brooklyn center. hundreds gathering at the city's police station defying a mandatory curfew. >> if you continue to violate the curfew order, you are in violation of an unlawful assembly. >> reporter: the crowd clashing with officers in riot gear who fired tear gas and pepper balls. the unrest spreading into the streets where several businesses have been looted. the second night of outrage follows the death of daunte wright, the 20-year-old unarmed black man shot and killed by an officer during a traffic stop sunday. this morning that officer has been identified as kim potter, a 26-year veteran of the force. the police chief calls the shooting an accidental discharge saying officer potter meant to use her taser, but instead she fired her gun. >> it is my belief that the officer had the intention to deploy their taser but instead shot mr. wright with a single bullett. this was an accidental discharge that resulted in the tragic death of mr. wright. >> police say after wright was

stopped for a traffic violation, officers discovered he had an outstanding warrant for a misdemeanor defense. body camera video shows a struggle and wright getting back in his car. officer potter is heard saying "i'll tase you," but she fires her gun. >> oh, my [ bleep ]. i just shot him. >> the car traveled for several blocks before crashing. wright was later pronounced dead at the scene. >> you don't mistake a stun gun from a gun. you don't mistake that. if i made a mistake that i will be in the jail cell. she needs to pay for what she hoof -- my family's blood is on their hands. >> reporter: the medical examiner ruled the death a homicide. officer potter on administrative leave and the mayor fired the city manager. >> our hearts are aching right now. we are in pain right now.

and we recognize that this couldn't have happened at a worse time. >> reporter: the tension in the city heightened because just ten miles away the trial of former minneapolis police officer derek chauvin charged in the death of george floyd. >> say his name. [ crowd chanting "daunte wright" ] >> reporter: this morning his family demanding justice while calling for peace. >> everyone is going to remember his name. so that's what he wanted. i'm happy that he wanted to be known, but not this way though >> reporter: at least 40 people arrested in the chaos overnight. police say the looting was limited. coming up later this half hour we'll talk to a former chief of the nypd about this case and whether that officer should be fired. prosecutors are expected to rest their case today at the derek chauvin trial. we should learn more about whether a passenger who was in george floyd's car will testify. yesterday in court a cardiologist denied that a heart condition killed floyd and a use of force expert said no reasonable officer would have

done what chauvin did keeping his knee on floyd's neck. there was also emotional testimony from floyd's brother. >> he was a big momma's boy. he would just lay up on her in the fetus position like he was still in the womb. he showed us like how to treat our mom and how to respect our mom. he just -- he loved her so dearly. >> the defense's case is only expected to last a few days. closing arguments are expected next monday. new details about a deadly shooting at a high school in knoxville, tennessee. when police responded to reports of a student with a gun, they say a male student refused to come out. he opened fire wounding one officer. the student was then shot and killed. knoxville's mayor visited the wounded officer in the hospital. >> the officer was hurt. i thanked him for taking a

bullet in the middle of this incident. he said he would rather that he be hurt than anybody else. >> one person was detained for questioning. this is the fourth time this year that a teenager from knoxville has been killed by gunfire. turning to the pandemic there's growing debate over whether more shutdowns are needed to address the covid crisis in the upper midwest even though more than 20% of americans are now fully vaccinated. infections are surging in some areas, especially michigan. abc's faith abubey has the latest on that this morning. good morning, faith. >> reporter: hey, good morning to you, mona. michigan's governor is now contradicting the cdc as both sides discuss the state's dramatic spike in covid cases and how to respond. this morning, a blunt message from the cdc director to state leaders in michigan pleading with them to shut the state down amid skyrocketing covid cases. >> really what we need to do in most situations is shut things down. >> reporter: michigan's governor is requesting more vaccines. she says doubling down on distribution to achieve 75% herd immunity is the answer. >> we've got to grit our teeth and keep moving forward.

