boiled down to a lawsuit here in san francisco. what this could mean for students. good morning, everybody. it is wednesday, february 3rd. before we share those stories with you, we want to check in with mike for a look at our forecast. good morning, mike. >> good morning, hi, everybody, thank you for joining us. live doppler 7, i'm tracking the storm to ur our north. a cold one. valley rain and mountain snow around eureka, crescent city, heading over towards reading. a 1, a lighter storm than yesterday. the bulk of the weather in the north bay, with some snow in the mountains of lake county, less than .15 and that's being generous, that's the top end in the mountains, if even it makes that much. we'll have a little fog this morn morning. >> we had some in santa rosa. the wind is blowing this from north to south. so right now it hasn't crossed san pablo bay to san francisco bay as we look from the east bay

hills, it is possible it may as we get deeper into the commute. low to mid-50s today, coolest day moving forward. all right, i'm going to turn it over to jobina with the latest on the san jose fire. jobina? >> thank you, mike. we have developing news on a fire that is causing some road closures in san jose. the fire department says an abandoned building burned on bascom avenue at forest avenue overnight. fire is under control. if you're in this area, northbound bascom is closed between san carlos and naglee avenues. southbound bascom opened an hour ago. it is not clear how the fire started. as soon as we get more information, we'll be sure to update you on the air and online. kumasi? >> thank you, jobina. new this morning, the city of san francisco is reportedly preparing to sue the school district and the school board over reopening plans. education, of course, one of our focuses as we work to build a better bay area. abc 7 news reporter amy hollyfield live in the city with more on this announcement. amy? >> reporter: kumasi, what a move by the city, suing its own

school district, and apparently the mayor is on board, mayor london breed telling "the chronicle," distance learning isn't working for anyone. the "san francisco broke the story in the hour. as far as this is concerned, they have earned an f, having a plan to make a plan doesn't cut it. the lawsuit claims the school district is violating a state law that says districts must adopt a clear plan during the covid pandemic to offer classroom-based instruction whenever possible. especially for those students who are suffering serious learning loss. herrera told the chronicle, the district's plan is full of ambiguous empty rhetoric. the chronicle reports he must file the lawsuit today so next week he can ask the court to

issue an emergency order to force the district to create a reopening plan. the chronicle asked herrera if he thinks he will have any luck, he said, yes, that this lawsuit is based on the law, it is simple, and he says it is focused. no reaction yet to all of this as it is just coming out. but you can imagine it is going to be an emotional time here in the city. reporting live in san francisco, amy hollyfield, abc 7 news. >> amy, thank you. this is interesting timing because that lawsuit comes just as four bay area counties including san francisco county get the green light to reopen some schools. so san mateo, marin, san francisco. covid case numbers in those counties are below the state's thresh hold to reopen. that means in person classes can resume at all public k through 6 schools. higher grade levels will return when the counties leave the purple tier. san francisco's high school

is considering ending selective merit-base d admissions. the city's school board took a closer look after anti-black and anti-semitic slurs were posted on a lowell messaging platform last month. the board held a virtual discussion last night with students, alumni, parents and teachers and the response was emotional from supporters and critics. >> i am tired of my students being hurt and race-blind admissions does not increase diversity, it decreases it. lowell is a beacon of hope for low income students like myself. if you try hard enough you can receive an education on par or better than an elite private school. >> the proposal is to move lowell to a lottery-based admissions system. the school board will vote after more public comment. new at 6:00, voting ends today on a poll to pick a new name for sir frances drake high school. drake was a 16th century english

explorer who had ties to the slave trade. the new list of name suggestions has been paired down from 500 to 85, with suggestions ranging from flowers and trees it filmmakers and philanthropists. once today's voting ends, the top eight choices will move to a march madness style tournament with the winner picked by next month. san francisco's opened a drop-in vaccination clinic in the bay view. and this is the city's viffirst vaccine clinic based on zip code. the bay view is one of san francisco's hardest hit neighborhoods, with infection rate of 10%. the clinic on keith street will offer 200 shots a day, seven days a week indefinitely. people over 65 who live in the 94124 or 94135 zip code qualify. >> it is getting serious. it is scary. i'm quite glad they have put it in the neighborhood where, you know, afro americans and latinos live, so that we have a chance to save our lives. >> the clinic is also open to

