georgia has not been called yet. the count continues to arizona, north carolina and pennsylvania. liz kreutz has been following the election closely and joins us with a look of the intensifying race for the white house. >> as you show there, we did just hear from president trump minutes ago. i think he's still speaking now and he's been tweeting quite a lot over the past 24 hours but this is the first time we seen him publicly since his remarks the night of the election. once again, he's claiming he's being cheated out of a win. >> if you count the legal votes, i easily win. if you count the illegal votes, they can try to steal the election from us. if you count the votes that came in late, we're looking to them very strongly but a lot of votes came in late. >> again, we have to say no

evidence for this right now. patience is really the word of the week. we're anxiously awaiting results in those battle ground states including pennsylvania. there was hope we would know the outcome tonight. as the day goes by, that seems more and more unlikely. >> reporter: as the country waits on pins and needles, all eyes on five states, nevada, north carolina, georgia and pennsylvania. biden needs two states to hit 270 to declare a win, president trump needs four and the final ballot counts to make the difference are very, very slowly strike ling in. biden today said he has no doubt he'll win once the votes are counted and call for patience. >> i ask everyone to stay calm, all the people to stay calm. the process is working. the count is being completed and we'll know very soon. >> president trump in the meantime continuing to make up

with brizen robbeazen robberies. looters had hours inside a pharmacy before police arrived. laura anthony has the response from police in a story you'll see only on abc 7 news. >> reporter: it started with a blow torch on election night at the backdoor of a long-time oakland pharmacy. several men showed up just after 10:30 cut their way through a metal backdoor and then the marathon begins. for hours, dozens of people running into the pharmacy smashing computers, wrecking displays, stealing drugs and other merchandise and ransacking a business that served oakland for more than 70 years. >> we feel like we deserve a little bit better. >> reporter: the owner says she's heard from neighbors who called 1 911 all most as soon a the brazen break in began but police did not respond for five hours. >> it's just disturbing to think that there is nobody looking out for us in this community.

this is an important store in the community. >> reporter: the looting and destruction went on for several hours, all of it captured by the store's many security cameras. the video is so clear you can potentially identify suspects but so far police have yet to even ask for it. once they get the video, police say they will see if there is a possible connection to this week's rash armed robberies at oakland cannabis businesses. for their late arrival, a call like this doesn't always get top priority. >> we have priority calls where someone's life is in danger will take priority over a business being burgized or vandalized. >> i don't know perhaps if they were spread too thin. it doesn't seem to be communication or ultimately the action taken that needs to be taken so that the community has the protection they need. >> reporter: in oakland, laura anthony, abc 7 news. authorities are investigating at least 11 separate incidents of apart rant

the cal football team will not play the season opener against the university of washington this saturday night because of a positive covid test and with that test, and subsequent contact tracing, several players are now in quarantine. the bears can't feel the competitive roster so that contest will be declared no contest. cal's next game is scheduled for saturday, the 14th at arizona state and because of the quarantine rules that state you have to be in isolation for two weeks, in berkeley that game may be a little to the nfl and four players sitting out but their post

driving the trump presidential campaign, it might be filerly, file often. the team now has active lawsuits in most of the remaining battle ground states and golden gate university law professor kathleen morris says there is a reason for the number. >> i mean, a lot of people don't realize that we are not a one constitution nation. we're a 51 constitution nation. >> reporter: she explains election powers rest with the individual states and specific laws. form erica median and senator al franken waited months for a lawsuit to wind it's way through the courts in minnesota. >> it's almost always state courts first because the elections are run at the state and local level. >> reporter: jonathan miller has been providing legal help to voting rights efforts around the country. he said the issues from the trump team range from mail in ballots to voting deadlines and individual battle ground states themselves believes the legal

team tipped their hand toward a broader strategy. >> try to get something that might affect the outcome of the election. >> reporter: historically, federal courts have been hesitant to step in without a clear federal issue. bush versus gore when the supreme court halted a recount in florida effectively handing the election to george w. bush. since then, many legal scholars have questioned whether the court had clear grounds to act. >> after bush versus gore you can't say anything with confidence because there was no jurisdictional basis. >> reporter: with the 2020 vote so close, even a success in one key state could be significant they say as for repeat of bush and gore. >> whether there is a case that can go to the supreme court that can alter the outcome of the election, i think we'll know a little bit more about that in the coming hours and days. >> reporter: adding more drama and anxiety to a historically tense election.

if the challenge were to reach the supreme court, there could be at least some deja vu because three current sitting judges, justices were also on the court for bush versus gore in 2000. joining me now, san francisco chronicle insider abc 7 news contributor phil talking all things elections. why don't we start with the president speaking about a half an hour ago claiming that he feels like he's being cheated. what was your reaction to his comments? >> well, first off, what we saw was sort of the broad donald trump statements with lack of specificity. i mean, he didn't have specifics. he said basically it boiled down to this, larry, that he was ahead in most of the states that are being contested until they started counting the late votes coming in. and he says that that shouldn't be the case. that it's improbable they would be breaking towards joe biden and not him. he hasn't been through a lot of elections and a lot of tight

elections. what we're seeing is marpar fore course. that's what happens. second challenge is to say he doesn't want them to count votes, let's say, that we're arrived after the election but we're postmarked before the election, well, local laws cover that yes or no. he says he wants greater access to observe the count. that's being granted. what he didn't have was a specific large enough case or a large enough number to actually change the election. and i don't know if you saw the president and listened to him but he was rather tired. he was rather withdrawn and it sounded to me like the air was coming out of the tires. >> well, i think everyone is pretty exhausted given the situation. weird for the republican party because in some places trump supporters say stop the count, stop the count but in others, it's keep counting because they need the votes in a state like arizona. >> that's right. whatever shoe fits you'll wear it given the state.

