>> no actual teeth? >> they just s good morning, america. breaking news. down to the wire. the race for president so close this morning in those all-important states with the white house within reach for joe biden. >> when the count is finished we believe we will be the winners. >> the former vice president now just 17 electoral votes away from the top job after picking up michigan and wisconsin and breaking the record for the most votes casts for a u.s. presidential candidate ever with more than 70 million and counting. president trump now launching an all-out legal blitz trying to freeze the ballot count in the crucial battleground of pennsylvania, and in michigan, chaos breaking out. >> the president's supporters demanding the count go on. we're breaking down all the challenges and the potential for a supreme court showdown. all eyes on the final six states. the path to victory narrowing with every second. our powerhouse political team is live across the country as every last vote is counted and a nation on edge awaits this historic decision. and we do say good morning, america. good to be with you on this thursday morning. just a handful of states where we know the votes are still being counted and want to take a look at this video. this video was live streamed for the nation to watch the ballot count in arizona. and now we want to take a live look right now at the ongoing count in two of the most critical states left, pennsylvania and in georgia. being so transparent. we're going to take a look at those remaining battleground

states in just a few minutes. >> a lot of good citizens doing their jobs right there. as for trickle in we are edging closer to a decision. joe biden increasingly confident of victory. right now, he has 253 electoral votes, he's leading in enough states to give him the 270 electoral votes he needs. president trump has 214 electoral votes. he will need a sweep of the open battlegrounds to win and the president's team is mounting legal challenges in those key states. >> joe biden breaking the record for the most votes ever received by a presidential candidate, a record 70 million so far. the former vice president speaking yesterday calling for unity. >> promising to be a president for all americans in this deeply divided country. mary bruce is with the biden campaign in wilmington, delaware. good morning, mary. >> reporter: george, good morning. while joe biden right now is confident he is on the cusp of victory while president trump is not ready to throw in the towel is digging in. he is trying to put a stop to vote counting in some states while calling for every ballot to be tallied in other places where he is behind, demanding

that officials take another look. this morning, the white house is within reach for joe biden. >> i'm not here to declare that we've won, but i am here to report when the count is finished we believe we will be the winners. >> reporter: eking out an apparent victory in wisconsin, and now projected to take michigan, biden now just 17 electoral votes shy of the presidency. he says he's confident he's flipped arizona and is feeling good about pennsylvania telling the country he believes once every vote is counted the results will be clear. >> of special significance to me is that we've won with the majority of the american people and every indication is that the majority will grow. >> reporter: but president trump even though he's behind has falsely declared victory. >> frankly, we did win this election. we did win this election. >> reporter: now after making unfounded claims of fraud he's launching out an all-out legal

[ crowd chanting ] >> reporter: swarming the building in maricopa county where officials are trying to do just that. in wisconsin, the trump campaign calling for a recount, but biden appears to have won the state by less than a percentage point,
7:05 am
virtually the same margin trump won there in 2016, confident he's on the brink of winning it all he is looking ahead ready to start uniting the country after this bitter election. >> we have to stop treating our opponents as enemies. we are not enemies. what brings us together as americans is so much stronger than anything that can tear us apart. >> reporter: now even some republicans are throwing cold water on the president's calls for a recount. former wisconsin governor scott walker noting that trump trails by about 20,000 votes, he says that is an uphill climb for him to try to overcome and the biden team is quick to note that the president took the state by a similar margin in 2016 and at that time he bragged that it was a landslide. george? >> and mary, over the course of the day yesterday, you could feel the biden team's confidence rising by the hour. >> reporter: yeah, george, this morning they are feeling extremely confident but also really prepared. they say they are ready to tackle whatever president trump and his legal team may try to
