rosa, up towards windsor. back in san francisco, looking from our exploratory camera, few low clouds rolling over. we'll call it partly cloudy. little bit cooler this morning, low to mid-40s at 7:00. mid to upper 50s at noon. and mid-50s to low 60s at 4:00. more on tomorrow's rain in the weekend rain coming up. let's get over to jobina with an incident to talk about in traffic. hi, jobina, what's up? >> hi, mike, thank you. we have new video this morning that shows the moment a semitruck slam nazs into a disa car. i want you to look at the frightening moments here, on camera, it happened last night before 11:00. a car spun out and was stopped in the middle of the highway when a semitruck going northbound drives by and hits it straight on. the crash sent material flying across all lanes and put traffic to a stop. no one appeared to be in the car when it was hit by the semi. and the chp was able to clear the roadway. >> thank you, jobina.

three hours to go until opening arguments in the second impeachment trial of former president donald trump. it marks the first time a sty, the trialents f both sides over whether the trial is even constitutional. abc news reporter andrew dymburt live on capitol hill. good morning, andrew. >> reporter: good morning, kumasi. house managers spent the better part of the first day of this trial trying to link trump's words in the days and weeks leading up to the riot, arguing if those words aren't impeachable, then nothing is. the senate chamber under siege a month ago now a courtroom. on the first day of former president donald trump's second impeachment trial. house impeachment managers using searing images from the january 6th attack to lay claim that trump incited the deadly insurrection. >> if you don't fight like hell, you're not going to have a country anymore. >> reporter: jamie raskin recounting how his family was with him that day at the

capitol, his emotions weighing heavy as he recalled what his daughter said to him. >> she said, dad, i don't want to come back to the capitol. >> reporter: day one for this unprecedented trial was meant to focus on the constitutionality of the trial. trump's lead defense attorney bruce castor spent most of his time on arguments that weren't clearly related to those constitutional questions. >> the united states senators are patriots first. they love their country. >> reporter: and sources tell abc news trump is not pleased with the performance of his defense team. trump's other attorney david schoen trying to assert since trump was removed from office by the will of the american voters democrats have no case. >> for a great many americans see this process for exactly what it is, a chance by a group of partisan politicians seeking to eliminate donald trump from the american political scene. >> reporter: and that argument ultimately falling short. senators voting to move ahead with this trial and you had six

better bay area, we are tracking every step of getting students back to the classrooms during this pandemic. today some kids in the san ramon valley unified school district are heading back to campus. abc 7 news reporter amy hollyfield is live for us at greenbrook elementary school in danville. good morning, amy. >> reporter: hi, good morning. the little ones here are returning to school, so tk through second grade will start today. can you imagine if they get in the classroom and the calendar says march 2020? that's the last time they were here for in person learning. so the little ones coming back today, the third through fifth graders will start next week. contra costa county is still in the purple tier. so middle and high school students are not cleared to return to the classroom yet. this state says the older kids can return when a county has been in the red tier for at least five days. officials say covid numbers are falling across the board in contra costa county.

this doesn't mean an end to distance learning, though, to limit the number of kids in the classroom at one time, students will have two days in class and they will join by zoom the rest of the week. the superintendent of san ramon valley schools says this is a day they have all long anticipated and he is grateful that this day has arrived. reporting live in danville, amy hollyfield, abc 7 news. >> thank you, amy. new this morning, san mateo union high school district says they will restart in person classes. the teachers association and the school board have agreed on a phased reopening that starts when san mateo county moves into the red tier. schools will start with specialized programs for students with disabilities first. then eventually students who opt for in person instruction will return to a hybrid system, switching between in person and virtual learning. san francisco is expanding its lawsuit against the city school district. the city now says the school district is violating students' constitutional rights by not

reopening classrooms. the amendments added this week also allege the district is discriminating against students on the basis of wealth and violating a state law requiring districts to offer in person instruction to the greatest extent possible. san francisco mayor london breed says she does not think it is realistic at this point that schools will reopen this year. that's despite a tentative agreement between the teachers union and the sf unified school district which says in person classes can resume after all teachers have been vaccinated. teachers will be eligible to get vaccinated in the city, starting just two weeks on february 24th. california is set to pass new york as the state with the most covid-19 deaths, according to data compiled by johns hopkins university of medicine. new york has reported 45,140 deaths. california now has 45,009 deaths. according to the new york times, new york ranks second in the nation in deaths per capita, and