in close elections like this, it's usually the underdog who says i want every vote counted. i want them all counted because therein lies the chance of making it up. the president feels like he got the early vote and he did and that's why he made a big move on that on election night. he was saying i won. i won. now everything from that going forward is a take away. the fact is in close elections and in big elections, it's hypered that the count isn't over until it's over. and you're going to go up and down, up and down and up and down. we may have states swing one way and the other. the margins might be very small and it can be frustrating but that's the way it is. >> yeah. i think we should be clear, everyone wants a legitimate count and count them all and we'll see what happens in the end. this is getting ahead a little bit, i know, if joe biden wins, what happens with kamala harris' senate seat?

any idea who would take over? >> you're not getting ahead of anybody in san francisco, sacramento and points between. people are lobbying and saying if it happens, let's get going on this. there are a host of possible candidates but i was talking with one advisor who said very simply there is only two things that sitting governors should be looking for making an appointment like this. i said what? who has been with me or with me when i ran for office and who will be with me next time? within that group you can find anyone that qualifies. gavin knew sonewsom's case, ale padilla, secretary of state, southern california, same resume, lgbtq candidate tony atkins, possibly mayor libby. he has plenty of friends qualified to go in there. the toughest decision is who does he make happy and upset?

>> wow. >> i know. i have to get my dig in early and have to transition to a serious topic, the election we're watching so closely. inching ever is slowly towards a resolution in the presidential election. let's be clear, votes are still being counted and neither candidate earned the needed 270 electoral votes, college votes. if things hold the way they are, joe biden will be the next president. in fact, the biden campaign launched its transition website containing only a message saying votes are still being counted but that the team is preparing so biden harris administration can hit the ground running on day one. the trump campaign is not conceding filing lawsuits in multiple states and just an hour ago you heard the president's news conference saying there is in fact fraud going on. he says without evidence. spencer, what is your take? >> well, i don't think things are -- i don't think the mood in the country is going to settle down for awhile. no matter what the outcome, they're are going to be people

very upset and disappointed and some will probably express their frustration in ugly ways. i think that's unfortunate. so i just urge everyone to try to calm down a little bit, you know. sip some hot tea, do some deep breathing exercises and hope for a more peaceful outcome to this thing. >> yeah, my take away, we're not used to this in this country. we're used to things being pretty fast and this is a different situation so we just have to try to be patient. san francisco based gap thought it was trying to unite the country instead, now they are apologizing. gap tweeted this half blue, half red sweatshirt with the one thing we know together we can move forward. social media immediately clapped back saying the gap was glossing over the issues dividing the nation. the gap apologized saying it was meant as a message of unity. ama, you can't even attempt a

a hump back off the coast of san lewis. they were recording video on monday when a whale's fin surfaced in the distance and the next thing they knew, a big pool of fish came up out of the water followed by the whale. the kayakers got flipped into the drink. there they go. fortunately, they were not injured. they have quite the story to tell. up close encounter there. >> you bet. >> excitement is 3wibuilding ase first snow forecast is expected to hit. resorts have been making snow for a couple of weeks despite the warmer that be normal conditions. locals say they are excited to get back onto the mountain.

bats in the bridge in the early 1990s. '93 when is we first started receiving reports. they selected this bridge because it's an awesome construction. it's perfect for bats. so the way that it's built, it has concrete beams with little crevices in between. so it's nice and warm for female bats when they're giving birth. if you look in the crevice, you'll see the bats sleeping. it's daytime, and they're hanging out, hanging by their toes, and sound asleep during the day. once sunset nears, then they'll shiver and warm their bodies up and be ready to fly. this is an example of the bats that you'll see in waugh bridge. this is a members call free tail bat. notice the narrow wings for fast flight and the long tail. part of the tail is free from

the membrane, the skin. and so that's how it gets the name free tailed. the bats in waugh bridge eat insects, primarily moth eaters. so they'll go up to 10,000 feet and catch moths that are flying in from mexico. so they're really, really good pest control on moths that attack our crops. so this colony of 300,000 bats eats about three tons of insects a night. they're using echolocation, kind of like sonar, to be able to catch the insects, find them and catch them. if you come to see the bats, come early. come before sunset. because usually they will fly out at sunset, or a little after. so come hit on the hillside, get yourself situated, and just wait for the bats. one sign that you can tell that the bats are close to coming out

is to watch for the predators. and they come every evening and they'll sit and wait. once you see them start arriving, you know that it's pretty quick the bats will be coming out. >> thinking like when a tornado, like a funnel cloud as they swirl up. >> when the bats emerge in the evening, they typically fly out the east side of the bridge. so somebody says go, in the group, and they'll drop out of the crevices. and either do a little swirl underneath the bridge or they'll be so hungry and ready to catch those insects that they fly immediately out. springtime is when the females in the bridge are giving birth, and each mother gives birth to one pup. and usually during those times they come out later in the evening. so when it's dark. so that they are not eaten by a predator. >> it was amazing. because you get to see all of them just like rushing through it.