7:06 am
throw at them. they have a massive legal team of their own assembled and they say any attempts to try and undermine our electoral process will certainly fail. the biden camp is increasingly looking ahead. another sign of how confident they are, george, their official transition website is now up and running. >> mary bruce, thanks very much. >> thank you, george. the path for president trump to victory appears to be narrowing at this hour and cecilia vega has the latest. on what's going on behind the scenes at the white house this morning. good morning. >> reporter: hey, michael. good morning to you. yeah, mary just hinted at it. the president's legal team has been working around the clock, they're filing one motion after the next. this is really becoming this hail mary strategy so they filed these two suits in pennsylvania. they've got one in michigan and they've got this recount request in wisconsin and just to give you a little bit of an idea of what it looks like, the suit they have in georgia alleges a poll worker may have witnessed 53 late ballots added to a stack
7:07 am
of on time ballots so they're fighting over 53 ballots there. i'd say this is a fight that could go all the way to the supreme court. as for president trump we didn't see him yesterday. he was here inside the white house. we're told he's working the phones and talking to allies, particularly republican governors. he's had multiple conversations with arizona's governor who has convinced the trump team that arizona, that the votes there are so narrow that margin they really could pull off a victory in that state. this is not going to come as a surprise. as for president trump sources close to him say that he's in a down mood. privately he's conceding that they are seeing this lead start to slip away and we're hearing him on twitter anyway continue to push these conspiracy theories that election is being stolen from him but what we're seeing is the way democracy is supposed to work. every ballot being counted and, george, listen to this now, this is something we don't often hear in this country. international elections observers saying what they're seeing here in our country, they're very concerned about it. they say president trump is undermining the democratic system and public confidence in that. >> boy, that is a sign of the times. okay, cecilia vega, thank you
7:08 am
very much. want to go back to tom llamas at the map to give you an idea how each side can get to 270 and why joe biden is increasingly confident right now. tom, let's begin with that first clear path for joe biden. >> right. so the easiest way to explain this to our viewers at home, joe biden needs two right now. president trump needs four so let's skip arizona and nevada. joe biden currently has a lead right now. you can see right here he's well on his way to the white house. there's one more path for him. if he's able to flip pennsylvania, he gets to 273. same scenario. on his way to the white house. >> but for trump it's a much higher wall. >> it's different. he has to win pennsylvania, north carolina, georgia and look at that number -- 265. he's still not there. he has to come out west and win arizona. we'll give alaska to him as well, that's how he win, 279. >> and tom, there's that tiny little blue box in the middle of red nebraska. explain why that could be consequential. >> there are scenarios where it could be 269 for president trump and 269 for biden.
7:09 am
let's go to nebraska right now and show you why that's so important. so there's a district here, i'll blow this up. this is the omaha region, right? so this is north carolina -- excuse me, nebraska too. it's tiny, it's one electoral vote. but if it ever gets tied to 269, george, these are the most important americans on the planet because their vote is that one electoral vote. >> that's already gone to joe biden. meantime, let's look at the key states, give people a sense of what's left to be counted as well. >> let's talk about pennsylvania. right now there are about 763,000 votes outstanding statewide but president trump's lead in that state is only 164,000. the mail-in vote, the early vote has been trending for joe biden. that's why democrats and really americans all across the country want those votes counted. in georgia, it's gotten tighter and tighter overnight. there's about 91,000 votes outstanding statewide but president trump's lead in georgia is just 18,000, george.
