>> and i'm dan ashley. today's storm ranks level 2 on the abc 7 impact scale, a moderate storm. yesterday's ranked 3. tree limbs came down, outdoor dining tents were blowing away and mud slides damaged homes. there is a mess to clean up all around the bay area, and the wet weather is not over yet. >> no, our weather team is monitoring conditions where you live. before you get to abc 7 news meteorologist drew tuma let's hear from abc news 7 meteorologist spencer christian. >> the atmosphere is still steering storms into the central coast and bay area as you can see. on live doppler 7 there's more rain developing offshore and we have steady heavy widespread rain just pounding, soaking parts of the south bay and starting in mt. hamilton going down and looking southward you can see into morgan hill and gilroy and watsonville. it's really wet and still coming down. the storm ranks 2 on the abc 7

impact scale so for tonight and tomorrow we expect periods of scattered showers, occasional downpours. the burn scar areas may have some flooding or mutt sliding and gusty winds at times. here's the forecast animation starting at 7:00 this evening. notice we'll have waves of showers moving through. some of those will be steady and heavy with torrential downpours. they may be brief but they add to the potential for flooding. that pattern continues through the early morning hours, through the morning commute and into tomorrow afternoon, so this storm is still with us. let's toss it now to abc 7 news meteorologist drew tuma for a further look at the storm. drew? >> spencer, we're already seeing problems when it comes to flooding. a lot of rain in a short amount of time, especially the south bay. a flood advisory is in effect for 7:15 for all areas shaded in green, including san jose, morgan hill and gilroy and santa cruz and we could see flooding on the roadways and small streams and creeks could likely overflow their banks. here's jose and here's

gilroy. this atmospheric river has essentially stalled right over gilroy. the pops of yellow and orange and red. this is intense rainfall leading to the flooding concerns, and it's really not going to budge over the next couple of hours so we do have a flash flood warning over the lightning burn area at 6:00 p.m. a lot of water and flash flooding is very likely in the area. the entire hills of the north bay, along with the santa cruz mountains under a flash flood watch until tomorrow afternoon. for any additional rainfall to potentially cause flooding issues around the burn scars. we're talking about snow and blizzard warning in good effect from up to 8 feet of snow. when spencer comes back he'll take an hour by hour look at this rain and then we'll find drier times in the accuweather forecast in just a few minutes. >> drew, thank you so much because the rain is still so

active, evacuation orders are required that people leave their homes and evacuation orders are in areas where there were previous wiles fires because of the risk of maude slides. homes were damaged, vehicles were damaged and even people were put in the hospital. abc's chris nguyen traveled to salinas to see the situation firsthand? tonight the cleanup has begun after heavy rain caused mud slides and debris flows throughout the region. on river road south of salinas the danger evident all around as fire crews tried to rescue people at their homes and local largers coming in to assist with their heavy equipment. >> we did have injuries to the civilians. they are in our local hospital being treated. >> reporter: residents in the area were ordered to evacuate yesterday but many chose to stay. at a property up the road county officials say one woman broke her arm after a powerful mud slide burst through her front door. >> we have o private property damage. people lost a lot of mobile equipment, motor homes and

vehicles and tractors and we're still trying to get our arms around the total loss. >> the scene here not a surprise to some because of the close proximity to a burn scar from last year's river fire. >> when a fire occurs in an area that heat and flame changes the chemical composition of the soil. >> reporter: professor laura sullivan green from san jose state university says this is why people should listen when they are told to evacuate. >> all that have precipitation that falls runs off, and as it does it collects all of the ash, burnt debris and loose soil with it and creates those mud flows and debris flows. >> reporter: closer to the bay, officials in the santa cruz mountains are pleading with the public to steer clear of the san lorenzo vale, an area that faces a similar threat because of the rain. >> the orders are in place to protect people. we would encourage people if they thought about staying to -- to seek shelter elsewhere. >> reporter: and the county fire department is expressing their gratitude tonight for the assistance that they have been receiving from other fire agencies throughout the area. heyward and fremont were among

