the senators, now jurors, were all witnesses to that deadly insurrection on january 6th and today they will return to the very chamber they fled from to put a former president on trial for the first time in our nation's history. this morning, the senate is now just hours away from launching the unprecedented second impeachment trial of donald trump, preparing to try the case in the same chamber that was raided by his supporters just weeks ago. democrats argue that the former president is singularly responsible for the siege saying his words incited the deadly insurrection. >> if you don't fight like hell you're not going to have a country anymore. >> reporter: trump's lawyers claim that speech was entirely protected by the first amendment writing in a brief that in over the 10,000 words spoken, mr. trump used the word fight a little more than a handful of times saying he didn't mean it literally and claiming that those who breached the capitol did so of their own accord.

>> rachel, thanks very much. let's bring in our chief washington correspondent jon karl. jon, we have a sense of what the trump legal team's arguments are going to be. how is the broader trump world looking at this? what do we know about what the president is thinking? >> reporter: they're focusing george, as you heard rachel say, solely on that question of constitutionality and making the case that the responsibility for the riot rests with the rioters. but what i am told donald trump himself is primarily focused on is revenge. he wants to take revenge on those republicans who voted for impeachment, on those who have been insufficiently supportive of him during this time and that once this trial is over, donald trump will re-emerge and i am told by his political advisers reassert his control or at least try to reassert his control over the republican party. >> meantime, jon, president biden is staying as far away from this as he can. >> reporter: no question. joe biden is in the midst of his first 100 days. he needs to get his legislative priorities through the senate

7:09 am
know, it seems as though from perspectives of logic and history and past practice we have done this before, that there is no constitutional obstacle to proceeding this way and every historian and legal scholar, i would say vast majority of historians and legal scholars who have looked closely at this have concluded the president's argument is wrong and this trial is perfectly constitutionally permissible. >> we saw that 78-page brief from the president's lawyers saying this is a political witch-hunt say he had a first amendment right to say what he said. what is their strongest argument? >> you know, i do think they will rest on these legal procedural arguments that the first amendment protects the speech. i don't think it's a strong argument. the first amendment maybe doesn't apply with full force in an impeachment proceeding anyway. this isn't a judicial proceeding where ordinary first amendment doctrine would be binding but even if it were there is a strong argument that this is incitement.
7:10 am
incitement of violence or insurrection is a type of speech outside the protections of the first amendment. but it seems as though both the argument about timing and the argument about the first amendment will be front and center and we won't hear many in defense of the president's conduct. >> what is a win then for house impeachment managers? >> i think if more independents around this country walk out of this impeachment proceeding and believe that the president is responsible and should be held accountable, when you view this as a political proceeding, that i think would end up being a win for them in a sense of accountability. >> dan, kate, our entire political team will join us for the live coverage of the trial that starts about 1:00 eastern. michael? >> all right, george, thank you. now to the race to vaccinate. major pharmacies are rolling out plans this week as they get ready for those additional 1
