parishioner said to one abc7 news i team reporter stephanie sierra. not one person has gotten it in our church. maybe people need to turn to god so they don't have to worry about these things and walk around with a mask on their face. >> reporter: katy mcdowell is attending a service at cavalry chapel san jose despite the public health order prohibiting it. >> reporter: people are dying from this virus. >> people are dying from suicide. people are dying from throwing themselves off bridges. >> reporter: you don't see you're risking people's lives? >> i'm not risking lives. i'm saving lives. >> reporter: you're saving lives by not wearing a mask and congregating indoors? >> i'm not hurting anybody. if you have a mask on, why you worried about me? >> reporter: san jose cavalry church started receiving violations for offering indoor services in august. it hasn't stopped despite pleas from county health officials. >> the goal has always been that they come into compliance with the health orders, and that they

do so now, because they're putting people's lives at risk. >> reporter: we've made seven attempts with emails and phone calls over the past five days to reach lead pastor mike mcclure for comment before showing up in person to knock on the door. we later spoke to two staffers who told abc7 news pastor mcclure is out of town tonight for christmas eve and the rest of the week. cavalry chapel san jose is facing a slew of violations, some of which are posted on their door after repeatedly hosting indoor service since august. pastor mcclure has previously said he has no intention to shut down his service, and he is even willing to go to jail for it. >> we will continue to be active in doing so. there are real consequences. >> reporter: those consequences aren't cheap. william says aside from legal battles, the church faces more than a million dollars in administrative fines. so far none have been paid. >> we're not going anywhere. then the fines will be collected and they will pay. >> reporter: according to the

the divinity of christ. >> reporter: the father has been holding outdoor masses, but this one is different. >> my message to the parishioners for this christmas season will be one of hope. >> reporter: hope after a traumatic year. >> people have come down with covid-19. but having our faith return has been reassuring to a lot of people. >> reporter: patsy survived covid. her son is still recovering from it after a long battle. >> it was a very -- a big test of our faith because no parent wants to lose their son. >> i believe if i did not have my faith, i don't think i would have survived. >> reporter: the church staff was following protocols, doing temperature checks and spacing out chairs. face masks required for worship. >> we're very happy to be able to offer all this to the community here on this christmas, on this very unique christmas season. >> through my most grievous fault -- >> reporter: with so many friends and family separated

this season, there are christmas wishes for the season. >> i hope for the vaccination soon for everybody. hopefully next year will be a great year and we're back to normal here in the church. >> reporter: meantime, christmas 2020 is here at a time when we need it most. in novato, cornell bernard, abc7 news. >> for days, even weeks we've heard pleas from health officials for families not to do traditional gatherings for christmas. busy airports indicates some lack of compliance. the question is why. after speaking with 3,000 people, researchers at uc berkeley and harvard says it has to do with deep-seated rituals which make it difficult to change our behavior. researchers think public officials need to change their messaging to focus on how distancing and staying home rather for the holidays are in line with the value system that many people actually embrace. >> to rephrase social distancing as a way to celebrate that christian value, to be generous to others, to be kind to others could be a way to get individuals to follow the

regulations. >> on a scale of 1 to 7, 7 being the highest, survey participants ranked their moral outrage to changes in christmas and new year's rituals at 5. one of the toughest rituals to let go of this season is the idea of getting together with friends and family. on our 3:00 p.m. newscast, i spoke live with lane moore. she is a comedian and the author of "how to be alone." she gave some practical advice for how to deal with this time of year. >> i would say that the first thing to do is honor whatever you're feeling. so feel whatever you're feeling. if, you know, there is so much pressure on the holidays that you have to be really happy, you have to feel really hopeful and good, this has been a hard year. it's okay if you don't feel super great. >> one thing she says will help, put on music and dance, even if you're just in your living room with the headphones on. well, it is a holiday tradition that we visit the last-minute shoppers on

