activities because of coronavirus. tonight, hear what the kids are supposed to do instead. i'm dan 7 on your side michael finney takes you inside an edd fraud. you're going to hear from two bay area residents who say they were asked to take part in a cri crime. >> announcer: this is abc 7 news. a new step in the presidential election. san mateo county began opening and processing mail in ballots today but the i-team is reporting duplicate voters sent out. a single voter receiving a second or third ballot. good evening and thank you for joining us. >> one vote there received a second ballot is worried this may be an example of potential problems with the election the president has been raising.

dan was asked to investigate and he is live with answers tonight, dan. >> dan and ama, most experts agree the amount of voter fraud is very small compared to the 156 million people expected to vote this year. still, it's worth checking out every complaint. she came to this country taijuan and became a u.s. citizen. she's concerned about following the rules in this very important election but look, she's received two ballots, exact same spelling of her name and address. when you got the second ballot, what did you think? >> i'm thinking what happened? went wrong? which one should i vote? >> then she was like which one is real? which one do i use? are they going to throw out my vote because i have two ballots? >> reporter: she and her boyfriend contacted the i-team to get to the bottom of it. >> she didn't know what to do so i contacted you, dan. i've seen your shows over the

years and what you do is helpful to society. >> reporter: they want to know could this be an example of potential problems with the election that president trump has been warning about as recently as last night at a rally in florida. >> so get out there and vote. send in your absentee ballot if you requested one. be careful. a lot of shenanigans going on. everyday you read it. >> reporter: i went to the elections office for answers and found a steady stream of voters dropping off ballots at a deposit box. i meant county election official jim and asked about her duplicate ballots. >> the issuing of two ballots is a normal and customary process in every election. >> reporter: he says san ma ma day owe county receives two in the mail and he estimates 1,200 voters will get double or triple ballots. >> ballots are generated twice when there is a change initiated by the voter or by the

all voting questions. submit your questions in advance on our abc 7 news facebook page. the california republican party plans to expand the ballot drop box program despite a cease and desist order. it allows county election officials to set up the drop boxes and there are rules for how the ballots are received. the boxes are legal because it's ballot harvesting, which authorizes another person to take a ballot to a collection site. >> we have been a posed to it. we have a choice. we can whine and complain about the election results later or get smart and figure out the rules and the chess board they laid out before us and play the game they are doing. >> governor newsom tweeted a picture saying this is what an official drop box looks like. thursday abc news hosts ado presidential nominee joe biden. you can watch it live on a

special edition of "20/20." a major ruling today from the supreme court on the u.s. census count. the justices cleared the way for the trump administration to end the head count temporarily halting a lower court decision that had extended the count. administration argued that the count needed to end immediately so the scensus burro had enough time to crunch the numbers. a coalition of local governments and civil rights groups however sued arguing that minorities and other people in hard to count communities would be missed if the count ended early. now to san jose where investigators are looking into the cause of a deadly crash at grand century mall after a driver struck a group of outdoor diners over the weekend. there are questions who may be held liable. chris nguyen has more from the little saigon neighborhood. >> reporter: cleanup is underway after a dramatic crash at grand

century mall in which a 69-year-old man drove his suv into a crowd of diners who were gathered outside for dim sum on sunday afternoon. police believe it was an accident but say it has taken a fatal turn after one of the victims succumb to injuries last night and declared brain-dead by the coroner's office. the case will be turned over to the district attorney. >> there are a lot of different factors that come into play when they decide the charges to pursue including priors, age, lots of different things and that's where we are with this investigation now. >> reporter: police say the driver hit the gas instead of the brake plowing into an outdoor tent being used by dynasty chinese seafood. a total of eight people were hurt including one woman who remains in critical condition. city officials say neither the restaurant nor the mall owner applied for a permit to operate outside. mall management declined our request for comment. >> when you put cars in a parking lot and people eating

