he says he's recovering in the hospital. more on him in a moment but first the new restrictions taking effect. this morning, more than 33 million people in california now under strict stay-at-home orders. >> i think it was inevitable until a vaccine comes. >> the new restrictions in california's major metro areas forcing bars, hair salons and movie theaters to close. restaurants are limited to take-out and delivery only and gatherings of people from different households are prohibited. >> this is the greatest threat to life in los angeles that we have ever faced. >> reporter: across california nearly one in ten coronavirus tests is now coming back positive. intensive care capacity at hospitals dropped below 15% this weekend, but in some counties defiance from law enforcement. sheriffs in riverside, san bernardino and orange counties are refusing to enforce the lockdowns. >> these closures and stay-at-home orders are flat out ridiculous. the metrics used for closures are unbelievably faulty and are

not representative of true numbers and are disastrous for riverside county. >> reporter: a restaurant owner outsnide l.a. expressing anger after her outdoor patio was shut down while a film crew was able to set up outdoor tables nearby. >> i'm losing everything. everything i own is being taken away from me. look at this. tell me that this is dangerous but right next to me is a slap in my face, that's safe. >> reporter: for film crews to shoot, they must follow strict guidelines on screening and testing unlike restaurants where testing was not a requirement. meanwhile, california is not alone. across the country more than 101,000 people are in the hospital with the virus, nearly twice as many as a month ago. abc news getting a look inside this field hospital in worcester, massachusetts, where doctors say they're better prepared this time. >> as far as we know, this is the first covid field hospital that's had to re-open from the spring first surge.

it's a little bit easier this time in the sense that we know how to set things up. we're learned a few things. >> reporter: and now an urgent warning for holiday shoppers. the cdc recommends avoiding in-store shopping and opting for curbside pickup instead. if you must go inside, they say go off hours. only touch what you plan to buy and use touchless payment systems. >> so when you're sort of shopping in a store, you should look at all opportunities that reduce the amount of contact that you have with another individual, so waiting in a line in close proximity to someone else could be problematic. >> but this morning hope is on the horizon. pfizer's vaccine is being delivered to british hospitals today. vaccinations begin there tomorrow. the vaccine could get the green light here in the u.s. after this thursday's fda hearing. >> if things are on track, the advisory committee goes well, i believe we could see fda authorization within days. but it's going to go according to fda's gold standard process, and i'm going to make sure it

does. >> on december 17th the fda will hold another hearing, this time on whether to authorize moderna's vaccine. in transition news president-elect joe biden is expected to nominate california attorney general javier becerra as his secretary of health and human services. if confirmed, he would be the first latino in the position. becerra served 12 terms in congress. as california's attorney general he fought to protect obamacare. more now on president trump's lawyer, rudy giuliani, testing positive for covid. several questions remain including exactly when he was infected. the news is forcing lawmakers in one state to shut down their offices. abc's alex presha has the latest from washington. alex, good morning. >> reporter: kenneth, good morning to you. giuliani is providing an update on his condition hours after president trump broke the news which is creating ripple effects across the country. this morning rudy giuliani revealing he's getting great care and feeling good while hospitalized with covid. giuliani's been leading the

president's legal battles to overturn the election traveling last week to arizona, michigan and georgia where he appeared mostly maskless at legislative meetings. >> you are the final arbiter of who the electors should be and whether the process is fair or not. >> reporter: the trump campaign saying giuliani tested negative before traveling to each state, and he did not experience any symptoms or test positive for covid-19 until more than 48 hours after his return. but arizona's legislature is not taking any chances closing this week after at least 13 lawmakers came in close contact with giuliani. on twitter trump writing, get better soon, rudy, we will carry on. >> we've never lost an election. we're winning this election. >> reporter: over the weekend in georgia trump pushed his baseless election fraud claims while rallying support for two senate republicans fighting to win runoffs next month that will determine which party controls the senate. it comes as trump pressures the state's republican governor brian kemp to order a special

session for the purpose of overturning the results of the presidential election, which joe biden won. >> your governor could stop it very easily if he knew what the hell he was doing. >> reporter: sunday night kemp released a statement declaring that a special session in order to select a separate slate of presidential electors is not an option that is allowed under state or federal law. in the meantime, most candidates in those two georgia senate races were on the debate stage last night. incumbent republican kelly loeffler declined to say whether trump lost the election when asked by her opponent. >> my question is pretty simple. yes or no, senator loeffler, did donald trump lose a recent presidential election? >> you know, president trump has every right to use every legal recourse available. >> reporter: in the other race democrat jon ossoff debated an empty podium because incumbent republican david perdue refused to participate. meanwhile, the website axios

reports that president trump is not planning to attend joe biden's inauguration next month. instead he's planning a rally in florida. kenneth and mona. >> we will see in 44 days. alex presha, thank you. a new report offers the most plausible explanation yet for an illness that sickened u.s. diplomats in cuba. a government commission report finds the illness that affected more than 40 americans at the u.s. embassy in havana was likely due to microwave radiation from a malicious attack. the state department says the investigation continues. in germany authorities have successfully dismantled a massive world war ii bomb. the 1,100-pound weapon was found at a construction site in frankfort. 13,000 residents had to evacuate. police in nashville searching for clues after the murder of a young icu nurse. 26-year-old caitlyn kaufman was shot and killed on the highway last week while driving to work. kaufman's family is baffled that anyone would want to hurt her. >> i just felt like our lives were shattered from that point on, like my heart just sank. >> it's a nightmare.

