trickling in. biden today said he has no doubt he'll win once the votes are counted and called for patience. >> i ask everyone to stay calm. all the people to stay calm. the process is working. the count is being completed. and we'll know very soon. >> reporter: president trump in the meantime continues to make unsubstantiated claims of voter fraud. earlier tonight he addressed the nation and claims he was cheated out of the win. >> if you count the legal votes, i easily win. if you count the illegal votes, they can try to steal the election from us. if you count the votes that came in late, we're looking to them very strongly but a lot of votes came in late. >> reporter: the president has shown absolutely no evidence of this, but his supporters are backing him up. bay area conservative activist melanie morgan says they won't go down without a fight. >> we will not be the ones with pitch forks in the streets if we lose this election.

we will absolutely honor the election results, we're not going to result to violence but that doesn't mean anything short of that we are going to be involved. >> reporter: the results right now are razor thin. for instance, in georgia the president's lead has dropped to less than 4,000 votes. for herini who spent the past few months calling and door knocking for biden, show how the efforts pull off. >> when you're on a phone bank in the zoom screen, you think the phone call doesn't make a difference but it does because when it comes down to nevada is 8,000 votes. >> razor thin. it appears democrats will likely retain control of the house but republicans did gain some seat there is. the control of the senate is still too close to call and it could come down to two possible senate run offs in georgia this january. a very, very close race all around and we continue to wait, guys. >> we sure do, liz. what is happening in georgia as you mentioned, the senate race

pandemic. they led a discussion today digging into key policies that could change post election. could we see a national lockdown? stephanie sierra has the story new at 6:00. >> reporter: an hour-long zoom discussions merging the minds of health policy shared a strong message, you can't separate science and politics. >> how do you create a sense of unity and a sense of trust on everything from mask wearing to taking a vaccine? and that's probably the most destructive thing we've seen in the last ten months. >> reporter: ucsf doctor consulted advisors close to joe biden's campaign specifically explaining the success san francisco has had responding to the pandemic and how that could play into biden's national strategy if elected. >> what we need is clear national standers about in this community or this state or this region, your cases are above a certain number, your test

positivity is above a certain number. keep these things open and close thi these things. >> reporter: he says the biggest hurdle is rebuilding trust and strengthening communication when it comes to masking, testing and vaccines. does that mean a national lockdown or even a national mask mandate? >> what is the most effective way to make that happen? is it a federal mandate? is it pushing all the governors to do that? is it reclaiming the normal role of the cdc and legal issues about, you know, can the president issue a national mask mandate. what does that mean? >> reporter: andy served as the director for the centers of medicare and medicaid services. if elected, he expects biden to work with governors to set guidelines that follow the data. >> we've done analysis that shows for every 10% more of the population that's non-compliant, you have 100,000 more deaths roughly speaking. >> reporter: ezekiel emanuel

brentwood resident hanging an apparent biden mannequin. neighbors were so disturbed, they called police. larry diamond says it will take more than election results to heal divides. >> each side should listen with an open mind and not try and persuade the other. let's talk to one another and find out what motivates us. >> i don't know it should be about changing hearts and minds. i think it's maybe about where can we find commonality. >> reporter: kris reyes for abc 7 news. >> that biden in been taken down but has drawn protesters. j.r. stone was there a short time ago. >> reporter: i'm in bentwood. there is outrage in this community after a donald trump supporter hung a dummy from a noose off of his roof and then put a sign around that neck of that dummy that said sleepy joe cheater. there were pictures and video posted of that online and since

that time, it's really taken off. you can see all of the people outside of that man's house. he has taken that dummy down, but so many people upset over what they saw there are crowd of at least 100 out here right there and then across the street right over there as well are very angry. officers are nearby. it's been a peaceful rally and protest outside of this man's house. a lot of people driving by honking on brentwood and a lot of blm supporters and trump support ers honking. a tense scene out here in brentwood. back to you. all right. j.r. stone keeping tabs on that. still ahead, a restaurant struggles to survive the pandemic got worse when it fell victim to an alcohol beverage control sting. the i-team looks into it.

police are investigating a homicide that h from the kizer hospital in richla richlaric richmo richmond. a man was shot and killed. police say the hospital was initially put on lockdown. it is now open once again. a grown up of thieves broke into a big five sporting goods store in san lorenzo.

