stay-at-home order hinges on icu capacity. right now it's at 8% in the bay area, and the deadline to climb up to 15% is at the end of this week, or the order will continue. now, many business owners in san francisco are hoping city officials intervene, citing an increase in burglaries citywide during the closures. as abc7 news reporter luz pena joins us live now, luz, many are having to pay for damages during this already tough time. >> reporter: that's right, dion. tonight i spoke to several business owners who are blaming the indefinite stay-at-home order implemented by city officials as the free pass for crime to rise. it's a foggy night, and the only lights shining bright on this side of the embarcadero are coming from inside epic state and water bar restaurants. the managing partner says those lights are necessary after their last break-in. >> a whole bunch of outdoor heaters that were attached to umbrellas that all got vandalized and some of them

stolen. at epic, we actual will had a break-in. >> reporter: graffiti on this wall marks the night they realized this burglary will cost them close to $10,000 in damages. another setback to add to the bill. this was a month ago when they were open. >> we're losing about $50,000 per restaurant per month. >> reporter: epic steak is not alone. just a day ago, a wine bar on polk street woke up to this. thieves tried to break in. the owner says the noise woke up neighbors, who called police. >> that's one of the consequences of the shutdown in the city is that nobody's around. >> reporter: the latest data from the san francisco police department shows that burglaries have gone up 47% from 2019 to 2020. but it's still unclear how many of those cases have been businesses. >> now people are starting to

see their insurance premiums go up. >> reporter: president of san francisco's business commission is urging city officials to take notice and respond before it's too late. >> small businesses are being asked to shoulder the burden of protecting the public health, and they're incurring all of the cost of that burden. >> reporter: business owners are asking for city officials and the federal government to increase aid specially under the current indefinite stay-at-hoe order, some telling me they don't know how much longer they can survive this. in the newsroom, luz pena, abc7 news. >> it is a dire situation. luz, many thanks. now, the pandemic is causing massive wait times at santa clara county hospitals. the santa clara public health department says ambulances have waited up to seven hours to get a patient into the emergency department. while ambulances wait, emts are unable to respond to other emergencies, and the fire department has served as a backup six times. on saturday, 689 people in the

county were taken to the hospital. new details now on a covid-19 outbreak among kaiser permanente employees at its san jose emergency department. the number of people affected increased by one today to 44. kaiser is investigating whether an air powered christmas costume worn by a staff member on christmas day may be to blame for that outbreak. kaiser says that staff member was not showing any symptoms. the emergency department is undergoing a deep cleaning and contact tracing is under way. rain is returning to the bay area as we close out the first weekend of the year. taking a live look from our sutro tower camera showing some wisps of fog still lingering over san francisco tonight. abc7 news meteorologist drew tuma tracking the storm that is moving in. and, drew, you say monday is going to be wet. >> yeah. tomorrow morning, dion, it's going to be wet and windy. live doppler 7 showing we have light rain in the north bay

developments. j.r., what a tragedy. >> reporter: it certainly is, and it certainly was, dion. i spoke with this grieving mother in japan, whose 27-year-old daughter died on new year's eve. so many questions tonight about how the suspect was still on the streets, but the mother says her focus is remembering her daughter. a grieving mother wiping away her tears from her home in japan as she talks about the memory of her daughter, hanako, one of two people killed as she walked in a crosswalk in the soma district of san francisco on new year's eve. >> i'm actually shaking right now, still talking about and thinking about what happened. >> reporter: that from han a's close friend in tokyo. currently as the memorial for hana grows in san francisco, this man, 45-year-old troy mcalester, is behind bars in connection with hana and another woman's death. police believe mcallister, who is on parole for robbery, was trying to make a get away, crashed into another car, and

