racism, he went after protesters instead. >> you have anarchists, and you have the looters, and you have the rioters. you have all types. you have agitators. and that's what you sh shot by police seven times in the back. his uncle telling abc's alex perez they're fine with it. >> we're not mad. he's got an agenda and we got one too. our agenda is to get justice. >> reporter: but the president is defending 17-year-old kyle rittenhouse accused of killing two demonstrators in the kenosha protests. this morning, rittenhouse remains in custody as his lawyer posted this video on twitter, sharing what he says is a jailhouse message from the teenager. >> i just want to thank every single of you from the bottom of my heart for the underlying support. it's just amazing. just want to let you know i'll be out of here soon. >> reporter: the president digging in on his unsubstantiated claim that so-called thugs dressed in dark clothing plotted to fly to the republican national convention

holiday weekend warnings. a big concern that potential labor day parties could lead to a possible new surge in cases, kind of like what we saw happen after memorial day and the fourth of july. eva pilgrim joins us from a beach in brooklyn. good morning to you, eva. >> reporter: good morning, t.j. this is the unofficial end of summer. people will no doubt be trying to soak up the last of the summer sun but dr. fauci is now urging states to not let labor day celebrations ruin the fall. on a call with governors the nation's top infectious disease doctor warning of dire consequences if labor day weekend gatherings lead to an increase in infections. >> you must remember, following the fourth of july following memorial day, when people understandably get out and coregate and we have surges.

one thing that we don't want, we don't want whac-a-mole as we go into fall. where you get one down, and another one comes up. >> reporter: some areas are not closing. the vandamere speedway defying orders and inviting the public to show up to the track in a stop the covid chaos rally. thousands showing up, mostly without masks. in palm beach county, florida, officials announcing public beaches will remain open during the holiday weekend with cdc labor day also traditionally the start of the school year in many areas. new york city announcing it's delaying the start of in-person learning by two weeks. in volusia county, florida, an anonymous teacher posting this image of a crowded hallway during the first day of school on monday. the union calling it a shocking and disappointing image that highlights the risks teachers are facing. >> the students were absolutely not adhering to any cdc guidelines, congregating in a large group, some with masks on, some with masks off, but absolutely no social distancing taking place. >> reporter: the school district says the crowd was quickly

dispersed, adding, we believe it is a snapshot of a gathering that lasted just a few minutes. in ohio 1,400 new cases tuesday, the largest single day jump since july. the governor pointing to the return of college and grade school students. >> we want our kids in school which we do. we want our school playing athletics which we do. then the way to do that is for buckeyes were supposed to kick off the big ten football season tomorrow but the conference delaying the start of the season due to coronavirus. on tuesday the president spoke with the big ten commissioner about getting them playing as soon as possible. >> we're pushing very hard. i think they want to play and the fans want to see it. >> reporter: sources telling espn big ten football is now planning its season kickoff which could come as early as thanksgiving. and while we're trying to hang on to the summer weather a group of lawmakers is already looking

ahead to halloween asking the cdc for guidance so people can start planning how they will celebrate that holiday. tom. >> another tough conversation parents are going to have with their kids. all right, eva. thank you. joining us is dr. ashish jha, the new dean of the brown university school of public health. i want to start with the image we just saw in eva's report there, this crowded classroom in volusia county at one school. yes, some kids are wearing masks, some aren't. look how crowded that hallway is. how dangerous is this? >> yeah, good morning, tom. thanks for having me on. you know, images are like are frustrating because we've all been working really hard to figure out how to get our kids back to school. schools have to take some responsibility to make sure that kind of packing up and bunching up doesn't happen. it's called staggering schedules and moving kids around in a way that allows for kids to get from class to class. i found that frustrating and really dispiriting in some ways because we can do better. >> dr. jha, here in new york

