building a better bay area for a safe and secure future. this is abc 7 news. developing news tonight. a san leandr police officer has been charged with felony manslaughter in the deadly shooting of a black man inside a walmart. friends and family of the victim say this is a first step, but as abc 7 news report j.r. stone reports, the officer's attorney is criticizing the d.a.'s decision. >> drop the bat. >> back up. >> drop the bat. >> this is video from back in april showing the moments before officer jason fletcher shot a killed stephen taylor inside a san leandro walmart. alameda county district attorney nancy o'malley says officer fletcher's use of force was not warranted. >> at time of the shooting, it was not reasonable to conclude mr. stephen taylor posed an imminent threat of death or great bold injury to either officer fletcher or to anyone else in the store. >> reporter: at the time of the shooting, taylor had a baseball bat. officer fletcher's attorney says

his client feared for his life and defended himself. >> the law doesn't require officers even in today's age to have their brains bashed out with a lethal instrument. which a baseball bat is. >> drop the bat, man. >> reporter: officers tased taylor but it didn't work. officer fletcher then fired a shot that proved to be deadly. o'malley has charged fletcher with voluntary manslaughter. fletcher seen here in this archive individual from 2013 had been with the department for more than 15 years. family members say taylor may have been having a mental episode but believe he could have been talked down. friends of the family say that while they would have liked murder charges, at least this is something. >> at the end of the day -- a lot of times we have to settle. >> reporter: at the time of the shooting, taylor was homeless. i did reach out to his mother and grandmother who deferred all comments to their lawyer.

a lawyer who says they are encouraged by the d.a.'s decision. in alameda county, j.r. stone, abc 7 news. three san jose police officers involved in a deadly shooting in may of 2019 have been cleared. the santa clara district attorney's office says an investigation has found the officers acted legally. police say the officers shot the man as he drove a stolen car into a sergeant. the d.a.'s report said the officers fired their weapons as a last and necessary resort. a tiburon police sergeant has resigned after a confrontation with a black business owner that sparked accusations of racial profiling. >> do one of you own the store? >> i do not have to prove my existence to you. >> body camera video showed the moments the officers questioned the owner who was there at 1:00 a.m. restocking his store. sergeant michael blazzy is seen arguing with him. tiburon police denied any racial motive. a plan to put supportive

staff for police in retail areas of san francisco moved by a step forward. the police commission approved a training manual for the community ambassador program. made up of ten retired members of the department to serve as nonsworn ambassadors in retail focused on quality of life issues. ambassadors will not carry guns but will observe and report crimes. >> they're not out there to use force. they're out there to be ambassadors. give directions. put a good face on. >> the pilot program will launch in union square. rias disinvited a uniformed police contingent from appearing in future pride parades. it comes in the wake of a protest during the 2019 parade. officers broke it up and arrested two people. sf pride called it an overreaction. the group says it's now learned all charges were dropped against the officers involved. if you're deal with issues of racial or social injustice,

we want to help you find an ally. go to abc7news.com/takeaction for a list of local resources. new developments tonight in nancy pelosi's blowout inside a san francisco salon. an attorney for her stylist released a statement tonight, saying he got prior permission from the salon owner for the appointment. the statement reads in part, quote, ms. kious took special interest in the appointment. she made several vitriolic and incendiary comments about speaker pelosi and her purported responsibility for temporarily suspending operations of ms. kious' business. there are now several online fund-raisers for kious who told fox news she is getting death threats and likely will have to move out of san francisco. abc 7 news reporter kate larsen has the story. >> i take responsibility for trusting the word of a

neighborhood salon that i've been to over the years many times. >> reporter: house speaker nancy pelosi deflecting after she was caught on surveillance video monday getting her hair done in this salon. the salon owner erica kious who abc 7 reached out to originally provided the video to fox news. indoor hair serves are still prohibited under san francisco health orders. >> they said what we're able to accommodate people, one person at a time. and that we can set up a time. i trusted that. as it turns out, it was a setup. >> reporter: speaker pelosi came here to the mission education center to talk about the heros act and the need for funding schools and children during the pandemic. but her message was largely overshadowed h overshadowed by her own decision to get a blowout. >> she makes rules. why would she even consider, like, bending them a little. >> reporter: today he opened the space as an outdoor barber shop since indoor salon services are