them. in monterrey county tonight, i'm chris edgen, abc 7 news. >> there were dozens of small power outages in alameda and contra costa counties today. many residents woke up to find themselves without electricity and some without phone or internet. pg&e and at&t had crews out working on restoration. >> i'm using a hot spot thankfully in order to get the kids on their zoom and then had to go pick up some breakfast for the kids at the restaurant and, you know, i don't have a generator so i'm kind of just making deal with it. >> coping as best as he can. a small mud slide was caused in the oakland hills and some tree limbs were in the road. no one was hurt. in the north bay restaurant storms took aim at their livelihoods, namely outdoor parklets and tents. every time i watched the tents roll down the street it's hope being pushed away by the wind, too. >> reporter: yeah, for sure, dan. it's been a real tough 24 hours

for restaurant own owners up here in the north bay. the storm flattening many outdoor tents like this one here on montgomery drive. this one is a total loss. the timing is terrible just days after restaurants got the green light to do outdoor dining once again. >> this pole here is not going to be safe. >> reporter: santa rosa restaurant owner josh sill verse shows us what's left of his giant outdoor dining tent. >> that pole bent. that pole bent. >> reporter: we were there when tuesday's storm blew in unleashing chaos. >> all of a sudden i see our tent just rise up and flip over. >> reporter: staff members at jackson's bar and oven tried to secure it but watch what happens. another tenttructuse a topples >> it was insane. we just got the go ahead to start doing outdoor dining as you know which we were super excited about. >> saw a couple of the tents blow out. >> reporter: around the corner two dining tents at grossman's

restaurant buckled from too much rain. luckily those can be rebuilt. >> that's one thing after another. >> across town paradise sushi and hibachi owner gustavo martinez says his outdoor dining businesses was decimated by the storm. this 50-foot tent destroyed. >> there's no way we can fix this, so we have to order a think one which is going to take a couple of weeks if you get lucky. >> reporter: for struggling business owners the timing couldn't be worse. everyone patiently waiting for things to get better. >> every time we move one step forward we go two steps back. everything is just -- it's been rough for restaurants. it's been brutal. >> reporter: yeah. brutal is right. many say what choice do they have at this point? most owners say they will reorder more tents or rebuild the ones that were broken and hope for better times ahead. we're live in santa rosa tonight. cornell bernard, abc 7 news. >> boy, cornell, such a shame

confirmed that a worker received a site at a county site last week. she's 42 above. >> did she have any pre-existing condition that would have allowed her to jump to the front of the line. >> i'm not aware of that but, no. >> the story started with an anonymous tip criticizing ramos. everyone knows she doesn't qualify and now vaccines were going to run out so instead of giving the dose to someone who needed it she took it for herself. bellia ramos has been available to abc 7 several times often to discuss wildfires but not available to discuss this. i've been communicating with her for two days and ramos tells me she's too busy with meetings for even a brief interview. >> questions have come up whether i've been vaccinated so i wanted to share that with you. >> reporter: she referred me to her facebook post overnight saying she was at the vaccination center to record a public service center and received a leftover shot. >> i was fortunate enough being

a standby list that i received the first shot of moderna. >> reporter: people on a waiting list is allowed to stand by in case someone cancels. in any case an official from the vaccine advisory committee says ramos should have refused the vaccine. >> if i was in her shoes that's what i would have said. how come you're offering it to me? we've got a 90-year-old out there that hasn't been vaccinated yet. how do we get it to that person? >> reporter: late today i got a text from ramos saying she hopes to persuade people who are on the fence about getting a vaccine. i'll post the entire message at abc7news.com. send me a story there or call 1-888-i-team. for abc 7 news. >> thanks very much. >> and an east bay doctor hailed a hero after creating an opportunity to vaccinate seniors

now faces questions about her motives and that clinic is prohibited from receiving vaccines. the doctor faces claims she unfairly distributed the vaccine. >> i'm pretty sure somewhere? think promised somewhere my first born child. >> reporter: dr. rebekah parrish made bold promises, carved out 60 hours to convince contra costa health officials to give her hundreds of covid vaccine doses and ended up with -- >> this is so amazing. >> reporter: what appeared to be a successful drive-through vaccination site for home bound seniors last week. >> it's the best deal. >> reporter: yet support shifted this week as the supply of 500 doses that supposedly went to elderly seniors ran dry. multiple sources close to the abc 7 iteam allege people with connections to her concierge medical practice comprehension itch wellness, reportedly not eligible for the shot, jumped the line while seniors sat on the wait list at the drive-through clinic. three physicians have filed formal complaints to the contra