anyone 65 and up in the san francisco health network. and the setup is already under way for a new vaccination site at san francisco's moscone center, the third vaccination site along with the bay view one you just saw and one at city college. it could open as soon as this week. appointments will be required, but this site is open to anyone eligible to get a vaccine. there is encouraging new information this morning about the effectiveness of astrazeneca's covid-19 vaccine. data from the uk shows it drastically cuts transmission of the virus and jobina, we know there is new data on the dosage. >> yes, reggie. so this new data, which isn't peer reviewed, could prove the uk strategy to space out the second dose is an effective way to get more people vaccinated. university of oxford researchers found the vaccine was 82% effective when a second dose was spaced out 12 weeks. that's nearly 30% more effective than when the second dose is given, four weeks later. the study also showed the

vaccine lowers transmission rates and protects people from serious injury and death. astrazeneca's vaccine is not available in the u.s. yet. the fda hopes to review data from a clinical trial later this month. the highly contagious variant from the uk of the coronavirus has turned up now in alameda county. health officials say they have identified six confirmed or suspected cases. they don't believe these cases pose any additional risk to■ county residents, other than the fact it spreads more easily. more than 100 cases of the uk variant have been reported in the state mostly in southern california. officials believe it is more prevalent than that, but it likely has not been identified because there is a lack of testing and genetic sequencing. they expect those numbers to increase as surveillance for new variants ramps up. still ahead, extra compensation for grocery store workers. one bay area city has also approved so-called hazard pay, while another still hashing out the details.

show you our 880 at the coliseum camera here. and just for reference, those headlights are making their way south, traffic is moving there as well. and then an overall look at our map. it has been such a clear commute, especially in comparison to yesterday when we saw so many spinouts due to the rain. you shouldn't have any problems when you head out the door if you need to leave. reggie? >> thank you. this morning a bay area family is heart broken after traveling to modesto to adopt a dog, they found out that it got stolen. ma marybell had been searching for a miniature pinchier for her sister who has cerebral palsy. she was told radar couldn't go home right away because he was part of a confiscation case from a breeder in the area. when hospital staff went to get him on monday, so he could be neutered, radar was gone. >> we do believe it is somebody that is related to the situation to the breeder who stole the dog. >> we want our baby back.

workers, but san jose leaders reach a stalemate last night deciding instead to delay the vote. the california grocers association has criticized hazard pay, saying that it will lead to higher food prices. they're saying that would be up to $400 a year for a family of four. san jose council members raised questions about the economic impact and they ordered city advisers to come back next week with more information. >> increasing wages may cause unintended consequences in the form of grocery stores being closed in communities that cannot lose a grocery store. >> if it is approved, san jose assess proposal would give grocery store workers an extra $3 an hour. oakland just approved an additional $5 an hour. the oakland zoo is reopening today, but if you want to visit, you have to reserve your tickets online and also wear a mask. the zoo's nighttime lantern festival, that resumes on friday. broadway is still shut down, but there are two musicals that are coming to your living room,

as we talked about, not much of an impact outside in the north bay. so let's look at our next system, promises to come in monday, especially in the north bay. and possibly reaching down into the rest of our neighborhoods as we head into tuesday. this one is not a great wet weather maker either. what it is going to do is bring our temperatures back to average after such a warm weekend. in fact, look at the rainfall totals up in the north bay, maybe up to .15 of an inch of rain. the rest of us, a couple of hundredths. we're seeing a dryer pattern developing starting tomorrow after today's storm. reggie? >> mike, thank you. three people are critically injured after an explosion near a film site in santa clarita. this was initially reported that the blast happened on a movie set, but it was an industrial business. the three people who were hurt

suffered second and third degree burns. the explosion also caused a small brush fire in the nearby hills. that was contained to about an acre. a hazmat crew will be back on the scene trying to figure out a cause. the push for racial equality is coming to wheaties boxes this spring. tommy smith will be on a commemorative box and one side features him running in his san jose state uniform and the other the iconic image of him raising his fist in the air during the national anthem at the 1968 summer olympics. john carlos also took part in the podium protest. there is a statue honoring the two men on the san jose state campus. apple is finding a way you unlock your iphone with face i.d. while wearing a mask. the new feature will require you have an apple watch. all you need to do is have an unlocked watch and then look at your phone as usual, and it will open up. the update is expected to be available in a few weeks. currently when your phone sees

it is wednesday, february 3rd, good morning to you. we'll start with a check of the weather and mike nicco. >> thank you, reggie, kumasi, thank you, everyone. it is starting to clear out a little bit as the breezes are blowing north to south. some of that may leak to san pablo bay and if it hangs around into san francisco bay. right now most of our activity from our storm is up to the north. i did hear reports some of light rain falling around santa rosa, live doppler 7 is pretty inactive in that area. expect light showers mainly after the morning commute. and before the evening commute, mainly across the north bay also. here is a look from sutro. maybe that's a little bit of fog on the left side of your screen? we'll definitely keep an eye on it, me and jobina. temperatures in the mid-30s to low 40s. this morning, cooler, low to mid-50s this afternoon. coldest day moving forward. more on that weekend warming trend coming up. here's kumasi. this morning, a big boost is apparently coming for the vaccine rollout.