investigators say the group went after the firearms inside. there have been at least 11 separate incidents like this in recent days, the majority in oakland. the acting police chief says the groups are loosely organized but strategic as to when they attack. >> these roving caravans of robbers and looters have been at the same time police and other resources of the city are tied up with crowd control management. >> the robbers often target a particular type of business, one group hit three separate cannabis businesses on tuesday night. thieves also hit a long-time oakland neighborhood pharmacy. looters had hours inside before the store -- in the store before the police actually arrived. abc 7's laura anthony has response from police on a story you'll only see on abc 7 news. ever. >> reporter: it started with a blow torch at a long-time

oakland pharmacy. several men showed up after 10:30. cut their way through a metal backdoor and the marathon begins. for hours, dozens of people running to the pharmacy smashing computers, wrecking displays, stealing drugs and other merchandise and ransacking a business that has served oakland for more than 70 years. >> we feel like we deserve a little better. >> reporter: the owner says she's heard from neighbors who called 911 almost as soon as the brazen break in began and an alarm company also apparently tried to call but police did not respond for five hours. >> it's just disturbing to think that there is nobody looking out for us in this community. it's an important store, an essential store in the community that helps people. >> reporter: the looting and destruction went on for several hours, all of it captured by the store's many security cameras. the video so clear you can potentially identify suspects but so far, police have yet to even ask for it.

once they get the video, police say they will see if there is a possible connection to this week's rash of armed robbers at oakland cannabis businesses. for the late arrival with limited resources, a call like this doesn't always get top priority. >> so if we have priority calls where someone's life is in danger, that will take priority over a business being burglar e burglarize. >> i don't know perhaps if they were spread too thin. it doesn't seem the communication or action taken that needs to be taken so that the community has the protection they need. >> reporter: in oakland, laura anthony, abc 7 news. investors shrugged off the uncertainty of the election results. the dow ended with a gain of 542. the nasdaq rose 300 points and the s&p is on track for the biggest gain since april. while millions of eyes are fixed on the returns of the

tight presidential race, h legal -- many legal experts have their eyes on the courtroom. how likely they are to success remains to be seen but several scenarios could play out. here is kristen sze. >> reporter: if there is one legal strategy driving the trump presidential campaign, it might be filerly, file often. the team now has active lawsuits in most of the remaining battle ground states and golden gate university law professor kathleen morris says there is a reason for the number. >> a lot of people don't realize we're not a one constitution nation. we're a 51 constitution nation. >> reporter: she explais election powers rest heavily with the individual states and their specific er comedian al f waited months for a lawsuit to wind its way through the courts in minnesota. >> it's almost always state courts first because elections are run at the state and local level. >> reporter: john monominathan s been providing legal help to voting rights efforts.

he says the issues sited from the trump team range from mail in ballots to voting deadlines to access to counting centers and while suits have been filed in the individual battle ground states themselves, miller believes the legal team tipped their hand toward a broader strategy. >> they will do whatever they can to get a case into federal court and try to get something that might affect the outcome of the election. >> reporter: historically, federal courts have been he is te -- hesitant to step in. one famous exception, bush versus gore. that's when the supreme court halted a vote recount in floridafectively handing the election to george w. bush. since then legal scholars questioned whether the court had clear grounds to act. >> after bush versus gore, you can't say anythig with confidence because there was no jurisdictional base. >> reporter: with the 2020 vote so close a success in one key state could be significant. as for repeat of bush and gore. >> whether there is a case that can go to the supreme court that can alter the outcome of the

another lovely day to check out in san francisco's field. the first snowfall of the season is forecast to hit the region this weekend. resorts like squab valley have been making snow for a couple weeks now. they are scheduled to open on november 25th after north star and heavenly. i bet the skiers are excited about that, dan. >> yes, you can ski, just do it socially distanced, right, spencer? >> that's exactly right. we got showers and a chill coming to the bay area and snow and a deeper chill to the sierra. here is a look outside right now. the view from the explore camera.