that car hit and killed hana and another woman. there are questions as to why mcallister wasn't behind bars due to his past crimes, but family and friends are focused on han a'sa's memory. >> the main thing that she wants to tell everyone about hanako is that even when she came across some adversities in her life or on some difficult days, she would still always smile. >> it's very hard to come to terms that something like this could have happen to such a wonderful person. she's always made time for her friends and she did not deserve this. and no one deserves to have died like this. >> reporter: san francisco's district attorney, chesa boudin, says sfpd did not notify parole in mcallister's most recent arrest, and daly city police did not arrest mcallister after receiving a report that he may have stolen a car. they also didn't contact parole according to the d.a. the state says they followed

procedures and that no criminal charges were filed by the district attorney. han a's mom gave her thoughts on the suspect. >> hana was a person who always wished for everyone to be happy, and if it was her, she would like this person -- this person who did this to become happy as well, to lead a happy life. >> reporter: heartbreaking story here. friends are hopeful that people can continue leaving flowers at the site where this accident happened, on second and mission in san francisco. they have already raised more than $60,000 so that han a's family can come to the u.s. to bring her body back to japan, where she will be laid to rest. j.r. stone, abc7 news. >> we appreciate your hard work on this story, j.r. that number undoubtedly will grow in the continuing days. on the heels of this deadly hit-and-run, there is a petition to recall san francisco district attorney chesa boudin.

targeted shooting. protesters are calling for vacaville police to fire the officer caught on video punching his k-9 partner. a warning, this video may be disturbing to watch. video shows the officer sitting on and even punching the police dog. vacaville police say the k-9 was not returning a toy and then got aggressive, which prompted the officer's violent response. protesters today called on the department to take action against that officer. >> police dogs are police officers, and if one cop is beating up another cop, he should be fired. >> any other time an officer would have been put on leave right away. >> but the city says the investigation is still in progress. >> the city of vacaville making any excuses. we're not justifying any behavior, but we are investigating the incident thoroughly to make sure that whatever changes are necessary, that we're going to make those changes to make sure nothing like this happens again. >> vacaville police say the k-9 has been taken away from the officer, but that officer is

still working. people are having their accounts suspends as california's unemployment department cracks down on suspected fraud. the edd send out a tweet this morning saying it's halting payments on claiming it considers high-risk. account holders are being notified and will need to verify their identity to have their accounts unfrozen. our 7 on your side team has been investigating the numerous problems that have plagued the edd during the pandemic. you can watch our continuing coverage at abc7news.com/7onyourside. once again kicking it over to meteorologist drew tuma with more on this impending rain. hi, drew. >> hi, dion. we're seeing some light rain right now, and we do anticipate heavier showers moving in tomorrow morning. so live doppler 7, we've got green on the screen. we're going to zoom in to a couple locations. first we'll press in close to the north bay right now, where from healdsburg, santa rosa, napa, novato, san rafael, we have some light rain. but you do notice in the east

bay around hercules, we do have a quick-moving downpour pushing off to the east right now. we'll slide south. san francisco, some very fine mist. oakland some light showers. same story around concord and san ramon. as we go farther to the south, it's mainly dry right now around the south bay, but these showers, they will fill in over the next 12 hours. so tomorrow morning we will all get some rain out of this storm system. we do have a high surf advisory along our coastline where we could see large breakers up to 30 feet. this high surf advisory will last until 11:00 p.m. tuesday. temperatures right now, we're mainly in the upper 40s to lower 50s. with this cloud cover overhead and these showers moving through, numbers pretty much going to stay where they are overnight tonight. so tonight we'll maybe drop one or two degrees from our current temperatures, but the bigger story is the rain that is going to be moving through. so on the storm impact scale, it's a level 2 moderate storm we

are tracking here tomorrow morning with showers and some pockets of heavier rain. gusty winds as well as that front moves through. there's the chance for some thunder. so future weather, early tomorrow morning, about 4:30 in the morning, mainly some light rain in the north bay. then close to sunrise, we'll begin to see more of those downpours develop along that cold front. later in the morning, we'll start to see those showers slide south, so it's later in the morning we do expect that rain to move into the south bay with those scattered downpours as well. as that front moves through here in the morning, it will kick up the winds as well. so future tracker wind gusts will stop the clock at 10:00 a.m. as that front is moving through. you can see the winds are racing out of the southwest anywhere from about 20 to 35 miles per hour. so it is a windy morning we will experience tomorrow. rainfall estimates as this front moves through, i think it's a really good estimate anywhere from a quarter to three-quarters of an inch of rain for many of us. we could see higher totals in

