desk with what this means for ur uric. >> could have a big impact on uber. what we're learning is that the uk supreme court's seven judges unanimously rejected uber's appeal against a lower court ruling. they agree two uber drivers were workers under british law entitling them to benefits such as paid holidays and minimum wage. uber argued that the two were independent contractors. this is similar to the issue california faced. the state designated ride hail drivers but that was overturned in november. uber said the next steps would be to survey driver answer what they want going forward and they will make a decision about what is next in the coming weeks. kumasi? this morning the new plan from lawmakers to get students back in classrooms by april and the pushback from governor newsom. education one of our focus

we work bld a frans oposal how w as a new proposed bill we talk to a teacher here at this elementary school in san francisco who is really excited about it. she says she is is a better teacher in person. san francisco assembly phil ting helped draft the bill. "the safe and open schools" plan. gives schools financial incentives to open by april 15th. the bill allocates $6.5 billion to districts. 2 billion to help reopen schools and 4 billion for inperson learning loss. for one san francisco teacher who wants to go back, she says this is a positive step. >> i'm pretty disappointed in how things have been handled. i just don't know what is taking our district particularly where we have low numbers so long. and it is frustrating i'm sure not only for teachers who want to go back but also families who

have younger students who need that interaction to go back. >> reporter: governor newsom says the bill is a step in the right direction but the bill doesn't go far enough fast enough. here? san francisco schools can't reopen without infrastructure for staff and student testing and vaccines for teachers and moving out of purple tier. san francisco city attorney said yesterday he's going challenge the legality of the district's plan if they don't reopen to vulnerable students in the current purple tier without waiting for staff to be fully vaccinated. so still a fight over whether schools will reopen, especially here in san francisco. and now stepping into the conversation lawmakers in sacramento. live in san francisco, amy hollyfield, abc7 news. >> thank you amy. happening today. a demonstration by parents and students in san francisco. students are holding a series of zoom in mornings where they

gather in front of their locked school sites or at nearby parks for their online classes. this one was near clarpten elementary yesterday. organizers say it sends a message that they are ready to learn at school and together. this morning' demonstration is happening at mira lume elementary. the 14-day covid-19 positivity rate is now below 4%. there were fewer than 6,000 cases reported in the last day and hospitalizations and icu administrations continue to decrease. there are now fewer than 8,000 covid-19 patients hospitalized in california. compare that to a week ago when there were more than 10,000. and the governor is expected in the pais area today to give an update on the pandemic and vaccinations. the governor has been touring vaccination sites across the state, including san francisco's moscone center just a week ago. today's event starts at 9:00.

the high volume vaccination site at city college of san francisco is expected to reopen today but they are only going to be administering shots for second doses. the city was forced to temporarily close vaccination sites at moscone center and city college because of lack of supply earlier this week. moscone center is expected to reopen next week. and a new place you can go if you are 65 and up if you live in san francisco, you can walk in to get your covid-19 vaccine. shared on twitter, you can get a shot from 9:00 a.m. to 3:00 fm at sf general hospital. and that is going to be available until tuesday. despite the progress that many counties are making, winter weather across america has crippled parse of the covid-19 supply chain. >> the gotten it sooner is because we're not getting enough vaccine from the state. >> supervisor john joya says

shipments to contra costa county are held up because of bad weather in the mid west. napa county is telling abc news 900 appointments will be delayed until at least thursday. marin county has delayed 300 appointments until it gets another vaccine shipment. at least a dozen states and washington, d.c. have declared emergencies because of the winter weather that is slamming much of the country. at least 40 people have died being blamed on that severe weather and the conditions there. and it was yet another frigid night across texas. jobina fortson at the live desk. a new crisis is emerging in texas, chaz short supply of water. over firefighters were forced to bring in water to battle a massive apartment fire because hydrants are empty nearby. the state's power grid buckled

