now the city attorney dennis herrera said the district and the board have months of opportunity to develop a real plan required by law. it's been nearly a year since public schools in san francisco shut down because covid-19. to reopen classrooms, san francisco unified has said it will do it with relative today the city attorney reminded the district and the school board that state law says a school district must offer classroom-based instruction whenever possible. dennis herrera believes it is now possible. >> over the past several months, 113 private and parochial schools in san francisco have opened and remain open. almost 16,000 students have returned to in-person school. and less than five cases of in-school transmission have been reported. >> reporter: mayor london breed said last september, the san francisco health department gave the school district guidance

regarding safety precautions. the plan the district came up to reopen schools was then voted on by the school board on november 17th. both breed and herera call the district's plan ambiguous, describing it as a plan to make a plan. >> during that time, the school board has alienated parents and made national news for renaming 44 of our schools, all while there wasn't a plan to reopen those very same schools? >> reporter: some students were supposed to return in january, including special needs kids, preschooler, kindergartners, and first graders. that never happened because the district has yet to come to an agreement with its labor unions, including teachers, many of whom don't feel safe. datendd eaerffetnac a cd misspe directo of the teachers is not a prerequisite

for safe reopening of schools. >> as dr. fauci said, you don't predict the date. the virus predicts the date, or the virus sets the date. we have had spread level rise up, go down. we also have been told vaccinations would be at a million a day, two million a day by a certain date, and those dates have not happened. >> reporter: today we toured six schools out of 85 elementary at early education sites ready to be inspected by the san francisco health department. they hope the get clearance to reopen all 85 by april 19th. >> april 19th, our goal is to have all of these elementary school sites prep and ready for in-person learning instruction. >> april 19th. now, we're only talking about being ready. that doesn't mean that classes start on that day. and if you notice, kristen, not included in that assessment are middle and high schools.

>> yes, yes. and by april 19th, you don't is much time left in the school year. lyanne, what happens if the district does not come up with a quick plan that satisfies the city? then what happens? >> well, if there isn't a real plan that dennis herrera finds legally sufficient, that's what he said, he will then file a motion next thursday, the 11th, asking the court to issue an emergency court order. if it the court grants it means the court must act at this point. i don't see the schools opening right at that point, as you saw in my story, every school has to be assessed by the health department. and my impression is that mayor breed and herera are doing this to push the district to act and act quickly. >> all right. thanks, lyanne. you've invited someone else who is relevant in this situation to join us? >> that's right. a san francisco school board president gabriela lopez joins us. i had a question for you president lopez. we know dr. matthews has said that you are still negotiating,

or the district is negotiating with them. they meet sometimes, especially the teachers union, three times a week. the teachers union also told me that we are very close. what is the district telling the school board? what are you learning from them, and are you satisfied with what information they are giving you? i guess i'm asking is will kids be back to school perhaps late april, early may? >> i do agree with what's being said, especially by our educators, and i have a lot of hope because we know that we are close. what this isn't helping is creating more division between the city and the school district and increasing the distrust that we feel when we're talking about safety in our schools. so a lot of the work that's been happening between our educators

and the school district, that's where a lot of the discussion is, is ensuring that safety. a loft what they're pushing in these standards are tools that the state is just getting around. and it's because of these efforts that we really are ensuring the safety of our school buildings. >> you told me there are certain areas that the city itself has not done enough of to help you, the school board, make this happen. what are those things? >> that's right. we have asked the city to lead the effort to provide surveillance testing for staff and students. and instead sfusd had to go through their own bidding process to find a provider to administer this critical component of opening schools. we know that as a city, we've been asking for low barrier testing and vaccine distribution. and they haven't been able to do this for our city's residents, let alone our school districts. >> now i know that the mayor