not scheduled to reopen in san francisco until the end of september. >> look, she could have came here today. she's too important of a person to make silly mistakes like that. >> ms. pelosi, i feel disrespected. >> reporter: san francisco barb barber bryce ward hasn't been to his shop since march. >> for covid to go away, we have to comply with rules. i feel like you owe the serves industry an apology. >> i just spoke to a san francisco barber who is a fan of yours, he supports you, but he thinks you owe the service industry an apology. >> well, i don't. i think that they -- that this solanos me an apology for setting up, but i will say this -- in fairness t hha to get our country moving again. >> reporter: after she spoke about the importance of face coverings, pelosi explained why she wasn't wearing a mask in the salon. >> that picture is when i just came out of the bowl. i don't wear a mask when i'm washing my hair. do you wear a mask when you're

washing your hair? >> reporter: while announcing a new citywide mask wearing campaign, mayor london breed came to speaker pelosi's defense. >> we have bigger issues as it relates to this country. we basically have a dictator in charge of running this country and we have our speaker, nancy pelosi, working day and night to try and fight against the challenges that we have with the white house. it's unfortunate that, you know, this conversation has kind of blown up in the way that it has. >> reporter: trump called pelosi crazy on twitter, saying she's being decimated for not wearing a mask despite constantly lecturing everyone else. he suggested the salon owner must really dislike pelosi for turning her in on tape. kate larson, abc 7 news. in the south bay, a winning hand for san jose card rooms. they've been given the green light to bring operations outdoors into their private parking lots.

meant to move business operations outside during the pandemic. abc 7 news recorder man it da del castilio has the story. >> reporter: bay 101 in san jose, card rooms cashing in on a decision to bring tables outdoors. the vice president says that means setting up gaming tables under the 8,000 square foot tent by week's end. >> then to schedule inspections with regulators so that they can sign off. make sure all our safety procedures, cleaning, sanitization and our regulatory compliance for cameras and security and surveillance are all in check. >> reporter: guidelines said by the state include general disinfecting, distancing, mandatory face masks and more. for card rooms, they'll need to provide time between dealer rotations to allow for thorough handwashing. card games players touch the cards, upon dealer rotation,

they must discard cards in play, sanitize them and keep them out of rotation for a week. after eight hours card rooms have to discard, disinfect, sanitize or take cards out of rotation for at least seven days. they're also required to use clean chips upon every dealer rotation and wash and disinfect used chips. additional steps, but a small price to pay since business was shuddered back in march. he says casino matrix and bay 101 were on track to generate nearly $19 million in tax revenue. took a hit to $13.5 million after being forced to close. >> the more months that they go out of service, the less that we're actually going to be able to generate. >> casino matrix on by the end of next week with 28 of their 49 tables and 300 of their 700 employees. in san jose, abc 7 news. developing news. crews across the bay area are

facing for containment before temperatures jump this weekend. the scu lightning complex in santa clara, alameda and contra-costa counties is now 76% contained, burning more than 391,000 acres. the lnu in napa, sonoma, lake and solano counties has burned more than 375,000 acres and is 78% contained. and the czu complex in santa cruz and san mateo counties has burned more than 85,000 acres. that one is 46% contained. a national guardsmen was injured and had to be rescued by helicopter while fighting the lnu complex. these are pictures of that rescue. the sonoma county sheriff's office says the national guardsmen was maneuvering across steep terrain when he slipped and fell 100 feet down the hill. the guardsman suffered a leg injury and a sheriff helicopter arrived within ten minutes. follow the latest details on the fires with our wildfire tracker, updated with the latest information from cal fire. you can also find air quality

dedicated. rosanna lost two daughters and her husband. >> we have plaques that have pictures of our two daughters, their names and their dad, so that there's a name to the face. >> the cause of the fire is still under investigation, though, court documents say criminal charges against" conception's" captain are imminent. a major development tonight in the fight against covid-19 is sparking both anticipation and concern. the cdc has now issued guidelines asking all 50 states and several large u.s. cities to be ready to distribute a vaccine, possibly by late october or early november. abc 7 news anchor liz kreutz has the details. >> reporter: the directive from cdc telling states to prepare for a possible release of a covid-19 vaccine seems to confirm hints dropped by administration officials for weeks. most recently, dr. anthony fauci tried to calm concerns over a vaccine being released early before it's completed clinical trials, saying an early release would need to be backed up by

overwhelming data. >> you don't want a vaccine to be available widely to the american public unless it's been shown to be safe and effective. >> reporter: an early release would deordered through an emergency use authorization, the same emergency power the administration has used for drugs like hydroxychloroquine and most recently convalescent blood plasma, but many infectious disease experts have raised red flags about potential problems with that strategy. >> i think we're all worried about that. >> reporter: dr. maldonado is involved in a number of drug trials. she says confirming safety and effectiveness is key to winning the public's trust and ensuring widespread distribution. >> we have to be extremely careful about why and how the data are interpreted to do that. >> reporter: but public anticipation has been building, driven in part by statements from president trump that a vaccine could likely be ready before or around election day. the cdc plan describes two vaccines, "a" and "b," which seem to match drugs from pfizer and moderna that are in