bay area for a safe and secure future, this is abc7 news. once again good evening and thank you so much for staying with us. i'm dion lim. okay. right away let's get back to those new developments in that deadly new year's eve hit-and-run. on the heels of the crash, there is now a petition to recall san francisco district attorney chesa boudin. he joins us live now. chesa, right away criticism over the way you have handled the situation. that undoubtedly is at a fever pitch. i mean forget about all of those who are upset over your handling of nonviolent crimes. in this case, two people are dead. the suspected driver here is a serial offender who is out on parole. your spokesperson told us tonight the parole office followed all procedures, essentially saying that they are, in a way, responsible. now, i should point out that the california department of corrections and rehabilitation, the parole office, made a statement which provided you all the details needed to revoke

bail, but yet you chose to do nothing. why are you blaming the parole office instead of taking direct accountability here? >> first of all, dion, let's start with the tragedy that this is. two families lost loved ones, and that harm can never be undone. my victims services team has been working hard all weekend to support the next of kin, and i am meeting tomorrow with the mother, hannah abe, who was one of the two women killed in this tragic accident. but the next thing we need to focus on is accountability. mr. mcallister, the man we believe committed this crime, will be held accountable. this is a violent crime, as you said. it is a deathly serious crime. and the case was only presented to us over the weekend, and we will hold him accountable. we'll announce the charges that we're filing tomorrow morning, and i expect that he will be arraigned in open court as soon as tuesday afternoon. in terms of the other issues that you mentioned, the fact of

the matter is we are not pointing the finger at parole, and i'm sorry if you misunderstood the statement that our spokesperson made. this is not about blaming parole. this is about recognizing that there are numerous law enforcement agencies and that we all have to depend on each other to do the job properly. here when mr. mcallister was arrested on december 20th, the san francisco police department neglected to even notify his parole agent. we cannot expect parole to intervene or to effectively supervise people if other agencies fail to communicate with them when their supervises are arrested. that's exactly what happened on december 20th. and on december 29th, the chronicle broke this story earlier this evening. on december 29th, mr. mcallister stole the car that he used in this fatal hit-and-run in daly city. the woman that he stole the car from reported it to daly city police, and daly city police identified mr. mcallister as the

person who stole the car. they were aware he was a parolee. they had his address, his phone number, and most importantly, they knew that he had a firearm in his possession. and instead of going out and trying to arrest mr. mcallister or instead of notifying his parole officer so they could do their job, they wrote in their report that they intended to wait until january 3rd, today. by today, it's too late. the harm has been caused. and so my office is going to focus on supporting the victim's families, on holding mr mr. mcallister accountable, and we're going to take a hard look on why it is that we relied on the san francisco police department to communicate to parole when we could have done it ourselves. and going forward, we will communicate directly with parole in every case. >> chesa, with all due respect, it feels as though you are deflecting just a little bit. i do need to point something out. i don't think i did or my reporter or my producer misunderstood any correspondence that came from our office.

but moving on for the interest of time, speaking of blame that you're putting on daly city police, it seems as though you have been blaming sfpd as well. a high-ranking source within the department tells me tonight that you're blaming police reporting, saying they are not sufficient enough to press charges. we saw it riff rinsed in a live facebook discussion you had with chief scott as well. talk about that blame you're putting on police for their shortcomings when really i'd lie to hear some tangible examples of what you plan to do going forward. >> sure. well, absolutely. this is not about blaming police for anything related to this case. but the fact of the matter is my office cannot prosecute cases until and unless the police present us with adequate evidence that a crime was committed. and i'll tell you in san francisco, this is according to the police department's own statistics. let's say burglaries as an example. in 2020, police solved 11.6% of reported burglaries. that means in about 90%, 89% of