last resort. this week alone five airports nd powoble.e pause of. tate eye to eye for opening schools for inperson learning. lawmakers drafted a proposal to open schools by mid april. and abc7 news amy hollyfield is live in san francisco with more on the plan and what school district officials are now saying about it. amy? >> reporter: well in san francisco, reggie, as you know getting schools to reopen has been a contentious issue. we talked to a teacher here at this elementary school. and she said she's really hoping that this proposed bill coming out of sacramento will make a difference and it welpen schools. she thinks she's better in person. this new proposed bill is called the safe and open schools plan. it says schools need to be open by april 15th and offers money as an incentive. the bill allocates 2 billion

dollars to help reopen schools and 4 billion for inperson learning loss. one of the bills authors thinks money will talk. he feels like the april 15th deadline will happen if this bill passes. >> you know, i have more than faith. what i have is we have incentives. if schools don't reopen by april 15th, they will have to start returning that part -- you know that the $2 billion. the $4 billion has to be used for inperson learning loss. >> governor newsom has tried this strategy. his $2 billion reopening plan also offered money as incentive. his plan was widely criticized. e lture is a in theed plan i right direction but he says it doesn't go far enough or fast enough. here in san francisco schools do not look anywhere close to opening with the district saying they need to be out of the purple tier. all teachers need to be vaccinated and infrastructures need to be in place for student and teacher testing before they reopen. but sacramento is now working on the issue and as the schoo

wiow up theheid continueis learn live hollyfield, abc7 news. thank you amy. president joe biden is preparing to visit pfizer's covid-19 vaccine manufacturing facility today. that trip had to be rescheduled from yesterday because of the winter storm that hit washington, d.c. jobina is at the live desk with how this winter emergency is really taking a toll on vaccination efforts. jobina? >> yes kumasi the weather emergency is impacting just about everyone in every part of the country in some way and all of this is happening as the u.s. comes much closer to a very grim milestone here. we are looking at half a million covid deaths. treacherous weather has slowed delivery of tens of thousands of doses across the country. vaccinations were postponed or canceled in at least 42 states. los angeles canceled thousands of appointments because of shipment delays. americans expecting a vaccine

to stay healthy. he's got word that workers are now eligible for the vaccine. >> it is a step forward and they have the option to be safer. >> reporter: but it could be several weeks before jose and his coworkers can get the shot. >> how quickly we can vaccinate those categories of individuals will depend on how much vaccine we get from the state. >> reporter: recent allocations have not been plentiful. so for now contra costa county is only taking appointments for second doses. >> this pilot has really taken off. >> reporter: san mateo county supervisor says this vaccine pilot program at an sfo parking garage has been successful. an estimated 12,500 shots over four days. 4,000 alone will be given on friday. he believes he can more than double that if more doses can be sere believe we could test potentially

be stored in regular freezers for up to two weeks. if approved that would give pharmacies and vaccination centers a lot more flexibility. pfizer is also launching a new trial to see if their vaccine is safe during pregnancy. pregnant were excluded from the first trials. anyone who is pregnant should speak to their doctor about the vaccine. costco is offering coronavirus vaccines to eligible people in several states. costco says it is administering vaccines as soon as they are available as part of the federal retail pharmacy program. now, this is only being offered in select pharmacies in some states including california but for now the only location locations are in southern california. proof of vaccination could soon get you into hawaii. the state is working on a vaccine passport program. it would low-you to skip the

uniform policy. happening today. santa clara is hosts a grant opening for his animal services center. the center is touted as the most advanced animal care facility in the country. the event will be live streamed at 11:00 this morning on the santa clara county animal services facebook page. the san francisco zoo is pledging to help raise money to rescue sea turtles in texas. over the last three days, several hundred volunteers have been braving the winter weather to try and save 1,500 sea turtles. the turtles have been washing up along the south texas shoreline. they are going through a cold stun which makes them lifeless. the volunteers are working to warm them back up and get them back in the water. if you want to donate, we have a