also today criticized the school board for focusing on things like renaming schools, which has gotten a lot of attention not only here locally, but also nationwide. she says instead of focusing on that, why haven't you focused 110% on helping kids get back to school? classes? >> that's right. i think it's important to understand that if we're talking about renaming and racism that we are combatting in our school districts, this has been years of work that is now in our hands. specifically with that resolution, it was passed in 2018 after the attacks in charlottesville. we are not focusing on anything other than school reopening. in fact, that is something that we talk about at all of our meetings. it's in all of our plans. today the superintendent was unable to attend a visit at our school building because we had

to respond to this frivolous lawsuit. tomorrow i'm got to be at a school site, again, making sure that the buildings are safe alongside the department of public health and continue along this line to reopen schools. . can you tell us which school? >> it is sunset elementary. >> thank you. thank you, president lopez for being here with us. >> really appreciate your time and lyanne appreciate you as well, as always. let's keep this conversation going. all right, as you know, parents just want their kids back in school. some are concerned that they're struggling with distance learning. we talked with one parent who supports the lawsuit. >> i was so happy to see mayor breed taking decisive action. i think it's very unfortunate that it came down to a lawsuit against our school board and our school district. but we have to see movement in order to protect our public schools. >> she says she's concerned for the public school system because so many parents who have the

means are now applying to private schools so they can get their kids back in the classroom. the american academy of pediatricians is calling for schools to reopen immediately. the group claimed today that medical data shows that school attendance does not increase the spread of covid-19 as long as safety protocols are followed. it says it's dismayed that millions of children are suffering and experiencing the negative impacts of school closures. meanwhile, in oakland, mayor libby schaaf says she has almost daily conversations with the superintendent of oakland schools to talk about where things stand, and she joined us live today on midday live. >> we need to get an agreement with our unions, and that is going to be a very piece to actually getting those schools opened. i know ousd is very hopeful that we will start reopening in the spring. they want to wait until we are in the orange tier. we're still deep in that purple tier. and then it's going to start with our youngest kids who are

today governor newsom announced new mass vaccination sites including one at the oakland coliseum. this comes amid another day of lower covid case numbers in california. 10,5 10,501 new cases reported. the 14-day positivity rate is now under 7%, and hospitalizations continue to decrease. so good news all the way around. vaccinations continue to ramp up, but not as fast as officials want or are hoping for. you see the numbers on our vaccine tracker. just about 60% of doses the state has received have actually been given out. that could increase soon because later this month the federal government is hoping to vaccinate about 6,000 californians a day at the oakland coliseum. chris nguyen tells us exactly who is eligible. >> reporter: in the east bay, a major announcement at a familiar

venue. >> equity is the call of this moment. >> reporter: the oakland coliseum will soon be transformed into a mega vaccination site. as a result, eligibility for the covid-19 vaccine in alameda county will expand to phase 1b, tier 1 starting next week. >> the whole idea is to speed up the through put, the efficiency, maintain an equitable lens in terms of the distribution of the vaccine. >> reporter: the site will be operated by the state in partnership with the federal government, but isn't expected to open until february 16th. once it does, seniors 65 and up, as well as essential worker, including those in food and agricultural, emergency services, education, and the child care sectors will be able to receive the vaccine. >> this site is not going to in any way impact the existing vaccine resources, the existing workforce resources. this is truly additive from our federal partners. >> reporter: the new plan is

of water resources measured the snow at philips station in el door rad decounty this morning. 63 inches with a water equivalent of 17 inches. that's 93% of average to date. much of that came from last week's storms. however, the statewide snowpack is just 70% of average. as we bring in spencer christian for a look at the forecast. so let me ask you this. on a scale of 1 to 10, how concerned are you about the shortfall in terms of where we are with water right now? >> i'd say about a 7 to an 8. not that we can expect anything disastrous. but we're still well below the average in snowpack. so we need a lot more rain here in the bay area where we have a serious rain deficit, and we need more snow in the sierra. and the season is getting shorter andowuc m can expect. a loot's beenng you can see on the satellite radar loop that we had light showers moving mainly through