late-stage trials. it isn't clear yet if either could clear phase iii trials in that timeframe, but according to cdc, the initial recipients of any vaccine would be health care workers and high-risk groups. liz kreutz, abc 7 news. abc 7 news spent a week exploring the bay area's role in the development and testing of possible coronavirus vaccines. you can see our special series on the race for the vaccine on the 57 news app or on abc7news.com. the number of coronavirus deaths in california topped 13,000 this week, but there are some encouraging numbers tonight. ♪ >> the last week we've seen a reduction in the total number of cases. >> reporter: statewide data shows there were about 4,200 new crisis cases in the past day. compare that to the 12,000 new cases in a single day on july 22nd. meanwhile, governor newsom outlined new eviction and foreclosure protections for californians. >> we've extended our

protections through february 1st of next year. so know evictions for rent non-payment related to covid-19 through february 2021. >> reporter: not wearing a mask could cost you in alameda. the city approved fines starting at $250 for the first offense. ♪ the governor also announced the state's new $300 supplemental unemployment benefit will begin on september 10th. there's been some confusion whether a san francisco institution is permanently closy. tommy's joint was vandalized last week and the buzz on social media suggests it maybe added to the list of the city's 1,300 restaurants that have closed permanently. but the owner of tommy's joint says they're not giving up and neither are their fans. >> there is nothing on this treat that is kind of old san francisco style, so it would be a shame if they were shut down, but i think that's kind of the new trend. >> meanwhile, a new study

published by eater sf found that sales across the city in restaurants have plunged 91% since march. more than half the restaurants are reporting no sales at all. that means roughly 1,300 have primarily closed or are gone for good. a beloved east bay christmas light display has been cancelled, of course, because of the pandemic. the dazzling display at the livermore home of deacon dave has been going on for more than 35 years. he wrote online that crowd control was the main reason for his decision. the massive crowds of people and cars just wouldn't be manageable. he also said he didn't want to put the lives of volunteers at risk. some beaches on thepewill bi lar edo shut down its beaches to keep crowds away during the pandemic. in half moon bay, the mayor says the mental strain of the pandemic played a role in the decision to keep beaches open there. >> mental health is very big. you know, being outside, being able to run, being able to smell

the ocean air, being out with nature, it's -- it revives your soul. >> ultimately, the half moon bay city council voted unanimously to keep beaches open over labor day weekend. santa cruz beaches will be closed except for a few hours over the holiday weekend. parts of the beach boardwalk will be open. stores and some too stands reopened today, rides and the arcade remain closed. a drive-in movie scheduled in the parking lot for friday and saturday is still on. the beach boardwalk says money from ticket sales will be donated to local wildfire relief efforts. all right. so let's talk about the weather conditions because our firefighters are still out there battling those fires, although they are getting more containment, which is always great to hear. sandhya, more hot weather? >> yeah, they are going to have to race against the clock because this upcoming weekend we do have very dangerous heat coming. although, tonight conditions are favorable for the firefighters. may not be the case as we head

towards the weekend. led me show you a hazy sunset from our emeryville camera. the reddish glow around the sun, yes, still impacted by the smoke. although it's not nearly as bad as it was in days' past. i want to show you the air quality right now. the air quality index. everyone is in green or yellow. everyone's in the good to moderate category right now. 46 in san francisco in the good category. now, i want to show you the smoke forecast. so as we head into tomorrow morning, yes, we'll still have smoke around, but we haven't seen blues show up in our area in quite some time, so tomorrow night we are talking about better air quality. as we go into friday, some of that smoke getting pushed off farther to the east out of our area, so we definitely will be breathing easier and hopefully enjoying some blue skies like we did today. air quality, though, tomorrow still under a spare the air alert because we are expecting moderate to poor air quality. friday, moderate for all parts

of the barea. here's bay area. mid-100s inland. look at sunday, extreme heat coming your way. talking 108 degrees. and still very hot inland on monday. along the coastline, you're going to be in the upper 60s to mid-70s around the bay in the 80s and 90s. this is a time when you do have to take it easy. excessive heat watch posted from 11:00 saturday to 9:00 p.m. sunday. there is a high risk of getting sick from this heat. we're talking heat exhaustion, heatstroke, so definitely something to watch out for this upcoming weekend. live dopplar 7 showing you some fog that has pushed into parts from the 50s to the 60s, so it's cooled off nicely. here is a view from our south beach camera. a little murky looking towards salesforce tower as we have the fog around. hazy and foggy in the morning. excessive heat for labor day weekend. increased risk in heat-related
