otherwise it's clear this morning. 61 degrees as we look down from sutro tower across the bay bridge and into parts of berkeley and oakland. here's today's temperatures, 52 to 57 this morning. 60s along the coast all day today. the and then look at that, 74 to 77 bay and inland at noon. 81 to 85, not much of a difference. we expect that this time of the year, back into the 60s and 70s at 7:00. more on the potential for unhealthy air today and tomorrow and that fire weather on the way coming up. back to you guys for some news. >> thank you. this morning there are multiple road closures as san jose police investigate a deadly shooting. jobina fortson is looking at that from the live desk. jobina? >> thank you. san jose police say a man was shot and killed just before 3:00 this morning. this happened near the shell gas station off of story road. parts of king and story are closed as police continue to

investigate. if this is a part of your morning commute, please take alternate routes. as of right now there's no information about a suspect. this is the 33rd homicide of the year for san jose. liz? >> thank you. this morning we are waiting for an update on a terrible outdoor dining crash in the south south bay. at least eight people were hurt when a man drove into diners in san jose. this is video of the aftermath at dynasty chinese seafood restaurant. this happened yesterday afternoon. police say two people have life threatening injuries. abc7 reporter julian glover is live for us in san jose this morning with an update. good morning. >> good morning. this outdoor dining setup quickly turned into people scrambling to save their lives when police tell us the driver of this toyota 4-runner was trying to park his vehicle and accidentally hit the gas and plowed into the chairs and tables here.

we want to show you moments after this chaotic crash that happened at grand century plaza. many of the people in the video were under that white tent eating. san jose police say it happened just before 12:30. eight victims were taken to the hospital. two with life threatening injuries. their driver was also taken to the hospital. here's what else they saw? >> he stepped on the gas. the back tires started to peel. the smoke started kicking up. he jumped the lane, went across the front entrance, jumped that lane, all these lanes and plowed into that first canopy right there. >> you can only imagine how terrifying it was for people to see that car going towards them. at least one eyewitness told us they were concerned there were no barriers blocking off the area to make it safer for diners. while this is not a requirement for outdoor dining in san jose, we do know some areas do have

should wait to do this. elizabeth schulze has more. >> reporter: good morning. a contentious hearing taking place today and amid the coronavirus pandemic which is forcing some senators to attend virtually. both the election and the coronavirus pandemic looming large over the supreme court confirmation hearing of judge amy coney barrett. the 22 senators on the judiciary committee are expected to appear both in person and virtually during the four-day event with two republicans, mike lee of utah and thom tillis of north carolina recently testing positive for covid-19. senate judiciary chairman lindsey graham telling fox news barrett will be confirmed before election day. >> that's my home. it will be up to senator mcconnell what to do after the 22nd. but we can easily get her confirmed before the election. >> reporter: senate democrats vowing to do everything they can to slow down the process. >> when the actual vote occurs in committee and on the floor, democrats will not be -- not supply the quorum, period.

>> reporter: democrats, including senator and vice presidential nominee kamala harris are expected to make the case health care is at stake. with the court set to hear arguments on a challenge to the affordable care act just one week after the election. >> we're going to focus on the issues that really explain her philosophy and what she will bring to the supreme court, what changes she'll make in this country. >> reporter: judge barrett will say her philosophy has been shaped by her mentor, the late supreme court justice antonin scalia. according to a copy of her opening statement obtained by abc news, saying that deciding policy should be left to the elected branches of government and the public should not expect courts to do so and courts should not try. if confirms, the 48-year-old devout catholic and mother of seven would solidify a 6-3 conservative majority on the court. on the campaign trail, joe biden refusing to answer questions about whether he would support packing the court, adding justices to shift that balance back toward democrats if he wins. >> you'll have my opinion on court packing when the election is over.

>> don't the voters deserve to know. >> no, they don't. >> reporter: an official also tells abc news democrats are expected to mount additional challenges to the hearing citing safety of senators amid the pandemic. but without a majority in the senate, democrats say they lack meaningful tools to prevent judge barrett from getting confirmed. >> gavel to gavel coverage of the nomination hearing gets under way in about an hour at 6:00 a.m. watch it right here on abc7. today president trump heading back on the campaign trail. his personal doctor says he is no longer at risk of spreading covid-19. jobina is at the live desk with the new claims the president is making this morning that go one step further. >> yes, they do. good morning. just days after leaving the hospital, president trump now says that he is immune to the coronavirus. the president's physician did not say whether he had tested