current temperature 62 in the city, 67 in oakland. we have mid to upper 60s in mountain view, san jose, gilroy and 55 at half moon bay. mainly clear skies so far. 63 santa looking back from the rooftop camera, forecast features, increasing clouds overnight. it will be windy with a dramatic drop in temperatures. cold showers are likely and a chance of isolated thunderstorms. the approaching system ranks one on the abc 7 storm impact scale. so again, expect some shattered, shattered, scattered showers, rough surf tomorrow and wind will gust 25 to 50 miles per hour. here is the forecast animation starting at midnight tonight. notice by 4:00 tomorrow afternoon, we'll have pretty active weather especially near

the coast and the north bay but these showers could pop up anywhere. there is just a greater propertibilipropert probability near the coast and later into the evening hours and a little bit of a break at least from precipitation on saturday but then going into sunday we might see another weak wave of showers coming through. rainfall totals we project by sunday evening, not more than about .5 of an inch in most locations although san jose could be bwetter and in the sierra, once again, there is snow on the way from 10:00 a.m. tomorrow to 10:00 a.m. sunday. a winter weather watch is in effect with expected -- snow expected to reach levels of maybe 6 to 12 inches accumulations above 5,000 feet. low temperatures tonight across the bay, upper 40s, mid to upper 40s in the north bay slvalleys d low 50s in most other locations. then tomorrow, look for the big chill certainly in. high temperatures tomorrow will be about 20 degrees or more

the presidential race still too close to call two days after the election and no projected winner. results cut into former vice president's lead there. 75,000 new votes were released and 56% of those favored president trump. the race is also extremely tight in pennsylvania where counting has stopped for the night in al

ga -- allegheny county. pennsylvania and alabama have yet to be called. they are also including alaska, georgia, nevada and north carolina. in the race for 270 electoral votes, biden has 253 at this moment. while president trump has 214. biden says he's confident of a win while the president claims fraud. though no votes have yet to be found to be illegal >> i don't know if you saw the president and listened to him, but he was rather tired, he was rather withdrawn and it sounded like the air was coming out of the tires. >> the trump campaign remains focused on georgia where the president's lead over biden continued slipping away today. he now only is up about 3400 votes as new totals come in. it's an area president trump won handedly in 2016. now to a story by the a be, c 7 news i-team.

in light of covid-19 the california alcoholic beverage control loosened restrictions on the delivery of mixed drinks. >> the goal is to help struggling businesses but created a new problem, alcohol delivery to minors. one local business is in trouble and says it feels unfairly targeted. melanie woodro has the story. >> reporter: like most restaurants, they had to adapt its business during covid-19. >> how is this going to affect our income and livelihood, our business? are we going to survive? >> reporter: sebastian's father owns the san rafael restaurant and he manages it. he says he appreciated when the california alcoholic beverage control awill youllowed them to mixed drinks until recently. >> i guess an order was picked up by grub hub that contained alcohol that was actually, what, meant for an abc sting. >> reporter: the california abc confirms the order was placed by an undercover decoy.

also that the grub hub delivery driver delivered the alcohol from the restaurant to a minor without carding that minor. a spokesperson for the california a bbc says the agenc are conducting compliance checks since april. >> we received a complaint that delivery services were not checking identifications and as a result, alcohol deliveries were going to places where there were minors. >> reporter: he says the california abc issued 214 citations to delivery drivers so far. though could not say how many have been prosecuted by local district attorneys. >> we found that the compliance rate was very low and that the violation rate was very high. >> reporter: according to the california abc, if a delivery decoy operation is conducted and a delivery person gives alcohol to a minor, delivery person can face a misdemeanor charge of furnishing alcohol to a minor. if an abc licensed business uses

a third party the licensed business can face disciplinary action which was the case with the sushi. they gave the option of one-year probation or a hearing to dispute the claim. he agreed to the one-year probati probation. >> if anything happens within a year we face suspension and fines. for abc to conduct a sting not just targeting myself but other restaurants during the pandemic is wrong. >> he says he feels especially frustrated because when orders come in, restaurants only see the first name and last initial, sometimes their phone number. subsequently. >> we took all the alcohol off any third party delivery service. i can't trust that every single delivery driver will i.d. customer. >> a spokesperson for grub hub says a driver must make sure that alcohol is only delivered to diners who are 21 years old

