giuliani, the latest in a series of people close to the president to contract the virus. we'll have more on his condition coming up. surgeon general dr. jerome adams is standing by to talk to us live as well, just three days before the critical fda meeting to discuss approval of pfizer's vaccine. first, let's go to kaylee hartung who starts us off in los angeles, almost the entire state of california is on lockdown this morning, just one day after reporting its highest daily case count ever. good morning, kaylee. >> reporter: hey, good morning, robin. these closed signs behind me have become an all too familiar sight. you can walk down the santa monica pier here but you can't stay long. the restaurants here, all closed. from l.a. to the bay area nearly 85% of californians are under the strict new lockdown at least through christmas. this morning, more than 30 million californians under lockdown after hospital icu capacity dropped to critically low levels in the state leading

to closures for businesses and banning gatherings with anyone outside your household until after christmas. los angeles county reporting 10,000 more cases sunday. a new record and statewide over 30,000 new cases in a single day pushing the total over 1.3 million people infected. >> this is the greatest threat to life in los angeles that we have ever faced. >> we cannot survive. my staff cannot survive. look at this. >> this frustrated l.a. restaurant owner posting this emotional video showing a television crew's tented dining setup just a few feet from the outdoor dining area she was forced to close. >> everything i own is being taken away from me, and they set up a movie company right next to my outdoor patio. >> we know covid is real. but we also, you know, followed every protocol they wanted, and to shut us down with almost no notice before the holidays with no funding, no way of surviving it, is cruel. >> reporter: the u.s. averaging a staggering 186,000 new cases a

day. covid-19 wreaking havoc from coast to coast. despite restrictions, this staten island bar refusing to close. ♪ >> reporter: the general manager arrested for a second time in less than a week. this while in massachusetts the governor tours a make-shift field hospital in worcester ready in case they reach capacity. but for many facilities, the bigger concern is having the staff available to care for more and more covid patients. >> i'm running out of nurses, and we have the space in the medical center but i do not have the nurses or the doctors. you can have a huge hospital but if you don't have the manpower, i cannot save your life. >> reporter: that concern, that our hospitals will be overwhelmed and the dire predictions from health officials that's what led officials in california to put in these strict restrictions.

amy? >> yes, such a tough situation. kaylee, thank you for that. now to the countdown to a vaccine data for pfizer's trials to be made public tomorrow, two days before its critical approval meeting with the fda. stephanie ramos joins us now from worcester, massachusetts with the very latest. good morning, stephanie. >> reporter: good morning, amy. we're outside a temporary field hospital that just re-opened over the weekend to treat covid patients. the facility first opened in the spring. at the beginning of the pandemic they closed but they're now back open at this convention center but this could be a pivotal week in the fight against the coronavirus. on thursday, an fda advisory committee will meet to deliberate the merits of pfizer's vaccine. health and human services secretary alex azar says if all goes well, the fda could issue an emergency use authorization within days and that shipments of the doses could go out within 24 hours after that, amy. >> wow, that's remarkable speed.

that's here in the united states. but in the united kingdom the vaccine is already ready to go, correct? >> reporter: exactly, amy. the first batch of the vaccine arrived at a london hospital over the weekend. brits can start getting vaccinated tomorrow, but unlike the u.s., which will give the first vaccines to health care workers on the front lines of the coronavirus battle, those over the age of 80 and caregivers at nursing homes will get priority in the uk. amy? >> stephanie ramos, thank you so much. george? >> amy, thanks. overnight we learned that president trump's personal lawyer rudy giuliani has been hospitalized with covid after a week of multiple public meetings pressing the president's false claims about the election. cecilia vega has the latest. good morning, cecilia. >> reporter: hey, george, good morning. so the campaign won't say exactly when giuliani tested positive but what we're seeing this morning is state legislatures scrambling to keep their members home, even having to close their chambering altogether because so many came in contact with giuliani during his travels last week, and he was not seen wearing a mask during any of those appearances.