christmas eve. abc7 news reporter wayne freedman has a look on the covid risk/reward equation of the season. >> reporter: they might have been under the tree or in a restaurant, but for jason and his extended family, this will do just fine. a wide open table inside the village at corte madera. welcome to the holidays covid style. >> christmas and hanukkah. >> reporter: all together? >> yeah. >> it's extremely worrying. that's why we come on the off hours like this. >> reporter: and on a day like this, the one before christmas, why is everyone out? >> procrastination. apparently. >> reporter: which explains the long lines everywhere outside of target and to this slightly less frenetic but still very busy moment in corte madera. call it the christmas rush with an element of gambling. are you going go home after this? >> after this we're going to go home. >> reporter: when are you going come back out?

>> only when i have to go to work. >> reporter: when is that? >> my next day of work is three days from now. >> reporter: medical experts tell us the surge we're dealing with is a result of last thanksgiving. they're concerned if people behave the same this christmas, we could see another surge, much worse. >> we saw it goes again like we saw at thanksgiving, what we're hearing is hospitals aren't going to be able to manage the case. >> reporter: marin health, with a 125 per 100,000 infection, there could be as many as 5,000 people walking around today with no knowledge that they carry the virus. and a worst case scenario, marin could see one thousand new cases a day within two weeks. >> we're seeing hospitals across the state now running out of icu beds. that's a real concern. >> reporter: if you do go shopping, dr. willis says look for stores that follow the rules and make people wait outside and that limit the numbers inside. >> as soon as we hit four people, we immediately close that door. >> reporter: call that a covid

of new cases appears to be at a plateau, and the seven-day average positivity race is going down. when we narrow the scope to cases in the bay area, you can see that we seem to have turned a corner from the steady increase of cases that's been going on for months. all right. getting to the weather now. hard to believe we're on what, storm watch now and christmas weekend? of all days, but we certainly need it, dan. >> we do, desperately actually. abc7 news meteorologist sandhya patel is tracking the rain for us. sandhya? >> that's right, dan and dion. we have two storms coming our way for this holiday week. let's take a look here. they're light storms. the first one is right here. and here is our second one. all right. the difference between the two, the first one coming in for christmas is going to be a fast-mover. for christmas going into saturday morning, light to moderate rain, gusty southerly winds. we're expecting spotty early morning showers on saturday. as you take a look at the hourly forecast, 1:00 tomorrow afternoon, rain is up in the north bay.

there won't be any help for the holidays as the coronavirus relief bill remains in limbo. president trump demanded that the stimulus checks be increased from $600 to $2,000, and refused to sign it earlier this week. congress did not advance a measure today, so house speaker nancy pelosi is planning to introduce a stand alone bill on monday to bump up the amount of money in the checks. some americans are echoing what the president says, saying $600 just isn't enough to get by. >> millions of americans have been waiting for some type of relief for a long, long time. and some people have lost their jobs. >> the president has also put a spending bill on hold. if he doesn't sign it, the government could shut down on tuesday. he also vetoed a defense policy bill, but there is enough support in congress so congress could potentially override it.

president trump and first lady melania trump host posted a christmas message to twitter today, bearing in mind how different this year is because of the coronavirus, and they struck an upbeat tone. >> courageous first responders, doctors and nurses have given everything to save lives. brilliant scientists have developed treatments and vaccines. >> we are delivering millions of doses of safe and effective vaccine that will soon end this terrible pandemic and save millions and millions of lives. we're grateful for all of the scientists, researchers, manufacturing workers, and service members who have worked tirelessly to make this breakthrough possible. it is truly a christmas miracle. >> now president-elect joe biden used a different tactic for his christmas message. he doesn't appear in it at all. ♪

been called off. abc7 news reporter anser hassan has the story. >> reporter: the big announcement came on facebook. greg sarris wrote graton resort and casino will close at 5:00 p.m. on 12/31 for all activities. all parties and gatherings on new year's eve have been canceled. the casino will reopen on 1/1/21 at 6:00 a.m. sarris would not comment on why the event was canceled, only saying that they continue to work closely with the county and that graton resort and casino will remain open on a limited basis and continues to exceed all cdc safety requirements. large indoor gatherings are not allowed in sonoma due to the pndemic, but casino owner, the federated indians of graton rancheria is a sovereign nation and is not subject to local public health orders. sonoma county officials may not have in been in support of the big bash, but did praise the

