a driver drove into this outdoor dining area, injuring several people. new details tonight about what led to this san francisco firefighter's death. more in my story. after a beautiful weekend, we're tracking warmer weather and gusty winds for the week ahead. i'll have all the details in the accuweather forecast. abc7 news at 11:00 starts right now. >> announcer: building a better bay area for a safe and secure future, this is abc7 news. i said, oh, my god, the car is running to us. >> it is so scary. two people have life-threatening injuries after an suv crashes into some outdoor seating as diners were eating lunch this afternoon in the south bay. good evening and thank you for joining us. i'm dion lim. eight diners were hurt and they were seated outside grand century mall in san jose. we do know the driver was also

taken to the hospital and police say he may have been having a medical episode. abc7 news reporter luz pena is following this developing story for us. and, luz, you've spoken to some witnesses. what can you tell us? >> reporter: dion, a devastating scene here in san jose. i've spoken to several witnesses who say this was exactly what they feared the most with outdoor dining. let me show you what happened behind us. they described the driver lost control of the vehicle and accelerated. he was going over the speed bump and instead of driving into the light, he turned right, drove over the divider and tn to cpl nd ttenta turned an afternoon of outdoor dining into tragedy. >> i looked out, and i saw the van was, you know, driving toward us. i said, come on, let's -- i say, oh, my god. the car's running to us. >> reporter: kim ran out of the way as the driver of this toyota

4runner struck multiple people next to her under this tent. >> he lost control. i don't know. he looked sick, not normal. >> reporter: according to san jose police, the driver may have been in medical distress prior to striking eight victims. >> he stepped on the gas, and his back tires started to peel. the smoke started kicking up. he jumped the lane, went across this front entrance, jumped that lane, all these lanes, and then plowed into that -- the first canopies right there. repter: an a omcrs the st, thisiss ownerelpl he called 911. >> a lot of people run away, but some people tried to help. he said probably one person still underneath the car.

>> reporter: san jose residents lee lee and dan sat across from the scene thinking she could have been hurt. tonight she's asking for the city to intervene. >> after this what happened and the city and count know, maybe we have another solution that we allowed to go dining inside, safer or some kind of regulation to protect the people that dining. >> reporter: all eight victims were transported to nearby hospitals. two of the victims have life-threatening injuries. san jose police confirmed the driver is a 69-year-old man. witnesses said he was crying and in shock as he sat inside his vehicle. many people here telling us they're wondering why the city has not put any barricades for outdoor dining, especially inin news. >> luz, of course there are still lots of questions about this story and if any changes will be made to outdoor dining. we will be posting any update as we get them to abc7news.com and

our app. tonight we're learning new details about what happened in the moments before a san francisco firefighter fell three stories during a training exercise that proved to be fatal. a new preliminary report says jason cortez was blasted by water before his fall last week. it also says covid-19 precautions could have played a role in that accident. here's abc7 news reporter j.r. stone. >> reporter: a massive black mourning band installed sunday, now hanging outside san francisco fire department station 3, a band that remembers 42-year-old jason cortez, who died last wednesday at this training facility and who was a firefighter at station 3. a preliminary report by the department suggests that covid-19 concerns and restrictions were a contributing factor in cortez's fall. egine 3 conducted a pump training operation alone since multi-company drills are suspended due to covid-19 concerns. basically four firefighters doing a training drill instead

of the usual eight. we spoke with rob rappaport, a fire consultant unaffiliated with the department. >> just the fact that you don't have a ton of supervision of experienced, you know, firefighters or officers, you know, could contribute to things going wrong depending on the experience level. >> reporter: the report states that cortez was on the third story of this training tower when he inadvertently opened a valve and a powerful stream of water hit him and knocked him off of the fire escape and to the ground. he died at the hospital a short time later. rapp the preliminary report. his gear may have hit the valve or if cortez went to drain the hose. >> he may have thought, oh, the drill's over, or maybe when he throttled down the pump and thought, oh, maybe the drill is over. >> ror department's local 798 union wouldn't comment on the situation, only saying they are

allowing family members to mourn before planning cortez's services. in san francisco, j.r. stone, abc7 news. an attempted carjacking suspect was fatally shot by san francisco police last night after he led officers on a chase throughout the heart of the city. this is the black toyota prius the suspect crashed at market and golf streets. the suspect then ran a block down goff to otis street and during that encounter, at least one officer shot the suspect. other officers gave the wounded male medical help, but he died at the scene. police say a knife was recovered. the incident was captured on body cameras. police, the district attorney'sr are all investigating. to the north bay where cal fire is making considerable progress on the glass fire. tonight. that fire has burned more than 67,000 acres. and there's outreach and support in the napa valley tonight for those impacted by the glass fire.