>> melanie woodro, abc 7 news. a form ersan jose code enforcement inspector faces 14 felony counts accused of demanding sex and money for massage parlor owners. 46-year-old bill jerry appeared in santa clara county court today. prosecutors say he received at least $140,000 over the course of a few months. they list six victims and believe there may be more. jerry is being held on $600,000 bail. tonight at 11:00 the i-team dan noise digs deeper into the evidence including text messages from alleged victims. coming up next, the biggest seizure of bit coin from the u.s. justice department from a case where the suspect was arrested right here in the bay area. plus, is the pandemic making routine health care checkups more expensive? we

morning hours on the 26th just the day after christmas. police caught mendonsaendonsaens two-damiy manhunt. mendonsa agreed to waive his right to appeal and the district attorney's office agreed to not pursue the death penalty. >> the u.s. attorney based in san francisco announced the seizure of $1 billion in bit coin today. it the largest seizure in justice department history. the doj believes it had belonged to silk road founder ross ulbricht arrested in 2013 for running an online marketplace for illegal drugs but the bit coin was stolen and left untouched for years. investigators identified the hacker that took the funds and on election night, the u.s. attorney's office says it seized the bit coin. cool and breezy and the possibility of rain. i hope you enjoyed today's sunny weather because it will look

rolled out soon thereafter. here in the bay area we're learning more what is next for schools in berkeley, middle and high schools can open on monday. oakland schools have pushed back in person classes until at least january. and on u.c. campuses, five schools are being added to a smart phone base notification system for covid-19. and there may be a new covid related surcharge the next time you visit the dentist, doctor and veterinarian. kate larson spoke with bay area dentists and patients about these new fees. >> it's so expensive to run a dental office. >> reporter: palo alto dentist netty hasn't taken a paycheck since june. >> we had to pour in so much money into the dental office. >> reporter: new covid safe tools, extra cleaning supplies and a huge increase in the cost of personal protective equipment. >> if a box of gloves cost $20 before covid, now it costs $60. >> reporter: who pays?

covid and ppe fees have turned up across the country. i've received numerous messages today from people here who have been charged for ppe not just by their dentist but doctors and veterinarians. this bill shows a practice charged an extra $20 for ppe. in colorado a dental patient with thousands of dollars in charges paid an extra $10 for covid-19 ppe and an east bay vet bill shows they increased exam fees by $20 to make up for increased cleaning and ppe costs. >> they're doing what they have to do. i don't blame them. >> reporter: that being said. >> i don't feel it's right to charge our patients this extra cost because they're already under so much stress. >> reporter: she did say she and several dozen bay area dentists are dropping delta dental, a major insurer. >> when we send the cleaning to delta dental saying we have ppe cost, they are refusing to pay

testing cheaper and faster involving technology and micro fluid. >> our vision is a device that's eventually a home test that you can do from saliva that anyone can do. >> reporter: instead of sending nasal swabs for testing, the sample can be analyzed containing micro channels. >> we need a few drops of liquid to get into our chip to load into our chip skp and be automated. >> reporter: by doing this in the field, results could be ready in 30 minutes. the concept is tested using samples from 32 patients confirmed with covid. it a three-step process that ex spa -- extracts dna. the second step amplification currently has to be done

good evening, the cal football team is waiting months to play the season opener and they will keep waiting, actually. the scheduled opener this saturday night is off because of a positive covid test and head football coach justin will sox not happy about this cancellation. this game will not be rescheduled. we do not know the identity of the player a position group is in quarantine, o line, defensive line. this was a decision made by berkeley public health officials. frustrated local restricts are stopping the game. other teams with positive tests play on. >> i'd be lying if i said i wasn't, you know, got some -- my blood boiling a little bit. you want these guys who work

our student athletes let us know if we can play, it's worth it. we knew it would be difficult and not take long. multiple games will be lost this year. they have been around the country and we're prepared for that in our conference, as well. >> onto the nfl, the 49ers have their own covid issues they are dealing with. they are playing the packers as we speak. one positive test may have been a false positive left their depleted roster thinner. kendrick born tested positive then negative. the nfl is looking into possible sanctions for born regarding not wearing his mask. that's a bigger story. trent williams and brandon were being held buecause they were deemed close contacts of born through contact tracing. the niners haven't had any other positive test, if williams and iuke were negative, they should have been able to play. they are out, a frustrating situation for the 49ers who
