no progress or resolution in the case. >> this is not just another one of those days. >> alameda county district attorney nancy o'malley announced charges against 49-year-old david misch who was already in custody. he faces murder charges with two special circumstances. one for murder in the course of a kidnapping and another because he was already convicted of a previous murder. >> the crime shocked not only the local community of hayward and alameda county but the entire bay area and the nation. it was so brazen, so ruthless, but clearly planned. >> o'malley says misch said garrett moved her scooter to the back area of a park, lot. thereby isolating her. investigators received new leads earlier this year. >> we had the opportunity to follow those leads patiently, as misc harx has been in state prison since 1989, convicted of murder. >> he's also awaiting trial for

a double murder committed in fremont in 1986. it was fremont police who alerted hayward police they might want to take a look at misch. he left a partial palm print on garrett's scooter that investigators said had to be compared manually, directly with their own eyes. we asked hayward's police chief if misch might be connected to other missing girls. >> right now, it's wide open, just like we were able to crack this after 32 years, nothing is off the table. >> garrett's body has never been found. the chief said he is hopeful they will find her remains and that it will depend on information they get from misch. melanie woodrow, abc 7 news. >> all right, melanie, thanks so much. mikhaila's mother, sharon, spoke with abc 7 news reporter kate larson a short time ago. she read a heartbreaking statement to kate. > in the last year, i had come to a place of accepting mikhaila was probably no longer alive, but somehow, that acceptance was

far more wrapped up in the idea of mikhaila sitting on fluffy pik clouds walking streets of gold, dancing on grassy hills. soaring among the stars. but i did not envision my daughter as a dead child. it was only when i heard this news that this vision of reality appeared, and i honestly have not figured out what to do with it. that chill set in that had nothing to do with the snow outside my home in southwest iowa. i feel as though i am still looking for cumaila, but now i don't know where. i honestly feel lost in the dark. >> coming up on abc 7 news at 5:00, we'll hear from her father about the arrest as well as the original detective in the case. >> now to developing news with the coronavirus. as california sets more records today. more than 17,000 people are in the hospital because of covid-19. we have seen a new daily high every day since december 9th. for the 18th straight day, the state has set a record for the

number of people in icu. today's count is more than 3600. there were more than 37,000 newly diagnosed cases of coronavirus in the state, which is below the daily average for the past week. here's a look at the current icu capacity for the five regions. the bay area has improved and at 13.7%. northern california is in the best shape at nearly 29%. the sacramento area is at 16.2%, san joaquin valley in southern california, are still out of icu beds. and as cases continue to rise and icu capacity declines, governor newsom says it's very likely some regions could have their stay-at-home orders extended. liz has more on the governor's update. >> with just four days until christmas, california's covid-19 crisis remains as dire as ever. governor newsom today said the state's 14-day test positivity rate is now 12%. two weeks ago, it was 8.7%. hospitalizations also continue to rise, with more than 3600 people currently in icu.

>> 51% increase in admissions as well over a 14-day period. >> the death rate is also climbing. right now, on average, 233 people are dying every day in california from the virus. >> sober, sober reminder of how deadly this disease is. and how tragic a loss of every life is, but particularly those lives that are lost during the holiday season. >> state-wide, the icu capacity is just 2.5%. there's still zero percent capacity in the southern california and san joaquin valley regions and now the state says it's very likely the stay-at-home orders there will be extended. they currently expire at the end of the month. >> at the moment our projections don't show that any of the regions that could first exit the regional stay-at-home order will likely do that. >> newsom also addressed the new strain of covid-19 believed to be spreading in the uk. he says the state is considering strategies to prevent it from

