driver waiting at the crossing. >> it was just an accident. i got stuck. >> reporter: the driver of the truck and passenger got out just before the collision. the truck driver said he had a full load, and was headed to the dump, when he tried to drive up over the track into the train crossing on fruitville avenue. >> all of a sudden i saw that i got stuck and that is when i saw the light. i said oh my god, man. i tried to back it up and go forward, no way. i got out of the truck right away and i ran all the way to that light over there to try to stop him. he could not slow down. no way. they dragged the track down

the road. even the passengers on board going from seattle to los angeles were okay. all of a sudden they started slowing down and kind of a halt but not too abrupt. everybody was safe. it was not too scary. then they told us that we hit something and we would have to get off. >> she chose to stay off and others reported and waited as engines were switched out. amtrak declined to go on camera about the accident. union pacific officials are here on the scene investigating how this happene. in oakland, leslie brinkley, abc7news. the rain is back today. video shot today in san francisco. you can see it is coming down pretty good. the question is how long will we see this rain? spencer christian with a first look at the forecast. >> it is beginning to taper off

already in some places but quite wet as you can see. let me give you a closer view a few seconds ago. we had some heavier activity right here in the central part of our viewing area around san francisco. that seems to be tapering off there. we had heavy downpours near san jose but as you can see in the south bay it is fairly steady around san jose but many other areas are seeing a little bit of a break in the action. the storm ranks one on the impact scale. a storm of light intensity. four tonight and the early hours tomorrow morning we expect more light to moderate rainfall tapering off two isolated showers in the morning and it will be gusty over the hills. here is the forecast animation. notice later tonight we will see more widespread isolated showers and by five tomorrow morning when the morning commute gets underway there will be partial clearing and some areas so that may lead to a mostly sunny day. i will have a look at the forecast coming up in a few minutes.

>> two elderly asian americans in their 70s and 80s were injured yesterday after being attacked by a homeless man on market street. the suspect is now under arrest. it is just the latest in a series of attacks on asian americans. we have been telling their stories and share the growing fears of the victims. >> i am so afraid to walk the streets to do my errands, because going to happen. >> reporter: the terror 83-year- old gordon paying is experiencing stems from what experienced on valentine's day. after he noticed a man staring at him while he walked to a tenderloin senior center for his daily launch. >> i knew that i was in trouble because he stared at me with that look. he came across very quickly and pushed me so i fell backwards. >> reporter: gordon broke his hip in three places. >> street people help to me. they were so kind, i cannot believe it .1 of the drug

dealers went to his car and gave me a cane. >> he spent nearly a month in rehab. he is still in immense pain. >> an awful experience, i would not wish this to happen to anyone. >> reporter: similar incidents have happened across the bay area. just today, and 83-year-old man was brutally knocked to the ground wednesday morning. a 77-year-old woman also was attacked in a similar fashion around the same time. unlike gordon, his father fell forward, and his neck is broken in several places. as fpd arrests stephen jenkins for elder abuse. the man arrested in gordon's case, haskell allen was apprehended as well but according to documents he has a long felony record including at least four cases of burglary and assault with a deadly weapon. i shared this news with gordon. >> oh my gosh. i just wish they keep him in jail. for a period of time.

>> while he does not know the solution to end this epidemic of assaults, he shares these words with everybody. >> i want to say be careful. be careful of your surroundings. it could happen to you. you know. >> the fundraiser for the 77- year-old woman attacked yesterday in san francisco has now reached $380,000. her grandson set up this go- fund-me page. he says his grandmother is a cancer survivor and is now afraid to leave her home. the money raised will be covering her medical expenses, therapy, and other bills. these kind of attacks are not unusual. they seem to be happening more and more often. we are here right now with more on what is happening here. this is to just be an occasional thing. it is now an epidemic and completely unacceptable. >> the question is what to do about it, and what we are

dealing with is an increased homeless population and mentally ill population on the streets. there is a myriad of problems sort of wrapped up. but they are on the streets now. and it is not just the elderly. a lot of people are concerned, including who we talked to this week, john brian, the president of the building owners and managers association in san francisco about what the problem or the challenges with the street behavior like you're talking about, with something like returning office workers and making them feel like they are safe to go back into the high rises downtown. here is what he had to say. >> the pandemic is on everybody's mind right now, even before the pandemic, san francisco's downtown was having problems with the homeless and safety. they were having problems with those transients and people feeling like they were not happy about it necessarily. what are the chances that the pandemic on top of that kills of the downtown?

>> they are real issues that we are facing and you are right, there are always going to be the issue of homelessness and safety and the mass transit and that all plays a part in the mentality and the psyche of people coming downtown. i think what we are focused on is making sure that our buildings are healthy, that our buildings are safe when people are ready to come back in, and they are. they have been since the summer and the fall and they will be ready once the summer causes things to open up. some of the other issues around homelessness and crime need to be addressed. i think that everybody needs to feel safe and comfortable in this environment downtown. >> we will have more on interview and other people we talked with in everything from the hotel industry to small retail about how the city is going to reopen and can reopen, and the challenges facing it. one of the things is the behavior on the streets. we have to be honest, we have various programs to encourage people to go into treatment for drugs and mental health but no

enforcement mechanism standing in the state of california or in the city of san francisco. here is a statistic that you might find shocking. the latest counts by the city, the people that go out and work with the people in the homeless, found that about one out of every 10 people in the tents now actually have a hotel room or a shelter space where they go to or have the option to go to, but they're choosing for whatever reason to go back out on the streets whether it be for drugs, friends or whatever. getting somebody inside into a house is not necessarily going to change their mental or drug state. >> that just complicates the whole problem, but let me ask you another question here. abigail stewart-khan was head of the homeless department and just resign. how will this impact the situation going forward? >> it complicates it. she is the second one to move on. it is a stressful and thankless job. you answered the board of supervisors and the homeless advocates in the media in the neighborhood association.