city the largest school district in the country they have pushed back the start of school. the unions were upset. there is a lot of confusion and yet every night people go home and they watch professional athletes that are able to play sports because there's frequent testing in professional sports. is that something that's even realistic for our schools? is it necessary? >> yeah, first of all, i think it is necessary. i think it's really helpful especially in places that don't have the very, very low transmission rate so there are a few communities in america that can maybe get away without testing but for a large part of america, surveillance testing, the kind that the white house staff get, the kind that professional sports get would be extremely helpful. we're not doing it and, in fact, yesterday, administration officials called it utopia to be able to have that for our kids. of course, i believe that if we can do it for our athletes, we can do it for the white house, we should be able to do it for our kids. >> we heard about the warning from dr. fauci about labor day. how critical are the next five days as we enter the fall? >> i think they're really

important. the fall is something we've all been worried about. flu season will be with us. spending more time indoors so people have to act responsibly on labor day. i think being outside is great. going out to the beach is great. it's the large indoor gatherings, it's the bars, it's the indoor dining, it's the house party where you have 30 people inside your home. those are the things that are going to set off big outbreaks and the things that people absolutely have to avoid. >> on that point, dr. jha, southern california saw spikes after july 4th, after memorial day. they're not closing any beaches this time for labor day. in florida, they are closing some beaches so who exactly has it right? >> yeah, you know, i don't necessarily think we need to be closing beaches. to me, the beaches aren't where the spread is happening because it's outdoors and again, don't let them get super packed, so maybe manage how incredibly -- how busy they get, but what happens is people get together on beaches and then they go out to the bar afterward, and that's what really spreads the disease. so keep the beaches open, close

the bars and i think we can get through it pretty safely. >> dr. jha, you mentioned this earlier, but let's be real. it will be labor day weekend. people have been living with the pandemic for seven months. they'll want to go to beaches and see family and friends at barbecues. what can you recommend to make sure people can have a fun labor day, but also stay safe into the fall? >> yes, so i do believe we can have a fun labor day. we can't do everything we did last labor day. what can we do? backyard barbecues are fine as long as they're not massive, you have to have a plan. what if it starts raining? don't have everyone come indoors because that becomes risky. go to the beach but don't go out to an indoor dining restaurant afterwards. there are things we can do that get us maybe 80%, 90% of what a fun labor day might be. if we try to go for the last 10%, 20% we'll get into trouble and a lot of people are going to get sick, and we've got to avoid that. >> fun but responsible. dr. jha, we thank you for your time. >> thank you. >> amy. well, tom to an exclusive

abc news report raising questions about how the trump administration is dealing with possible russian interference in the election. abc news learning that a warning about russian dirty tricks was pulled two days before it was set to go out to law enforcement. chief white house correspondent jonathan karl has more on that. good morning, jon. >> reporter: good morning, amy. abc news has obtained a draft department of homeland security bulletin that warns about russian attempts to interfere in the upcoming election. it was a warning that was supposed to be issued two months ago to law enforcement agencies but never went out, raising serious questions about who stopped it and why. it was meant to be a warning, an intelligence bulletin from the department of homeland security alerting local, federal law enforcement to a russian scheme to damage joe biden's presidential campaign. a draft bulletin titled russia likely to denigrate health of u.s. candidates to influence 2020 election said intelligence analysts had determined with high confidence that russia is

trying to convince voters that joe biden isn't mentally fit to be president. as evidenced, the bulletin cites stories by russian controlled news outlets from september 2019 until may of this year claiming without evidence that joe biden's, quote, verbal miscues are symptoms of dementia. we assess russian malign influence actors are likely to continue denigrating presidential candidates through allegations of poor mental or physical health to influence the outcome of the 2020 elections, the bulletin said. the bulletin also said chinese and iranian state-controlled media had also been raising questions about mental fitness, but about trump's mental fitness, not biden's. according to an email obtained by abc news, the bulletin shared with senior staff at the department of homeland security on july 7th. it's scheduled to be released on july 9th, but just an hour after receiving the bulletin, the chief of staff to the acting secretary of homeland security