it is going to be dry all day. take breaks if you're inside, it is our last really sunny and mild day moving forward. now, here is a look at what's going on with the storm impact scale for tomorrow. a 1 and that goes through friday morning light for light to moderate rain, slippery pm commute tomorrow and a.m. commute friday. little gusty, but nothing that will cause any damage. here is a look at what's going on, light rain developing to the north bay during the morning hours, becoming moderate after lunch and then spreading over the rest of our neighborhoods during the evening and early overnight hours. about a quarter to half inch is likely. jobina? >> thank you, mike. good morning, everyone. we are going to look at the map first here and talk about how clear it has been. pretty much all morning long. the past two days we have definitely had some issues on our roads. look at that, mainly green. we have slowdown out of tracy and then approaching the bay bridge. that's why i want to take the toll plaza camera so you can see what is going on there. according to the chp, no mitering lights on yet that we know of. so it is good that we are not seeing any huge slowdowns there.

you can tell for sure as people approach. and then also i want to look at our next slide camera outside here and just see the conditions around the bay area and this is in san jose showing off 101 for you this morning. again, no major blocking issues or crashes to report so far this morning. back to you. >> all right, hope to keep it that way. thanks, jobina. developing news to get to here this morning, crews working to clean up hundreds of gallons of petroleum that spilled into the san francisco bay. it happened yesterday near the long wharf off point richmond. you can see it in the video from sky 7. officials confirming 600 gallons went into the water and at one point in the day at least five gallons were leaking every minute. refinery officials say the leak was contained. a health advisory was lifted last night. some people are concerned that this oil could affect wildlife in the water. >> there haven't been any oiled animals reported at this time. we have the oil wildlife care

week. jobina has more on s the plans to use astrazeneca's vaccine. jobina? >> thank you, kumasi. south africa pulled astrazeneca's vaccine over concerns that it did not protect against mild and moderate cases of the variant found first in south africa. now they're going to move to this one shot johnson & johnson vaccine, even though it has not been authorized in any country yet. south africa's health minister declared the vaccine safe in the national address. he said they will study to see what protection it provides frontline health workers from covid-19 and the new variant. j & j's trial was tested in south africa, the united states and latin america. south africa's health minister says it has proven effective against the variant found in south africa. last week they filed for emergency use authorization with the united states fda. if it is approved, the vaccine could become available as soon

as next month here in this country. kumasi? >> thank you, jobina. new at 6:00, marin county health officials expect to open a drive through coronavirus vaccination site in just a matter of weeks. it could actually come as early as february 21st. the county health officer said agreements are being finalized. however, he didn't say where it is going to be. when it opens, the site will be able to give up to 1500 vaccinations a day. got some cool video to check out here. hundreds of hummingbirds taking over a northern california home. wow. patty wagner-covington showed the video, it shows them fluttering around her garden in the sierra foothills. she said it was unreal to be able to watch this. she had one land on her head. patty says she set up bird fe feeders throughout her garden and this was the result. this is so serene, zen, peaceful looking, i'm channeling this on

welcome back. 6:23 on this wednesday. here is a look at the rainfall totals from our next two storms that hit us saturday and monday. not very impressive, but they at least keep us from getting deep near a drought, anywhere from about a quarter to a half inch of rain. here's jobina and kumasi. >> thank you, mike. this morning, police are revealing new details about the suspect in a mass shooting at a minnesota health clinic. jobina is tracking all of this from the live desking. jobina? >> thank you, kumasi. police say gregory ulrich was unhappy with the care he received at a clinic buffalo, outside of minneapolis, and had