everybody is pulling at different directions because there is not a common idea about how to go forward. until san francisco comes up with that they will continue to be pulled in different directions and unfortunately, we may be seeing as much or maybe even more of the random violence on the street that we have seen up until now. >> thank you, phil. appreciate the time. the city of oakland of oakl big step forward in reimagining public safety. the oakland city council green with a new program that will send out civilian medical and mental health professionals to respond to nonviolent emergency calls instead of police. julian glover explains how this program would work. >> reporter: 911 calls for non- violent emergencies will soon be met with two civilians with medical and mental health training. that is instead of police with

badges and guns. >> a large number of 911 calls that get sent to police traditionally involve nonviolent matters that would be better handled by trained civilians who have expertise in mntal health. >> the motion passes with a vote of eight yes. >> they voted unanimously to move forward with the creation of a civilian crisis response pilot program. it stands for the mobile assistance community responders of oakland. mental health experts and emts from alameda county will be contracted and the program will be run by the oakland fire department using the existing dispatch system. police will be freed up to respond more quickly to urgent 911 calls, potentially improving response times. >> it means a less violent oakland. >> they have already seen the work in action. she wants the community led program called mental health first, offering free mental health support on the weekends when other nonpolice options were unavailable. she sees this as a move towards

enrollment because what has happened over this pandemic is we have seen a record number of families leave the system because there has been no in person learning and number three, to get back enrichment activities that make education a full experience for education. the music, the art, the sports, the library. >> property taxes once the main source of funding but that source of income was cut short because of proposition 13. passed in the 1970s which protected homeowners from future sharp increases. the rice initiative proposed for san francisco public schools would require $2.5 billion over five years to meet his goals. the money could come from philanthropists but to sustain that level of quality, school districts need the funding to be in perpetuity.

for the social distancing guidance when it comes to schools. the cdc is expected to recommend schools in force three feet of ethical distancing instead of six. according to reports, health officials are basing the recommendation on new data including a recent study of massachusetts schools that found no discernible difference in infection rates in districts that enforced six feet versus three feet of social distancing. maybe with kids going back to school, what is your take on this? >> you know, i would like to know more about the study. how many kids were involved, how many were infected? i think that there is still a lot of uncertainty about what can happen. remember early on when the study was done, if you wear a mask versus not wearing a mask, how far do the droplets move? so i don't know. i feel like it is just one study. i'm still a little skeptical. >> spencer, i think the key from what i hear talking to the doctors who appear on the show is that it is about ventilation

and then the digested turning it into a soft creamy cheese which sounds inviting. and you crack open the top and eat it, and all .although some spin the cheese through a centrifuge to merge the with the cheese , so maybe it is not as crunchy. i don't know. i do not know anybody that would eat that. anybody want to raise their hand if they would like such a delicacy? i see no hands being raised. anybody -- spencer, you you you fine dining, this sounds like something -- >> spencer. >> spencer? >> i do enjoy fine dining, but there are many things that are typical items on fine dining menus that i don't eat. this would be one of them. i'm not into that. >> i would do pig blood, i would do fishbowl eyes or fish eyeballs, and i would do maybe even chicken feet, but not . that is -- yeah. two adventurous. >> and i love cheese.

celebrity chef, guy fieri, is known for his community service during the pandemic. i caught up with him to talk about the future of restaurants and his love of the golden state warriors. >> there was an estimate that 50% of the restaurants in san francisco, let's say, might never open again. how concerned are you about something like that? >> i am more concerned about it on so many levels than i can probably even really breakdown. knowing hundreds of restaurants, personal friends that have closed. and knowing that each one of those restaurants has at least 50 employees,

employees. restaurants are so much more than a place to eat. it is not just about consumption of great food and drink, it is a meeting place. it is a -- it gives us wellgive being and comfort. fortunately, the positive side, dc restaurants adapting and overcoming. fortunately, there is the california restaurant association and a great president over there and really working hard, fighting to get restaurants open. the negative is, we are going to lose some of our favorite restaurants and we are going to see families and communities really adversely affected by this, even now as we are we somewhat through this and getting our vaccinations and so forth, the echo of this financially of what it takes, restaurants do not have a lot of -- i mean, most restaurants do not have a lot of reserve capitol, you know you mark we kind of make it every week but i will tell you what, you will never meet a more optimistic group of people. and they work together and stick together and help one another. so, i have nothing but positive

i have been called the kite guy, the kite man. people would come been and ask if i am the kite guy from martinez. it is a lot of fun. like a lot of people growing up, i flew kites as a kid. i grew up with my sister find kites but then i took a hiatus until i moved to california and son people in san francisco flying kites. that's how i got back into at about 22 years ago. the best time of year to fly kites especially at the marina is from mid-april to mid- october. you want onshore winds. they are smooth and consistent and some of the best winds i have flown in in the world. a lot of my kites are custom. colors, designs, led lights that i can light up the night

with. i have one that is twice as big as this which is about 67 feet across and that is massive. last august i hurt my back and it took almost 4 months of lying on my back. august, september, and october are some of the best times to fly. people would ask when i would be out to fly and i said that i can and i'm sorry. they asked what i need. it was humbling. now i fly for the community that loves me and i love it. you cannot help but feel pride that the sport that i enjoy is enjoyed by so many people. this is why i do it. >> flying high once again. thank you for joining