7:10 am
>> but meantime, arizona got a little better for president trump overnight. >> things are looking better for president trump right now. there are about 275,000 votes outstanding in maricopa county. about 100,000 to 200,000 more around the rest of the state and it's gotten narrow and narrow, we're talking about 68,000 is the spread. joe biden's lead is 68,000. but you can see there are hundreds of thousands of votes still outstanding. that's why president trump thinks he still has a path in georgia. if he wins arizona it's going to be a long week. >> tom llamas, thanks very much. >> okay, george. we know those states still up for grabs, we'll start in arizona where the race as you know is very tight at this hour. whit johnson is in phoenix and has the latest on the count. good morning, whit. >> reporter: robin, good morning to you. we're live here in the wrest, where the race in arizona has just gotten tighter. new results from overnight showing joe biden leading donald trump just over 68,000. all united states are on maricopa county and those
7:11 am
275,000 outstanding ballots, most of those absentee ballots that voters dropped off at the on election day. democrats are increasingly confident that joe biden will be able to turn this red state blue. protesters gathering outside the county recorder, some of them armed, some tried to get inside to monitor the vote count, before they were turned away by authorities. we do expect more results later tonight. michael. thank you so much. next we go to nevada which was quiet on wednesday and now joe biden with a slight lead there this morning. our chief national correspondent matt gutman is in las vegas with more. good morning, matt. >> reporter: hey, good morning, michael. it's quiet no more. the margin is paper thin, 7500
7:12 am
votes at this point, one of the reasons that the trump campaign is flying in major top operatives, they said they have a major announcement coming up this morning. i just got off the phone with one of them, there will be a lawsuit here in nevada, complaining about a lack of transparency, now that press conference is due to happen a half-hour the state releases its unofficial results and mail-in ballots. now, the trump campaign is very hopeful about that, they believe about 70,000 of those mail-in ballots are coming from clark county, reno and las vegas the only democratic strongholds in the states, room for a possible recount, no minimum threshold here in nevada, the trump campaign could press for that at that point, but that means joe biden could be a little bit cloerg to that magical 270.
7:13 am
now to pennsylvania with the count that didn't start until the election was over. as we said the president has filed a lawsuit to stop the votes from being counted there. eva pilgrim is in philadelphia with the latest where they are making progress. good morning, eva. >> reporter: good morning, robin. they're making serious progress on that ballot counting. we're live in pennsylvania. about 80% of those ballots. trump's lead is very narrowing. they're about 750,000 votes left to be counted. now some trump advisers are expected to hold a press conference here in philly in just minutes, meanwhile, biden's camp thinks a win is still within reach, the votes still outstanding are mostly mail-in ballots, registered democrats returned to 3 to 1 margin compared to registered republicans. george. >> thanks very much.
7:14 am
the gap is closing in georgia as well. steve osunsami is there as well and closing in on the final count, steve. >> reporter: good morning to you, george. 7:00, of course, on tuesday the polls closed. by midnight, the president was up about 372,000 votes. this morning that lead has shrunk to about 18,000 votes and the secretary of state now says that there are about 25,000 absentee votes still to be counted. about 7,000 of those votes we hear are here in fulton county which is breaking heavily for joe biden. they are going to continue to count the votes in counties across this state. these are all absentee votes that we're talking about. this is going to be super close. all of a sudden those provisional ballots are going to count. military, overseas ballots are going to count. the democratic party's encouraging residents here who voted by absentee to make sure that their vote was counted and if there are issues, if their votes are one of those cure
7:15 am
ballots they have only a couple of days to fix it, george. >> thanks very much. let's bring in rahm emanuel and chris christie for more. rahm, let me begin with you. you've been a part of two presidential transitions, right now as we said the biden campaign is increasingly confident though by no means sure but talk about how they're thinking in these final hours and how they have to think about the job ahead. >> well, you got to keep your eyes kind of split screen. one set of eyes is all about the legal and ballot counting process, making sure arizona, nevada, pennsylvania, georgia which are all -- and north carolina -- are all counted differently when the ballots can be focused then your legal strategies like in those states if there is a legal fight from the trump campaign i'd make sure obviously that your legal team has a -- reflects your political strategy which is both democrat/republican lawyers on there and then there's a transition focus. you don't want to be presumptuous but you want to assert which is exactly how the vice president did that and i suppose on top of it put a bow
7:16 am
of the voters who vote, this is their country and we have to respect their will. so the transition, you begin to think about the white house, you begin to think about departments and cabinets, you lean in without going over your ski tips but you never get too far ahead in that process of the foundation, which is you got to win and knock down the next 17 electoral votes. they have two different paths. they're focused on all -- or actually three to do them all in that place so you're kind of operating in a dual track strategy. >> flip side for you, chris christie. take us inside the white house. what's the best hope for president trump to get to the 270 he needs? how does he have to think about confronting falling short? >> well, it starts with arizona, george, and they made progress overnight and the principle remains the same for the president that it does for vice president biden. all votes should be counted and fairly. so in arizona, i know some news organizations have called the state. we have not. i think that's appropriate.
