now at 5:00, movie theaters reopening in one bay area county. but the strict guidelines we're expecting. and fertility fraud, and at-home dna test leads an east bay woman to sue her former doctor. the unexpected results uncovered 40 years later. and heavy smoke impacted yosemite. mike is looking at our air quality. good morning, everybody. it is friday, september 18. good to see you guys. it was really weird to hear that yosemite, i was supposed to go there last weekend and we had to postpone the trip. but now seeing the park being closed all together, it is weird >> yeah, it has just got worse as the wind shifted. you can't escape it. and it is going to be there for the better part of the weekend. plus they have the high fire danger right near the red flag warning. and back here at home, still green. how about that for the third consecutive morning. we do have a few clouds out there as a dold frocold front w through today andbring us a touch of autumn. and katrina is to our south and that is where it will stay. so check out our temperatures, waking up mainly in the low to mid-60s, mid-60s to low 70s at lunch. and mainly 60s and 7s at 4:00. and a comfortable evening, temperatures back nto the 60s. may even need a light jacket. we'll talk about the weekend coming up. new overnight, crews in san jose on the seen ofcee of a fira tire shop. access to the area and high gra hi hgh dwrantss was tricky. and crews are expeted to be there for a while. they will let the tres burn. s cause is still under investigation. and you can start going back to the movies today in marin county. they had been forced to shut down for about six months now. and amy hollyfield is live in san rafael with what we can expect to see. >> good morning. they had five movies here at this theater in san rafael and the showings will start at 1:00 this afternoon for the first time in six months. the movie theaters are open in napa, so we did head up there to check it out, see what it looks like during these times. and theaters are only allowed to fill up to 25% of capacity.

masks are required except for when you are eating and drinking in the auditorium. and the theater will make sure not to sell the seats next to you. we spoke to a couple in napa who said that they were happy to be out. >> i've missed it a hot, just missed coming here with friends and family. it gives us something to do. like kind of stuck at home. >> nice to see a movie and not have to sit in your bed while watching it. >> reporter: opening theaters is allowed once the county reaches the red level of the state he's reopening plan. but a county doesn't have to open them. san francisco and santa clara are red, but have decided not to open theaters yet. but today they open in marin, so if you are ready to get off the couch, you have this opportunity. amy hollyfield, abc 7 news. at the live desk, a new report finds controversial testing guidance released by the

cdc last month was actually not written by cdc scientists. the guidance said patients without symptoms should not get tested for covid-19 even if they were exposed to someone who is infected. according to an email obtained by the "new york times," trump administration officials at the health and human services department rewrote the guidance despite warnings from doctors to actually ramp up up testing. this comes after dr. red field and trump went back and forth over a time line for a vaccine. >> i think we're probably looking at late second quarter, third quarter 2021. >> no, we want to go immediately. >> meanwhile the trump administration is facing new criticism after recently uncovering memos revealed the white house blocked a proposal from the postal service to send 650 million disposable masks to american households back in april, this is around the same

time the president was largely resisting wearing a mask. an east bay woman is suing her former doctor for medical rape. 40 years ago, she thought that she was artificially inseminated with a sperm donor, but now you a test reveals that her ob/gyn is likely the wouldbiological f. >> i look in the mirror and i don't even recognize myself. sometimes i see him. >> reporter: him meaning dr. michael kiken seen her in a facebook post. at 40 years old, julie discovered that he is likely the biological father. >> this all dates back to when my husband and i were newlyweds and trying to conceive a child. >> reporter: and katherine richards is julie's mother.