the white house says it will allocate an additional 500,000 doses for states per week which will bring the total to 10.5 million. in addition to that, 1 million more doses will start going to more than 6,000 pharmacies across the nation next week. so far more than 52 million doses have been distributed, but less than 8% of americans have actually gotten the vaccine. this morning on "gma," dr. anthony fauci says we should not delay getting second doses to get more people their first dose. >> it looks like as we're getting through february into march, we're going to get a much steadier supply or cadence of vaccine coming in. certainly you don't want vaccines sitting around in a refrigerator or in a freezer if they're ready to go. you want to give them to people. but if you balance it well, george, you can get as many people in their first doses and then when the next shipment comes in, take care of the people that are about due for their second and then give more

to the first. >> you can watch george stephanopoulos's entire interview with dr. fauci at 7:00 this morning on "gma." this morning, a major development in the fight to get kids back to campus in san francisco. the city is reportedly about to sue the school district and the school board. abc 7 news reporter amy hollyfield is tracking this story. you just heard from the teachers union? >> reporter: that's right, reggie. this story is just now breaking. but reaction already coming in. i just heard from the president of the teachers union, susan solomon, she says she is disappointed. here is her quote, she says she's disappointed that the city has chosen to attack rather than support the school district. united educators of san francisco has been calling for this city to help with resources such as covid testing and vaccines. but this has not happened. now, san francisco mayor london breed has said she has contributed $15 million to the reopening effort and has partnered with the district to offer covid testing for

teachers. mayor breed told the chronicle she supports the lawsuit saying distance learning is not working for anyone. city attorney dennis herrera told the chronicle it is a shame it has come to this, that the school district has earned an f in the assignment of reopening, saying they had more than ten months to come up with a plan. the school district spokesperson has not gotten back to us yet. this is all just now breaking. so a lot for all of the players in this to digest this morning. that lawsuit is expected to be filed today. live in san francisco, amy hollyfield, abc 7 news. >> amy, thank you. california is showing improvement when it comes to our covid numbers, but there are concerns about these new variants that they could possibly cause another surge. california's 14-day positivity rate is now at 7.2%. that is down from 9% a week ag drop of people going to the hospital in the past two weeks.

state health officials say the west coast covid-19 variant has more than 1,000 total mutations. there is a concern it is making people sicker. dr. mark ghaly says the state is getting $1.7 billion in unanticipated federal funds for covid response and vaccinations. he said california will begin collecting race and ethnicity data on those who have been vaccinated. >> track our ability to reach communities of color, communities that have been disproportionately impacted, we have to have that data. we're working on it with our local partners to make sure we have as accurate as we can. >> he says the state's equity framework may include money for targeted outreach efforts and payments to providers to bring vaccines to communities of color. vaccine doses will head straight to pharmacies in a new strategy to speed up the shots. the federal government will ship doses to 6500 pharmacies nationwide. that includes wall greens and

democrats like nancy pelosi. top senate republican mitch mcconnell called greene's views, quote, looney lies and conspiracy theories, saying they amounted to a cancer for the party. >> i think i adequately spoke out about how i feel about any effort to define the republican party in such a way. >> greene has fired back calling him the real cancer in the party. meanwhile, loyalists of former president trump want to strip congressman liz cheney of her leadership post after she voted to impeach trump last month. mcconnell and other top republicans have voiced their support for cheney. kumasi. >> thank you, jobina. happening today, the california department of water resources will conduct its second survey of the season on the state's snow pack. this is video from its first survey back in december. it is conducted at phillips station off highway 50 not far from lake tahoe. in december, the snow pack was

52% of average for that time of year. but now that we have had a few storms, there is hope for a better reading today. this morning, the northeast still digging out after a powerful winter storm blasted the region. this is a look from livingston, new jersey, where a person made a time lapse video showing 19 inches of snow piling up on his deck. that happened between sunday night and yesterday morning. the nor'easter also caused flooding in other parts of the region. this is a part where it goes from being pretty to just being slush and brown. >> mm-hmm. mm-hmm. >> mm-hmm. hard to shovel. >> yeah. >> and if you don't have kids to do it for you, it is that one time you're, like, oh, i really wish i had a snow blower for that one time. want to talk about our snow pack. you mentioned that it was 52% in december. we dropped to as low as 40% last week. now these are the electronic measurements, we're up to about 68% of average for today's date.