hundreds benefited from a food giveaway today, and we are still hearing amazing stories of survival and property protection. abc7 news reporter cornell barnard is in the napa valley. >> reporter: these food boxes were going fast in calistoga, a drive-through giveaway. employees of the hotel chain are getting one, all of them impacted by the glass fire during weeks of evacuations and power outages. >> it speaks to what calistoga is all about and how we really rise up to any challenge. >> it was a really struggle for my kids to see this. >> reporter: daniel has worked at the neighboring property, the calistoga ranch. it was destroyed by the fire. this is all that's left. >> the ranch was my family. i actually met great people there. everybody was helping each other out. eer veryfr. daniel hopesoaob wn >>eporte meantiowner fiona b su

>> it was very close to burning down the winery. >> reporter: this winery sits at the very top of spring mountain road in st. helena. two weeks ago resources were stretched thin so employees here jumped into action to save the property. watch how close the fire got to these vineyards. but friends, family, and employees grabbed hoses and made a stand. >> we weren't trying to fight the fire as if to extinguish it but just keep it off the property. >> reporter: by some miracle, it worked, some grapevines burned as well as an observation deck but most of the property survived. >> the adrenaline is gone now, but at the time it was pumping and we were running in every direction. but we feel very blessed that we're standing here right now. >> reporter: dozens of other wineries suffered damage, but some like barnett were lucky. >> my heart goes out to everybody that has suffered all their losses. >> reporter: in the napa valley -- >> that was cornell barnard

reporting. now, pg&e is warning of possible public safety power shutoffs on wednesday and thursday in the bay area. winds are expected to pick up those days, increase the risk for a wildfire. the utilit says it will have a better idea of the cities and counties that could be impacted by the end of tuesday. don't forget you can always check the weather conditions where you live on our free abc7 news app. some election news now. danville city officials say they do not believe ballots were stolen or tampered with after a collection box was found unsecured after it was serviced. the box is located at a park and ride lot near sycamore valley road and camino ramon. it had been worked on earlier today but was not properly closed and locked. the lid was left open for about an hour this afternoon. a city spokesperson says there is no evidence anyone's ballot went missing or was mishandled. but if you dropped your ballot off today and have concerns, you can contact the contra costa county registrar. happening right now, celebrations on both coasts

after los angeles lakers again became nba champions. this was the scene on the streets of l.a. tonight after the lakers beat miami 106-93. the city's mayor had asked for no crowds due to covid, but as you can see, that did not keep people away. the lakers were led by lebron james, who is the first player in history to win mvp with three different teams. the win caps an emotional season for lakers fans, shaken earlier this year by the death of former player kobe bryant. now, the pandemic also complicated some things as well. the finals were played in the bubble at disney world in orlando. this was the scene there tonight. we will have more game highlights coming up in sports. also still ahead on abc7 news at 11:00, there is no slowing down president trump. his controversial comments about recovering from the coronavirus and his campaign plans. and i'm meteorologist drew tuma.

away from the start of a four-day hearing in d.c. senate republicans hoping to fast-track judge amy coney barrett to the u.s. supreme court. we have all the details on what you can expect coming up in our next half hour at 11:30. all right. and getting to our weather situation with meteorologist drew tuma, the warm-up on the way. we can already feel it. >> yeah. it felt mild today, dion. we also had fresh air today, blue skies, and tonight we're looking at good air quality. so the current map of our air quality right now, you can see a lot of green dots across the bay area, indicating that good fresh air is still overhead. our pm 2.5 levels are mainly below 50 right now. we do anticipate that will stay that way overnight tonight. it's a clear picture from our emeryville camera. a live look. you can see sutro tower blinking well off in the background. no fog tonight. it's going to be nothing but sunshine from start to finish tomorrow and pretty good air quality for much of the bay area. so the next two days, you could

