large black letters spray painted on the wall. city staff started painting over the graffiti today. yesterday the iconic sign was removed. delays by the national park service reaching a long-term operating contract forced them to close. a napa restaurant defied the stay-at-home order offering in-person dining on their patio. the state is investigating, matt boone. >> reporter: they have been welcoming guests on their patio as well as a semi-closed area

after the county went into the stay-at-home order on december 18th. >> i am still working full-time. i am willing to spend my money to help other people out. >> reporter: phillip, a customer does not want to show his face due to his job, he came to dine in person to support the restaurant's employees. >> i am willing to risk possibly getting it to help other people survive. >> reporter: napa county had 5,471 positive cases and 2400 of them were in the last month. their icu capacity is at 0%. they defied the in-door ban back then. he did not want to do an interview for this story but gave a staple. for." fume bistro will remain open. the city of napa tells abc7 are aware of the restaurant and referred the complaints to the task force as well as alcohol beverage control. matt boone. abc7 news. fitness 19 staying open in-doors have closed down. the gym says san mateo county fined them $3,000 twice and promise to issue more fines if they continue to stay open. fitness 19 says they'll reopen once restrictions are lifted. california started 2021 of by setting more coronavirus records. the state recorded 585 deaths. the previous high was 432. the number of people hospitalized dropped by 100.

the number of people in the icu is up to more than 4500. that's a new record. take a look at regional capacity statewide. the bay area dropped to 6.3%, a record low since tracking started. the nation's death toll is pushing past 347,000. tonight "the new york times" reports the new variant of coronavirus detected in 33 countries. abc reporter has more on the virus. >> reporter: despite health warnings, the u.s. is entering 2021 with peak covid numbers and a new variant of the virus is highly contagious. florida became the third state to identify the u.k. variant with a man in his 20 with no history of travel. california has four cases. >> it was inevitable that it is going to be here.

you will be hearing about reports of other states and more cases in the states that already reported. >> reporter: the crisis is more dire in california. los angeles are seeing four times cases than in december. 585 deaths in just 24 hours. hospital and healthcas and heals are pushed to the brink. >> it is unimaginable. we are begging you, please stay home. >> reporter: illinois, north carolina, emergency field hospitals going up for the first time. with the brunt of vaccines falling on large hospitals, small clinics and private pharmacy chains, states have used small percentages of their stockpiles. the 20 million promised by the trump administration by the new year of vaccines. if the pace don't pick up, some pfizer doses can expire while sitting in freezers. >> this is a national emergency,

comment on it since. any time police kill a person who's not armed, the state attorney general must investigate. the grant's case would be an example. police are no longer to use carotid restraints or choke holds. the first law of its kind in the nation and the task force will make recommendations. there are significant changes come to the real estate market this year. the first is in february. those inherit a home must use it as their primary resident or the tax values get reassessed. those lost their homes in a disaster would be able to transfer their tax assessment to another home even if it is more expensive. you can find a list of new laws

lose our tax deduction. when she's born at 12:20, she will be the first baby in town. baby vanessa is dr. vanessa walker. she's at the frontline of the coronavirus pandemic. >> i was born a critical care doctor. her mother was an icu nurse and her father still works as a respiratory therapist. though 2020 has delivered unparallel challenges. she says there are still so much to be grateful for. >> i get to ring in the new year, i am here and alive and i am healthy. >> this year she will spend her birthday working 15 hours shift in the icu and reflecting. she says 2020 marks a year of learning and being able to be on the cutting edge of treating a new disease that nobody knew about. >> and a year of triumphs. seeing all the things we have been able to do coming together in science has been amazing.

now back here in the bay area, families welcomed new members at the stroke of midnight. meet jack and his parents, he was born at 12:06 a.m. >> oh, she's the first baby of the new year in the bay area. abc7 news spoke with the proud parents this afternoon. >> so went in for a c-section around 11:50. >> i remember getting the count down and it struck midnight and said happy new year to everybody. >> 12:06. >> i was getting the c-section and i heard them say happy new year. >> she went into get induced on december 30th and 36 hours later when it was not going quite as expected, she had a c-section. this is the couple's first

here in the bay area. and we started it 2012, and it started out as a way to bring the community together and make lunches to feed the homeless. and from that, to this idea of trying to create job employment through training programs in the fashion industry and then keeping the industry alive and creating jobs in the industry that also don't want to see die down in the bay area. so through the nonprofit, i also launched a manufacturer because i realized that in order to keep the industry alive, we needed to also have a place to directly employ people and offer these services. i opened up d.a.d. sewing house, and we have a full-service design studio, as well as a sewing manufacturer, which we do all in-house. >> designing a difference is helping this community in so many ways. she's employing a lot of people right now, she has been employing a lot of people throughout this whole pandemic. when most people were laying people off, she was finding new ways to keep people employed, coming up with projects. she really wanted to keep people

employed, because they have families, too. >> i've been in the fashion industry for -- i guess about 2010 and just started doing my own designs. i started with bathing suits, started with a little streetwear. and then i transitioned into the manufacturing side, just because i saw that there was a need and there was really nowhere to get manufacturing work other than maybe l.a. or internationally. so then i decided to -- that i didn't want to see it disappear, and i had to be part of the change and opened up a sewing house. ♪ this is our eighth year coming together. usually, we gather in person, but this is our first year hosting a virtual event. and the people that are here today are just the actual contributors, the partners of the items that we're contributing today. but we're encouraging everybody from all over the bay area to join in our efforts and make care packages to contribute to the homeless community. >> right now, we're all