she soughtn nefertility treatme and on wednesday, she filed this lawsuit against kiken alleging battery and fraud. the complaint says that kiken inserted his own sperm into richards without her consent and against her wishes. the suit characterizes it as medical rape. >> dr. kiken lied to us. >> reporter: last year she received a 23 and me ancestry dna test kit. >> i was jewish and had a half brother. so you need to start question things. i got connected to gene yol guest and was able to make the connection. >> and so we tested my son and found he shared the same biological father. >> dr. kiken needs to answer for what he did to katie and to others. >> reporter: an attorney says that boy in the richards neighborhood was also the result

of kiken's deceitful insemination. >> we're aware of three children who were the product of dr. kiken's violations. we don't know if there are any others. certainly something that we'll find out through our lawsuit. >> reporter: kiken now lives in virginia and he is still licensed to practice medicine. but a former clinic says he hasn't worked there for about ten years. i spoke to kiken's attorney and says i have no comments and i don't speak to reporters. kate larsen, abc 7. what a story. all right. developing news now, an arson investigat is under way at an armenian church. yesterday morning fire gutted part of a community center. and officials say the cause of the fire is under investigation, but church leaders believe that someone purposely did this and used at least one molotov cocktail to start it. in july the armenian school associated with the church was vandalized with hateful

to mid 60s. 67 in antioch and 57 in answer rosa. not nearly the fog that we had yesterday. and in fact you can see some breaks in the clouds from our exploratorium camera at pier 15. so you want to have the sunglasses early. and your activity planner for today, everything is pretty good. it will be confident abomfortab. and the beaches will have sun and clouds and temperatures a little above average and the water temperature about 57 degrees. and your air quality forecast through the weekend, and now the smoke forecast, tomorrow morning it will start getting hazy in the north bay first and then it will spread northern half of the bay throughout the day. and then overnight sunday, you can see it tries to reach more of the bay, maybe excluding the south bay. and then monday, that is our last day with haze as another nice clean cool air mass is headed our way tuesday.

75 in yosemite with that smoke. palm springs at 109 and a few showers around eureka. unfortunately the cold front won't bring us any shower, but a pretty comfortable day. there is a new plan to pave over a "black lives matter" mural. the day after it was painted in july, it was vandalized. and the next day a man was arrested for allegedly waving a gun at nearby protesters. inside then it suffered just regular wear and tear. martinez's city manager says that the street will be repaved in october as part of a larger downtown project. and we're focusing on race and social justice this week. and we're also launching new series giving you a chance to hear the diverse voices in our communities. and jobina is here to kick things off. >> yes, as you stated, we're doing something new here at abc

7. we're turning our mics over to people in our communities for a segment we're calling for the better. highlighting those that are working hard to build a better bay area. so this morning you will hear from tyson amere and mike davis with an organization that promotes literacy and also competerehension through releva content in classrooms. >> you already know if you were here last week, i write heavy bars. so we want to break it down. >> the black program is an evolutionary step for us because as the title says, building leaders and activists, they will get the writing skill, they will get stuff that allows them to touch on the common core and kept standards that the state of california or the united states wants them to be exposed to in school. but in addition to that, they will get the social, the political, the cultural, historical foundation that they

should have but we know that the school system is in the going to give them because the school them was the not set up to educate our community properly. we bring in that education allege experience that so many are hungry for. >> i use poetry to bring in the trauma and so that they can learn to articulate their emotions, identify certain traumas that impact them. and then provide them a platform to express themselves. because oftentimes they are shut down or they don't feel like they have a voice. so we try to provide that in a setting where they feel safe to express themselves and to be creative with that expression. >> let's talk about it. okay, i got you and then you next. >> and that is just a small part

the table there. meanwhile the oakland education association telling as soon as 7 reporter lee yanne melendez, th have not negotiated with the school district and there is no talks of reopening schools there at this time. and in san jose, it was announced that they are committed to distance learning for the rest of 2020 and we're trying to figure out what exactly that means for the other school districts in the bay area. >> and the issue is elementary school districts, it is easier to bring back their teachers if you are a unified district, that is hard because the union may take the position what is good for one is good for all. so a harder negotiation to make. >> reporter: and san jose unified say that they will be regrouping in decembdede so they are doing distance learning the rest of the