see much of the region in that green or good zone for the air quality from the coast to the central bay to the south bay, we will have fresh air. however, there are some problems localized in the north bay close to the glass fire. we will see a little bit of smoke in our atmosphere from time to time, so that has prompted a spare the air day for tomorrow and tuesday as well. but still much of the region will deal with good air quality, so you can breathe easy the next two days for most of us. right now temperatures, it's mild out there tonight at this late night hour. 61 in the city. 68 in novato. 63 in hayward. 59 in livermore. san jose right now is at 64 degrees. so overnight tonight we'll hang on to those clear skies. plenty of stars out there. good radiational cooling, meaning we're going to cool off pretty quickly over the next couple of hours. upper 40s to low 50s in the north bay. low to mid 50s around the bay shoreline. a little bit cooler tonight than we were last night. here's live doppler 7 along wite

the' that broad area of high pressure off our coastline that will continue to strengthen over the next couple of days. what it will do, it's going to act like a heat pump, bring in some of those warmer temperatures and unfortunately it will bring in some gusty winds midweek. highs tomorrow, warmer than we were today. 88 in concord, 74 and sunny in the city tomorrow. 87 in santa rosa, up to 84 the high in vallejo. future tracker temperatures as we get into tuesday, that's when we expect 90 degree readings to come back in our warmest spots inland. even around the bay shoreline, we'll be in the 70s and 80s, so above average for this time of year. but as we head into wednesday night into early thursday morning, as our temperatures continue to stay warm, you can see gusty winds do develop early thursday morning. this is 3:00 a.m. thursday morning. you can see those offshore winds gusty in the north bay between 15 and 30 miles per hour. so that's something we'll watch very closely in the coming days. here's the accuweather seven-day forecast.

sunday president trump's nominee to replace justice ruth bader ginsburg could be confirmed a week before election day. >> that's my hope. it will be up to senator mcconnell what to do after the 22nd. but we can easily get her confirmed before the election. >> reporter: the judiciary committee's hearings are expected to take four days with senators asking questions in person and virtually. this after two members of the committee tested positive for the coronavirus. democrats were hoping those covid-19 cases would delay the process. senate minority leader chuck schumer indicating they could employ other tactics. >> when the actual vote occurs in committee and on the floor, democrats will not supply the quorum, period. >> reporter: that move might not actually have any impact on the timeline. gop aides telling abc news the committee chair could simply move to vote even without any democrats present. president trump has repeatedly said he wants his nominee on the court before the november election in case results are contested. >> this is a moment unlike any

yesterday, and brokered by russia in the conflict over the disputed nagorno-karabakh region. armenians refer to it as art sock. we heard yesterday from armenian-american protesters during a rally at the golden gate bridge. now, today the azerbaijani cultural society of northern california gave its take on the conflict. >> it's a really complex situation, and if we want to solve it, we need to find common ground and agree on the very basic facts that are true. first, there is no fighting in armenia. all the fighting is in azerbaijan. second, territory of karabakh is internationally recognized as azerbaijan by every country in the world, including armenia. >> reporter: the mountainous region is inside azerbaijani territory but is controlled by ethnic armenians who claim it belongs to them. the recent fighting started last month and is the biggest escalation of a decades old conflict in the territory since a separatist war there in 1994.

the state released new details on the covid-19 pandemic today. the california department of public health reported 3,800 new cases saturday. the number of hospitalizations was up just 19 to 3,100. there were another 64 deaths reported. and the 7-day and 14-day positivity rates are both at 2.6%. that number indicates the percentage of all coronavirus tests that are actually positive. sonoma county business owners who operate bowling alleys, arcades, and skating rinks are warning they may be forced to close permanently. some rallied in downtown santa rosa today to let people know that covid-19 restrictions are threatening their livelihoods. sonoma county is the only bay area county that is still in the purple tier because of the number of new cases being reported. we talked to one man who says hi treated the same as a movie theater or a mall. >> we just want to be given a

chance to show that we can open, do it safely. i mean that's our ultimate concern. we love our customers, and we want them around. the way things are going right now, a lot of these businesses have another month or two and they're gone. >> now, under the state's current system, sonoma county would have to move up two tiers to orange before those businesses could open. an annual pre-dawn tradition on alcatraz island will take place over the radio tomorrow morning because of the covid-19 pandemic. indigenous people's sunrise ceremonies have happened every year on the rock since 1975. they commemorate the 1969 alcatraz red power movement when native american activists occupied the former federal penitentiary for 19 months. tomorrow's sunrise ceremonies will also highlight all the previous pandemics indigenous nations have survived. bay area drag performers made appearances in several neighborhoods to voters their voices will be heard in the upcoming election. some well known personalities