county public board and another complaint was foiled to the state medical board. i visited the doctor's office but she once available and i later spoke to her on the phone for clarification. she denied the allegation and did concern her practice actually received more than 500 doses. >> we realized at 1:00 p.m. on sunday that we have more doses than people scheduled. we didn't have enough needles. >> reporter: patricia garrity, a nurse practitioner working in her office says 418 doses were given to people over the age of 75, plus an additional 160 doses at mip sterd -- administered to under 65. >> you're saying not one health care worker or people under 65 didn't receive the vaccine? >> i don't know the numbers in terms of people who came through and lied. >> reporter: later nipt view i

asked the same question. >> when the vaccine doses were at the risk being discarded at the end of sunday night, yes, under 65 was vaccinated as happens in every clinic. the every effort was made to make sure that no one understood 65 was vaccinated in those two days of the clinic. >> reporter: contra costa health services confirmed the county stopped giving additional doses to this clinic while records are reviewed. >> yes, i'm not surprised that something like this could happen. >> reporter: mike wasserman who sits on the vaccine advisory committee says he sees other cases where seniors are pushed out of line. >> i have to say, you know, there should be consequences of some sort. >> reporter: abc 7's analysis of newly released data from walgreens shows only 18% of assisted living and other long-term care facilities have been vaccinated across the state. it's slightly better cvs. data shows 27% have been vaccinated within the same groups. >> there will be those that will

try to get the vaccine for whomever, whatever they can get them for and that takes away from the folks who need it the most. >> reporter: dr. parrish charges $2,500 for a consultation according to her office but she says she had no financial incentive as she's not accepting new patients. >> i'm so emotional. >> reporter: yet the vaccine drive-through was free. the question is why didn't more seniors like lisa get the shot? contra costa public health stressed to dock towards importance of not letting any doses go to waste, even if that meant vaccinating those in a priority tier. now, dr. parrish says less than 35 of her patients were vaccinated at the drive-through clinic all except one person were 56 and older or in tier 1a. for the iteam, stephanie seer race, abc 7 news. >> stephanie, did the doctor say if she regrets hosting this drive-through clinic? >> reporte regret, no,

there because we're advised not to try to get there. there's a blizzard warning in the sierra until 2:00 a.m. friday we expect 5 to 8 feet of snow. wind gusts 50 to 70 miles per hour producing whiteout conditions, of course, and there is severe or extreme avalanche danger and avalanche warning is in effect until 7:00 a.m. friday for widespread avalanche activity. again, travel is not recommended. back to the bay area. things are a lot calmer to what's happening in the sierra. we have pockets of showers and downpours moving onshore and down to the south bay there's a mass of moisture. heavy steady rain has been pounding that reaming op for the last couple of hours with very little movement so from mt. hamilton to fill roy and holste, you can see heavy saturating rain. back here in san francisco right now looking back at the skyline from the explortorium cameras, temperature is 47 degrees and it's damp out there and no

downpours reported in the city right now. oakland 5 is and mid-40s, san jose and morgan hill and 50 at half moon bail. an unobstructed view looking westward back towards san francisco. it's 47 degrees in santa rosa and also upper 40s or mid to upper 40s, napa, vacaville and concord and livermore. as we look across the embarcadero from our rooftop camera. showers and downpours will continue overnight and into tomorrow. intervalues of sun and rain, mainly light rain friday, saturday and sunday and steadier rain returns to the bay area early next week. here's a look at our flash flood watch which will be in effect until 4:00 p.m. tomorrow for virtually all of the higher terrain of the bay area. there's a threat of debree flows over the burn scar area. risk of mud slides and flash flooding, again, is possible. the storm, which was level 3 yesterday now ranks only, only level 2. still a significant storm for

tonight and tomorrow. look for scattered showers, occasional downpours and gusty winds at times. here's the forecast animation starting at 7:00 this evening between 7:00 and midnight. we'll see this pattern conditions of waves of showers moving in and that pattern conditions through the early morning commute so it's going to be a wet commute and slippery roadways, localized flooding and occasionally gusting winds to contend with as well and shers continue to move into the bay area. rainfall estimates by 11:00 tomorrow night we expect these additional rainfall totals, up to nearly half an had much at san matteo and two-thirds of an inch in san francisco. it 2 one one at ben lohman and many of our inland east bay locations will have between an inch and a quarter, an inch and a half so it's just going to be more wet weather just saturating parts of the region through tomorrow evening. overnight lows tonight mainly in the mid-40.