>> dan, you know what? i think you'll be just fine, especially if you start really early in the morning. >> oh, boy, okay. >> you might have the dry conditions where you are, dan and dion. right now on christmas eve here we have a beautiful night. san jose camera shows you the view right now. we do have gentle winds. and just some clouds passing through the region. here is a look at the forecast. wet and breezy for your christmas. lingering showers saturday morning, and a colder storm arrives on sunday night. let's take a look at your christmas planner. so for those of you getting on the scooters like dan, 7:00 a.m. just clouds and fog. 40s, 50s. at noontime showers will be developing. it gets breezy. breezy to gusty at 4:00 p.m. rain spreads. and in the evening we will see scattered showers. hopefully you'll get a chance to stay indoors and just enjoy your time with your loved ones. live doppler 7 showing you two storms that are developing over the pacific. right now the rain with the weak system ahead of those two storms is in southern california. they didn't get a lot. but it is enough to at least dampen some of the roadways down

there. live doppler 7 locally showing you some cloud cover that will be increasing as we go into tomorrow. temperatures right now 40s, 50s. level 1 system for christmas going into saturday morning on our storm impact scale. exclusive to the bay area, light to moderate rain. we are expecting gusty southerly winds and spotty showers early saturday. you get a break before the next system comes in. so 9:00 tomorrow morning, mendocino county you're starting to see a few showers. nothing major. 2:00, that storm is actually right over the north bay, getting them wet. approaching the coastline. as we head into the evening hours at 5:30, most areas should start to see some rain. it is not going to be a big soaker, but just enough to where we get beneficial rainfall here in the bay area. scattered showers friday night at 10:00 p.m., going into tomorrow. saturday morning, excuse me. and then it winds down for the afternoon and into the evening. in terms of rainfall, because it's going to be a quick mover, we're looking at anywhere from a tenth of an inch in san jose to about a half an inch around

santa rosa. a little more than in cloverdale, and a little north of that. temperatures first thing in the morning upper 30s to the upper 40s. in case you do have to run any last-minute errands or you just want to get out for a walk, we do have clouds in the forecast tomorrow morning. you'll need the umbrellas if you're heading thought the afternoon. and if you're driving give yourself plenty of time to get where you need to go. mid 50s to low 60s. starting to get wet across the region, and the rain just spreads friday evening across the entire bay area. so here is your accuweather seven-day forecast. christmas rain followed by morning showers saturday. both level 1. and then we go into sunday, monday. so two storms. that sunday storm is a cold one with scattered showers into monday and drying out tuesday, wednesday. on thursday, which is christmas eve, there is a chance of seeing some showers again going into 2021. can you guys believe that, dan and dion? >> i can't believe i'm going to see dan on a unicycle soon. >> oh, it's a unicycle. >> was it a scooter or a

building a better bay area for a safe and secure future. this is abc7 news. >> tonight an abc7 news i-team exclusive. a former vallejo police department captain is speaking out. >> captain john whitney claims in a new lawsuit he was fired for whistle blowing, including raising allegations of officers bending their badges to commemorate their involvement in shootings. he spoke to abc7 news i-team reporter melanie woodrow. >> reporter: former vallejo police department cam tain claims he was fired for reporting unethical and corrupt behavior within the vallejo police department. >> officers were not held accountable. >> reporter: the allegations are outlined in a new lawsuit whitney is bringing against the city police department, former