>> reporter: kaufman is the third nurse at that same hospital to be killed since 2016. no connections have been made. police say they're chasing down leads from multiple tips. turning now to the weather, much of maine is still without power after this weekend's nor'easter. more than 80,000 customers remain without electricity. at one point a quarter of the state lost power. time now for a look at your monday forecast. the northeast wakes up this morning with windchills at midwinter levels. those temperatures mean the snow that fell over the weekend won't be melting until midweek. meanwhile. in california high wind and fire warnings are posted in the northern and southern parts of the state. the fire threat is critical in southern california with winds gusting up to 60 miles per hour today. los angeles reaches 74 degrees today. low 50s in the pacific northwest. around 40 near the great lakes. 75 in miami. 57 in albuquerque.

they say hsieh was planning to enter rehab just before a house fire in connecticut that caused his death. he was reportedly struggling with isolation. investigators say his death was accidental. we turn now to the daring rescue on mt. mood in oregon. a woman who was skiing suddenly went plunging down a vent inside the volcano, and now she's describing the terrifying ordeal and how she was rescued. here's abc's megan tevrizian. >> reporter: this morning, an oregon woman, is sharing her terrifying experience after falling down a snow-covered volcanic hole on mt. hood. >> it's like someone pulling a chair out from underneath you as you're trying to sit down, so the ground, i had that sensation of falling. >> reporter: 32-year-old caroline sundbaum was climbing at an elevation above 11,000 feet when she stopped to rest unknowingly sitting on top of a volcano vent known as a fumarole. >> i fell about five feet onto the surface of the mountain so

under the snow, landed on my shoulder and then slid another five to ten feet kind of down the side of the mountain in really this sort of cave-like structure. >> reporter: the air in that cave-like structure can be toxic and potentially deadly. >> heat, like heat on my hand, which was concerning. >> reporter: confused and frightened, sundbaum was stuck at the bottom of the fumarole for several minutes but she says her dislocated shoulder popped back into place giving her a sense of relief. >> once my shoulder was working again, then i was going to be able to get myself out of there. >> reporter: a nearby climber noticed she had disappeared and then found the hole where she had been sitting. that climber calling 911 and then lowering a rope down into the fumarole. sundbaum was able to secure herself to the rope and was hoisted to safety.

boy and a 6-year-old girl visiting from kentucky. no charges have been filed. a texas teenager is taking on his high school after being suspended for wearing nail polish. trevor wilkinson says the principal at clyde high school told him he was violating the dress code and gave him three options, remove the polish, virtual learning or in-school suss pension. wilkinson said he's a proud gay male and chose suspension. >> my ultimate goal in this is get the policy changed completely and for them to realize that their policy is discriminatory and sexist, and i would also like a formal apology because i think i deserve that. >> wilkinson set up a petition that has thousands of signatures. the district will review the decision. turning back to the coronavirus, more states are imposing shutdowns. meanwhile, all eyes are on britain where the covid vaccine is ariving in hospitals. earlier i spoke with dr. imran ali. dr. ali, first let's start with what are you seeing right now? what are your biggest

concerns? >> well, kenneth, i'm seeing the rate of infections, and we are really are -- i mean, this is more than we've ever seen before. if you look back at the early days of the pandemic, it took about 100 days to reach 1 million infections. now we're seeing 1 million infections in the span of only five days. i'm really concerned about not only bed capacity but hospital staff are very exhausted, and that's what's really going to make it or break it for a lot of people if hospitals can maintain their staff to be able to care for all these patients. >> we expect it will be a big week. what are you expecting to hear this week from the fda meeting on the covid vaccine and whether to approve emergency use authorization? >> once they provide that green light, "operation warp speed" will, you know, deploy about 6.4 million vaccines within 24 hours. we're expecting 3 million vaccines to go out initially with 3 million additional vaccines 21 days later for that second doze because, remember,

it's a two-dose vaccine. >> much of california, as you know, is entering another shutdown this morning. there appears to be more pushback as businesses struggle to survive. how do you respond to people who argue that dining outside or going to a business where social distancing is enforced is a right and anyone concerned about the virus can stay home? >> it's important that people understand that this virus doesn't care. it needs a host. so as soon as you gather with other people, you may be asymptomatic, you may not know that you're carrying the virus, you can easily transmit it, and it goes from person to person, so it's just so important that you really just be patient for these next couple of weeks. >> our thanks to dr. ali there. one sports note. the chiefs clinched a playoff berth by beating the broncos last night. the chiefs took the lead for good with a touchdown late in the third quarter. they held on, 22-16. coming up, the kitchen of the future. plus, a very unusual workout partner. that's next.
