diversity. >> i hope that we have greater conversations about what it is really going to take to make sure that communities of color have a seat at the table because quite frankly, we shouldn't be fighting over crumbs like a united states senate seat. >> padilla will take the seat in the senate in january. >> all right. and just moments ago, we found out the name of padilla's replacement. assemblywoman shirly weber will be nominated to fill padilla's seat as secretary of state. the 72-year-old is a retired professor and legislator from san diego. she will be the fourth woman to hold the position and the first ever black woman to be california's secretary of state. we'll dig in a little deeper and see what this appointment means with abc special correspondent at 4:30. today the man accused of kidnapping and killing 9-year-old michaela garrett had his arraignment moved to next month. meanwhile, other law enforcement

agencies are revisiting similar kidnapping cases that have been cold for decades. melanie woodro has that story as well as community reaction. >> reporter: news of david niche's arrest in connection with the 1988 kidnapping is spreading through hayward and reviving memories from that time. >> even after decades, it felt like a relief. >> reporter: simone was 5 years old when garrett went missing. she works here at abc 7 with the 7 on your side team. >> i remember being scared and i remember that fear rippling through all the people, all the kids in my school especially the girls. >> reporter: pher per rents wouldn't let her play outside alone. >> everybody walked their kids to school and picked them up and we didn't leave them outside at all. >> reporter: they were relieved for closure 32 years later. niche is in santa rita jail serving a prior murder conviction awaiting trial for a double-murder committed in fremont in 1986 of friends jennifer and michelle xavier.

other law enforcement agencies including dublin police services are revisiting kidnapping cold cses. eileen was last seen walking home from school in dublin on january 30th, 1999. >> piqued our interest and sparked us to look into this individual to see if there is links in our case. >> reporter: the father hasn't considered the possibility niche could be responsible for his daughter's disappearance. >> most of the times it's just not the same person. >> reporter: every year the family walks eileen's path home from school in her honor but this past april, his wife passed away. >> they can know that i just can't do it this year. it very difficult and about my wife, i don't know how i can do it. >> reporter: dublin police are holding out hope for the family that eileen will still come home. if that's not the case, they want to provide answers and closure just as hayward p.d. did for garrett's family. melanie woodro, abc 7 news.

family and friends pleading for justice in the death of a 6-year-old boy. chase young was shot to death on the fourth of july in bay view. his family says he was watching fireworks with his sister at a birthday party. today jace's sister and friends led a caravan across the bay bridge to bring attention to the unsolved murder and to call for an end to gun violence. >> he was wrongfully murdered. we're just protesting for my brother trying to spread awareness and trying to get justice for jace. >> so sad. billboards have been set up in san francisco in jace's honor. police belief jace was not the target of the shooting. california reported more than 32,000 new diagnosed cases of the cloronavirus today. that's well below the daily average of 44,000. again, the state is setting the wrong kind of records with hospitalizations. the number climbed to close to

18,000 people today with more than 3700 of those in the icu. both are once again single day highs. a quick look at the regional icu capacity. the bay area went down a hair from yesterday and is now at 13.5%. it was 13.7 yesterday. northern california is in the best shape with close to 30% capacity. the sacramento area is at 15 mon15.7%. san joaquin and southern california remain at 0%. to abc 7 news reporter receive nisi ya ra with a play from san francisco officials to stay home and stay safe. >> mayor london breed could not have been more clear today. we're in the most dangerous time of the pandemic and while the last two weeks during the shelter place is showing progress, we know the worst is still ahead of us. >> i don't want to everyone look someone in the eye and say their

loved one is dead because we don't have space in the hospital for them. as you make your choices this holiday, please think about that. think about what you can do to get us through these next few weeks. >> reporter: there are more than 20,000 diagnosed covid cases across san francisco. 173 people are currently hospitalized. sadly, so far, 176 people have died from the virus. and while the pfizer and moderna vaccines give us hope, dr. grant colfax explains cases are still skyrocketing across the city. 275 new covid cases reported each day. the highest seen since the onset of the pandemic. but it's not all bad news. there are signs of progress. >> the pace of increase is slowing down. >> reporter: before the shelter in place went into effect two weeks ago, covid cases were increasing 8% each day. today, they're increasing 2% each day. >> our changes in behavior are starting to show an impact.