negative for the virus, but president trump says he is no longer on medications for the virus. as for his immunity claims, scientific evidence is unclear on whether people who have recovered are protected from a second infection or how long any immunity might last. >> looks like i'm immune for, i don't know, maybe a long time, maybe a short time. it could be a lifetime. >> this as dr. fauci accuses the president taking his words out of context. dr. fauci said he did not approve a new ad campaign which makes it look like fauci was praising the work the president was doing. the trump campaign says it plans to keep running the ad. today governor newsom is set to give an update on the state's response to covid-19 and the wildfires. last week the governor signed an

executive order to preserve 30% of state lands in an effort to fight climate change that he has blamed for recent wildfires. you can watch his update at noon right here on abc7 and on abc7news.com. the annual half moon bay pumpkin festival is not happening this year but they're still going to be doing the weigh-off. this is one of the contenders ready for its moment on the scale. i don't know why the tiger is on there, but it's giving me "tiger king" vibes. first place wins $7 per pound. when you do the math, that's a lot of cash because the biggest pumpkin often weighs over a ton. there's a $30,000 prize if a grower breaks the world record. that record was set in germany in 2016. it weighed in at 2,624 pounds. this event begins at 7:00 a.m. the public is not allowed to

attend but you can watch this streaming live on facebook. > >> trying to imagine carving that. >> no. chainsaw? and they're not edible either. they don't taste good at all when they get that big. you can't make pies out of them either. let's look at what's going on. starting with neighborhood temperatures. good morning. we're clear in our east bay and look at those low 50s. low to mid 50s through t t wo upper 60s out highway 4. temperatures mainly in the 50s. we have a 60 in pacifica. 61 in los gatos. 49 in napa. here's the east bay hills, a warm 70 right now. if you're working from home, everything will be may need the air conditioner if not today moving forward. monitor the air quality if you're out and about or if you're out exercising. also look at the air quality right now. everything looks green. we are doing well.

but as we move into the forecast, the bay area air quality management district still has today and tomorrow as spare the air days because of the potential from the air quality monday, today and tomorrow up in the north bay. if you're following drew on twitter, he put out a visible satellite yesterday showing the smoke hardly putting out any -- or these fires hardly putting out any smoke right now. let's look at the smoke forecast, as we head through today and tomorrow, we're pretty clean. so let's look at wednesday. wednesday is looking clean. most of the smoke staying down to the south. some of that tries to leak up towards us for thursday, those offshore breezes get stronger. but that's about as far as they get as we head into friday. hopefully today and tomorrow will be our last spare the air days for a while. we have warm temperatures and critical fire conditions possibly coming back. we'll look at that coming up in the accuweather seven-day forecast. let's get over to jobina and talk about the morning commute.

hi, jobina. >> hi, mike. good morning, everyone. we'll start off with a live look in oakland showing you our 880 at the coliseum camera there. i want to see if there's a slowdown at this point. as you travel northbound between 23rd and 29th avenues you will run into some roadwork in the area. you can kind of see those brake lights off in the distance there. for the most part it seems to be moving smoothly. that road work will pick up by 6:00 a.m. i want to bring in the san mateo bridge camera. this is the camera giving us some problems but nice, clear picture this morning. busy as people make their way westbound. no major issues to report at the moment. hopefully it will stay that way. the l.a. lakers won their 17th nba title and fans gathered outside staples center to celebrate. a fan climbed up a street pole and then fell down into the crowd in downtown l.a. thndsslo a y c the

even though public health officials did warn people not to celebrate or to do so at home because of the pandemic. the crowd was mostly peaceful but there were reports of small groups throwing rocks and bottles at police. police showed up dressed in riot gear to disperse the crowd. tmz reports the team's victory parade will be postponed until the pandemic is over. i saw so many nice tributes to kobe bryant. >> that is nice. happy for them. they've been through a lot this year. all right. coming up, a push to reopen travel between the u.s. and london. the work happening now to make it possible for the holidays. don't say that. i was supposed to go to london this wednesday. still getting over that. new information about the death of a san francisco forever,iref. a report reveals what happened in the moments before a three-story fall. >> dan

all right. let's look at what's going on around the state. first we'll start with where our heat is coming from. it's starting to build down in southern california. a heat advisory starting tomorrow through friday, at least 12 million folks going to be dealing with some dangerous heat there. temperatures today in the mid to upper 80s. palm springs rocking the 100s. mid to upper 80s in the central valley. 74 in monterey. wednesday, you can see the offshore breezes just starting to develop in the north bay and the east bay. 90s, low to mid 90s there. while the rest of us have 80s and a few 70s holding on to the coast. thursday the temperatures are too cool for san francisco. i think you'll get near 90 like the rest of us. same thing on friday. the models have a hard time adjusting to the offshore heat. so i think it will be in the 90s everywhere come friday. we'll look at the weekend possibly a little bit cooler weather coming up.

