faith adieu bay joins us from -- faith abubey joins us from washington. good morning, faith. >> reporter: good morning to you, mona. federal facilities are only allowed to keep migrant children in custody for three days, but we're learning many of them, thousands are being held longer than that. breaking overnight, new numbers reveal thousands of migrant children are being held at border facilities longer than legally allowed. sources tell abc news more than 3,000 unaccompanied migrant children have been in custody longer than three days, the maximum amount of time legally allowed, and 823 of them have been in custody longer than ten days. that's a fivefold increase in just one week. >> what it looks like are children standing up with nowhere to sit down, children who can't lay down all at the same time or can't lay down at all. >> reporter: president biden and his administration recently encouraged the migrants not to come to the u.s. as border facilities have become dangerously overcrowded. despite a promise to be more transparent, the administration has not allowed journalists

inside those facilities to see the conditions. >> it seems to me to say it's impossible to do because of covid sounds like an excuse. >> chris, we're working on providing access so that individuals will be able to see what the conditions at a border patrol station are like. first things first, we are in the midst of a pandemic. >> reporter: returning from camp david last night, the president said he'll be visiting the southern border to see the conditions firsthand. >> are you thinking of going to the border? >> at some point, i will, yes. >> reporter: repealing donald trump's so-called remain in mexico policy, which required asylum seekers to wait on the other side of the border. republicans saying that change led to the surge in migrants happening at the border. >> it's going to get worse. it's going to get a lot worse. springtime, summer, more and more come over, and i predict a million people trying to get into this country by the summertime. >> reporter: and this morning, a new report claims the biden administration was warned about a border surge even before biden

took office. according to "the washington post," career officials at u.s. customs and border protection, quote, tried to issue sober alarms to the biden team about the likelihood of a crisis at the border that could quickly overwhelm the nation's capacity. yet biden immediately embarked on an aggressive strategy to roll back trump administration policies. and the biden administration says it inherited a broken immigration system that it's now working to rebuild, mona. >> faith, thank you. turning to the pandemic, there is a new move to crack down on spring break crowds in miami beach after violence erupted over the weekend. it comes as doctors warn about the rising risk of coronavirus mutations. >> reporter: overnight, more spring break chaos in south florida. people dancing on cars in miami beach as a massive crowd packed the city's iconic ocean drive, ignoring a mandatory curfew. >> it's now past 8:00 here in miami beach which means we are past curfew.

there are still thousands of people out, but police are doing their best to clear out these crowds. >> reporter: miami beach extended an 8:00 p.m. curfew for the next three weekends after spring breakers descended into the district saturday. forcing s.w.a.t. teams to move in, shooting pepper balls to break up the mostly maskless crowd. local police say more than 1,000 people have been arrested since the beginning of february. a majority of them from out of state. the crackdown coming as an internal government document shows miami had the highest coronavirus positivity rate of any major metro area in the u.s. last week. florida now leads the nation with the most cases highly contagious uk variants of the virus. >> i'm worried right now, especially with this very contagious uk variant spreading in florida, what we're going to see is people get infected, pick up the infection from each other, and then spread it across the country and possibly around the world. >> reporter: across the country, cases are on the rise in 15 states. michigan has seen infections rise 92% in two weeks.

>> we could potentially be at the beginning of another surge in michigan. >> reporter: and now a new warning from the former head of the fda. dr. scott gottlieb says a new york city variant of the virus is concerning because it carries a mutation that could allow it to reinfect people even if they have been vaccinated. >> half of the cases of the new york variant contain a mutation seen in the south african variant which may allow the virus to invade our immune system, make the antibodies and that vaccine less effective. there's the potential here, so people need to absolutely paw attention to this. >> reporter: in texas, which has also seen big spring break crowds, the governor says the state's positiity rates have dropped to its lowest level since last year. the ceo of texas roadhouse has died from suicide. he suffered from covid-related symptoms. ken taylor was involved in his company's oernperations until h death, and during the

