voter turnout. >> people realize their voice does matter. you know? and maybe took it for granted before. >> people mobilized early to get out and vote. it's a good thing. it's a testament to where we are right now. it's really encouraging. there's both excitement and anxiety on this election day eve. good evening. >> two very strong emotions this election eve. thank you for joining us. there are now 27 hours until the polls close in california. counties start releasing early results after 8:00 p.m. tomorrow as soon as the polls close. full and final results won't be known for days, possibly weeks. that's because counties must count mail in ballots that arrive up to 17 days after the election. as long as they are postmarked by november 3rd. nearly 12 million californians have now cast their ballots and for some it has been a struggle. abc 7 news reporter stephanie sierra has the story of a man that caugfought to get his voic

counted. >> this has my new address on it. >> jim is struggling to get his ballot. he is temporarily living in illinois caring for his father who is battling stage four lung cancer. usps confirmed the mail would be forwarded to the new address. on the 2nd, they notified him his ballot was sent but he never got it. >> they sent me another ballot on october 15th. yet, i never received that one either. >> he then got a letter from uspt. the post master in illinois said there was a mail delivery backlog at the evans avenue post office location in san francisco. referring to it as a flag in the system. >> the flag is this detailed paper that's why they were not forwarding the mail properly. and that still isn't resolved, actually. again, i've only received 15 pieces of mail since i've been here. >> abc 7 reached out to usps for comment and the agency did not

clarify if there was a flag or glitch in the system but did respond with the following statement saying ballots typically cannot be forwarded if the intended recipient's address is out of date or if the mail piece is not properly addressed. in such instances, the ballots will be undeliverable. yet the agency confirmed to him his address was accurate. >> it is saying that, hey, severing official. >> but still, no ballot. lucky for him, the state legislature approved a new program this year to help out of state voters fill out their ballot online by signing up with the local county elections office. >> they can receive a ballot. they can sign up. they'll receive a link to their ballot and they can swipe the bat lol on a ballot on any computer and print it and return it to us by mail. >> 34 of the 5,000 out of state voters have returned ballots so far in this county. a majority using that new

service. >> thank goodness they sent me a confirmation that they had received it and it had been counted. >> happy ending there. we just learned 289,000 ballots have been returned so far in san mateo county. that is double what was reported at this time in 2016. live in the newsroom, stephan s air yashgs nbc 7 news. >> early voting has been going on in the east bay since saturday. chance for voters who want to cast ballots in tern to do exactly that. so far there haven't been any long lines. they sur vafd several polling places in east bay today and joins us live from pleasantton. hi, laura. >> hi. we're at a middle school here in pleasantton. they just now closing up shop. voting continued until 5:00 tonight. we actually saw some folks running in just before 5:00. they were told they had 40 seconds to get inside the door even though we haven't seen long

lines. so many people have already voted. >> take your ballot cards. >> call it last minute early voting. yet another new phenomenon around the historic election of 2020. an election where in the east bay 60% plus of the lekt rat has already cast their ballots with still a little more than 24 hours to go. >> once the word got out they could come into the old training facility, we have a lot more people. taking pictures of what they see and live memories. that's nice. the best part is it's bringing people into the area. >> in oakland, there was a steady stream of them dropping off ballots but no lines for in person voting and plenty of available booths for people that wanted to cast their ballot the oelt fashion old fashioned way. >> i feel like people are voting to make a difference or they just trying to figure out what they want in life. >> at this middle school in

pleasantton, poll workers say 3/5 of those voting to day were dropping off their mail in ballots. not wanting to take any chances. >> i wanted to make sure my vote counted. i wanted to put it in so i knew it got to the right place. hopefully my vote doll what i need it do. >> thank you very much. have a great day. >> we did a little informal survey here in pleasantton in the past hour. we saw about 50 people show up. most of those, i would say 40 dropped them off in the box. the mail in ballots dropped off. about ten went inside. i spoke with the registrar here a short time ago. and he said about 580,000 people have already voted here in this county. that represents about 60, a little over 60%. that was as of this morning. you can bet that number went up significantly today. live in pleasantton, laura

legal but the county's process of counting votes is safe and secure. >> i haven't seen fraud here. >> still former talk show host and conservative activist says she has seen an unprecedented number of people sign up to volunteer as poll observers. >> we've got poll watchers that are at almost every single polling place. we are keeping a close eye on the ballots that come in from the different precincts. >> we spoke to a trump supporter who said they sat outside this polling place last night to monitor it. the person declined to go on camera citing incidents like this one over the weekend when a couple participating in a pro trump caravan said they were egged. >> we've been threatened, bullied, harassed, egged. >> morgan believes it's tloed a silent majority and that despite polls showing otherwise, people will be shocked by the enthusiasm and turnout tuesday for president trump. >> and that's why republicans are not going to be talking to a lot of people in the media.

court. the pastor is facing more than $350,000 in fines and could face jail time for holding indoor services with more than 100 people and no enforced use of masks or social distancing. abc 7 news reporter spoke extensively to both sides about what happens next. the judge is validated that they need to comply as said he doesn't find any of the arguments otherwise. >> with the court order granted, the pastor named in the lawsuit can be held in contempt should he continue to hold services at cavalry chapel where gatherings of 700 people have been happening regularly since may in defiance of public health rules. social distancing and masks are also not enforced. >> we'll continue to litigate this case as necessary. we have a hearing on a preliminary injunction. i think in the long run we're going to win. >> the court ruling is the latest between the county and the church which received ten notices of violation if recent

months. if the pastor continues services this sunday, he could face possible arrest. his lawyers say the pastor is continuing whether to continue to defy orders. >> we'll be continuing to pursue enforcement. and the reason is because this is so important for our community's safety. >> more than a dozen pastors from all over california stood in support of cavalry chapel on friday. they say they're standing their ground because they believe the governor and the county's public health orders are unreasonable. church leaders say the cavalry chapel has not had a single covid-19 positive case since reopening. >> does the past your believe that he cannot minister or continue to give out his services without following those rules? >> to turn one person way from church means you're not ministering to them. and, of course, the church can minister to its congregation. it just needs to do so within those safeguards.