put the brakes on. please hold on sending this one out until you have a chance to speak to as1, he wrote, referring to acting homeland security secretary chad wolf. that was nearly two months ago and the bulletin was never issued. in response to our reporting a spokesperson tells abc news while dhs generally does not comment on leaked documents, this particular draft product lacked the necessary context and evidence for broader dissemination outside of the department of homeland security's office of intelligence and analysis. after briefing the acting secretary, i & a leadership delayed the product for further review. the spokesperson also notes dhs did share three other reports on election security with state and local law enforcement. the trump campaign's message on biden's fitness has been similar to the one the bulletin attributes to the russians including this ad released in june. >> joe biden is slipping. >> rapidly rising -- um -- and

woman dangling from the window of a harlem high-rise. the firefi breaking the windows on the floor above and lowering a firefighter to the woman as she clings to the window below, the sill just a few inches wide. >> i didn't want to see anybody fall. that's all i cared about. i just wanted to get her inside. >> reporter: the rescue met with cheers from onlookers. this morning, the firefighters hailed as heroes after hoisting the woman to safety. >> this is really a heroic rescue, and it really shows the talent and the bravery of the members of the new york city fire department. >> it was awesome. that was hero, superhero spiderman superhero stuff you saw today. >> reporter: one firefighter says he stayed at the window and kept telling the woman not to jump, that fdny would save her, and they should did. guys? >> wow, thank you. >> talent and bravery as the commissioner said. we are following a lot of

other headline this is morning, including breonna taylor's boyfriend speaking out as he sues the city and police accusing them of trying to cover up her killing. then the dramatic video showing how ineffective face shields and masks with valves can be at stopping the spread of coronavirus. but first, let's go to rob marciano. a little rain outside of the city today. we have severe weather down across the south. here's one of seven tornadoes being reported outside of little rock, arkansas. they're still dealing with the aftermath of hurricane laura. a little bit of damage from this tornado. also some rain, heavy at times, and we had it yesterday in oklahoma, today texas and parts of arkansas where flash flood warnings are posted just northeast of little rock. we could see four to six inches from south of dallas up to texarkana and now a high risk for flooding is expected just to the west of little rock. could be dangerous stuff. time for your sunny cities now brought to you by jeep.

including president trump's tense visit to kenosha, wisconsin. the president pushing his law and order rallying cry and going after protesters when asked about systemic racism. the president will head to north carolina today, another battleground state, with the election 62 days out. also right now for the first time ever, a kennedy has lost a congressional race in massachusetts. congressman joe kennedy iii conceded to incumbent senator ed markey. serena williams kicking off the first round of the u.s. open by winning her 102nd victory at the grand slam breaking the record for most wins by a woman at the u.s. open. this win was extra special for the 23-time grand slam champ. it was her daughter olympia's 3rd birthday. so a big day overall. we want to turn now and start this half hour with that explosive new lawsuit filed by the boyfriend of breonna taylor, the louisville woman fatally shot by police in her own home. taylor's boyfriend said police mistreated him on that night as another man now alleges

prosecutors offered him a plea deal to smear taylor after her death. abc's marcus moore joins us now with the latest. marcus, good morning. >> reporter: t.j., good morning. that lawsuit was filed tuesday and in it breonna taylor's boyfriend describes the horrific moment those shots rang out in their louisville home. his cries for help, the lawsuit says, went unanswered. speaking out publicly for the first time since his girlfriend, breonna taylor, was shot to death by police, kenneth walker is revealing the deep pain and his call for justice. >> my life changed forever. i can no longer remain silent. >> reporter: walker is now suing the city of louisville and the louisville police, seeking $10.5 million in damages for assault, battery, false arrest and malicious prosecution and asking for immunity from any further prosecution. >> the charges brought against me were meant to silence me and cover up breonna's murder. >> kenny was, for lack of a better term, framed in this case