as for the former mayor, he says this morning he is feeling well. this morning, rudy giuliani remains in a washington hospital, the 76-year-old former new york city mayor and president trump's lawyer diagnosed with the coronavirus saying he's feeling good, recovering quickly and keeping up with everything. president trump broke the news tweeting, get better soon, rudy. we will carry on. on sunday morning he was on fox news once again leading the president's efforts to overturn the election results. >> do you believe that you still have a path to victory? >> we do. >> reporter: but it's unclear exactly when giuliani tested positive. the trump campaign would only say he was negative before he traveled around the country last week in his attempt to challenge joe biden's win. giuliani meeting indoors with state lawmakers, never seen wearing a mask during any of the public appearances. from arizona on monday where the legislature will now not meet this week due to giuliani's contact with members, to

michigan on wednesday where he asked a woman sitting near him to remove her mask. >> i don't want to you do this if you feel uncomfortable. but would you be comfortable taking your mask off so that people could hear you more clearly? >> can you hear me now? >> yes. >> can anyone hear her clearly? >> we can hear her. we can hear you. >> okay. >> reporter: after he was face-to-face with georgia lawmakers on thursday those in the hearing room have since been asked to work from home until they receive negative covid test results. >> i saw some looks on people's faces even with their mask on. >> reporter: giuliani has repeatedly been in contact with people who tested positive including the president during preparations for his debate against biden. giuliani's own son tested positive last month, a day after attending that widely panned news conference at republican headquarters. and just like president trump, giuliani has questioned the seriousness of the coronavirus and the efficacy of masks which by all accounts help stop the spread of this deadly disease. now, giuliani's legal partner

jenna legal ellis says that the campaign will continue their challenges and that giuliani's absence from the legal team will not affect their efforts going forward. we were talking about their efforts to be clear here to overturn the results of the 2020 election, and, george, so far, the campaign and its allies have lost 38 cases in courts across the country. >> and states have certified joe biden's win totaling 279 electoral votes. okay, cecilia. thanks very much. let's bring in the surgeon general jerome adams for more. thanks for joining us again. you've been vigilant about wearing masks and telling people to wear masks but is this being hampered by mixed messaging from the broader president's team? >> well, it's really concerning to me that we still have people out there who don't understand how much spread is occurring by people who don't have symptoms, who think they're fine and then we find out a week later that they've tested positive and they've exposed other people. that is very concerning but more people than ever are wearing masks. i want the american people to

know this virus is incredibly unforgiving. cases are going up. hospitalizations are going up. my colleagues are dog tired, and we need you to hang on just a little bit longer because we've got vaccines coming, but want as many people to be alive to get them as possible and a lot of that will depend on your behavior. >> and you talk about the vaccines. pfizer is releasing its trial data today. we're having those key fda meetings later this week. what's the most important thing you need to learn about the vaccine right now? >> well, the most important thing for me personally is making sure people understand that these vaccines were developed safely. they are over 90% effective and that it's a way that we can ultimately end this pandemic, but it doesn't matter if people won't get the vaccination. we know that vaccine levels are only about 50% for adults for flu and they go down to about 40% for african-americans. so i'm working with historically black colleges and universities.

faith communities. i'm working with the divine nine which is the leaders of the african-american fraternities and sororities working with hispanic leaders. we want everyone to get this vaccine when it's available which is why we're having a vaccine summit at the white house tomorrow, and we'll be talking about vaccine confidence, and one thing you can all do right now. it's national flu immunization week. get your flu shot. 500,000 were hospitalized last year for the flu. we can't afford for that to happen this year with hospitals being overwhelmed. >> we want people to take the vaccine once it's available. we know that health care workers in residential facilities, elderly and residential facilities, will be first in line for the vaccine. who should be next? there's a debate about whether it should go first to essential workers versus the elderly who are most vulnerable. >> well, we want to immunize for impact. we want to make sure we're giving it to the people who are most likely to die from this virus, and we know that 40% to 50% of the deaths are occurring in people who are in long-term care facilities or older and

we also want our health care workers on the froontlines to gt it. this surge is different than earlier surges because it's not about ppe. it's not about testing. it's really about health care capacity, and certain places are just being overwhelmed. so we know that we can actually help them with their health care capacity by immunizing their health care staff. we're going to leave it up to the states, but we're going to give them guidance, and some states are going to have to immunize their health care workers first and others will do older people and people with vulnerable conditions first. but about 20 million full doses will be available by the end of the year and we'll keep pushing vaccines out to the people as quickly as we can to end the pandemic. follow the three ws -- wear your mask, wash your hands, watch your distance, avoid people outside of your household as much as possible and please be patient with your leaders around the country. they're trying to preserve hospital capacity. they want you to be able to have a bed, and they want my sister who is pregnant to be able to have a bed when she comes into