chiefs alio and andrew perdue along with city manager. in the complaint whitney complains in february of 2019 two department firearms instructors alerted him that officer ryan mcmahon, seen here in a deposition vito had embedded the words veritas, the latin words meaning truth and justice. >> what could it mean to him? does he believe he is invoking justice upon the community? and that's certainly a concern. >> reporter: in an email statement, mcmahon's attorney tells the department the inscription is directly related to officer mcmahon's roman catholic faith. also, the matter was investigated by the vallejo police department and interim chief allio determined that officer mcmahon had not violated department policy. according to his lawsuit, whitney reported it up the chain of command and advocated an internal investigation be conducted mcmahon was placed on might have leave and required to surrender his badge. >> the internal affairs sergeant had discovered that his badge

was not sitting flush on the table and brought it to my attention and chief purdue's attention. and what we discovered is that the two points on the badge had been bent. and the sergeant went back and talked to officer mcmahon and was told that the bends were as a result of another officer bending them. and it was done because he had been in two officer-involved shootings. officers were bending their badges to commemorate when they were in an officer-involved shooting. >> reporter: captain whitney claims he insisted chief perdue conduct an internal investigation into badge bending, but chief perdue refused. instead, whitney says the chief had him instruct sergeant, lieutenants and captains to collect and turn in all bent badges. he says approximately ten were collected. >> chief perdue told me to get the badges returned to the officers and have them all repair them themselves and pay for the repairs themselves.

he was afraid that if the badges had been returned to the badge repair company or the badge-making company that it would generate a bill that finance would see and there would be questions about why so many badges had to be repaired. >> reporter: mcmahon's attorney would not address allegations of badge bending. whitney also alleges while serving as acting police chief when chief perdue was on vacation, he told city manager what he heard supervisors were doing the night officers shot and killed willie mccoy at a taco bell drive-through. >> supervisors were apparently in the police department watching netflix, both supervisors. >> reporter: whitney says he sent the information to chief perdue. he did not want an investigation conducted because it would add further liability to the department for the failure to supervisor. >> reporter: officer ryan mcmahon was one of the officers who fired his gun that night on september 30th of this year. current vallejo police department chief williams fired

mcmahon for engaging in unsafe conduct and neglect for firearm safety. while dpd would not provide more detail, a civil rights attorney for mccoy's family what said mcmahon was let go because there was another officer in his line of fire during the shooting. whitney's lawsuit outlines allegations of additional mismanagement he says he reported, including the chief allegedly changing the 2017 sergeant's promotional exam to benefit police officers association president matt mustard. >> had the original waits stayed, i don't believe he would have promoted at that time. >> reporter: mustard was the lead detective on the denise huskins kidnapping case vallejo police mistakenly called a hoax. he was in the room when chief perdue allegedly instructed kenny park before this now infamous prison conference. >> the fact that we've essentially wasted all of these resources for really nothing is upsetting. >> chief perdue told the lieutenant to burn that [ bleep ].

>> reporter: huskins recorded this exclusive skm statement for abc7 news. >> i guess in their eyes if you're a woman, you're another [ bleep ] to burn. if you're a person of color, you're another criminal to kill. it's horrific and the community of vallejo deserves better. >> reporter: according to whitney's lawsuit, within weeks of reporting mismanagement to the city manager and mayor, chief purdue ordered an investigation into captain whitney. his lieutenant says whitney was fired in august of 2019 for resetting his department cell phone before turning it in for inspection. >> we have evidence that his phone was used to access several of captain whitney's personal account after it had been surrendered to the vallejo police department. if the data on his phone had been deleted as they allege, that would have been impossible. >> reporter: whitney believes the department terminated him because he was a whistle-blower. >> i was doing everything i could to make the police department a better place. >> reporter: a spokesperson says whitney and his family have not

