tier. >> first we start with abc7 news reporter luz pena who spoke with san francisco owners and they are excited. >> reporter: prior to covid-19, this is what a regular night at the irish pub looks like. it has been seven months since they last opened and this is the reality now. the decorations are still up and today they're feeling hopeful? i was surprised. >> today city officials elevated. its reopening to the yellow tier, aka the minimal level. >> reporter: next tuesday, october 27th, that is when nonessential businesses are going to reopen. the next date to pick in mind is november 3rd. that's when bowling alleys as well as indoor pools will reopen. then theaters, zoos and aquariums can increase to 50%

capacity. by mid-november bars like this one are on track to reopen with 50% capacity. >> planning to get my permits. >> reporter: according to california's covid-19 website, san francisco has a 1.5% health equity positivity rate. >> we are being equitable in our approach. >> reporter: next week fitness centers are allowed to go up to 25% capacity indoors. >> we're probably going to go to about 18%. not that full 25. >> reporter: in san francisco, luz pena. abc7 news. >> let's take you to the south bay where santa clara county is it very clear, professional sports venues and theme parks will not reopen to guests. despite the state allowing that, amanda del castillo explains why. >> reporter: we've taken over the usual tailgating area. levi's stadium remaining empty and silence at great manager.

santa clara county announcing it is going against guidelines that would allow theme parks to reopen at limited capacity. >> this is the worst thing to be doing at a time when california is beginning to see some light. >> reporter: the county receiving back lash from great america. in a statement saying, cedar fair is extremely disappointed and frustrated with the look of reasonable consideration given to the opening of california's most popular theme partial. state guidelines would allow levi stimd open doors to 49ers fans after 20% capacity with ticket sales restricted to a 120-mile radius. but the county isn't ready. >> the only method of treatment for covid is to keep people apart. keep them masked. keep them socially distant. >> reporter: the 49ers organization says it will continue to collaborate with public health officials on a plan. in a statement for ongoing

they're not consistent. why can i reopen but some other business cannot? >> county officials stress if covid cases rise, they could slip back. san quentin must cut its population in half following a coronavirus outbreak. inmates must be released or transferred. also prisoners over the age of 60 who have served at least 25 years of their sentence must be included in any release program. >> all the strategies in the state have excluded this when they're the obvious people to let out. they've aged out of crime. they're already old and they face the highest rigs of covid because they are old and suffer from health problems. >> there are about 3400 inmates at the marin county hospital. it is estimate 75% have been