outside in that parking lot, accidents are foreseeable, and the courts are going to say what are reasonable safety precautions taken to protect these diners? >> reporter: in this case, it doesn't appear any barricades were separating the outdoor dining space from the street. >> the fact that the permit process was bypassed here is going to be a strong factor in favor of the plaintiffs if they bring a lawsuit. >> reporter: legal analysts stephen clark says restaurants and business owners will take notice especially as outdoor dining gains in popularity during the pandemic. >> these people went to have a safe dining experience and turn into a nightmare. >> reporter: police reminding everyone to do their part to keep each other as safe as possible. >> whether it's a busy parking lot like grand century malls, there is lots of pedestrians or you're driving through a school zone, it's very important to pay attention and have heightened awareness of your surroundings. >> reporter: chris nguyen, abc 7 news. >> state health officials have announced that alameda and santa

clara cnties can move from the red to the less restrictive orange tier of coronavirus related restrictions. the two counties join san francisco as the only bay area counties in that tier however, oakland mayor libby shaft alameda county residents shouldn't expect immediate changes. >> they do plan to announce new activities that will be allowed but probably not starting until the week of october 26th. >> santa clara county is moving forward starting tomorrow. it will allow outdoor gatherings of up to 200 people and shopping malls can operate at 50% capacity. indoor dining and gatherings are also being allowed at 25% capacity or 100 people, whichever is fewer. good news if you're a fan of the house of prime rib. the san francisco institution is reopening on thursday after being closed since march. it's only allowed to have 25%

capacity inside. right now, things look booked up through january, however, the restaurant says it does expect some cancellations. a second clinical trial for a potential coronavirus treatment is now on hold. pharmaceutical giant eli lilly is pausing the study for safety reasons. the company didn't say what happened. yesterday johnson & johnson halted their trial after a volunteer came down with an unexplained illness. moderna and pfizer are still moving along. today the state released long awaited guidelines for halloween and recommending against trick-or-treati trick-or-treating. >> reporter: going door to door collecting buckets of candy but this year think twice before you do it. >> the whole act of going door to door in groups, ringing

doorbells, digging into buckets of delicious candy, create a risk of spreading covid-19. >> reporter: the state's newly released guidelines for safely celebrating halloween did not include a flat out ban on trick-or-treating but strongly discourages it. instead, the state is recommending other safer activities. among them, hosting an online costume party or pumpkin carving, participating in a car based activity like drive in movie night or costume contest or outdoor halloween theme meal with a small group of friends. >> during this hard time, we know the importance of halloween. we believe we've outlined a number of important activities can supplement and create alternatives in lou of the trick-or-treating. >>. >> reporter: the strait released recommendations for celebrating dia de los muertos. place it outdoors or create a virtual alter.

they say if you plan to visit a cemete cemetery, go with members of your own family. as the holiday season nears, the state recognizes there will likely be an increase in private gatherings and hoping people will follow precautions to prevent a spike in covid-19 cases. they recommend limiting these gatherings to no more than three households to host outdoors, to limit the gatherings to two hours or less and refrain from singing, chanting, shouting or physical exertion. aka, it's better to watch football on thanksgiving than actually play it with your friends. but if you do, you know what to do. >> we want you to wear your face covering. >> reporter: liz, a brbc 7 news because of the pandemic, most schools are in distance learning. tonight, teachers give zoom school grades. i'm wayne freedman where they dealt with fires, two power sho shut offs and there may be another tomorrow. dealing with increasing fire weather conditions.