the hospital, and my mother to have a bed, and that's not going to happen if we keep engaging in behaviors that lead to the spread of the virus. >> dr. adams, thanks for your time this morning. >> thank you. >> robin? george, now to those critical senate runoff races heating up in georgia. both seats up for grabs. control of the senate hanging in the balance. president trump and former president obama both rallying supporters, and there was a fierce debate last night as well. steve osunsami has the latest. he's there in atlanta for us. good morning, steve. >> reporter: good morning to you, robin. while the president was here he called for republican state lawmakers to call a special session or do something to overturn the election that he lost. but georgia's governor, brian kemp, a republican, says he's not going to do that because, putting it simply, it's against the law. they're trying to focus on the runoff election coming up in january and the deadline to register to vote in that election is today. to many georgia voters who will decide january 5th if democrats will end up controlling both

houses of congress, the u.s. senate debate sunday evening was a must watch. >> you've just heard radical liberal raphael warnock lie again. >> reporter: like in most of her campaign ads, republican senator kelly loeffler kept calling her opponent who is a baptist preacher, a radical. reverend raphael warnock accused her of cheating on investments while she was in office. >> so she's continued to misrepresent my record. she's lied not only on me but on jesus. >> reporter: loeffler, who is a strong supporter of the president, struggled to give a direct answer when asked who won the election. >> this process is still playing out, and president trump has every right to every legal recourse. >> reporter: in the other senate race, sitting senator david perdue refused to show. so democrat jon ossoff stood on stage alone. >> your senator is refusing to answer questions and debate his opponent because he believes he shouldn't have to. >> reporter: both parties are bringing all their big guns to georgia. president barack obama here virtually for the democrats.

>> georgia is going to determine ultimately the course of the biden presidency. >> reporter: president trump rallied here in person for republicans, but spent most of his time talking about the election that he lost. >> we will still win it. we will still win it. >> reporter: the fact remains that joe biden won this state by about 12,000 votes, and on "this week," the state's republican secretary of state continued to fight back against the president's false claims of a rigged election. >> we've never found systemic fraud, not enough to overturn the election. >> reporter: already a million request for absentee ballots have been filed for the runoff election, a super large number for a runoff. most of those votes are expected to break for democrats. historically republicans do better in runoffs here. robin? >> all right, steve, thank you. we turn to the nfl. some great news for quarterback aaron rodgers throwing 400 touchdown passes in his career,

good morning. i'm reggie aqui from abc7 mornings. four bay area counties are under a stay-at-home order to stop the spread of covid-19. that went in effect in alameda, contra costa and san francisco counties. marin is going to join tomorrow. they're getting ahead of the state's guidance which requires the changes once the region's icu capacity hits 15%. the lockdown is prompting changes that will lost until at least january 4th. no more indoor or outdoor dining and restaurants can only do takeout and delivery. hair and nail salons are also closed and no more indoor religious services. capacity at grocery stores and all stores can only be 20%. wineries and entertainment centers and playgrounds are also closed. hiking trails remain open,

with the mysterious death of tony hsieh, the zappos ceo, who died days after being pulled from a house fire. the cause under investigation as friends of the tech titan speak out with new allegations of increasingly erratic behavior. eva pilgrim has the latest for us. good morning, eva. >> reporter: good morning, robin. yeah, some of hsieh's friends say they knew something was wrong, telling us that they tried to reach out to him by texting or calling, and they were just unable to get through. this morning, new details about the months leading up to the unexpected death of former zappos ceo tony hsieh. >> the downward spiral happened in three months, two, three months. >> reporter: hsieh dying from smoke inhalation after a fire at a home in connecticut. questions now swirling about his death. >> reporting fire in the building. >> reporter: the fire happened in the early morning hours of november 18th. according to police, hsieh was locked inside a storage area at the back of the home when firefighters arrived.

>> the male is barricaded inside and not answering the door. everyone else is outside the house. they're trying to get him to open up. >> reporter: now "the wall street journal" reporting that sources say before hsieh went into that shed, he asked the people in the house to check on him every five minutes. they said tony used a heater in the shed to lower the oxygen level. hsieh was rushed to the hospital with severe injuries before being transferred to a burn center. the cause of the fire still under investigation. >> the biggest question we have working on this case right now is the actual cause of the fire. what transpired inside the room where the fire took place. there was only one person in the room at the time. >> reporter: according to "the wall street journal," after hsieh retired, his drinking increased, and he grappled with the isolation enforced by the pandemic. friends telling "the wall street journal" hsieh began experimenting with drugs such as mushrooms and ecstasy, along with other extreme behaviors like becoming increasingly fascinated with fire and depriving his body of food and oxygen.