served the city with a civil lawsuit yet. in an emailed statement, the spokesperson tells i-team in part mr. whitney did not raise badge bending claims or allegations relating to pd staff watching netflix on duty in either his tort claim or in the administrative hearing provided to him. in addition, mr. whitney never filed any whistle blowing complaints with the city during his employment. chief williams launched a third party independent investigation in allegations of badge bending by vallejo police officers after saying the city received statements from two different sources within the vallejo department saying that badge bending occurred. the department did not respond on the status of the investigation or attempted allegations. i attempted to reach chief perdue for comment but did not hear back from him. melanie woodrow, abc7 news. >> you can find all of our investigative stories and share them with your friends. they are all at abc7news.com/i-team. moving on now, a gruesome

head-on crash took the life of one person along highway 121 just north of sonoma valley airport. terrible on this christmas eve. the crash happened around 9:00 this morning when one of the vehicles crossed the center divide. you can see the extend of the damage to both vehicles. one person died at the scene. the other was taken to the hospital. investigators have not determined what caused this terrible crash. then there is this. the aftermath of a collision between a car and an amtrak train in fremont. this all happened at the western end of stevenson boulevard. 42 people aboard the train, they were not injured, thank goodness. no one inside the abandoned car. that train was heading northbound from san jose. so far no word yet on how the vehicle got on to the tracks. coming up next, a sneak peak at an abc7 originals. meet a group bui

>> you notice this no snitch culture, which i agree with. you don't want to be in other peple's business. but in oakland, we've taken it too far, y'all. we need to have a space where we get into each other's business, where we ask each other, man, how are you doing? we need to be nosy like that, because if not, we're going to turn around one day and no one is going to be there. tribe really got started through youth work, seeing that youth really needed a place to go, but more, they needed people to invest in them. i see the need. i see the struggle. so me and basically some youth and some other parents got together and we said we really need to do something in the community. and as we were working, you know, whether it's through working through a church, working through other nonprofits, working through the city, working through oakland

parks and rec, we found that was what was needed was really to build something that people can feel a part of, home, that can exist apart from funding from the government, exist apart of family breaks down. just be there continually through all of life challenges from birth to death. i don't want to see any more death in this city. we're trying to bring life. >> it's my heart, really. i come from being here for more than 15 years. and from starting off hoping, being in the streets and having a way that they like was there to comfort me in times. and it's all about being family. that's what tribe is about. and it's bringing more life to me as i give back to my community that i struggle from and grew up in. you know, just loving what we do for the people here. >> try my best to help people to get back. so it's been teaching me how to do that as well. it's a good cause. i've been grateful to be a part of it.

>> i've been laid up from restaurant. we've been there for 17 years. this pandemic really kill us. and i saw for a long time. so they asked for help. and i love what i do right now. i'm helping people, which is what i really love to do. >> you see one of the issues that we have nowadays is people talking about it but not being about it. and with social media out there, it's just -- and the media in general, it's just too much where things are played to the camera and things are played to words rather than actually getting out there in the streets. right now we have a county program that is funding us through the c.a.r.e.s. act, but that funding ends on 12/31/20. we're all calling it the cliff. but after 12/31 on january 1, people still need jobs and there will still be hunger out there. we are fearful of that cliff and we're working our darnedness

just off our coastline. right now we have some clouds just gathering ahead of the storm system. we will see some changes. so tomorrow we are looking at showers developing as we head towards early afternoon in the north bay. by mid afternoon, it's spreading across the central bay. and at nighttime, some of those showers will move into the south bay. it's a quick-moving system. it will bring some snow to the mountains. winter storm warning in effect for the sierra 4:00 p.m. tomorrow until 4:00 p.m. saturday. up to two feet for the highest peaks, but that warning is for the 5500 foot level. travel will be difficult. probably best not to go anyways with covid. tomorrow afternoon temperatures upper 40s to the low 60s. make sure you have your rain gear if you are stepping out. accuweather seven-day forecast. we have a delivery of red cross rain for mother nature. a level one storm for friday going into early saturday. colder storm sunday going into monday. and then the possibility of one more before this year is over on new year's eve. so dion and dan, we'll take any storms we can get right now.