judge, pat brown and others. considered an elite school, lowell remains on a high grade point average and a state test. both of which will not be counted this year because of the coronavirus. >> there was not an option for an a, b, c, d, f. there was only the option of credit and no credit. >> reporter: the test was suspended last spring. >> before us is the superintendent's proposal, not a board proposal is for us to waive the policy for one year based on covid. >> reporter: this means students who apply to lowell will use the same lottery system as other high schools within season fran unified school district. the algorithm takes into account a few factors including if a sibling attends that school and proximity to the school. still, the president of the board believes the academic rigor at lowell will dissuade

some families from applying. >> students will know that going in. a student not prepared for that is not likely to apply for that. >> reporter: the board commissioner gabriella lopez says this could lead to change in the administration process making it more equatable. >> i've been vocal about eliminating state standardized tests for all students. >> reporter: i am hearing that the school board has enough votes to pass the superintendent's resolution next week, again, today is only a discussion but while they say it will only be for this academic year, this coronavirus may still be around in the spring and that test they have to be suspended one more time. uncertain times. lyanne melendez, abc 7 news. >> thank you. tomorrow pg&e could start turning off the power to some 22,000 local customers to try to reduce the risk of equipment sparking fires amid hot, dry, windy decisions. a final decision has not been

made. parts of nearly all bay area counties have been affected. napa down tip has the highest number of customers to be impacted. more than 9,000. pg&e is holding an update on the conditions to determine whether to shut off the power. we're streaming this live and bring you any major headlines. for now, let's hear from an abc 7 news reporter wayne freedman that spent the day where the city says power will go out in 24 hours from now and won't come back until friday. after everything they've been through there, a power shut off is more worry in a community burdened by it all. >> reporter: on a perfect fall day, they have seen better times in downtown, color the place worried. >> i guess this year you have to be ready for everything, huh? anything. >> reporter: just days after the glass fire forced evacuations here and blanketed downtown with smoke. there will be another red flag warning tomorrow and a third

dan, we're feeling the heat already and apparently, the wind is coming, too. >> a concern for fire danger and spencer christian is tracking it. looks like it will get worse again. >> you are so right dan and dand we have undincreasing wind gust and relatively low humidity. wind gusts are picking up over the higher elevations between 15 and 20 miles an hour expected to get gustier during the overnight hours and warmer as you know right now it's about two to four degrees in most locations than this time yesterday. so let's take a look 75 in san francisco, upper 70s in oakland and low to mid 80s in san jose

and gilroy and 64 at half moon bay. beautiful view of the setting sun looking westward from emeryville. 88 in santa rosa now and napa 83 and 92 fairfield and livermore 88 and the view from mount tam of the setting sun. these are the forecast features. gusty winds during the overnight in the hills but breezy everywhere. fire danger will be high wednesday through friday and record heat thursday and friday and record high overnight low temperatures as well. we have a red flag warning until 11:00 a.m. friday for high fire danger and for the santa cruz mountains during that time along with the rising temperatures we'll see wind gusts up to 55 miles per hour at the peak gusts and higher elevations dangerously low and under those

conditions, of course, fires can start and spread rapidly. overnight, we will not see any marine layers to speak of. low clouds and fog passing near the coastline but it will be a clear night and during the clear night, low temperatures in the upper 50s to low 60s, a little cooler than that in some farther north locations like santa rosa which will see low 50s. tomorrow's highs in the south bay look for mid-90s, 94 morgan hill and upper 80s to about 90 on the peninsula and coast, breezy but warm with highs in the upper 70s in most coastal locations and downtown san francisco low to mid-90s across the region. east bay highs upper 80s and inland east bay highs in the mid-90s tomorrow and climbing later into the week. with the increasing temperatures we expect relatively descent air quality moderate to good but thursday and friday it will be

7 on your side learned more local charges are likely to be filed in an unemployment benefit scam sweeping the country. >> michael finney has been looking into this closely here to explain michael how this wor works. >> dan, ama we talked to law enforcement officials into those asked to take part in the scam. now, those asked to take part didn't want to talk on camera. but they did want to talk to 7 on your side. a source that asked to remain anonymous said it was a get rich quick scheme filled with glitz and glamour. we're told some of the culprits allegedly spent their new found fortune in las vegas where those with large amounts of money blend in with evening else. some of the truly unemployed say they waited months without receiving their benefits. the normal waiting period is three weeks. according to a second source, people who she says fraud lenuly

applied received their benefits in one. person a who hasn't been employed since having a baby two years ago. she applied and almost instantly received back benefits from edd totaling $10,000. person a, then offered to help person b apply for his benefits. the edd promptly sent him benefits totaling $12,000. person b, then promptly turned over 2500 of that money to person a as payment. person a did the same for person c and d. edd paid person d's claim at least $10,000. edd put person's c claim on hold to ask additional questions about c's job history. person a made one phone call to edd, someone actually answered and the problem was fixed.

