coronavirus vaccine and antibody treatment shows promise but daily hospitalizations just hit the highest level since july and president-elect biden is warning of a dark winter ahead. this morning, obamacare is hanging in the balance. as coronavirus cases surge across the country, the supreme court today will hear arguments on the affordable care act from the trump administration asking the justices to invalidate the entire law. >> it done me a lot of good and honestly i wouldn't have known where to turn or where to sign up for insurance. >> reporter: 21 million americans would lose health insurance nationwide if the law is struck down and protections for 54 million people with pre-existing conditions could also be eliminated. veronica valdez, a mother of five, is watching closely after enrolling in obamacare after she lost her job. >> having kids also you can't take the risk of not having insurance. >> reporter: the court upheld the affordable care act

in two previous cases but now there's a greater conservative majority on the bench after president trump appointed three justices. the law's challengers including 18 states led by texas are urging to rule that its individual mandate which requires all americans to get health insurance or pay a tax is unconstitutional. the trump administration has not revealed a replacement for the law if it's overturned. >> we have reached a very dangerous phase in the pandemic. >> reporter: the case comes as several states report their highest number of coronavirus indications. governors in new york, california and others are hinting at new restrictions. >> we have one last chance to stop a second wave. >> reporter: but some optimism this morning. pfizer has announced its vaccine appears to be 90% effective. if approved, pfizer expects to produce enough vaccines to cover 25 million people around the world with the first vaccines potentially available in mid-december and more could be on the way according to dr. anthony fauci. >> the other good news, wolf, that's important is that the type of vaccine that it is, an mrna vaccine that i

have discussed with you in the past, that's not the only company that has it, moderna has a vaccine very similar, if not identical to this. their results will be coming out soon. >> reporter: pfizer is dismissing claims that the company delayed the announcement. president trump tweeting that pfizer and the others would only announce a vaccine after the election because they didn't have the courage to do it before. >> we were not working with the election as a time line. we are going to follow the speed of science, so science spoke, and i was predicting that this would happen at the end of october. it happened a week later. >> reporter: in the meantime, dr. fauci is telling americans to hang on. >> help is on the way with a vaccine. we need to hang on, double down, and we can blunt these surges that we're seeing. it's possible to do, and we will be able to do it. we just need to do it, put the effort in and just hang in there. >> as for the obamacare arguments at the supreme court today a rule something not expected until june. president trump's housing

and urban development secretary ben carson is recovering after testing positive for covid. carson was among 400 guests at a white house party on election night. also this morning, trump adviser david bossie has tested positive. he's heading up the trump campaign's legal challenges to the election. now to the breaking news overnight concerning the transition. president trump is refusing to concede to joe biden, and now attorney general william barr is authorizing possible investigations into voter fraud, and that's prompted a top prosecutor to resign in protest. abc's alex presha joins us live from wilmington, delaware, with the latest. good morning, alex. >> reporter: mona, good morning. so that order from attorney general william barr changes how and when prosecutors can look into allegations of voter fraud and now the man who oversees voter crime at the department of justice is stepping down from his hole. this morning, a shake-up at the justice department. the head of election crimes resigning overnight after attorney general william barr

issued a new policy to u.s. attorneys telling them to pursue substantial allegations of voting and vote tabulation irregularities. investigations of voter fraud would typically begin after state certified results weeks after an election. the career official richard pilger writing, having familiarized myself with the new policy and its ramifications, i must regretly resign from the role of director of the elections crime branch and now president-elect joe biden's team is threatening legal action if the general services administration fails to formally recognize the election results. >> it's clear now, there's no mathematical path forward for trump, and we are obviously trying to get our job and get our jobs going here. we're not going to take any options off the table. >> reporter: traditionally the general services administration ascertains the winning candidate allowing them to access a variety of resources for the transition of power. the director of national intelligence says biden will not receive full intelligence briefings until that happens. but this morning, the head of

