for a safe and secure future, this is abc 7 news. we'll begin tonight with what happened after a simple request to wear a mask. good evening. thank you for joining us. >> and i'm dione lynn. this come is sharing this story to protect her family. in this story, you will see only on abc 7. >> it's really unacceptable to feel fear in your own home neighborhood. >> reporter: that fear is exactly the reason she is choosing only to use her first name in sharing the story behind this racist letter. >> it just basically says i wear my mask if i want, f word, asian. you create the virus. >> reporter: it all began with a walk with her twin infant girls when she spotted a man near by. >> he wasn't wearing a max. i asked when he came into ear shot that he wear a mask. >> reporter: what happened next was the beginning of a nightmare.

>> he locked eyes with me and immediately started charging up the hill at me. >> reporter: she ran into her home terrified. her husband then scared the man away. >> he came rushing out because he heard the fear in my voice. >> reporter: the man police believe is connected with the incident came back multiple times. one to throw a water bottle, then an egg and to leave not only the letter but a mask with this writing on it. >> it says keep america without asians. >> reporter: the case has been escalated to special investigations and increased patrols in the area. after seeing so much of our coverage of the hate and discrimination toward asian americans, she has this message to the people of her hometown. >> if you have experienced the same thing, please do report it. it is really natural to be fearful. but if we don't speak out, no one will know that this is happening and no one can do anything about it.

>> it is a powerful message. marie says she hopes by sharing her story, the young man will find the help he needs as spd asks if anyone who has experienced a similar incident to please come forward. also, a family reaching out after a young mother pregnant with her second child was killed in a drive-by shooting in berkeley. it happened last night as several other family members sat in the car with her. laura anthony has the story. >> they said 22 shots in her car. >> reporter: less than 22 hours after her 19-year-old was gunned down in a drive-by shooting, she stoot with her ten-month-old grandson after the family was caught in a hail of gunfire sends night. >> i will not be able to see my baby walk in the house, give her kisses or anything.

i just need answers. >> reporter: two months pregnant, serenity was driving. henderson's baby son and teenage brother and sister in the backseat when two cars sudde sue boxed them in. >> it was a black car that pulled up alongside and a white car alongside of us. the white car just opened unfair. >> reporter: somehow, no one but serenity was struck. like its neighboring cities, berkeley has seen an alarming uptick in shootings in recent weeks, including increased use of weapons capable of firing dozens of shots in a matter of seconds. >> i mean, these people never bother nobody. >> reporter: he's a funeral director in the east bay where services for young people like her have been all too frequent. they're just shooting because they feel like don't nobody care. you know?

they really feel like don't nobody care, and that's sad. >> they didn't care about her baby being in the car. we just want answers. she never bothered nobody. she never hurt anyone. >> reporter: in berkeley, abc 7 news. berkeley city council member tweeted that in response to this obviously horrific shooting he and the mayor will be launching a regional effort to address gun violence. he says, quote, enough is enough. developing news coming out of east oakland where a man who had been barricaded inside a shoe store for hours just sur rended. police say the man took a hostage, but that person was released unharmed at around 2:00 p.m. police say six gunshots were heard inside the wss shoe store on high street. but, again, he surrendered within the past ten minutes or so. police have shut down a six

block area around that store and asked people in the area to shelter in place. in santa clara county now, the district attorney's office began the process of dismissing select cases involving san jose police officers who made hateful comments on social media. abc 7 news reporter chris wynn. >> after reviewing nearly 215 minor cases dating back to 2005, the santa clara district attorney office will dismiss those handled by police officers accused of making racist remarks on social media. >> we determined that 14 of those cases we needed to dismiss because we could no longer stand behind those convictions. >> reporter: the move comes after the officers were exposed by the blogger earlier this summer. santa clara county public defender molly o'neill defended them for taking this initial step but hopes more case dismissals are on the way. when you have officers freely posting vile, racist comments on a public website, there is

clearly a deep-rooted problem with the culture of that department, and when you have such a racist culture, you simultaneously have decent officers silenced by the very nature of that culture. advocacy organizations such as the council on american islamic organizations say the public should speak out when they see something inappropriate. >> we need that data to continue to make progress, to advocate for reforms and really to hold those who abuse their power accountable. >> reporter: in a statement, san jose police chief eddy garcia says the scrutiny officers are receiving regarding inappropriate behavior is warranted, and in this instance, i understand the d a's office decision to seek dismissal. he added any officer found to have acted inappropriately would be held accountable. however, the police union has come out against the da's position calling it political grand standing and it would not stand for any of its officers to be used as the da's political

football. two officers have been cleared of any wrongdoing and are already back at work. despite the criticism, the da says this is a matter of building trust. >> trying to make sure that everybody knows that they are entitled to and will receive fair and equal treatment under the law. that's my solemn pledge. >> in san jose, chris wynn, abc 7 news. the end of red flag fire conditions is bringing some good news for pg&e customers in the bay area. changing weather conditions mean they will not see their power cut. the utility has canceled shut off for six local counties. alame alameda, contra costa, lake and sonoma. at least 4,300 customers who were scheduled to have their lights turned off will now get to keep them on. but another shut-off is possible on sunday wech. on the peninsula, traffic is finally moving again after a

traffic trailer caught fire on highway 92 at crystal springs reservoir. a one way traffic control was in effect in both directions. the chp had to cutoff the lock as you see to unload the truck. and on interstate 80 today, a car drove into a power pole knocking it over and as you can see starting a fire. glad to tell you no one was hurt, but it was as you can see a big mess to clean up. power was cutoff to near by residents. it took hours to clear the roadway. both directions were closed for roughly four hours. at one point traffic was backed up for 12 miles. >> in less than an hour, president trump and joe biden will have their final faceoff. coming up, the new rules to reign in the candidates in this late debate before ballots get counted. and the all-out search for this pig. it is a pet and he ran off as the family evacuated their home.

