temperatures are milder in san francisco, mainly in the 40s. we'll hang out in the 50s, mid 50s at noon, upper 50s at 4:00. near 50 at 7:00. we had an earthquake here. here is jobina with more. >> i felt like most people did feel it except myself and one other person in here. a 3.6 magnitude earthquake struck near muir beach. people across the bay area felt it including many of us at the station. we have not heard reports of damage. that's good news there. the now, as reggie would say, don't start none, won't be none. so this new year's eve in san francisco, put the fireworks done. party by yourself. abc7 news reporter amy hollyfield is live from the embarcadero and officials are saying no, good-bye. >> they're saying stay home. officials will work hard today to get that message out. they'll be pushing the word to

stay home, to not come out tonight. so, yes, take a look at the video of last year's fireworks show. that's all you will see this year, file video. they will cancel this show. do not come to the embarcadero. stay home. there will not be a fireworks show. they will shut down other parts of the city as well. in golden state park, they will turn off the holiday lights. they'll block all the parking lots to discourage people from gathering. ocean beach and stern grove will be closed. and b.a.r.t. will make sure there are no rides home at midnight. they usually expand hours on new year's eve. tonight the trains will stop running at 9:00. officials will also be reminding people not to set off fireworks. it's illegal in san francisco. you shouldn't be able to buy them here and you can't set them off here. the big message they will be pushing today is to stay home, celebrate with the people you

an isolated case. san diego county health officials say another person who lived with that patient showed symptoms and got tested yesterday. icu capacity has dipped now to 7.5% in the bay area. that's the lowest we've ever reported. the southern california and san joaquin valley regions are both at zero percent capacity. governor newsom pointed out zero percent does not mean there are no beds available, but that we're in a surge phase. governor newsom revealed a plan to reopen california schools for in-person instruction as soon as february. >> distance learning will still remain an option for parents and students. there's a lot of trepidation, we recognize that, a lot of anxiety about going back into the classroom. >> the plan includes $2 billion in funding. young elementary students and students with special needs come back first. the plan calls for increased covid testing and school staff and students would be required to wear masks.

the fines are piling up for a danville restaurant. the place has been getting cited for the past 13 days because they're still offering outdoor dining. the restaurant owner says he is staying open to help his employees. >> reporter: each night gabe moufarrej opens his restaurant he faces another $1,000 fine. >> the reason we are open because we have about 25 to 30 employees and we cannot send them home without a paycheck.

>> reporter: incontro is open for outdoor dining in violation of a covid-19 health order. he says if he closes his employees suffer. some of them have already run out of unemployment benefits. >> these people have mortgages, rent, car payments, little kids, it's cruel to do this. >> reporter: he says he's not trying to make a political statement. he knows covid-19 is real. he spent $45,000 in upgrades to become covid compliant. he says take-out alone is not enough. he's breaking even with outdoor dining. some locals say if social distancing guidelines are followed they support the restaurant staying open. >> i pay a lot of money to come to danville, there's some excellent restaurants here. >> the police chief said he reviewed the health order with the city attorney and county lawmakers. >> we realize this is hard. it's hard when the rules change as rapidly as they are. >> this is not the time to be fooling around. we're at the home stretch.

we have the vaccine. >> reporter: candice anderson admits it's been a tough year for small businesses and says other restaurants are following the rules, and anderson says one danville restaurant is at risk of being shut down. >> it's potentially a real possibility that they will be shut down by our environmental health division. >> reporter: in danville, anser hassan, abc7 news. the cliff house restaurant is set to close permanently after 157 years. on instagram and facebook the long-time proprietors announced the cliff house sign will be taken down at noon today. they say after days of negotiations with the national park service, talks fell apart. the nps said it offered the concessionaries a new 3 1/2 year term to keep the restaurant open but the proprietors did not accept the offer. the existing concession contract expires today. childrens fairly land in oakland will remain closed until

now to the latest on the pandemic. california has shattered its record for covid deaths. 432 people died just yesterday. a total of more than 25,000 californians have died from the visit. progress is being made in vaccinations. more than 300,000 doses of the moderna and pfizer vaccines have been administered statewide. we are learning new details about that second confirmed case of the new coronavirus variant discovered in the u.s. averi harper has that and a grim new warning from the cdc about what they expect next month. >> reporter: the second confirmed case of the more contagious variant of covid-19 has been found in southern california's san diego county. health officials there trying to determine where the 30-year-old patient got it and how many more people could be infected. >> because there is no travel history, we believe this is not an isolated case. >> reporter: the first confirmed case discovered in colorado and another suspected one found in

members of the national guard deployed to help a nursing home amid the outbreak of the coronavirus. >> we do not have evidence that the variant virus is circulating in that facility, but testing is ongoing. >> reporter: health experts say the mutation is not more deadly and vaccines should still be effective against it. but the pace of vaccinations is still far behind expectations. >> that number is lower than what we hoped for. >> the trump administration pledged 20 million vaccinations by the end of the year. so far 14 million have been distributed and only 2.5 million doses administered. the president blaming the states for the slow rollout tweeting they need to get moving. there are fears the death toll will only worsen as we enter the new year. the cdc is predicting that deaths could reach 424,000 by january 23rd. averi harper, abc news, washington. federal and state health officials admit the number of covid-19 vaccinations is below what was initially promised.

tens of millions of doses were promised to be delivered nationwide by the end of december, we are here now and those numbers have fallen short, including in the state of california. the surgeon general dr. jerome adams talked about that this morning on "gma." >> from a federal perspective we are on track to have 20 million people able to be vaccinated, doses on the ground by the end of next week as general perna said. we're on track from that perspective and have to help the state even local entities to get the vaccines administered and into bodies and arms. >> the surgeon general talked about the new variant of coronavirus. >> take any worry you have and understand the vaccines still look like they're going to work and talked to dr. collins and fauci about it as recently as yesterday. a more contagious variant means it's more critical we follow basic health measures, wash your hands, wear a mask, watch your distance and wait to gather.

some 40s around the usual spots, san francisco, san rafael, richmond, oakland, san mateo and half moon bay. high pressure is pushing the next storm to the north. a few high clouds will blow off. when i say a parade of storms, swirls of low pressure lining up in the eastern and central pacific. that's why we get a break today, during the day tomorrow. tomorrow night all the way through wednesday we have either a 1 or a 2 on the storm impact scale. because they're light, they're nice, they won't soak in. hydroplaning could be an issue and some spinouts in the morning like we've been seeing this morning. happy new year, be safe tonight. not a good start for the california snow pack. a team from the california water resources conducted their first survey of the season yesterday. this is at phillip's station. the numbers there were good. 30.5 inches of snow with a water equivalent of 10.5 inches. however statewide the snow pack is just 52% of average for this