pandemic, he gave up his pay to support his workers. his family says after fighting covid, he suffered from tinnitus, or ringing in the ears. he was 65. an outcry against violence of asian-americans. a 27-year-old woman of asian descent was shot and killed in compton, california. her family is calling on police to investigate the case as a possible hate crime. in new york, a 66-year-old asian man was attacked on the street, left swollen and bruised after being punched in the face. protests were held across the country this weekend, demanding an end to the hate. a new poll finds 25% of americans say they've seen someone in recent weeks blame asians for the coronavirus pandemic. >> today we extend our support, our solidarity, and our love to our asian community, our pacific islanders. we see you. we love you. you're valued, and you belong. >> data from 16 big cities show anti-asian hate crimes reported to the police rose 149% just in the last year. one california lawmaker

feels the atlanta spa killings last week were hate crimes. judy chu told "this week" that the suspect indicated he purposely targeted asian-americans, but investigators say they have not found concrete evidence they were killed because of their race. retiring after facing a sexual misconduct allegation. the new york republican says he will not seek re-election. he apologized to a former lobbyist who accused him of rubbing her back and unhooking her bra without consent in 2017. reed says he was struggling with alcohol addiction at the time. he's among those who have called for new york governor andrew cuomo to resign over harassment allegations. reed was considering running against cuomo. former president trump is planning to make a comeback on social media. trump was permanently banned from twitter, facebook and other major platforms after he was blamed for inciting the capitol riot, but a spokesman says trump plans to return with his own platform in two to three months. time now for a look at your

a dormant volcano in iceland has come out of a 6,000-year hibernation. lava traveled more than half a mile down the mountain which is only 20 miles outside the capital city. no injuries or damage was reported. new to the moments that caused a panic at the san diego zoo. a father carried his 2-year-old daughter into this elephant exhibit. when the animal became upset, the man dropped his daughter while running away. they both still managed to escape from the cage there, but experts say they were lucky. >> so when i see this individual on this incredibly stupid behavior to risk his life and his children's life, i think that elephant displayed an incredible amount of patience. that elephant could have killed him and would have dispatched

him instantly. >> the father has been charged with child cruelty. police are looking into whether drugs or alcohol were involved. the man jumped into the cage despite multiple barriers, including a fence that was reportedly electrified. we turn to the scam targeting people receiving their government stimulus checks. scammers are pretending to be your bank, even using your bank's phone number to get to your cash. >> reporter: this morning, the better business bureau with an urgent warning. if your caller i.d. shows your bank is calling, be careful. it might be a scam. >> i started getting suspicious, but i was looking at the phone and it says capital one. >> reporter: jennifer gray thought capital one was calling to report fraudulent activity on her bank account. >> you think you're trying to stop something from happening, and i was stressed out, and my bank account got zeroed out real quick when they got what they wanted. >> reporter: she lost her most recent paycheck and stimulus check. >> we're seeing people saying contacting us saying they're

turning overseas, the british royal family could soon be making a family to improve diversity after fierce criticism stemming from their alleged treatment of duchess meghan markle. abc's megan tevrizian has more. >> reporter: this morning, buckingham palace is considering a move to become more inclusive. the royals are weighing whether to hire a so-called diversity czar to collaborate with minority communities saying the palace hasn't seen the progress it would like in terms of representation. it comes in the wake of that explosive oprah interview with prince harry and meghan markle, in which markle who is biracial claimed at least one member of the family questioned how dark her son's skin color would be. >> there were several conversations about it. >> there was a conversation with you? >> with harry. >> about how dark your baby is going to be? >> potentially, and what that would mean or look like. >> oh, and you're not going to tell me who had the conversation? >> i think that would be very damaging to them.

>> reporter: the couple not revealing who made those comments, later clarifying it was not the queen or prince philip. >> what was that conversation? >> that conversation i'm never going to share. at the time it was awkward. i was a bit shocked. >> reporter: days after the interview, prince william insisted his family is not racist. >> can you just let me know is the royal family a racist family, sir? >> we're very much not a racist family. >> reporter: a statement from the queen said, the issues raised particularly that of race, are concerning. while some recollections may vary, they are taken very seriously, and will be addressed by the family privately. a royal source says the new diversity chief could examine inclusion across the three royal households and says the work to do this has been under way for some time now, and comes with the full support of the family. that royal source said that many options are being considered, and the palace, is quote, listening and learning to get this right. kenneth, mona? >> thank you.
