernard headed up a special white house bioterrorism team and a wide-ranging law called the bioshield act of 2004. create a stockpile of vaccines as quickly as possible. >> well, of course. >> reporter: first, federal dollars poured into a market for vaccine development. pharmaceutical companies were ultimately granted protection from most liability and the secretary of health and human services, along with the fda, were given special authority to speed the release of promising drugs and vaccines. >> emergency use authorization gave the government the ability to declare a public health emergency or a need for that product that was more important

than the full licensesure pros. >> reporter: that is the legal driver for much of the government's emergency covid-19 response. it kickstarted a race for a covid vaccine and it federal agencies. >> delegates broad authority to an executive agency to solve a highly specialized problem. >> reporter: but the trump administration has yielded other bioshield problems early and often with mixed results. an emergency use authorization for the drug hydroxychloroquin touted by the president was reversed. and blood plam was approved after a back and forth over the scientific data and now published reports the administration is considering a fast track re vaccine possibly before the november

mid to upper 60s for san francisco and along the coast where we'll see more sunshine than we have the past couple of days. we still have that dangerous heat coming at us this weekend and an update on your seven-day forecast coming up soon. here's kumasi. >> thank you, mike. some relief for renters this morning. state lawmakers and governor newsom beat a midnight deadline to extend a eviction moratorium. julian glover is live to break all of this down for us. hey, julian. >> hi, kumasi. as you mentioned, this came down to the wire last night. the state moratorium with eviction will expire tomorrow on wednesday. now we know the new protections in place for renters and will last through february of next year. 2021. let's walk you through exactly what's inside of this bill assembly bill 3088. so, tenants are protected from covid-19 related evictions until february 1st of 2021. as long as covid-19 related hardships are presented.

this had to have occurred between the start of the pandemic, march the 4th, through august 31st, yesterday. now, moving forward starting today, tenants must. gin paying at least 25% off rent due to avoid eviction and the bill states a tenant cannot be evicted for unpaid rent during this time. relief for now but for many renters and property owners alike, this just kicks the can further down the road. >> many rental providers have had to forego mortgage payments on their rental units. they had to defer paying taxes and also concerned that the longer the pandemic and the financial impacts continue on, then they might not be able to stay current on those obligations and they may lose their units to the bank. >> just keep going back to the idea that the government itself told people to stop working. you know, like you've got to give people more time before you start evicting and foreclosing for not being able to pay the bills. >> now, landlords can begin

recovering their past due rent as early as march 1st of next year. that is month after those protections expire. in a statement san francisco mayor london breed praised the bill. we know some landlords will likely be unsatisfied with ts it does not address foreclosures or mortgage forbearance. for now, relief for those renters. for now reporting live, julian glover, abc7 news. california now has the most coronavirus cases in the nation. at 712,000. and while that might seem kind of grim, there are some bright spots here. the state reported 4,176 new cases yesterday. and that is well below the seven-day average which is just over 5,000. 28 people died, but that is the lowest number that we've seen in quite some time. the seven-day positivity rate is 4.9%. it's been a while since it's dipped below 5% and the

positivity rate is a pretty indicator of how rapidly covid-19 is spreading. small businesses in san francisco are getting help to stay safe against covid-19. mayor london breed helped hand out ppe to businesses. the mission, bay view and virus. ppe includes over a million surgical masks. 600,000 face shields and 150,000 bottles of hand sanitizer. now abc7 news live desk update. this morning, president trump is vowing to move forward with his plans to visit kenosha, wisconsin, despite calls for him to cancel the trip. the president is set to visit the city as the deals with protests following the police shooting with jacob blake. yesterday mr. trump defended kyle rittenhouse the teenager accused of shootingi and killin two protesters in kenosha. >> he was trying to get away from them. he would have probably been killed. it's under investigation. >> they urged the president not

to come saying his visit would dolittle to he little to heal t wounds. he does not have plans to visit the family of jacob blake. >> thank you, jobina. new this morning, state lawmakers passed a bill to prevent racially motivated 911 calls. this bill would make calling 911 to harass many instances of this in recent years where people wrongfully called police on black people. ceeporow, the discrimination. sad new development in the wildfires burning throughout northern california. the u.s. forest service says now that a firefighter has died while battling the august complex fires. this happened yesterday in the

mendocino national forest. a second firefighter is receiving medical attention. the forest service has so far not released any more details. the august complex has burned 236,000 acres. it is 20% contained. the lnu lightning complex is now 66% contained. more than 375,000 acres have burned in sonoma, napa, lake, solono and some evacuation orders have been downgraded to warnings. 1,200 structures have been destroyed. the czu lightning complex is now 41% contained. nearly 1,500 structures have been st re in sanmaou and the rest in santa cruz county. cal fire has lifted all evacuation orders and warnings in alameda county for the scu lightning complex. in santa clara county, some ofrders have been lifted and

not being out we could see unhealthy air tomorrow morning and that could prompt a continuation of the spare the air alert. you could definitely see a thinning as we head into wednesday afternoon and also as we head into thursday afternoon and that is a good trend. let's take a look at our microclimates for san francisco and we're in the 50s through 10:00 and mid 60s from noon all the way through about 6:00 with mixture of clouds and sunshine. let's head over to the east bay and we're in the 60s through 10:00. sunshine and low to mid 70s noon through about 5:00. and on the peninsula just a little bit warmer by noon we're 74. by 4:00 we're 80 but by 8:00 we're comfortable back around 67 degrees. heat advisories, watches, warnings and all possible this weekend. i'll have that forecast coming up and here's jobina with a look at the morning commute. how's it going, jobina? >> you know, it's going pretty well out there, mike. good morning, everyone. i'm really going to breeze through this traffic report and bring you a live picture showing the bay bridge toll plaza.

a deal for tiktok operations could be announced as soon as today. oracle, walmart have been talks to buy the popular app. president trump threatened to ban tiktok unless it is sold by its chinese parent company bytedance. they have given it until september 20th. the sale price is expected to be at least $20 billion. amazon just got the green light for its prime air drone delivery fleet. you won't get any packages this way any time soon but testing drone deliveries. the company hasn't said yet where or when those tests are going to happen. queen and adam lambert are coming out with a new album this fall. the band had to call off its summer tour because of the pandemic, but they're making it up to fans.