soon after, our source says the agency sent person c nearly $16,000. yet, person after person has told 7 on your side they can't get anyone to answer the phone at edd or to even help them. assembly person jim patterson of fresno said edd could be part of the scam. >> edd is an inside job. >> reporter: as i previously reported some of those suspected of taking part are incarcerated. eight of them are in the correctional facility and some are serving for murder. one is in san francisco county jail and another in california state prison sacramento.

the san mateo county charged 11 inmates and ten others with 17 counts of conspiracy to commit fraud. we've since learned three of the defendants have pleaded no contest and have received sentences ranging from 16 months to four years, eight months in state prison. more charges are expected. >> the sheriff's office completed an investigation, which has found well over 100 other people who were involved in the fraud and another couple dozen who received benefits. >> reporter: those charges are expected to be filed soon. many of those charged listed their occupation as barber apprentices, an occupation gallagher says the edd did not verify. >> there was quite a rush and an emphasis to get money into people's pockets, so there weren't a lot of safeguards put into place so edd was not verifying employment. >> reporter: one of our anonymous sources tells us the scammer also obtained credit

profiles on the black market. sometimes it's from a clerk at a hospital or another workplace where personal identifying information is required. applicants will apply using someone else's name and information. once approved, our sources say the app will put in a address. >> it could be past among inmates in county jail or state prison as a place where the benefit cards could be mailed to for someone on the outside. >> edd says it's moving quickly to process legitimate claims. it did not however respond to the specific concerns brought up in this report. i will post their entire statement on abc7news.com just go to the 7 on your side page. ama? >> all right. michael finney, thank you so

pg&e based on weather conditions and threat conditions so we're really hanging to find out what is going to be like the next few days. >> spencer is tracking it all for us. spencer? >> okay. ama and dan, we're forecasting at the moment fire weather for the next few days. let me give you a look at the red flag warning. it will be in effect from 5:00 a.m. tomorrow to 1: -- 11:00 p.m. friday. we'll see wind gusts up to 50 miles per hour or higher in the higher elevations. for tonight, we'll see that wind pattern, that offshore flow developing under clear skies, overnight low temperatures will be mainly in the upper 50s to low 60s. tomorrow's highs will range from upper 70s at the costa upper 80s around the bay shoreline to mid 90s inland. that's the beginning of the heat the next couple days. here is the seven-day forecast. highs will be in the upper 90s

good evening. college football is returning to the bay area. san jose state will open the abbreviated schedule with a home game against the air force october 24th and the pack 12 is pack with stanford and cal beginning their seasons. stanford has been practicing at wood side high school in san mateo county but allowed to return to their own campus tomorrow as they are moving into the orange teal. their practices will follow the county's newest guidelines for college athletes. chris alvarez has more on how stanford and cal, the golden bears are preparing for a return to play. >> reporter: after punting on the pac 12 season, new information about covid-19 and increased safety protocols have both stanford and cal eyeing a

november 7th regular season kick off. when the regular season began, you see teams playing across the country, did you feel a little left out? >> the first week i'll be honest, it was hard for me to watch because we didn't have a lot of answers for what we were doing. the next week is when we were talking seriously about coming back. >> it's hard to watch other programs and teams. we're glad we have the opportunity to get back on the field. >> coach wilcox and coach shaw express gratitude and a safe return to play. both sides enter the year with great optimism. >> we'll try to compete and win every game and ultimately, win the north and pac 12 or whatever game we're put in. >> the entire vibe of the team is we'll work our butts off and be prepared for november 7th. >> the 123rd edition of the big game but no fans. what do you think that atmosphere will be like?