and charged with crimes that he did not commit. >> reporter: nearly six months have passed since taylor was killed. according to the lawsuit, walker says he and the 26-year-old emt worker had fallen asleep when he says police broke down the door on a no-knock warrant. walker says in self-defense he fired a shot. taylor caught in the middle of the officers firing bullets, was hit five times. in the lawsuit walker claims he yelled for help, quote, but no one came as his wounded girlfriend bled to death. >> help! oh, my god. >> every night he goes to sleep worried this is going to happen again. and every day he gets up he doesn't know is today the day they're coming back. >> reporter: one officer was shot in the leg. police initially charged walker with attempted murder but those charges were later dropped. walker's lawyers maintain that the bullet that hit the officer may have come from friendly fire. >> i was raised by a good family. i am a legal gun owner and i would never knowingly shoot a

police officer. >> reporter: there have been months of protest and outrage calling for the officers to be charged with taylor's death. the hashtags, justice for breonna taylor and say her name going viral. this as taylor's ex who was the subject of that no knock warrant is speaking out from jail accusing louisville prosecutors of offering him a plea deal if he would connect breonna to his ongoing drug case. >> i turned it down from day one when i seen the names on there. they're incriminating other people who had nothing to do with anything. >> reporter: the prosecutor's office deny breonna was ever a co-defendant in the case, saying the sheet that sam aguiar posted on facebook was a draft that was part of a pre-indictment plea negotiations. those were never part of the court record and are not court documents. breonna taylor's family has released a statement saying in part that they are outraged and that it's enormously ironic that the accused drug dealer here

acted with honor refusing to falsely discredit bre after her death even when offered the temptation of no prison time for lying while prosecutors and police acted in the most egregiously dishonest way possible. amy. >> marcus moore, thank you for that. now to an important new study about two popular face coverings, face shields and masks with valves. researchers are looking at whether they are effective in blocking viral particles such as coronavirus from escaping. will reeve joins us now with the dramatic visuals you need to see before you head out wearing one of these. good morning to you, will. >> reporter: good morning to you, amy. with face coverings required at so many places around the country and experts recommending wearing them at all times amid the pandemic, it's important to know whether what you're wearing works and what might be a better option. >> three, two, one. >> reporter: this morning, new video showing just how ineffective a face shield can be when used alone to protect

against the spread of coronavirus. it's part of a new study from florida atlantic university. researchers using a water and glycerin mixture to simulate a cough or sneeze from a mannequin's mouth or nose. >> the larger droplets will get stopped but the smaller droplets, they follow the air streams very well so they can be flow around the visor very easily. when face shields are used by health care workers, it's always in conjunction with a mask. >> reporter: researchers also testing an n-95 rated mask with an exhalation valve. >> when we inhale, the valve closes so all the air gets filtered through the mask material but during exhalation, the valve opens and nothing needs to go through the mask material. there's a free flow of air which is not good if you're trying to restrict the spread of droplets. >> reporter: he noted these specific masks are mainly

we are back with one woman's miraculous great white shark attack survival story, and she's speaking from her hospital bed about how she escaped the predator's jaws when her partner fought it off. victor oquendo joins us with more with this. good morning, victor. >> reporter: good morning, amy. her partner saying he started raining down punches on the shark. chantelle doyle still can't move or feel her right leg, but she has a much different outlook than you might expect. >> when i was in the water i could feel it holding me. i just sort of thought, shark's got my leg. what am i going to do?

aired. >> well, do you think, carole, you can turn it around with this show and by dancing? you say you were villainized. now people maybe get to see you in a new light. >> i really hope so and the biggest thing for me is that the longer my partner and i can stay in the running and in the competition, it will keep the cats forefront in the viewer's eye, and to me that was where "tiger king" missed the ball. it really should have been focused on the animals and so i'm hoping "dancing with the stars" will do that. >> you talk about the show there. it highlighted kind of a beef you had, right, and we've seen how tenacious you can be against a rival. now, should some of the other competitors be concerned that you're going to bring that same tenacity to the dance floor? >> i am competitive. but i'm competitive with myself. i want to do the very best that i can possibly do.