a vendetta against the medical workers there. ulrich opened fire inside the clinic, killing one person and injuring four others. according to a court document, ulrich had been banned from the facility since 2018, and was not allowed to have contact with the doctor working there. investigators have not released the reason for the restraining order, but according to the minneapolis star tribune, a police report from 2018 says ulrich, quote, was calling his former doctor three times a day, threatening a mass shooting, to blow things up, and other revenge scenarios. >> i heard this man say get down on the ground, and i turned and i saw the back of this man and he had a gun. and there was screaming and there was shooting. >> ulrich's brother tells abc news he developed an opioid addiction after back surgery a few years ago, which he believes may have been a factor in the shooting. police have not released an official motive. julian? >> such a bizarre situation, thank you, jobina. new here at 6:00, overnight,

a fire caused major damage to an iconic atlanta krispy kreme location owned by none other than basketball legend shaq. video here showing the fire raging as crews try and put it out. wow. no injuries reported thankfully and the cause under investigation right now. the landmark location opened more than 60 years ago. i've seen a lot of people chiming in on social media saying they got to rebuild this criskrispy kreme. on a post on instagram, shaq who purchased the location in 2016, said we'll be back stronger than ever. >> let's hope. well, this black history month abc 7 news is celebrating the people in our community who are working to build a better bay area by making black history right now. a group of seven black friends from san francisco have banded together to expand black cultural space, home ownership and businesses. they counted sf black wall street after seeing last year's racial unrest and health disparities. the group worked on multiple community efforts including creating a city wide juneteenth

before we get to those stories, we want to check in with mike for a look at the forecast. good morning, mike. >> what's 9:00 to 5:00? i've never heard of such a concept. not in tv, right? >> the struggle. >> all right, yeah, can't wait to hear that story. nice to see you both this morning. let's look at what's going on. we have a little bit of fog in the north bay, visibility a couple hundred feet in santa rosa by the mile in napa, that stretches across 37 and heads over to novato. a light northerly wind means some of this may slip south. as you look at san rafael, nothing but sunshine waiting for you as you look south on 101 toward the golden gate. we're looking at walnut creek, 46 and partly cloudy. temperatures in the low to mid-40s. cooler this morning. 53 to 58 with sunshine at noon. a few passing high clouds as warmer air arrives this afternoon. 53 to 61. and if you're heading out at 7:00, we're under the stars around 49 to 53. quick turn around, rain in the forecast tomorrow, more of that coming up. kumasi. >> thank you, mike. students and parents in

contra costa county are wup newi some schools can finally reopen as covid cases are declining. we are tracking education as part of our commitment to build a better bay area. abc 7 news reporter amy hollyfield live at greenbrook elementary school with more on the plan to return. amy? >> reporter: you can feel the excitement here. the lights are turned on, the janitorial staff arriving early to get everything ready. the county's covid numbers have been going down. and that is why contra costa county's young children can return to school. the young kids can go back because contra costa county has seen less than 25 cases per 100,000 residents for the past five days. the county isll in cannot retur yet. middle and high schools can reopen after a county has been in the red tier for at least five days. so those are the state rules. there will be a mixture of kids -- of kids in class and

kids zooming from home. and that way they can limit the class sizes and get everyone to spread out and socially distance. tk through 6 is now allowed to return in contra costa county, acording to state guidelines. some districts are still working on their reopening plan and will remain closed for now. but here in danville, some schools in the san ramon valley district are ready and will start welcoming kidsen danville hollyfield, abc 7 news. >> thank you, amy. new this morning, the nation's third largest school district in chicago has reached a deal for students to return to class. chicago teachers union has approved a deal with the district and it includes plans for more teacher vaccinations and the possibility of school closures if covid infections spike. the first wave of k through 8 students will return tomorrow. san francisco's board of education has voted to end merit-based admission at the elite lowell high school. after an exhaustive seven-hour

meet, the board voted 5-2 in favor of changing the admission policy to a lottery system. t when racist incidents resurfaced at the school last month, the board quickly proposed a several community members felt the issue of equity and the safety of black students at lowell had been delayed for too long. >> stop saying this is a rushed process. black families in sfusd have been fighting for justice. what you're witnessing now is our words finally moving into action. >> has failed our students, has failed ed our families address what we know to be -- >> lam hopes the district and the school continues to discuss how the new policy will impact students there.