we're making great progress. we are getting close. >> reporter: but the white house says a so-called whac-a-mole approach with vaccine shipments won't work because it would take up to six weeks to send the state more doses. instead the cdc is sending michigan a surge team to help fema with vaccinations and the agency's director is calling for stronger restrictions in the state. >> go back to our basics and go back to where we were last spring, last summer and to shut things down, to flatten the curve. >> reporter: across the country the daily case average is now at peak summer surge levels, about 66,000 cases per day. experts say looser restrictions and more contagious variants of the virus are driving the spike. a new study says the uk variant now the dominant strain in the u.s. is more transmissible but likely does not cause more disease. >> we love you. feel better. you are missed, okay? >> reporter: now another famous face is added to the list of people infected with the virus. country music star luke bryan, sidelined from his role as judge

back now with the erupting volcano on the caribbean island of st. vincent. cruise ships are waiting to evacuate thousands of people if necessary. the heavy ash falling to the ground is collapsing roofs but the prime minister says no deaths have been reported. an aerial view shows it spewing 40,000 feet into the air. the u.s. is sending $100 million in relief aid. we turn to amazon making a new push launching its own food brand. fans and critics alike say they are set to take over another industry. here's abc's megan tevrizian. >> reporter: this morning, the now disrupting the snack food r- industry. amazon is launching its own food brand aplenty that will include hundreds of food like pita chips, snack crackers and other pantry food staples. >> amazon is the goliath so they

can dominate. >> reporter: it comes at a time when online grocery sales and snack food sales are soaring thanks to people staying home more because of the pandemic, and it comes four years after amazon bought whole foods. >> once they bought whole foods, then, you know, they decided, hey, this is a good complement. they weren't in the grocery business and learned a lot working with whole foods. >> reporter: retailers launching their own private labels is nothing new. costco has its own kirkland brand. walmart and target have their own house brands too. experts say moving to a visit label can be good for business and the customer. they can get the same quality food for a cheaper price saving 10% to 20%. but if amazon wipes out the competition, prices may go up. >> when competition goes away then you're able to raise prices and so unfortunately that's probably what could happen. >> reporter: last year amazon started its own wine brand. and a fresh line of bakery items and salsas.

mistaking her gun for a taser at one point stating that she shot him. in the video we see she is holding a gun. talk to us about the training involved here and how this could happen given that she is a veteran police officer. >> unfortunately, it appears that the taser was on the duty belt as well in a cross draw fashion. i'm a big fan of the thigh holdster with a straight draw on the weak side hand of it so you can't confuse the two. the firearm is about 34 ounces fully loaded. the taser is about 8 ounces so you could tell exactly the difference in the heft of it almost immediately and the color is different as well. it should be tactically the direct opposite of what your firearm is, and i don't know if that's true of what i saw in brooklyn center. >> officer potter on leave but the mayor of brooklyn center is calling for her to be fired. do you think that she should be fired? >> justice has to be served. we had this elsewhere in 2009 in the bay area where an officer

did something similar to what this officer did. it is an egregious act. it's something you cannot walk away from. >> i want to talk about the other case getting so much attention. u.s. army officer caron nazario pulled over for a missing license plate. turns out it was a new suv and had a temporary registration taped to the back window. one officer involved has been fired after pepper spraying him. >> i'm honestly afraid -- >> you should be. >> what is going on? can you please talk to me about what is going on? >> get on the ground. get on the ground now. >> we're told nazario took 1:40 to pull over because it was dark and wanted to pull into a well lit area but police claim he was resisting. what do you make of this and is taking less than two minutes to pull over unreasonable? >> i saw it. i timed it myself. it was about two minutes. he pulled over then he was

compliant initially with all the verbal commands by the first officer. you saw his hands. he wasn't a threat at that point. the time now is to teach de-escalation to our officers to get them out of the car as quickly as possible but also be firm but not to be overly because then escalating a situation where you're screaming like that so i saw improper tactics by the one officer, the other is the secondary officer who apparently was not terminated. >> and, chief, while i have you, let's talk about a separate situation in oakland, california, the police chief addressing murders are up 300% so far this year compared to the same time last year, carjackings up 160%. shootings up 100%. the police chief is blaming pandemic related budget cuts. but what do you think is going on here and what can be done about these numbers? >> well, i think the place is not working and is a complete failure so i see well-trained police department is what you really want in the city sensitive and transparent to the community needs. i see we're up in a violent crime surge.