the agency appointed by trump in 2017 says she has not determined a winner is clear. >> i am the ranking democrat of the committee that has oversight over gsa. we're investigating what options we have. >> reporter: the recently fired secretary of defense is speaking out. president trump terminated mark esper yesterday months after the two disagreed on how to handle civil unrest. trump saying this about esper in august. >> mark yesper? did you call him yesper? oh, okay. some people call him yesper. >> reporter: esper has denied being a yes man. he said in a new interview if his replacement is a real yes man, then god help us. >> this election is not over. far from it. >> reporter: it comes as president trump along with some republicans remain defiant about the election results even though they presented no credible evidence of voter fraud. fox news even cut away from white house press secretary kayleigh mcenany after she accused democrats of welcoming illegal voting. >> whoa, i just think we have to be very clear she's

charging the other side as welcoming fraud and illegal voting. unless she has more details to back that up, i can't in good countenance continuing showing this. >> the director of the national counterterrorism center is now the acting secretary of defense taking over for mark esper. mona. >> alex, thank you. for the second time in three weeks, a houston police officer has been killed. colleagues escorted the body of sergeant shawn rios to the medical examiner last night. he was a 25-year veteran of the force and was killed during a shootout while driving to work. he was not in uniform. the killer was still on the loose overnight. time now for a look at your tuesday morning weather. south florida is drying out after widespread flooding from tropical storm eta. nearly 18 inches of rain fell in some areas near ft. lauderdale. this lamborghini was nearly submerged.

look at that. this green ball of flame was spotted south of oslo, norway, lighting things up. experts say it was a meteor 18 inches across and it weighed more than 200 pounds. in littleton, colorado, friends and neighbors of a woman shot and killed by her husband are demanding justice. scott smith claims his wife tried to attack him with a butcher knife and says he shot her in self-defense. people who knew kanokwan smith said they don't buy his story. no signs of struggle and no marks on her husband but he has not been charged in this case. >> she'll never be able to wrap her arms around her little girl again, and he shouldn't have that right. he shouldn't be out, and he shouldn't be free. >> scott smith recently filed for divorce. police say there is not enough evidence to charge him, but the investigation is active. we turn now to the passing of alex trebek and new speculation on who might replace him as the host of "jeopardy." here's abc's megan tevrizian. >> reporter: overnight a new

back here in the u.s., some grocery store chains are limiting the sales of certain items as coronavirus cases soar. kroger, giant and other operators are limiting the purchase of paper products, soap and wipes. it's all to prevent the shortages many customers experienced last spring. >> we think that there's going to be a lot of limits at retail level that will hopefully help mitigate that to earlier to allow the lack of stockpiling that we saw before. >> experts suggest buying nonperishable and frozen items now. united airlines is adding 1,400 domestic flights for thanksgiving week as more people start traveling for the holiday. the airline expects to see the biggest number of passengers since march. it's also bringing back food service. we've heard about the new coronavirus vaccine and overnight more good news. a new antibody treatment. also this morning, new cdc guidelines on thanksgiving. earlier i spoke with dr. shashank ravi about these headlines. let's begin with what appears to be a major victory in the battle

against the coronavirus. drugmaker pfizer announcing its vaccine is more than 90% effective. what do we need to know about this? >> well, it's definitely great news, mona, and bodes well for being able to get a vaccine out to society very soon. we need to look at more data to know how long will any immunity last for. we also need to look at the age ranges as we know that elderly individuals usually have less of an immune response. >> what do viewers need to know about that, for example, who will get it first, when will it be available and where? >> we do know it will take several months if not half a year to get a vaccine distributed across america. we also know that we likely won't be able to rely on a single manufacturer. many of these vaccines including the pfizer candidate required two doses, so we'll need to have a way of tracking individuals to make sure that they return for their second dose after about a month's time and that the supply is there so that they can actually get that second dose on

time. >> we also learned overnight that a new antibody treatment for covid has been approved. what are you hearing? >> so this is exciting because we really haven't had a treatment targeted at this population who are mostly well and aimed at making sure that they aren't getting sicker and aren't needing to be hospitalized. >> then lastly the cdc has released some new guidance on the thanksgiving holiday. you know we are just weeks away. what are the takeaways? >> we know that as the virus has definitely surged across many states, much of that spread has come from families, extended families mingling, and so we must all try to do what we must to stay apart, and if we have symptoms, don't interact with other individuals and really stay distant. >> our thanks to dr. ravi. coming up, celebrating 30 years of "home alone." also ahead, pandemic boredom inspires one dad to build an amusement park in his backyard. >> ooh. who've got their eczema under control.