the north bay. they have pretty much tapered off although santa rosa did have reports of light rain in the previous house. doppler 7 shows almost nothing in the way of precip. let's take live pictures or a logistic at live views from sutro tower looking other san francisco. 53 degrees in the city. mountain view, san jose 56. 54 at half moon bay. this is the view from emeryville. still clouds. the sky is fairly bright in general across the bay area. 52 in santa rosa. 53 at napa. mid-50s at fairfield, concord and livermore. and looking across the embarcadero, we see a much bluer sky over the bay. and these are our forecast features, mainly clear and chilly overnight. g ou t e of the some inlandays week. and minor rain chances may develop early next week. but really minor, because the forecast model, the computer model indicates no measurable

rain is likely to fall in the bay area over the next seven days. but again, we do have the minor chances, which i'll get to in just a moment. forecast animation shows the passage of a few high clouds. we just saw evidence of the clouds on the live camera pictures. skies will be clear, which is going to allow temperatures to drop into the cold to chilly range overnight. look for low temperatures mainly in the low to mid 30s in the coldest inland valley locations. mid- to upper 30s, just about everywhere else. then tomorrow, sunny skies. a little milder than today. mid-50s on the coast. upper 50s to near 60 right around the bay shoreline. and we'll see a few low 60s inland in places like fairfield, vallejo, napa, up at cloverdale. they expect a high of 64 there. and now looking at the accuweather seven-day forecast, you can see that string of sunny and mild days coming our way through sunday, through the weekend. in fact, high temperatures over the weekend will be in the upper 60s inland. mid- to upper 60s near the bay

covid. >> you absolutely could. and lunar new year is celebrated by people all over the world. and one of the hallmarks of it are these massive banquets that are amazing. half of my family is chinese, and we celebrate it every single year. i hand out the red envelopes, which i'm going to be mailing out this year with the lucky money for the younger kids. so there are ways to distance. if you have to have a gathering and you must be outdoors, do it outdoors and make sure you're not sharing any food. you're keeping that six feet distance, and people have their own food. they're not sharing silverware, not sharing any of that. a special note to my chinese family, i have to say -- happy new year. >> can you translate that? thanks. my mandarin is not that strong these days. valentine's day. it seemed to be pretty safe. if it's you and your significant other, and we assume maybe you're living with your significant other, pretty safe. what warnings would you have for

that? are we okay on valentine's day? >> i think if you are going to be with someone in your immediate household, or someone who you may have a special bubble with, or you potentially quarantined enough to be safe with that one person, that's a different story. but this is a time when people want to get out. they want to go on dates. they want to go have dinner, have food, interact with one another, just remember any slip-up could push us backwards. two quick notes about valentine's day. think about everyone else out there who might be lonely and need an extra reach-out. try to be there for one another when a lot of people might be feeling the effects of the quarantine. and for all three holidays, try your best to support local businesses. there is a lot of businesses which would be able to deliver food for flowers. try to reach out and help your local community as you're all celebrating safely and at home. >> i think those are great points, especially for people who may not have somebody to share valentine's day with. we're coming up on a year of going through this. the loneliness factor is through

the roof for so many people. >> absolutely. absolutely. >> one more thing i want to touch on before we wrap it up here. the mass vaccination site that was announced for the oakland coliseum coming up february 16th. earlier we reported they're hoping for 6,000 shots per day. how much will that help us kind of rev up here, because we're really way behind with we had hoped to be in terms of vaccinations. >> i think it's going to help us get to place where every person in the bay area who needs a shot definitely needs one. a couple of important notes is the federal support in conjunction with local and state officials, which is a really important note because it's not going to diverge away from other resources towards getting our local community vaccinated. i think it's really important for people to understand this is not only a move to get more vaccinations into californians, but it's also addressing the inequity we've seen throughout the pandemic and making sure that there is a regional resource for the underserved community, which is really important when it comes down to