someone scrawled racist graffiti across from the school in san francisco. a derogatory term for wall of a near the chinese-american international school. a man who was driving with his kids home from school says that he was at a loss when he saw it. >> my children immediately asked me, you know what is that? and what does that mean? and i didn't have an answer for them at that time. because i was so -- i myself was shocked. >> he says he was surprised it see graffiti like this in san francisco, saying that he was born in the city, he considers it to be a melting pot. police say they contacted their graffiti team about it. in just a few hours, the democrat house-led impeachment team will begin opening arguments in the second impeachment trial of former president donald trump. yesterday the senate voted 56-44 to proceed after debating the constitutionality of a trial of a former president.

jobina is at the live desk tracking what is happening this morning. >> thank you, julian. good morning. the trial resumes at 9:00 a.m. today, our time. and the arguments -- it will begin with arguments and a vote on any motions and that will be made this morning. opening arguments will begin after that. yesterday only six republicans voted with democrats to advance the trial. trump's defense attorney and -- had a -- trump's defense attorney had a rambling argument yesterday that included at least one moment where he praised democrats. sources tell abc news trump was not pleased with the performance, despite that it is unlikely democrats will get the 17 republicans needed to convict trump and bar him from holding future office. there is another possibility, though, for republicans, censure. jonathan carl talked about that on "gma." >> republicans who do not condone what the president did, who condemn what the president did, need some way to be on record saying that they condemn

this outbreak. help is available now for small businesses in napa hit hard by the pandemic. they can ask for a $5,000 grant, but there are some requirements. the businesses must have five or fewer employees and the owner has to be considered low to moderate income. also they must be able to prove they lost at least 25% due to the pandemic. fficial explained they're trying to target a specific segment of business owners. >> we're really trying to support those small mom and pop shops that likely didn't get access to some of the bigger resources out there when they were -- even some state programs. >> so many business owners looking for lifeline right now. applications will be taken until february 22nd at 4:00 p.m. new details this morning on the push to give hero pay to grocery store workers in san jose. the city council approved a $3 an hour pay bump.

providers. cases of covid-19 in santa clara county have fallen dramatically, but health officials are still warning that they are in the deep purple tier and the numbers are extraordinarily high. santa clara county health officer dr. sarah cody said they are still recovering from the greatest and deadliest surge which started back in november around thanksgiving. that decline began on january 14th and continues today. and when it comes to minority groups, the county reports that those cases are also declining. but are still high, especially among the latino population. >> we are trending where we want to be. but we are by no means, by no means are we out of the woods. >> there is some more good news to report. hospitalization rates are also down, but still too high. that's one of the reasons that the county is still in the purple tier. and will be there for a while. now to your morning money report, the city's largest private employer salesforce

the sale of tiktok is now on hold. according to wall street journal, president joe biden is reviewing his predecessors efforts to address potential security risks from chinese tech companies. the tiktok deal had been driven by former president donald trump, he called the app a quote, danger to national security, a claim that tiktok denied. aunt jemima is getting a new name and new logo and new look. the company announced it would be dropping the brand name following the criticism that it featured a charactaricature of k woman, it will be called pearl milling company. aunt jemima was one first brands to announce it would be changing its name last year as protests against racial injustice unfolded across the u.s. uncle ben's also joining that list as well. a case of zoom filters gone wrong has become a viral

transportation secretary pete buttigieg, speaking to axios on hbo. he says the cdc is looking into the option, and that data and science will ultimately guide any final decision. on monday the new cdc director said screening u.s. travelers for covid-19 could be helpful. san mateo county will hold covid-19 vaccination clinic at sfo this week. on friday, the clinic will provide first vaccine doses to more than 5500 residents who are 65 years and older. in addition to the vaccination clinic at sfo there will be a clinic for a second dose vaccinations at the san mateo county event center. appointments in the wait list have been filled for both clinics, and as of sunday, nearly 85,000 people in the county have received at least their first dose. happening today, the super bowl champion tampa bay buccaneers will celebrate their victory with a boat parade. it will be held on the hillsboro river along tampa's downtown water front. fans will be able to view the parade at various spots along