>> thank you. a protest is planned today in response to an officer killing a suspec this weekend in san francisco. an attempted carjacking suspect was shot and killed by an sfpd officer saturday night after that suspect led police on a chase through the city. police say the driver crashed at market and golf streets before running to otis street. at least one officer shot the suspect and that man died at the scene. police say they recovered a knife. that incident was captured on body cameras. police, the d.a.'s office and the medical examiner are investigating. and new details about the san francisco firefighter killed in the line of duty last week. jason cortez died after he was knocked over a third floor fire. ercise. from athat h accidenopet those details were released from a preliminary report into his death. the fire department says it will investigate whether covid-19 safety measures which included

fewer firefighters taking part in the training activities might have played a role. cortez was a 13-year veteran firefighter and a paramedic. cal osha and police are condu conducting their own investigations. a riverside family's halloween decorations are so realistic people called the fire department thinking that there was an emergency. this raging inferno looks like it's engulfing the home, but it's actually a display that's all in good fun. the family started putting up pirates of the caribbean themed decor three years ago and they added realistic looking flames and got the fog machinet sme. neighb some called 911 thinking it was a real fire. >> we had a hook and ladder here, another big truck on the side. initially they thought it was a fire. they got out of the trucks, they walked around, gave my husband a high five and said great job it looks so good.

and eventually a red flag warning for wednesday, thursday and friday. the reason we probably won't be under any type of heat advisory, probably is because our nights are so long and so cool. up in the hills looking at temperatures in the 60s and 70s for lows. here's an area of high pressure, you can see it off our coast down to the southwest. that's what is steering all of the hot weather our way eventually and anything that would cool us down it will keep well to the north of us. we have about 83 to 87 through most of the south bay. could get near 90 in gilroy and morgan hill. near 80 to the low 80s on the peninsula today. check out the temperatures along the coast. 70 for you with mid to upper 70s in downtown and souanusit 83 to 88 through the north bay valleys. along the east bayshore, 80 to 84 degrees. inland we have 87 to about 89 degrees. here's the relief. look at these temperatures, temperatures in the 50s tonight.

mid 70s officially in san francisco. i wouldn't be surprised if a few districts reach 80, which the rest of us will be. a few thermometers on your house or your car in the inland east bay neighborhoods could reach 90. that's a foreshadowing of what's coming up in the accuweather seven-day forecast. i'll see you in a few minutes with that. there are questions this morning about the safety of outdoor dining after a car crashed into eight people in the south bay. here's a video from the incident in san jose. this happened yesterday afternoon, two people suffered life threatening injuries. abc7 news reporter julian glover live in san jose. he's standing where this happened. he will tell us where the investigation is this morning. >> good morning. i did reach out to sjpd this morning, from the video you saw dozens of people enjoying a day out outside here outside dynasty

chinese seafood restaurant and those people jumped into action helping people pinned under the car when this toyota 4-runner seeming to come out of nowhere. we want to show you video of the aftermath again. chairs thrown about, tables knocked over. this happened just before 12:30. eight people taken to the hospital. two with life threatening injuri injuries. others with minor injuries. san jose police first reported the 69-year-old driver had a medical emergency while driving, but later said he was trying to park his car but hit the gas instead. sending diners running for their lives. >> i look out, i saw the van was driving through towards us. i said come on! i said oh, my god, the car is running to us. >> that woman was fortunate enough to get out of the way beore being hit by the vehicle. the driver was also taken to the hospital. i did reach out to san jose police again this morning.

hearings. she is expected to be as tough on judge barre asst brett kavedr confirmation hearings about the russian investigation. according to the "washington post" senator harris faces a delicate task. she would need to appear tough enough to satisfy liberals upset with the nomination but also be restrained enough to support joe biden's outreach to disillusioned republicans. some say her job during these hearings is to be presidential. democrat the was want to focus questions on the affordable rre should be overturned in the past. abc news will have live coverage of the opening statements and the nomination hearings for amy coney barrett. it begins in about 30 minutes at 6:00 a.m. president trump is heading back on the campaign trail in florida today after claiming he

