to get vaccinated. some getting their first shot today, others left on hold for hours. >> tonight a mother and her daughter are battling covid-19 in an oakland hospital. what they want you to know. >> community activists demand that san jose unified schools be police-free. >> a forecast that will feel more like spring than winter. your forecast is coming >> he's been on hold for two hours and still hasn't spoken to anyone. >> tis appointment and confusion tonight. bay area seniors facing busy phone lines and crashing websites in their race to get the covid vaccine. county leaders sharing their frustrations at the rocky rollout. >> people, the public don't want to hear excuses. they just want to get vaccinated. >> but there is hope as some are able to get that lifesaving shot. >> so we were able to make an appointment and zipped over

there this morning. >> and amid the rush, a key piece of advice from health officials. >> the great word that is really challenging for all of sus is patience. >> good evening. >> right now vaccines are being delivered to the state but there's no clear process to know where or-wheel you can get the vaccine. bay area counties tell us they don't have them and don't know when they'll get them. local hospitals like kaiser say they don't know the time line for getting the vaccine and local hospitals tell us they won't be giving the vaccine. tonight abc 7 news reporter kate larson spoke to frustrated bay area seniors trying to make vaccine appointments. >> but she also found a marin woman who actually got the

vaccine this morning in a neighboring county through her health care provider. >> we felt so lucky. last night we received an e-mail from our wonderful doctor. >> reporter: hoping to sign-up for a vaccine appointment and by thursday morning they were getting vaccinated at a clinic in berkeley. >> we made our appointments last night, and we went over this morning about 45 minutes early and there were only three people in line. it was just effortless. >> reporter: the buckley's experience is far from universal. >> your center provider is not able to schedule vaccination or provide vaccination at this time. >> reporter: centers online portal and vaccine phone line was jammed up with traffic as was kaiser's. >> he's been on hold for two hours and still hasn't spoken with anyone. >> reporter: a resident spent the day trying to help her 90-year-old father try to get an appointment to no avail. >> i really want my parents to get vaccinated. i don't want them to die from

covid. >> we have almost no vaccine left at the end of each week. the more we get, the more we'll give. >> reporter: matt willis says marin doesn't have enough supply to start vaccinating age based patients until next week. >> if there's another county where they're able to offer that vaccine and there's no other barriers to it, i can see why people would cross county borders. my hope would be there would be a more uniform approach across the state so there weren't these disparities between counties. >> kate larson, abc 7 news. >> in the east bay cities are working to make the oakland colosseum a super vaccination site. one local hospital has already requested the space, and others are expected to follow. oakland council member at large rebecca kaplan says it's about getting as many shots in arms as

fast as possible. >> right now in california the holdup is actually getting those vaccines outs to people. and so working to open large scale vaccination sites like the oakland colosseum is a crucial part of how we protect peoples lives and protect public health. >> the colosseum authority will discuss the issue when it meet tomorrow morning. tonight there are some signs that california's overwhelming covid surge may be subsiding. the percentage of coronavirus tests that have a positive result dropped from last week and the number of hospitalizations and icu patients are declining slightly, but we are very far from being out of the woods. tonight there are more than 400 people in the hospital with covid-19. jr stone spoke to a mother and daughter who say they're just trying to stay alive. >> right now 38-year-old jackie

who was connected to an oxygen tank is battling covid-19 at kaiser permanente in while she is alone in her room, she's not without family in the building. her mom she lives with has covid-19 and is hospitalized on a different floor of the same hospital. >> i was about to go home last -- i think yesterday but -- >> jackie lin came to the hospital monday and came into contact with someone who had covid-19 while working at walgreens. doctors have told them both lay an their stomachs and they've been doing just

and that positivity here at kaiser permanente has rubbed off. >> we can do it. >> j.r. news. to the south bay now where seven hospital morgues in santa clara county are either full or close to capacity. that's obviously a troubling sign as the pandemic rages on. three refrigerator trailers have now been brought in to handle the overflow. each can store up to 60 bodies. even funeral homes can't keep up. at bennington field in san jose demand is triple what it would normally be this time of year. >> the county health department is taking longer than usual with processing death certificates, so we can't even get the permits

in a timely manner just because everything is so backed up right now. >> well, they have stopped short of turning families away but say they may have to reassess if the situation gets much worse. tonight president-elect joe biden unveiled his nearly $2 trillion pandemic rescue plan. >> there's no time to waste. we have to act and have to act now. >> the proposal would provide an additional $1,400 in direct payments to most americans. that's on top of the $600 checks most just received plus $130 billion to help schools reopen safely. >> the grocery delivery app, instacart announced today it will pay its workers25oet covid.

