i'm not here to declare that we've won but i am here to report when the count is finished, we believe we will be the winners. >> this election has seen record voter turnout that america has not seen in a century and the american people must be assured it is both fair and transparent. >> after a very long night, rallies calling for transparency and video of another rally in san francisco, this one happened about an hour ago near the emba embarcade embarcadero. good afternoon. thanks for joining us. >> the race for the white house too close to call that surge f of early and mail in voting leading to the need for more time to tabulate all the votes. let take a live look. this is the popular vote right now. joe biden 50% with 71 million votes for him.

and president trump 48% of the vote with 68 million american vot votes. now what really counts is electoral counts. 270 magic number at 264. president trump having locked in 214 electoral votes. it is coming down to razor thin margins more than anyone expected if you watch the polls. liz kreutz has a look at the current state of the race and the discrepancies we saw in polling. liz? >> we did. many of us expected this race to be close but not this close and depending on some results that were expected to get in the next few hours, 12 hours from arizona and nevada. there is a chance biden wins the white house by reaching 270 on the dot. but as we know, it's not over until it's over and the president is not going to go down without a fight. after a roller coaster 24 hours, the path to 270 are starting to come into clearer picture.

today abc news saying former vice president joe biden is the apparent winner to win michigan. it a big victory for the biden camp but it not over yet. >> we're seeing something that actually looks and feels unbelievable, but it's also predictable and in fact, the largest probability of 50% probability going into this election is the that race would come down to pennsylvania, wisconsin or michigan. >> reporter: in pennsylvania, the president is currently in the lead, but millions of mail in and absentee ballots are still being counted. still, the trump campaign is already ready for a fight. they've called for michigan and pennsylvania to halt counting and the president falsely asserted election say saying democrats are trying to steal the election. >> there is absolutely no evidence to suggest any of that is true. >> reporter: in wilmington today, biden held his ground. >> we the people will not surrend surrenderer. i'm confident we'll emerge

victorious. >> reporter: biden does appear to have won back at least part of the blue wall trump flipped four years ago, the poll suggested the lead would be wider. the most recent abc news washington post poll had biden winning by 17 points in wisconsin. they're currently tied at 49%, biden ahead by 20,000 votes. pollsters have claimed they made changes since 2016 but for many, this feels like deja vu and they're now asking if we can ever trust the polls. >> i honestly can't blame them. >> reporter: san francisco state political science professor says it appears the polls this year just didn't capture the full electret. >> we were missing minority voters, rural voters, young voters, more importantly, new voters. >> reporter: and now we have not seen the president since his address to the nation overnight and don't expect to see him later tonight. that said, as we all know, he has been actively tweeting. twitter flagged a hand full of his tweets today for

misinformation. kristen and larry? >> all right. thank you. let's go to the battle ground state of pennsylvania now where abc 7 news anchor dion lim is following the campaign and dion, i know i was watching your twitter feed. there was a press conference that was supposed to happen that i'm not sure happened and nobody seems to know what is going on at this point, do they? >> reporter: you hit the nail on the head. confusion is certainly the word. here in pennsylvania, the race is just too close to count. and we have seen protests across the city of philadelphia today. elections officials are promising a fair count while president trump and his campaign and his supporters are crying foul. speaking with the same confidence we saw on election night at his watch party in wilmington, joe biden maintained confidence in the voting process the day after. >> it's clear that we're winning enough states to reach 270 electoral votes needed to win

>> there is nothing illegal going on. >> voter suppression happens like this with seizing the counting of legitimate votes. >> reporter: and held a rally of their own. >> democracy is not a spectator sport. >> reporter: in a state where 20 electoral votes are up for grabs where trump won by less than 1% in 2016. biden doubling down on the fairness. >> we the people will not be silenced. we the people will not be bullied. we the people will not srrenderer. >> reporter: an eventful day in pennsylvania indeed. now, we should point out that in this case, pennsylvania may not be done with their count for at least another day or so. if biden wins arizona and nevada, that would put him exactly at 270 electoral votes, meaning whatever happens in pennsylvania becomes moot. in philadelphia tonight, i'm dion lim, abc 7 news. >> all right. dion, we'll see.

here is the latest on the balance of power in the senate. republicans hold the lead with 48 seats now to democrats 44. 51 seats are needed for control of the senate. democrats spent six years in the senate minority. they were hoping to get it back. doesn't look like it going that way. in the house, democrats right now are holding on to control. they have 208 seats losing three to republicans who have 197. 218 are needed for a party to claim a majority. abc news projects democrats will maintain control in the house. voter turnout was expected to be high in this unusual election year, and it certainly was but how high when you compare it to past priest terrible electi -- presidential elections? leslie brinkley looked into that question today and joins us live in contra costa county. leslie? >> reporter: hi, there. there was a really big drive out here in the east bay to register more voters. they succeeded 100,000 more on the roster than four years ago.