is immune to the coronavirus. joe biden will hold his first general election campaign in ohio. >> reporter: this morning president trump preparing to return to the campaign trail just days after leaving the hospital. >> looks like i'm immune for, i don't know, maybe a long time, maybe a short time. it could be a lifetime. >> reporter: kicking off a jam packed week of back-to-back rallies after his doctor announced the president is no longer at risk of spreading covid. during a call with supporters sunday, the president claimed he's not only covid-free but immune to the virus. the president is also touting the experimental treatment which he credits for his recovery. >> we want to get it brought into the hospitals. it's a transfusion. i really believe it will solve the problems of a lot of people. >> reporter: despie promising results for drugs like remdesivir and regeneron's antibody cocktail, both part of president trump's treatment, the ceo of

regeneron is warning the company only has enough doses to treat 50,000 patients. >> we have to figure out ways to ration this. >> reporter: the president is eager to get back on the campaign trail with his poll numbers slipping. when it comes to handling the pandemic, our poll shows voters now trust joe biden over trump by 12 points. >> america deserves a president who understands what people are going through. >> reporter: now the president's campaign facing new questions. >> president trump tackled the virus head on. >> reporter: abc news confirming dr. anthony fauci did not consent to this new ad in which he's heard apparently praising the president's response to the pandemic. >> i can't imagine that anybody could be doing more. >> reporter: fauci writing in a statement, quote, i have never publicly endorsed any political candidate. the comment attributed to me without my permission in the gop campaign were taken out of context. the trump campaign says it plans to keep airing the ad, saying the doctor has praised the

president's work in the past. one of those topics of praise, the administration's decision to restrict travel during the pandemic. this morning the administration is in talks with some airlines to fast track some international travel. officials revealing possible plans for a so-called air bridge between new york and london, a program that would test travelers before and after they land allowing them to skip the mandatory two-week quarantine. the talk comes as infections in the u.k. have doubled in the past week. pubs and restaurants in some areas facing tighter restrictions. coming up later this week a town hall with joe biden. george stephanopoulos will moderate that prime time event. it is happening the same day that biden and president trump were supposed to meet for their second debate, and that has now been canceled. you can watch thursday night at 5:00 on abc7. the state released new details on the covid-19 pandemic. the california department of public health reported 3800 new cases on saturday. the number of hospitalizations was up just 19 to 3,100.

there were another 64 deaths reported. the seven-day and 14-day positivity rates are at 2.6%. that number indicates the percentage of all coronavirus tests that are actually positive. sonoma county business owners who operate bowling alleys, arcades and skating rinks are warning they may be forced to close permanently. some rallied in downtown santa rosa yesterday to let people know covid-19 restrictions are threatening their livelihoods. sonoma county is the only bay area county still in the purple tier because of t oas reported. we talked to one man who says he just wants his family business to be treated the same as a movie theater or mall. >> we just want to be given a chance to show we can open, do it safely. that's our ultimate concern. we love our customers, we want them around. the way things are going now a lot of these business have another month or two and natheye gone. >> sonoma county would have to move up two tiers to orange

>> it speaks to what calistoga is all about and how we really rise up to any challenge. >> it was a really struggle for my kids to see this. >> reporter: daniel has worked at the neighboring property, the calistoga ranch. it was destroyed by the fire. this is all that's left. >> the ranch was my family. i actually met great people there. everybody was helping each other out. >> reporter: daniel hopes to get a new job within the company. >> we were very frightened. >> reporter: meantime, winery owner fiona barnett sharing her story of survival during the worst of the glass fire. >> it was very close to burning down the winery. >> reporter: this winery sits at the very top of spring mountain road in st. helena. two weeks ago resources were stretched thin so employees here jumped into action to save the property. watch how close the fire got to these vineyards. but friends, family, and employees grabbed hoses and made a stand. >> we weren't trying to fight the fire as if to extinguish it but just keep it off the property. >> reporter: by some miracle, it worked, some grapevines burned as well as an observation deck but most of the property survived. >> the adrenaline is gone now,

but at the time it was pumping and we were running in every direction. but we feel very blessed that we're standing here right now. >> reporter: dozens of other wineries suffered damage, but some like barnett were lucky. >> my heart goes out to everybody that has suffered all their losses. >> reporter: in the napa valley, cornell barnard, abc7 news. san jose officials do not believe ballots were stolen or tampered with after a collection box was found unsecured. the box was serviced yesterday and the person did not properly close and lock it. the lid was left open for about an hour. a city spokesperson says there's no evidence that anyone's ballot went missing or was mishandled. if you have concerns you contact the contra costa county.