friends like the singer jewel trying to intervene. according to "forbes" she sent hsieh a letter writing, i'm going to be blunt. i need to tell you that i don't think you are well and in your right mind. the people you are surrounding yourself with are either ignorant or willing to be complicit in you killing yourself. ♪ somewhere over the rainbow >> reporter: jewel posting this video after hsieh's passing writing, this is my elegy, tony. this is me singing for you. may it find you smiling on the other side of the rainbow. and investigators tell us right now, they are trying to piece together exactly what happened in the hours leading up to his death, interviewing the other people who were in the home at the time that he died. they say they hope that will answer some of these questions surrounding his death. robin? >> hopefully it will but we're

james longman has the details. good morning, james. >> reporter: yeah, good morning, george. the murder of meredith kercher and the trial of her roommate amanda knox gripped the world for months. since then, only one person has remained in jail for that crime until now. this morning, the man convicted in the assault and rape of british exchange student meredith kercher is freed. an italian judge ruling rudy guede can complete the rest of his sentence with community service. he was the only person still serving a sentence, a fast track process resulted in less jail time. he continues to maintain his innocence saying justice has not been done. kercher's roommate amanda knox and her boyfriend raffaele sollecito were found guilty, but their convictions were overturned. >> i continue to this day to be shocked that he is the forgotten killer. the one who was quietly tucked away, convicted of a lesser crime, and does not have to live with the burden of being forever

and at least some bad moral behavior had gone back historically but not necessarily those affairs. >> reporter: in this recording obtained by "the daily mail," hillsong church founder brian houston allegedly revealing a timeline of improper behavior by lentz. >> that staff member had found a very compromising chain of text messages on carl's laptop or computer. >> reporter: lentz was known as a rock star pastor to hillsong, a church previously attended by chris pratt and vanessa hudgens, and followed online by more than 500,000 people. in the end of october hillsong firing lentz citing several reasons including, quote, moral failures. lentz later admitting online that he had been unfaithful in my marriage. janice worked for hillsong for nearly 11 years before leaving in 2017. she says she grew frustrated of how the church began to cater to celebrity culture. >> it kind of overtook everything else and it just

though on a resignation and the church is in the process of negotiating a severance package with her. neither carl lentz nor hillsong church returned our request for a comment on this story. robin? all right, amy. now to a parenting alert about a texas high school student sparking a call for change after he was suspended for that, wearing nail polish. erielle reshef joins us now with what the teen and school district are saying this morning. good morning, erielle. >> reporter: hi, good morning to you, robin. trevor wilkinson says he just wants to be able to express himself and part of that is wearing nail polish. now tens of thousands of people have signed a petition backing him up. this morning, with a freshly painted set of nails -- >> i am a gay male. so i kind of went for a pride theme. >> reporter: -- texas senior trevor wilkinson is fighting back against what he says is his high school's unfair policy against male students wearing nail polish. >> i went into my class and immediately my teacher sent me to the office because she said i broke dress code.

in costume. so i was trying to come up, you know, something sort of like, well, and there's another photo. wow, you just have all the photos. so i decided that i would dress up as a shlutty astronaut and arrived at the party and it was just me, anne roth and meryl streep and no one was in a costume and i was there for about 20 minutes. it was just the three of us and i was in that costume and, yeah, it was pretty rough. eventually people showed up and had costumes on then it was a little bit better but, yeah, that was not, not the best way to meet meryl streep. luckily i don't think she remembered so that's good. >> that's a hard one to forget. let's take a look at a clip of "the prom." >> why you dressed like a waiter? >> i'm in between gigs at the moment. honestly, didi, i feel adrift als i did in my days before

juilliard. >> oh, my gosh. >> you see, my passions are fueled by lady theater and how she can with the gentle touch of her hand sculpt a human soul. >> oh, my goodness. you know, there are so many wonderful performances, dance numbers, you are renowned for your moves, but you said there's one particular move that makes you a little nervous. >> well, yeah, so casey who choreographed "the prom" also choreographed and directed "the book of mormon." when we started rehearsal, he said can you still do that like jazz split thing that you did in "the book of mormon." i said, casey, that was almost ten years ago. i don't know if that -- no, you can do it. so, yeah, i had to work up and i was dancing with children, like i was dancing with like, you know, people from "so you think you can dance" literally and