>> reporter: to put it in perspective, we know the virus is spreading out of control when the reproductive rate or r number is above one. on december 5th, the reproductive rate was 1.45. on december 20th, the reproductive rate was 1.24. >> as a result of that change, projected peak median hospitalizations decreased from 14 90 to 590. >> reporter: the projected number of deaths went from 544 to 214. >> that is 330 people who are projected to die from covid-19 in san francisco that may not die. >> now, covid cases in san francisco increased by 50% after thanksgiving and as we heard from dr. colfax today, the numbers are very clear. we cannot afford to see that happen again. stephanie sierra, abc 7 news. >> stephanie, before you go, do we know if any hospitals are

invalid. federal law requires retailers to look out for then report suspicious orders to the drug enforcement administration. but the complaint alleges walmart failed to do that. damages for the company could be into the billions of dollars. gift cards are still the payment of choice for scammers. that according to data from the federal trade commission. a quarter of those who report losing money in a scam say they paid with a gift card. not surprising since gift cards have topped the list of payment methods every year since 2018. a reminder no legitimate agency or company will ask you to pay with a gift card. if you've become a victim in such a scam report it to the ftc and local law enforcement. larry, how many times have i reported that someone is being told they have to pay a fine and they need to do it with an itune's card or a visa card? that's not how the world works. once somebody wants a gift card,

so it's official newsom alex padilla to replace kamala harris. the first latino to represent california in the u.s. senate but not everybody is happy about this appointment as we told you. let's check in with san francisco chronicle insider and abc 7 news contributor phil. we heard london breed say this is unfortunate. pretty strong reaction. are you surprised at the tone? >> no, not really. in politics, larry, everybody is your friend until you make a decision and then you're going to make somebody upset. in this case, it was london breed and a number of people who wanted a woman, especially a woman of color to replace harris although, kamala harris came out of support of padilla as did barbara lee. it was unfortunate she would have liked somebody else but gavin picked, you know, he

picked somebody if you follow sports and look at the stats on a player, look at alex padilla's stats. parents were immigrants, he's an mit grad. young member of the los angeles city counsel. state senator. secretary of state moved up the ranks. good friend of gavin's, hey, it's a safe pick and a smart one if you look to bring the latinos into the fold, as well. >> yeah. i guess, you know, devil's advocate if you want to say should barbara lee or karen bass been given more consideration? are they more deserving? >> it's not a question about deserving but what works. this works for gloavin, as well. let's say padilla doesn't have washington experience although he was an aid to senator dianne feinstein. you can say that bass or lee more washington experience but, you know, a senate appointment, the push for the female of color was a national push.

he was somebody that says there is 100 senators, we should have x amount of groups. gavin made a state pick. he picked one of the up and coming groups, latinos. he also picked somebody -- this is where it gets important, too, larry. he picked somebody that has a statewide fund raising and political operation already up and running that got him elected secretary of state because he's going to have to run for senate in two years. he's got something going statewide that can keep him in office and you got to look at that if you're making an appointment because what you don't want is to appoint somebody that gets knocked out in two years. >> sure. the other thing he has going is representation in the latino group demographic is now up to almost 40% of the state's population so this is really big >> it is. the 20% of the votes so that's big for gavin newsom who by the way will be running for reelection at the same time that padilla is running.

as you know, many families are struggling to put food on the table. nonprofits around the bay area are working around the clock to fill the gap in the holiday season. in richmond, the bay area rescue mission handed out 600 boxes of foot to east bay families for the boxes of hope christmas event. the bay area rescue mission held this event for 40 years but this year the need is greater than ever. >> we went from 40,000 meals that we wouldn't be handing out

on a monthly basis to 140,000 meals. this within itself has shown to be one of the greatest needs in our community and our goal is to try to do whatever we can to meet the needs. >> people received boxes of turkeys and ingredients to make their own holiday meal at home. in san jose, the nonprofit hunger at home started distributing meals for families. they are one of 22 organizations working with the city to send out 100,000 meals throug new year's day. volunteers have been working around the clock to meet their goal of sending out 1500 meals per day. and sacred heard community service in san jose is hoping fr more donations for their annual holiday food distribution. the organization plans to handout 3500 boxes filled with turkey, ham and sides. they say more people have shown up needing help since the start of this pandemic. a southern california deputy is giving back to the children's home that took him in as a baby. orange county sheriff deputy josh broad water is leading the

dozens of homes in the fremont neighborhood are keeping a five-decade tradition alive despite the pandemic. east bay community journalist melissa pixcar. we display about 300 painted plywood decorations every year. it now involves over five streets and over 80 homes decorated with unique plywood decorations and holiday lights. christmas place is the neighborhood holiday display and fund-raiser started in the 1960s. on the street cripps place for
