companies are embracing remote work, she thinks that employees will want to come to their office and be around other people. it also allows gyms and restaurants to increase the number of people allowed in side . even though she is talking about wanting to see the city jumping again. her message also comes with a bit of caution. >> we know that there is work to do. we do not want to see another surge. that is why we are proceeding with caution in how we open. our museums were at 25% capacity, they are going to 50% capacity. indoor dining was at 25% capacity and it is going to 50. as we geintollow fice ace will increase. we have a role to play in getting the vaccine when we qualify. >> reporter: the mayor is working with the giants on opening day details.

>> reporter: the suspect in the shooting is scheduled to make his first court appearance later this morning. he is charged with 10 counts of first-degree murder. each for the 10 victims. family members say he may have been suffering from a mental illness. president biden is also calling for congress to immediately pass gun-control legislation. the president says assault weapons must be banned and loopholes must be closed. >> we have learned, one of the victims in the shooting was working as an instacart úshopper. that person was identified as lynn murray. the san francisco-based company issued a statement that says in part, violence of any kind has no place in our society. we reached out to the shoppers family to offer support and resources during this difficult time. authorities given all clear out the yountville veteran some. report of a woman with a gun led to a lockdown. officer spent three hours searching.

weeks. a new federal survey finds half of the nation's elementary schools are open for full-time classroom learning. the number of children learnincl in person very greatly by region and race. in february, across the country students in rural areas and towns were far more likely to be back in the classroom full- time compared with students, cities and suburbs. among fourth-graders, 49% of white students were learning fully in person with 27% fully online. those numbers reversed for black students. 50% learning online with 20% learning and person. 56% of hispanic students were distance-learning. among children with asian percent 68% were doing remote learning and only 15% doing in person learning. alameda and napa counties could advance to the orange tier as early as next week.

proposes a bunch of laws that would do nothing to stop these murders. >> ted cruz is good at yelling. he is not good at telling the truth. the truth is that states with stronger gun laws have lower rates of gun violence. >> reporter: the senator suggested he may introduce gun legislation that he proposed in 2013 which would expand background checks. it would not include restrictions of the bills that passed in the heart of oakland chinatown to remember those killed in the a lantus ball shootings. many are demanding hate charges be brought against the suspect. >> reporter: a massive crowd of people in oakland california tuesday afternoon to remember those killed last week more than 2100 miles away, at three area spas in atlanta georgia. >> from heartbreak, to rage, to

grief, to numbness, to fear, even at times i embrace my children. >> reporter: police are still investigating the motive behind the shooting spree. they say the suspected gunman, 21-year-old robert aaron long, told him he blames the businesses he targeted for providing an outlet to his addiction to sex. in their eyes this is a hate crime as six of the eight killed were of asian descent. >> to see another case were asian women have been targeted and murdered is heartbreaking. >> reporter: judy brought her six-year-old daughter and three- year-old son to this vigil. >> i think it is very important that they see what is going on and they are part of the healing process. >> reporter: long is is suspected of killing all eight victims. police have not determine if they were a specific target.

breezy. look at what they are doing to the temperatures. most of us are milder. that will lead us to a milder afternoon. along the east bay shoreline. we have some of our warmest temperatures compared to 24 hours ago. a lot of mid and upper 50s. 52 in richmond. a little cooler and shelter areas. 44 right now in concorde. ú48 i 49 in albany. 43 in santa rosa. some of those are the cooler spots. 48 as a look at 87 in san jose. we use that for the backdrop of our planner. temperatures settle into the 40s by 7:00 as the breeze will taper a little bit. sunshine at noon, we are starting to season high clouds in the north base guy that will overspread from north to south as we go through the afternoon. it will not stop us from being warmer than yesterday as temperatures will be around it

starbucks is apologizing to a black man for alleged discrimination at a local store. the man said he was asked to wait outside while employees made his coffee. the customer believes it was because of his skin color. abc 7 race and cultural reporter has a story that you will see on abc 7 news. come straight up to me and points the door and says i need to outside. at that moment, it is embarrassing. it is humiliating. why be? >> reporter: starbucks apologizing to the san francisco barber as he was told to step outside the san jose

location while he waorder march he said a manager told him the store was at capacity for santa clara county covid restrictions. but other customers were allowed in. úhe told abc 7 news he was targeted because he was black. >> i was the only black in there. i do not know what was going through her mind. >> reporter: after the incident he took to instagram posting a video sharing his experience. >> it is sad and unfortunate how real discrimination is. >> reporter: i reached out to starbucks and received this statement. we have no tolerance of any kind in our stores. we apologize to mr. ward for his experience and we are retraining staff on how to respectfully navigate capacity limits to protect the health and safety i was also told by a spokesperson that the company does not have video available. despite having security cameras at the store.'s attorney is not buying it.
