2004 of killing wife laci peterson and unborn son. appear appeared wearing a mask. covered as legal analyst. >> every death penalty case gets double and triple scrutiny. any small error made through the appeal process, it will come out. that's what happened in this case. >> reporter: in august the california supreme court unanimously overturned his death sentence because a judge reportedly dismissed perspective jurors improperly. but there's a second issue playing out that could overturn peterson's entire conviction, making the death penalty issue a moot point. juror is being accused of lying onto the jury. during jury selection said had never been victim of a crime. but it's alleged she was threatened and assaulted when she was four months pregnant. >> that's a serious error.

think to yourself, is that a fair jury? juror lied about her experience as victim of crime. >> gives us sense of we're finally going to get justice in this case. >> reporter: today scott peterson's defense attorney said peterson is happy the court is looking at his case. >> innocent man's beena sitting in jail 15 years, time to get him out. >> am i frustrated, yes. that's the court system for you. >> reporter: i spoke to juror number eight in trial. >> i know he's guilty, how all 12 of us voted. >> reporter: he said the selection process was thorough and said this mr. nice. >> she didn't present a bias in the jury room, doesn't feel like should be a penalty for this. >> reporter: judge in san mateo county will have to decide if there was juror misconduct. as for the death penalty issue, new court date is set for november 6th in

county. abc7 news. economy is major part of the effort to build a better bay area. many people have lost jobs, unable to pay rent. state has protections in place but one place in concord is exempt, landlord and tenants are outraged. leslie brinkley. >> reporter: hundreds of residents in clayton crossing apartments on monument boulevard are terrified, trying to negotiate with the landlord to hold off on raising rent. >> don't know if we can pay. >> live with son, single mother, lost job in march. >> reporter: unemployed housekeeper, not able to pay rent since may.

>> today i own $1,000. >> and now a substantial monthly rent increase on top of the debt. all tenants who owe back rent september to january have until january 31st to pay landlord 25% of what they owe. residents sheer say rent increase makes that even more difficult for them. >> although the rent increase is legal right now, according to has, they're saying it's not fair. it's legal, not fair. >> reporter: shared a letter from the property manager saying clayton crossing rents under the federal low income tax credit program. they say that exempts them from state mandates during the pandemic that prohibit rent increases. letter tells tenants they will not be postponed further. local assistance groups are rallying to help the tenants. >> normal people want fairness and compassion right now during