the smoke and flames are finally gone after the glass fire, but so much more work remains. many people are searching for what they have lost. and for some that includes beloved pets. abc 7 news reporter wayne freedman has one family's intense and emotional search. >> reporter: you are looking at not so subtle hints we entered the glass fire zone. the signs, so many, many, many signs. including this one for lost pets. >> that's a spring picture. he's a little less fat in the fall. >> reporter: that's sara talking about the loss of piggy smalls, a 100 pound pot bellied pig. on the night of september 27th,

the fire started about a mile away and advanced. they packed up quickly, but piggy ran off. it is as if he made up his own mind, sara said. when is the last time you saw him? >> as we were driving away. >> reporter: the family left that house with no time to spare, roughly one hour ahead of the flames. they came back two days later and found nothing. no sign of piggy smalls. >> i don't see any signs here. >> reporter: not a day has passed without sara and the family wondering or searching for their beloved pig that liked to play with the dog or wander through the forest. for that last reason especially they cling to hope. >> i think he's still out there. >> reporter: which led to the signs. this is putting one foot in front of the other, says sara. >> i think looking for piggy smalls is a beacon of hope for us. have we looked under this bridge yet? >> reporter: still missing, a pot pelly pig nearly 100 pounds.

who is behind in nearly every national poll. if this is anything like the first debate, it is sure to be contentious and combative. the president is setting the stage for that going after kristen welker. there will also be changes made tonight. a candidate's mic will be muted. the debate commission is hoping this will prevent the serial interruptions we heard from the president during the first debate. this is something the president is unhappy about. meantime, biden says he is expecting the debate will get personal. >> i think the mute is very unfair and i think it's very bad that they're not talking about foreign affairs. >> reporter: he's signaling that it's all going to be personal attacks. i'm going to try very hard to focus on the issues that affect the american people and talk to them. >> reporter: now, the debate rules allow the moderator to select the top ticks, which will include coronavirus, supreme

you can watch president trump and joe biden go head to head in nashville. the debate begins at 6:00 right here on abc 7. in the east bay, oakland mayor cast herbal lotto day in order to send a message. she and a city council member went to the library to use only one of alameda county's 66 official ballot drop boxes. >> please do not give your ballot to a carrier put it in one of these safe spots. and the u.s. post office works fine, too. >> now, keep in mind, as long as your ballot is postmarked on or before election day and received by your county's election office 17 days later, it will indeed be counted. turning now to a turkey notorious for terrorizing residents in one oakland neighborhood, it now has a new

home tonight. gerald, you may remember, was captured in the rose garden this morning after months of evadini wildlife officials. they wanted to tame the turkey after he became increasingly aggressive, sometimes even attacking people who walked by. wildlife experts were able to bait him with kibl, blueberries and sunflower seeds, a favorite of turkeys. the bird was released into the wild in the east bay hills. >> turkey is now in a wild area. he was situated with other turkeys where he will be safe, so, yeah, it definitely feels like the best possible outcome. >> california's department of fish and wildlife helped secure gerald's new home. >> and off gerald goes. well, a big day is coming for kids of all ages in san jose. tomorrow the city will open nearly 300 playgrounds after a seven month hiatus. more than a thousand amenities

like basketball courts and picnic areas will reopen in the coming weeks. park goers will be required to wear masks and sanitize their hands and the equipment before every use. guidelines urge people to limit playground visits to 30 minutes, but it is exciting for folks in san jose. well, the eye uber and lyft are like every big guy i've ever brought down. prop 22 doesn't "help" their drivers-- it denies them benefits. 22 doesn't help women. it actually weakens sexual harassment laws, which are meant to protect them. uber and lyft aren't even required to investigate sexual harassment claims. i agree with the la times: no on 22. uber and lyft want all the power. so, show them the real power is you. vote no on prop 22.

taking a look at the weather conditions now, sandy patel joining us with another round of extreme fire conditions that we could see this weekend. sandy, i thought things were cooling down. >> things are cooling down, but the winds are not going to be relaxing much this weekend. as a matter of fact, they will be picking up again as we head into late sunday and continuing into early next week. we do have gusty winds right now. 19 mile an hour winds. it's a dry down sloping wind offshore flow, as you know, is bringing that humidity down 9% at atlas peak.

ultima 18%, which is why that red flag warning is in effect for the east bay hills and east bay valleys until tomorrow morning. any fires that do develop will rapidly spread. gusts could be anywhere from 35 to 50 miles an hour. now, a fire weather watch has already been issued for us sunday morning at 11:00 a.m. until 11:00 a.m. tuesday. the reason for this, this is expected to be a stronger offshore wind event. gusts anywhere from 40 to 60. 70 plus not out of the question for the hills. critical fire conditions are expected as we head into sunday night and monday. take a look at the hour by hour winds. 11:00 sunday night, 40 mile an hour winds. notice those winds spread to the lower elevations as well. up to 50 miles an hour as we head into monday afternoon. still very gusty and that pattern continues into tuesday. right now it is a little breezy at the lower elevations as you look from our kgo roof camera. gusty winds in the hills. stronger winds arriving sunday night into monday.