7:17 am
there's still a lot of votes to be counted. the governor, doug ducey, of arizona believes that there's enough votes out there to make a difference given where they're coming from. second he has to keep his eye on the ball in pennsylvania because that's a must-win state for him now and again, he still has 180,000-vote margin so still a large margin. a lot of votes to count, but they're making progress in that. we may know by this evening whether that lead stands up or doesn't. so, for the president his focus is not on transition, but is on trying to get to a place where he can get to 270. this one is not over yet and no one should act as if it is because that's respecting the american people's will as well and that's what the president and his team should be focused on and i believe they are. >> chris christie, thanks very much. talked about arizona. it is tight. we'll talk to the secretary of state of arizona coming up in our next half hour. all right, george, and those razor-thin margins are raising big questions about all those

7:37 am
simply too many places right now and too many votes for this to matter. but if it did get down to that point, then, yes, then the specifics of how ballots were counted will become a critical question but that's not really what a lot of lawsuits are about. a lot of them are about broader process and it seems more like an effort to try to delay the process and prevent some states from certifying the vote so the trump team can continue the ongoing fight. >> but two of these lawsuits in michigan and pennsylvania, they are about access to ballot counts. republicans are saying that they have been blocked from observing but would that be enough to stop vote counts, dan? let's start with you. >> no, it's not going to stop the vote count. the question becomes, what do you do now, and when the remedy for this sort of situation would be give them the access and potentially challenge ballots later but you don't stop the vote count to allow something like this to change.

we want to get straight to what frank luntz said, that the polling profession is done. do you agree with that sentiment? >> so i'm not a pollster, but i think frank is kind of exaggerating a little bit for a couple of reasons. one being we know that in a lot of states the result is changing from what it was initially on election night, so if you went election night, you thought, oh, my gosh, biden is going to lose wisconsin by ten points. turns out, he is ahead in wisconsin, and wisconsin has been called or projected for him, so when you compare the final results, it will take a couple of weeks. they probably wind up 48, 49 out of 50 states right. and come a little low on biden's popular vote. so i think in the light of date it's going to be a mediocre year for the polls but where they correctly pointed towards biden's wins in key states.
7:44 am
>> how is polling conducted? did mail-in early and or absentee ballots affect the polling? >> that's a big question. i don't think the polls were perfect. they clearly underestimated in some key states president trump. one big change here is that you have so many more ways to vote, people voting by mail, so maybe votes can be spoiled meaning, you fill out the ballot incorrectly when you send it in. maybe some votes were lost. i don't think that's enough to explain all of it, but a new factor that pollsters are dealing with and something we have to look into and account for. >> nate, you have always been careful with your forecast. you caution people, you know, at 10% probability of something if something is not nothing, and i take your point about the polling not being perfect but not way out of whack, but we've had two and perhaps two elections in a row where the error was in the same direction twice in a row underestimating the support of president trump. do you have any theories about what that is about?
7:45 am
>> i mean, i would potentialize a bit where it's pretty typical to have a polling error of this magnitude. people were spoiled by 2008 or 2012 where it's spot on. different science now where views are correlated across a demographic with how they might vote, but one idea is that people who have so-called low social trust, people who may not trust the government may also not, for example, answer polls quite as often, it's pretty hard to use that to weight your way out of. not that trump supporters deceive a pollster or lie about who they're supporting but they just won't pick up the phone and that can be a problem. again, we don't know. pollsters thought they'd fix it by doing education weighting but if you miss, you want to miss not in the same direction twice in a row so i think there will be a lot of questions that need to be asked, but i think if you use probability you understand hey, look, the reason biden hung on in states like michigan and