in the south bay tonight a protest rally brought parents, teachers and community activists together. they're urging san jose unified school board members to make all of its campuses police-free by re-imagining school safety. abc 7 news reporter cornell bernard is in jose. >> reporter: a small but vocal group protesting outside san jose unified school district headquarters demanding campuses be police-free zones. >> cops having a presence on campus is dangerous for students. >> reporter: thisoa nts the district to end thch reimagines school safety. a resolution named after derek sanderland injured by police during last summer's black lives matter protest. >> the reason why they put my name on the resolution was simply because they found my

alameda county d.a. not to charge a second police officer in the grant police case. however, earlier this week alameda county district attorney nancy o'mally announced she wouldn't pursue charges despite public pleas from grant's family. >> justice delayed is justice denied, but i think that we have an opportunity to go on record with the district attorney. >> we're not experts in the law. it is not up to this board to determine if legal standards of prosecution have been met. >> grant was shot to death by an officer on new year's day 2009. he was convicted of involuntarily manslaughter and served 11 months in jail. abc 7 is committed to racial and social justice as part of our efforts to build a better bay area. to join the fight and to find your ally go to abc7news.com/take action.

developing news, governor newsom is calling on the national guard tonight to protect the state capitol on inauguration day which is next wednesday. the governor signed and ordered deploying 1,000 guard members, of course, amid heightened concerns of civil unrest as president trump leaves office. workers have added a temporary chain-link fence around the state capitol to strengthen existing barriers. the california highway patrol is not issuing permits for rallies at the capitol. >> we're treating this significantly and appoint resources to protect public safety, critical infrastructure and first amendment rights. but let me be clear, there will be no tolerance for violence. >> the stepped up security follows a warning from the fbi that armed protests were planned at all 50 state capitol buildings around the country during inauguration week. joe biden launched a new twitter account tonight ahead of his inauguration. president-elect biden is intended to serve as a placeholder until he takes over

the official presidential account january 20th. however, joe biden won't inherit them when he takes office. they will have to opt to follow the new administration's twitter accounts. as kamala harris makes history as the vice president, twitter will create a second gentleman account for her husband. it's a way of marking the election of the first ever female vice president and one of several switches in the transition from the trump white house to the biden administration. abc news will have continuous live coverage oof the inauguration on wednesday. it begins as early as 6:00 a.m. right here on abc 7. all right, turning our attention to the weather, and it was like springtime outside today, dan. >> oh, my gosh, ama, it was gorgeous outside. i know you got outside. i did some today. sandhya, we need to rain but we can't change it so we might as well enjoy this weather. >> that's very true.

and it was hard to come back inside once you got outside because it was so beautiful. tonight it's not so beautiful. visibility is coming down to about a half a mile in fairfield at this hour. fog has formed. napa down to a mile. half moon bay, down to zero. so definitely watch out. fog has become thick across parts of the bay area and a dense fog advisory has been issued so definitely allow yourself extra time for the morning commute. we had fog earlier this morning. it was so thick it was hard to see in the north bay, but look at those temperatures in the afternoon. a tie in livermore, 71 in half moon bay, san jose, oakland. mid-60s in napa to santa rosa. and we're heading into that same kind of weather pattern for the weekend. tomorrow i think the temperatures will be about the same or take a step back a little bit. temperatures right now 40s, 50s.

a minor 3.8 earthquake rattled the east bay today. happened around 11:20 this morning. the epicenter was in concord as you see. it was felt as far away as daly city. nearly 5,000 people reported feeling it. no damage, though, was reported. >> that's good. also in the east bay oakland airport is getting its first vending machine for covid-19