reported burglaries, there's no case for us to even prosecute. now, this isn't about blaming the police. as i said, with chief scott in facebook live and as i've said repeatedly, we need to work with the police and with all other law enforcement agencies that we partner with to do a better job keeping the city safe. i can't do it without the police. they can't do it without me. and parole certainly can't do it if nobody even tells them somebody they supervise was arrested. and that's exactly what happened here on december 20th and again with a different agency on december 29th. >> wrapping things up, i need to ask you for a tangible solution because i feel like this is the response you give whenever we end up speaking to you after the countless number of nonviolent crimes, for example. you mentioned burglaries that happened across this city. i have covered personally dozens upon dozens of them where victims want answers, and we get the same lip service. what is your response to them? >> well, dion, i don't think i've spoken with you or been on

your show before, so you certainly haven't gotten lip service from me. but my answer is this. my office, since i took office less than a year ago, has filed over 4,300 new criminal cases. we've done that despite the courts being shut down, despite covid-19, and i have personally taken an old homicide case that was languishing for no reason to a grand jury and obtained an indictment so that we can move that murder case forward to justice. i will continue to personally do whatever it takes to provide justice and safety to the people of san francisco who i am so proud to lead and to serve. >> we should point out members of the district attorney's office have indeed been on our newscast multiple times. chesa boudin, district attorney for san francisco. moving on now, we are tracking the return of rain to the bay area. a live look at the golden gate bridge showing that thick fog, socking it in tonight. you can really hardly see the bridge is even there. it's all part of a storm that

weather, by 9:30 tomorrow morning, there are those downpours moving through. and this front will slide south throughout the mid-afternoon. we will get maybe some sunshine before the day is through as this storm system clears out. but tomorrow morning it is rainy. it is windy. here are the wind gusts. you can see racing out of the southwest. likely anywhere from 20 to 35 miles per hour, so it will be a pretty gusty morning tomorrow. here's the accuweather seven day. morning rain and wind on your monday with na level 2 moderate storm we are tracking. drier day tuesday but evening showers move in wednesday. another storm arrives on friday. dion, it looks like next weekend is unsettled as well. we'll track some on and off showers both saturday and on sunday. >> all right. drew, thanks. here's chris now with a final look at sports. coming up in sports, the 49ers prepare for life after robert saleh. plus all eyes on alex. could the former niners quarterback lead washington in the

washington will host tom brady and tampa on wild card weekend. rams hosting the cardinals. winner makes the playoffs. jared goff out due to a thumb surgery. kyler murray went out with a leg injury early in the game. troy hill of the rams with a juggling interception. he's going to go 84 yards for the pick six. rams win 18-7. l.a. will play seattle in the playoffs. the cards are out. green bay at chicago, packers win and they clinch the nfc's top seed. the bears scored first but in the second quarter, all rodgers. he drew one td to tie it up, then a wide open 72 yards. 14-10 packers. this touchdown pass to dominick daphne sets the packers.packers. late fourth, rodgers finds palo alto high's de'vante as ams. packers win 35-15.

they clinch the top seed and a bye in the nfc playoffs. with the cardinals loss, the bears also made the playoffs. how about jon gruden and the raiders trying to avoid a four-game losing streak to end the season. denver deep m their own until drew lock. this is a disaster for the raiders defense. the longest pass play in the nfl all year. 92 yards. 31-24 broncos. fourth and goal for vegas. josh jacobs gets them within a point. john grud ensays let's go for two. derek carr and the team going to have to dial this thing up. they go for darren waller. tight pass. two-point conversion is good. gruden, he approves. last chance for the broncos. field goal triy and it is blocked. the nfl playoff picture is set for the first time ever we have a super wild card weekend. two days of triple headers. tom brady and the bucs take on alex smith saturday night.