we're here at basically election headquarters now. this is a warehouse in martinez where they are tabulating the vote. up on a shelf behind me, you'll see boxes shrink wrapped. those are votes that have already been counted but for turnout numbers, it's not just the number of people who voted, you have to look at the percent of voters who actually voted. this machine takes pictures of signatures on ballots. first step in the process of counting a vote. there are ballots that were dropped off at the polls and those that arrived in the mail today. on this white board, tallies of the ballots collected from drop boxes across contra costa county, over 365,000 voters already have had their votes counted. >> right now, we still have about 180,000 ballots that's an estimate in house to process. >> i use the apology of a fire hose. we're going to be slamming them as fast as we can. but then after friday, they're

really going to dry up, the supply is going to turn into a trickle. >> reporter: so far, turnout looks less than historic. >> in 2008, we had our highest turnout ever in a presidential election. it was 86.7% and all indications were that we were going to be able to hit that same target. in 2016, we had a 79% >> reporter: there was a stsunai of early ballots. a quarter of what they thought. turnout is now projected to be on par with 2016. >> we have to wait until november 20th for vote by mail ballots that have been mailed by election day. >> reporter: so by this friday, it's expected officials say they'll have 99% of the ballots tabulated here in martinez, but if you want that final, final count, the 100% of every single

vote counted that won't be as you heard until november 20th. we're expecting an update friday on the vote count here. reporting live in contra costa county, i'm leslie brinkley, abc 7 news. >> thank you. now to the california propositions. uber, lyft and others are celebrating the passage of prop 22. it would classified ride share and delivery drivers as workers, not full-time employ s employees. it's ahead by 17 points with 9d -- 9 9% counted. >> props passing are prop 14 continue stem cell research, prop 17 restores the right to vote after a prison term, 19 changes some property tax rules and 24 amends consumer privacy law. those that are failing right now include props 15, a proposed tax to fund schools and government, 16 that would have restored

into an officer-involved shooting. police shot and wounded a man after two officers were hit by a vehicle and injured during the incident on 92nd avenue around 10:15. the victim's condition is not known. it was the first of three incidents at marijuana businesses last night. another left two security guards wounded during an attempt at armed robbery at a dispensary. in the meantime, the owner of another oakland cannabis shop is vowing to rebuild his business after losing everything in a break in last night. thieves smashed in through a car that is through the front entrance on high street taking almost everything inside. owner lavelle russell els mstim the losses at more than $100,000. he calls it sad and devastating. >> it's not just me that built this property, people from our community. people that put in the hard earned dollar, you know, whether it was $100 or $500 to get this thing up and started.

>> russell opened the in august. he will persevere to prove businesses can be a success in communities like his. no changes for bay area counties on the state's covid-19 four tiered reopening system. most of the bay area is in orange, san francisco yellow and sonoma county in the most restrictive purple tier. signs of a fall surge. the u.s. reporting more than 91,000 new cases on election day and more than 16 million in italy are now under a red zone lockdown. that lockdown is aimed at slowing a surge there and preventing hospitals from being overwhelmed. bay area health officials are considering a 14-day quarantine for people who return home after traveling out of the state for the holidays. the officials are expected to discuss that plan tomorrow. state health and human services secretary dr. mark galley was asked if it's sthamg migomethin might work for the entire state. >> really looking forward to see

how the bay area counties come together on this to see if there is something applicable that should be considered in other regions or statewide. so open question certainly something that we believe is part of our entire effort to keep transmission low. >> there is a possibility that a traveler could take a coronavirus test a few days after a trip. now if adopted, that proposal would be likely a recommendation instead of an order. contra costa county health officials say they've seen an uptick in cases and hospitalizatio hospitalizations. they announced new plans. most outdoor bars will be prohibited. occupancy outside restaurants, movie theaters and religious services will be reduced from 50% to 25% or 100 people, whichever is less. officials say they're concerned of moving back into the more restrictive red tier. so how close is your county to reaching the next colored tier? you can find out with our

reopening tracker on abc7news.com. the 49ers packers game tomorrow night is still on despite a positive covid test that prompted the 49ers to close the facility today. the niners say they have shut everything down and implemented the league's intensive protocols after learning kendrick born tested positive. his agent says his client does not have any symptoms at this point. the niners are scheduled to play the green bay packers tomorrow night at levi stadium and the packers had their own covid concerns as one of their players tested positive. we'll see what the nfl decides to do, keep the game tomorrow night, push the gape to sunday. we'll wait and see what happens and let you know. to the forecast, kristen, things are about to change dramatically. >> yes, why are you talking to me? talk to the expert, spencer, hey, there. now, we're still in this rather warm november pattern. lots of sunshine right now, too, across the bay area. let's take a look from the tower camera looking over san francisco. it is currently 65 in the city, 71 across the bay in oakland low 70s mountain view, san jose and gilroy. 63 at half moon bay. here is a view of blue sky over the golden gate. it's 78 up at santa rosa and 79 that v navado and 80 livermore. you can see it's really warm by november standards in many of our inland areas and looking westward toward the golden gate, we see clear skies. the forecast features, november warmth continues again tomorrow. turning windy and much cooler, though. much cooler on friday with cold showers and a chance of thunder. during the overnight hours tonight, we won't see much of a marine layer, there will be some low clouds pushing up against the coastline but basically talking about clear skies inland and just patchy low clouds along the coast and another sunny day tomorrow. overnight lows will be mainly in low to mid 50s near the coast