spreading in california, including quarantines for people traveling here from britain. >> i hope the federal government takes action in this space. they should. in the absence of that, we'll be pursuing different strategies on testing and quarantine. >> newsom himself is back in quarantine at home after a staffer he was in contact with tested positive for the virus. >> i'll be here for the next number of days and hopefully we'll keep getting tested negative. >> the good news comes from the vaccine. newsom says the state administered more than 70,000 doses of the vaccine last week, more than 100,000 doses of the moderna vaccine have just arrived. >> moderna vaccine has arrived and that's indeed good news. >> abc 7 news. >> president-elect joe biden received his first dose of the pfizer vaccine in delaware this afternoon. he said he wanted to receive the shot on live television to encourage public confidence in the vaccine. biden is 78 years old and is at risk of a more severe infection. incoming first lady dr. jill

biden received her first dose earlier in the day as well. >> the long awaited rollout of coronavirus has heightened the anticipation of slowing the pandemic. clinical trials will continue to bring more vaccines to market. a bay area company is behind that effort. david louie gives us an inside look. >> bay area based headlands research was involved in the clinical trials for the pfizer and moderna vaccines but their work is far from ov. >> we need hopefully three to four if not more of those to succeed if we're going to really try to get across the whole global population as fast as we can. >> headlands is also working with johnson & johnson and astrazeneca. both pharmaceutical companies have large scale trials under way, possibly involving 30,000 people that will wrap up some time in january and early february. this map shows that most of the trial sites are in the south, and that's important to researchers to have access to patients who come from diverse backgrounds. covid has disproportionately infected and claimed the lives

of members of ethnic and racial minority groups. >> we had 90% latinx population across one of the trials of moderna and in excess of 40% african-american. and that's really important for the trials we get that diversity enrollment. >> such enrollment could address concerns about vaccine safety or their efficacy. as the vaccinations get under way, data will be collected to track granular details such as adverse reactions and which vaccine a patient received and when. this will help with future vaccine development. it's made possible because each vaccine has a tracker. >> you can make sure who's gotten the vaccine, make sure they have a follow-up. a lot of this is done electronically, and when you're trying to vaccinate 320 million people ideally across the united states, you can't really do it on a paper format. >> by the end of the trials. it's estimated as many as 164,000 americans will have participated. david louie, abc 7 news. >> and we spent all last week

the warriors season starts tomorrow, but they're in brooklyn. they invited me to work from home, their home. i think they just got tired of looking at my fireplace in the background. so i'm here actually at center court, making myself very much at home. we're the first to see the warriors' brand-new sideline virtual setup. huge video boards all along the court where fans can check out the game from home. and warriors president rick welts is joining us now. i should mention at the top, we both in order to get in the building had to have a negative covid test and masks are mandatory, but regarding the board, it's so nice of you to bring your tv from home and haul it in here. >> i wish. mine is kind of like this big, but this is going to be a little

>> building a better bay area for a safe and secure future. >> more countries are restricting travel from england and other countries that have reported seeing new strains of the coronavirus. britain imposed strict new lockdown measures saturday night because of what it described as the unusually rapid spread of a new strain there. a few other european countries have confirmed cases of the virus variant, and another strain considered especially infectious has been identified in south africa. >> all right, right now, let's find out more about the new strain with abc 7 news special correspondent dr. patel. dr. patel, we want to talk about the new strain of the virus. first of all, let me ask you this. is it really a surprise? viruses mitate. >> it's not a surprise off the bat, you're correct. virus do mutate. this has been estimated to have one to two mutations per month. the reason this is getting

headlines is it has over a dozen. what has everybody kind of, i don't want to say concerned but paying attention is potential mutations in the spike protines or parts of the virus that make it available to infect people, jump around from person to person, and potentially evade our immune systems. >> but are we seeing any evidence at all yet that this is in fact more transmissible or if you get it, is it deadlier, if you will, more potent? >> now, i know what i said probably evoked a little bit of a fear response in the control room, but there is no evidence that it is more deadly or it's causing more severe disease. there's an early thought that it may be more transmissible, but again, i think it's really important that people don't speculate too early and don't spread ideas that are not yet confirmed. just because this specific strain is being reported in large quantity in the uk, it doesn't give us any data just yet. it's something scientists have to keep an eye on and track closely. >> as you know, some european nations have now banned flights from the uk because of this new