>> reporter: unfortunately for carla winter evan she hasn't had much entertaining to do thanks to covid. her party business has been shut down because of the pandemic. >> everybody cancelled and my industry got wiped out. >> reporter: fortunately for her contract workers for the first time qualified for unemployment. she received her first check in may for benefits going all the way back to the beginning of the pandemic. everything went smoothly until december when her benefits stopped without explanation. >> you know, well, they cut mow off like everybody else. i kept going online and checking, and i kept sending in, you know, they have a form there where you can send in problems and stuff. where's my payments. >> reporter: on new year's eve she received note anycation her claim had been closed, again without explanation so she went back online to reopen her claim. >> you get to the last button and it's like you've got to do everything at least two or three

times in order for it to get through. >> reporter: much has been report about e.d.d.'s outdated computer system which still relies on '80s computer technology run on cobol programming language. john thomas flynn is the former chief information officer for the state of california. the state hired him to deal with a similar problem with the dmv in the 1990s. >> it doesn't seem like we learned very much. certainly there were the technology problems that raised their head, the whole issue of legacy systems which is a euphemism for old falling apart systems that are kept together with wire and chewing gum. >> the auditor's report released this week doesn't directly address the outdated computer system but did address why so many claims had to be processed manually. in the first six months of the pandemic 48% of all claims had to be processed manually. the implementation of the ibd system in october helped increase a number of claims that

could be processed automatically. now just 10% of all claims need human intervention but the auditor's report says that's not sustainable because shortcuts adopted during the pandemic will not be allowed post-pandemic. flynn says e.d.d. needs to be more assertive and demanding money to upgrade its computer systems. >> the computer system old. that's a dog ate my homework kind of excuse. they need to ask and demand the resources to fix those systems and that's what should happen. >> at the very least, flynn calls for a two-factor verification system common in today's financial world to prevent fraud. it takes more than hocus pocus to make problems disappear. >> would you like blow on this caays she's confident her issue will be resolved soon and her benefits will resume. fingers crossed. we reached out to the e.d.d. for

comment for this story, and they did not get back to us. the huge spike in unemployment claims is because of the coronavirus pandemic, butty with continue to be encouraged by the new state data. the number of new cases, hospitalized patients and icu patients are down or below average. the test positivity rates are dropping. nearly 700 people died though in the most recent 24-hour reporting period, a number that is above average but shy of our state's report set last week. >> on "midday live" this morning we spoke with oakland mayor libby schaaf about the decision made by the state earlier this week to lift the regional stay-at-home area. all bay area counties are in the purple tier which includes a lot of restrictions aimed at minimizing the spread of the coronavirus. >> we can't keepio yo-yoing back and forth. stay outside and wash your hands and stay apart as much as possible. we've got to go back into this purple tier with extreme caution

and appreciation for what this virus has done. >> alameda county has more than 71,000 diagnosed coronavirus cases total and 31% are in oakland, more than any other city. the hardest hit zip codes are in the east oakland area. case rates per capita there are double the rates than in other areas of the city. >> new developments. we're learning a lot more today about a north by a man under arrest who now faces both federal and state charges. abc 7 news reporter wayne freedman has the latest in the investigation that's being locked into as a possible case of dangerous political extremism. >> reporter: these are the pipe bombs seized by napa county sheriff's deputies when they arrested ian rogers bingaman last week, 49 weapons, a white privilege card and more all found after raids of his business and home. the 44-year-old owner of this automobile repair business now faces both state and federal charges. they are serious enough that the

it wasowling out there and the wind was driving. >> you know, we had wind gusts last night and in some parts of the bay area between 60 and 80 miles per hour. is that incredible, and that, of course, makes driving extremely difficult along with the rain and the potential for flooding. it's just been a mess. meanwhile in the sierra, we have a blizzard warning in effect until 2:00 a.m. friday. we expect 5 to 8 feet, not inches, but feet of snow with winds gusting 50 to 70 miles per hour producing whiteout conditions. needless to say travel is not recommended and an avalanche warning is also in effect for the sierra. widespread avalanche expected or possible until 7:00 a. go to the bay area where there's still showers developing offshore and then moving into the region along with heavy downpours in parts of the south bay. the storm ranks two on the abc 7 storm impact scale so for tonight and tomorrow we expect scattered showers, occasional downpours and possible flooding in burn scar areas.