pepaw was just trying to keep up with the kids. that was a tough couple of days shooting that because they're flipping over things and i was just trying to keep up with them. i was just trying my guess. >> and you did. you did. >> and, andrew, i know that this is actually based on a real-life story from 2010 and speaks to the two americans -- two amer a americas that a lot of people are feeling right now. do you have any advice for anyone who is young out there who wants to come out, feels like maybe they can't or for parents who are dealing with this as well? what is your advice for those families? >> well, i think, you know, coming out is always going to be obviously it's very personal and i think the timing of that is something that you can only do when you're ready to do it. and i think what this film sort of message of this film is even though you might feel like your people are not out there and maybe there is not a support system for you or, you know, maybe you're nervous about are

there going to be people who will accept me and i think that in this film what we -- the characters that james and meryl and nicole and i play, we're out there for emma, and she doesn't necessarily know she has the alliship when she starts to come out, but people are out there and i think that's the important thing to remember is even if you feel like that support system is not in place, there are people who are ready to accept you and love you and be there for you and that's, you know, it's one of the many reasons i'm so proud to be a part of this particular film is that message really resonates with me. if this movie had existed when i was in high school i think i would have felt, you know, very seen and very heard and so i'm happy that, you know, we get to share it now particularly over the holidays, hopefully for a lot of young people, some of whom might be thinking about this very thing. >> right, right, perfect timing

special connection with ben. what was that? >> we share the same birthday. >> oh. >> so very exciting because he had heard his whole life that i was his celebrity counterpart who shared the same birthday as him and then when -- and he knew this. i didn't know it but then when we were on location shooting the movie, we got to be together and what you're seeing now is us sharing our birthday. we got a restaurant, sat outdoors and celebrated with the rest of the cast and it was really very special. >> yeah, speaking of special and celebrating, i'm curious how it felt to be a part of lifetime's first ever rom-com lgbtq style. what did that mean to you? >> well, you know, i'm pretty outspoken as a gay civil liberties activist so for me to

be in a movie that's distinguished in this way, not only makes sense but is a great honor for me. i'm so happy that the networks are beginning to reflect real life instead of creating an idealized world that, you know, isn't really what we are living, and what i love about this movie is that it's -- it doesn't have any angst, it's not about, you know, the hardship of coming out or rejecting parents, it's none of that. this just totally normalizes the fact that i have a son that happens to be gay who i love, you know, dearly and i have a straight son who comes home from the military and i love him too and i fix them both up and my setups end up being much more successful than any matchmaking i've ever done. >> i know lara said you shot

this in canada and had to quarantine when you got there and understand had you a pretty good setup there while quarantining. want to tell us about it? >> yes, you know, i was so freaked out leaving los angeles, i had been, you know, in the house more or less completely for five months and then all of a sudden when lifetime called and said, if you want this part, you know, you have to get on a plane within a week, get your work permit, get your covid negative test, get your dog's travel papers in order and hit the road and then you have to do a two-week quarantine and i said, well, look, if i'm going to be in quarantine i want to be with emily and i knew that my dearest friends donna dixon and dan aykroyd were at their home on a lake near kingston so and that wasn't really that far, maybe it was 90 minutes from the location and the movie company said that would be fine. i never left the property, but it was really delightful to be with my loved ones and then from

there, i had, you know, i felt more relaxed about having left the cocoon of my little nest here in l.a. and once that happened i was like the animal let out of the zoo. it was so liberating. so healthy and so beautiful to be in such a feel-good movie. i mean it's really not about being gay. it's about love is love. it's about feeling good. it's about the holidays, it's about family and i think everybody is going to enjoy it. >> we are going to enjoy seeing you and thank you so very much and the work you do with cancer schmancer. bless your heart. >> i so appreciate you mentioning that. on 12/12 when this movie airs cancer schmancor will have it's fran all day and i hope everybody experiences it. >> we will. thank you, fran. you take care and "the christmas

performing for us in just a moment. first let's welcome shags to "gma." nice to see you. tell us what inspired this new album. >> good morning, it's great. you know what inspired it, being in jamaica in the summer -- in the warm weather. you know, it started with me and sting, we did the disney's special, christmas special last year and we started doing a couple of songs in reggae and one of the songs was like i think we did "silent night" and "little drummer boy" and said wouldn't it be cool to do a christmas reggae album and at the start of the year i played a couple for sting then the pandemic hit. i figured the pandemic would probably last about, i don't know, two months, but then he was stuck in the uk. i was stuck in new york then i ended up going to jamaica getting stuck there and i knew there would be a shaggy christmas album and talked about my experiences on the island.
