this happened just after 12:15. the usgs is reporting this was a 2.8 that hit near piedmont. this is the second earthquake in that area this week another one can't monday morning. happening today, president biden will address his first joint session of congress. he is expected to unveil plans for free day care. he also expects to make the affordable care act permit. >> ror new details emerge about a sweeping childcare and education plan he is expected to unveil. abc news has learned the bill will provide free preschool for all 3 and 4-year-old children. the average family would save $13,000. he is also expected to call for free community college. he wants to make permanent the temporary extension of the

temporary care act which is allowing many americans to play lower premiums. he will call for raising taxes on the most wealthy americans. tim scott will deliver the republican response to the address. >> thank god there is unity in the diversity. i hope to talk about that tomorrow night. >> reporter: the joint address will take place under heavy guard. fencing still alarms following the insurrection. before the speech, he is expected to meet with staffers who were there during the riot. the white house usually keeps one cabinet member in a secure location while others attend the speech. because of the pandemic, only a few will be on capitol hill. the plan to pay for his programs bases fierce criticism. they feel this will be a job killer.

guidelines. the cdc says vaccinated people can go for outdoor walks or runs without a mass. they can sit at a table with on vaccinated people outdoors but some are telling us they still want to be cautious for a bit longer. >> just wait just to see if more people get vaccinated or if not. i am just on one dose. >> reporter: the federal government says masks are still recommended outside in big group settings like concerts and sporting events and indoors at the barber and hair salon, small indoor gatherings, indoor activities like shopping. the cdc says it is safe for people who are fully vaccinated to be outside without a mass. officials are hoping this will encourage people who haven't gotten vaccinated to go get the shot so they can take this next step towards normalcy. live in san francisco, amy

hollyfield, abc7 news. >> thank you. the mass vaccination site at the event center will reopen tomorrow. it had to close earlier this month because of low supply. they plan to hold multiple events per week. the site is drive-through only and appointments are available now. police body camera footage has been released from an incident last week when a man died as alameda police were trying to arrest him. after seeing the video, the family now says police murdered him. we want to warn you this video is hard to watch. >> i think you had too much to drink today. that's all. okay. mario. mario. >> police say that the 26-year- old died of a medical emergency during this arrest last monday. body cam video shows officers attempting to place his hand

behind his back and then him losing consciousness. police say they did not use excessive force. the family says that's not what the video shows. they say gonzales complied with officers at the scene and they believe the weight the officers put on his head and back is what killed him. >> yesterday, my family and i saw the footage and we know what really happened. alameda police officers murdered my brother mario. >> the alameda county sheriff's office, the county district attorney's office, and the city police department have all opened investigations into this and they are waiting for autopsy results. the fbi has opened an investigation look into the killing of a black man who was shot by sheriff's deputies in north carolina. jobina fortson is at the live desk where a curfew was put into effect. jobina. >> reporter: protesters have demanding answers in the shooting of andrew brown, a

father of seven. he died a week ago today and was killed by deputies in elizabeth city, north carolina. an autopsy showed brown was shot five times, four times in the right arm and once in the back of the head as he was trying to drive away from deputies. authorities were there to serve a warrant against brown. no weapons were found. the family says they were only able to see 20 seconds of body camera footage of the deadly encounter. they are calling it an execution by law enforcement. they are demanding the release of the entire footage which the governor and the sheriff has supported doing. >> a black man, unarmed, a bullet in the back of his head for no reason. >> is also against police practice to shoot into a moving vehicle, to a person who poses no threat whatsoever. >> reporter: demonstrators have

about the protocols. i told them three times that it should be pfizer for my shot. obviously, it is in the medical records because i got my first dose there three weeks before. it was definitely in their computer system. >> the cdc's saying that sayingi not interchangeable but there is no risk. vaccine missing is helping in the uk where experts are trying to find out if it will have an increased benefit. alameda health says they are investigating. the health provider added, quote, we have added 31,000 vaccines using careful protocols. the pandemic has forced the cancellation of burning man for the second year in a row. they are now focusing on putting together a plan to bring burners back to the desert in 2022. organizers said there were too many issues to resolve. they hope to have online events to help fill the void.

new developments as the drought intensifies. water agencies and officials are taking action. sonoma county supervisors have proclaimed a local drought emergency. the east bay district board has voted to declare a stage one drought and in the south bay, the water district is hurting people to cut back. millions of customers across the south they are asking -- are being asked to cut back. they voted to ask customers to voluntarily reduce use a 25%. >> one dry winter, you know, you can survive through that. after a couple of dry winters, you have to take a look at the outlook. >> matt keller says groundwater levels are normal but with drought conditions getting more serious that action is needed now. santa clara county is in a

severe drought with the board of director voting to double the price it pays to homeowners to use drought tolerant landscaping. we are learning what that drought means for you. the latest report shows water supplies are far before normal. they prompted the board to call for a voluntary water reduction of 10%. that starts may 1st. they are urging customers to fix leaks, keeps showers short, and invest in water efficient appliances. it is here and it is only going to get worse unfortunately. i was joking, can i get a child credit for the east bay mud? we had two people last year and we have three now. the water usage is going to go up.

i'm sure we will get dinged for that. all joking aside, the drought did get worse during the rain season. it won't get much worse from here on out. we don't expect any rain. the entire state is 100 percent dry. look at the extreme. it jumped from 35% to 50% over the winter. now, we are going to keep this in the back of our mine. we are also going to watch what happens to the war reservoirs. that's where the drought is going to be felt the worst as we head through the next several months and the fire season getting an earlier start and a later ending, more than likely. those are the things will focus on moving forward. today, really focused on more sunshine and warmth and calmer. a little bit of fog. milder. high pressure overtop of us. that will bring us the warmer weather today. we will take a look at that. 77 to 82 across the south bay. 77 to 80 to san bruno and the

patients from the veterans affairs health system. they were not hospitalized with covid. they experienced long-lasting medical problems. patients experienced respiratory issues, cardiovascular problems, gastrointestinal pain, and memory loss. >> the major headline was they found in months two through six after infection, people were about 50% more likely to die than the control subjects, people who had not had covid-19. >> the majority of the survivors analyzed were white men. more than 1600 died, that was about 2.3% of this group. the specific cause of death is still unknown. a flight attendant is suing her employer, accusing the company of blacks safety calls which she says led to her husband's death. the 69-year-old is seeking more