strain. yet dr. fauci today said that may be an overreaction, and that he wouldn't advise against us banning those flights. i know the state is considering it. they're not there yet, but this brought it up as something they were considering. what is your thought on this? >> so many thoughts. foremost, there are a lot of countries banning flights from uk, latvia, argentina, colombia, the list goes on. i do agree with dr. fauci not necessarily in saying i'm against banning flights or telling people not to travel right now, but because that's not necessarily the solution. first of all, this variant could be in other parts of the country. other parts of the world. it is identified in the uk because of what they were doing with pcr testing, but it might be all over the place, and also it doesn't matter what we're doing or saying about flights. if people don't change their behavior, and that's what it comes down to, even if you say, hey, don't fly to the united states, we already have enough surges right now. people need to be following all of the restrictions we keep talking about to keep that down.

it doesn't matter how many strains are circulating, if people aren't taking the right measures, wee not going to get anywhere. >> now that the vaccine is being given out and today, president-elect biden got his very publicly, i want to ask about this. this morning, you tweeted, it's funny how many politicians downplay the virus, not that biden is one of them, and are now rolling up their slievs to get vaccinated. politics gonna politic. or politrick. some are saying, hey, politicians should be getting them because continuity of government, all that. people are voting on the stimulus checks. you want to make sure they're protected. but what do you think? what's the issue here? >> i'm not saying that politicians shouldn't be protected. that's not the point of that satirical tweet. what i'm saying is that it caused a response in the physician community when we saw politicians who downplayed the virus, politicians who even accused doctors of lying about death tolls in order to profit.

that is senator joni ernst who said that. you have marco rubio, lindsey graham, mitch mcconnell, people rolling up their sleeves when for the last nine months where were they? where were they in response to all the rallies where people weren't wearing masks or not speaking out to president trump when he was say downplaying it. the reason this is getting such a response is i personally know plenty of physicians, frontline works, nurses, doctors, in the icu, who have not yet gotten their vaccine in the same states where these politicians have. >> it does seem like in ernst's case, she was not wearing masks and mingling and poo-pooing it as a hoax, i understand what you mean about the public being angry when they're rolling up

i have to say, i just love how relevant e-40 and too short are, because they literally were the soundtrack to my, like, youth. middle school, high school growing up here in the bay area, they were just, you know, awesome. and they still are. so it's just, i don't know, just so great every time i see them because it's like, yeah, they're still out there, still doing good things in the community. i love it. >> well, also, you know, kristen, we talked about the times square situation. here are these two icons in music, and they're putting on a performance and going back and forth against each other, but they're doing it virtually and making it work in an environment where normally you would say, come on, that's not going to work. >> right. >> it can be done. >> we're so used to the virtual now, and we have seen so much creativity from artists, that was amazing. i have to say, jobena, and i mean this in the best way possible, is like an onion. every time you peel away a layer, there's another layer of talent and skill there.

san jose food pantry martha's kitchen has increased 100% this year. while they have met that need, the soup kitchen wanted to do more. south bay journalist dustin dorsey shows us how martha's kitchen is giving back in a new way. >> even in what has been one of the most difficult years for bay area residents, martha's kitchen in san jose continues to give back. this holiday season, they're lending a helping hand to santa claus. >> merry christmas! >> this year we recognized that with covid there's a lot of families that are struggling more so than normal. and a lot of other organizations have reduced or eliminated their toy giveaway programs. so we decided that it was important that somebody step up and fill the void. so we decided to do that. >> volunteers wrapped thousands of toys and handed out the presents for every age group. after two days, 5,000 gifts for given away with another 3,000 more on monday. each wrapped with special care to make sure children in the bay