where uncertainty over the election and coronavirus pandemic are taking center stage at the federal reserve board's two-day policy meeting, analysts predict the fed will hold off on determining if the central bank needs to takection to help the ailing economy. they're likely to wait to see if congress will agree on another aid package, a move analysts say the fed is hoping will happen. the irs is warning of a new tech scam that attempts to get banking information from consumers. here is how this works. the scammers send a text message that tells people they received a direct deposit of $1200 from a covid relief fund but they must click on a link that looks like a government website. anybody that receives this text says to report to the irs. i have details how to report it

work for contesting the outcome if battle ground states and moments ago filing the legal paperwork in the state of georgia to try to stop the votes from being counted there. joining me now, san francisco chronical insider and contributor phil to talk about what this means. i want to give you credit first of all because you said on monday regardless of the vote count, the sun will come up today and it did so you're one of the view people who nailed that but everything else is up in the air. so tell me do you see the similarities with florida in 2000? it took along time to sort out who won and a similar scenario. a lot of people are stunned we don't have a result. there is precedent for this taking time to go through the count. >> exactly. what you were talking about in 2000 was florida when wed a al gore versus george w bush and questions about the validity of the votes they were counting or

how they were counting. was this piece of paper blocking the right vote? there is questions about how to cou count, we have the question whether to count. the trump administration is raising legal questions about pennsylvania's law or rule that says if they receive a ballot up to three days after tuesday's elections, in other words, they can still be accepting ballots up until friday as long as they're postmarked the day of the election. there are questioning about whether that should be done. it's not about how the ballots are counted properly or making sure they are counted properly but whether they should be counted at all and that's sort of what wul see here. that will work its way out in the courts or in various rulings but the trump administration is throwing up or tossing in leg l documents. some of it is public relations, larry. i got to tell you, sometimes they call lawsuits a $75 press

release. you're triing you're trying to make a point. they want access to counting operations and georgia, nevada, pennsylvania, michigan, to make sure that they have somebody watching the count over everybody's shoulder and we'll get it resolved. it could wind up -- will probably wind up in the courts in some fashion so we could have a replay of the hanging chads. >> well, that could really delay things. do you see this, these legal maneuvers as more of a hail mary or is there a legitimate chance a court, we know the supreme court at this point is controlled by mr. trump, you know, they're learning that way on most issues. >> you know, i got to give the supreme court a didn't agree with goeorge w. bush, many peope thought the court over stepped boundaries and made a one of a

kind decision that handed the presidency to george w bush and that was a very hot and contentious issue at the we have to hope the supreme court looks at the law first because they look at precedent going forward. you're right, this race, is it a hail mary pass or laying the groundwork? it's a hail mary pass because this type of election, there is no bigger election in the world. this is where everything is on the table. either side would be reacting this way if it wasn't going in their direction. let's just stipulate that. it wasn't as if democrats ruled that out. the second part is what you're doing here and this is one of the more questionable parts of our -- how we've evolved as a democracy is laying doubt about the legitimacy of whoever wins. the other side wins, you're laying doubt about their legitimacy. the democrats did it with trump last time out saying the

prospect of russian intervention or interference in the election questioned the legit ma simatcy election or reason for getting into the white house. we saw barack obama, is he a proper citizen? this is the latest where they will possibly say there is a question in pennsylvania even if it doesn't matter in the end. >> real quick, you were so good on the sun coming up. how soon will this get sorted out? >> larry, it's going to get sorted out for one of them to put the hand on the bible and took the oath of office. will it be sorted out in the public consciousness, probably never because just like the obama question of citizenship, just like the hanging chads before, just like everything else the russian interference in the public's mind, this will be there forever and that's part of the democracy, as well. >> all right. i don't know if you can hear, the phone is ringing.

and may be for awhile. so let me start with you, spencer, because people may not realize how closely you follow politics but how late were you up last night and how anxious were you/are you? >> well, the answer to the first part of the question is most of the night. i think i got maybe two hours sleep. yeah, there was a lot of anxiety there, high anxiety. i wasn't -- i can't say i was surprised that things are playing out the way they are because even though some of the polls showed wide margins, most respectful political analysts said expect a race that is much ground states than the national polls are showing. in fact, the race was much closer in the battleground states than the individual states polls were showing. that didn't surprise me too much. i'm looking forward to getting some sleep tonight. >> yeah. you know, it's interesting, dan, because i saw a clip today at bernie sanders like a week and a

half ago correctly predicted how this would play out, the early returns for mr. trump and celebration and then the later mail in ballots coming in and then mr. biden. so he was dead on, actually. >> yeah, he was. bernie sanders of course very popular and plugged into the younger voters, 18 to 29 years of age. voted about the same numbers four years ago, which is interesting. he kind of understood that demographic particularly but absolutely right as were some of the pun dendits like philadelph highly democratic areas yet to be counted, they understood that was where this race might end upcoming down to. >> all right. well i'm just feeling anxious hoping however it ends, the two sides will come together and work together. a few records were broken during this election, marin, santa cla ra had record voter turnout. other counties say with mail in