so we have definitely gained some ground. i can't wait to hear what they find manually later today. most of us are anywhere from 9 to 18 degrees colder this morning. may have noticed the heater kicking on, more and running longer this morning. look at these mid to upper 30s in red wood city, menlo park, foster city, san mateo, 37 in half moon bay. everybody else in the low to mid-40s in the peninsula. mid to upper 30s santa rosa, napa, fairfield, cool spot, san ramon at 42. 41 in san jose. clearing conditions and the temperature will drop for another hour, hour and a half. could have some 30s before all is said and done. a little bit of fog up north, but with the clouds rolling in, a lot of the fog is flowing away. and it is going to be wet between most of our commutes. so take an umbrella in the north bay, you may run into a little light rain. santa rosa said there is a little squeezed out of the cloud deck as it moves s in. the bulk of the chance will move

19-year-old accused of attacking and killing an 84-year-old man is scheduled to be arraigned. we want to warn you this video is disturbing to watch. san francisco police say that the suspect antoine watson attacked the senior alolast thursday morning. it is not clear what may have motivated this attack. the victim had to be taken to the hospital with life threatening injuries and died on saturday. police arrested the 19-year-old suspect on sunday with a woman who was with him. and that attack as well as the death of a renowned private investigator during a robbery attempt is leading to growing calls for san francisco leaders to do something about the uptick in crime. yesterday mayor london breed and district attorney chesa boudin addressed the wave of violent incidents. the d.a.'s office faced criticism for not charging or holding suspects who later had gone on to commit more crimes. >> you will be held accountable

by the police as well as the district attorney. there will be consequences. let's dispel the myth right now that there are no consequences for committing crimes in san francisco. >> the two suspects have been arrested in the death of that pi, jack palladino. their arraignment is set for next week. happening today, pg&e is headed to federal court for a probation hearing over the deadly zog fire in september. prosecutors suspect pg&e sparked the fire and they're investigating the company for possible homicide charges. the utility shut off power lines that day, but not the one located where the fire started. an investigation found pg&e based its decision on wind speeds from a weather station three and a half miles away. >> everything about this terrain tells me you would expect the weather to be different there where the zog fire is than where the weather station is. >> in the hearing, the judge plans to make pg&e factor in whether it has properly trimmed trees or not when making shutoff

decisions. the utility has already admitted that in this case it didn't do so. the ongoing pandemic is taking its toll on governor newsom's job approval rating. the uc berkeley institute of governmental studies conducted a poll which shows 46% of californians like the job he's doing. that is down from 60% just four months ago. despite the falling numbers, 45% of people surveyed are opposed to the recall effort that is now under way. but 36% of people support it. more than 10,000 people participated in the online poll taken last week. san diego's former mayor officially announces candidacy for the republican nomination for governor next year, claiming newsom has botched the state's covid-19 response. >> when you shut down outdoor dining with absolutely no science behind outdoor spread of the transmission, the governor came out and shut down playgrounds for a couple of weeks, outdoor playgrounds, and then changed his mind two weeks later, there is no science

behind that. that's the difference that i would make. >> kevin faulconer served as mayer from 2014 through last year. the 54-year-old moderate republican said he's raised a million bucks since launching an exploratory campaign last month. governor newsom's team issued a statement saying faulconer isn't the first trump supporter running for governor, but he is the first former lobbyist who bungled a local pandemic and homeless crisis. now to your morning money report, the current head of amazon web services andy jassy will be taking over as amazon's ceo when jeff bezos steps down later this year. amazon announced yesterday that bezos will remain at the company as the executive chairman. bezos founded amazon as an online bookstore back in 1994, and has built it into an e-commerce giant, making him one of the richest men in the world. the 57-year-old issued a statement saying, quote, right now i see amazon at its most inventive ever, making it an optimal time for this

lake county the best chance of some snow today. you see the cold clouds overrunning us from tam southward across the bay. 37 degrees up there. coolest afternoon on the way, that's going to be a bigger deal than the showers. most of that is going to stay in the north bay. chilly nights, frost is possible in our valleys. and then mild afternoons before a weak storm monday brings our temperatures back to average in the afternoon hours. today, we're actually a little bit below average, 54 to 57. so not only dressing warmer this morning, but also staying warmer this afternoon. and if you think about going out and grabbing something to eat or outdoor dining, we're still in the low to mid-50s at 5:00. once that sun sets, you don't have the warm sunshine and the dry air and the lack of clouds, we're going to drop quickly into the 40s. make sure you're bundled up for that. look at the wealth of 30s tonight in our inland valleys. frost is very likely. low to mid-40s around most of the bay. all right, my accuweather seven-day forecast, we'll rebound back to average with
