san francisco but overall, the number of reported incidents is actually down in each of the last three years. here are the numbers. 818 in 2019. 590 last year and 568 this year. assault is defined as any intentional act that causes another person to fear they are about to suffer physical harm. it doesn't necessarily include physical harm. now to the latest on the coronavirus evan anderson won an appeal of a challenge to one of his executive orders during the pandemic. republican lawmakers say the act illegally laid out procedures for a male in election but the appeals court ruled newsom's order complied with a law that gives him expanded powers in extreme circumstances like an pandemic. california's seven-day positivity rate increased slightly to 1.2%. the number of hospitalized pati thnumber of patients in intensive care is increasing, however.

vaccination tracker at abc7news.com. this photo of a smoldering tree may not look like much to you here. but it is if what scientists and fire crews believe is true. according to the national park service, experts believe the giant sequoia is still smoldering and smoking from the last year's castle fire in sequoia national park because it is well within the fire area and there is no trail access to it. the castle fire started last august. we are talking about nine months. the fire management officer says it shows how dry the park is right now. it is going to be a rough fire season this year according to the latest wildfire forecast from accuweather. abc7 news meteorologist has a look at what is expected. >> i wish we had better news but i don't think it is anyone's surprise that accuweather is forecasting an above average fire season. looking at california, much of central and northern california including the bay area is in extreme risk of wildfires for the season and had according to

accuweather. the biggest factor that is fueling that risk is the record dry vegetation. everything is in a drawer right now. anywhere from extreme to exceptional across a big swamp of california so accuweather is forecasting 9.3 million acres burned across the western united dates as a whole. that is 130% of the five-year average. at home in the bay area, the highest threat for wildfires really comes in september and october. these numbers just came up from cal fire a few hours ago. this year, so far, up until today, we have already burned 13,600 acres. compare that to this time last year. we had only burned about 1700 acres. so it is a significant increase already from last year, kristin and all signs are pointing to a very fast start to the fire season and a pretty long fire season that could last 5 to 6 months to september and october.

afternoon. what is your take on this decision? it feels a little bit like facebook is trying to make up the rulebook as they go along here. >> i think that is right. i think that is a good feeling. the oversight board actually got a lot correct here. it said to facebook, we are not going to make this decision for you. we are not going to provide you with political cover because you are uncomfortable with making an actual decision here. we are going to call you to do that but did that is important for users, not just for president trump but for everyone, is they said, look, facebook, you need to have clear policies and you need to apply them clearly and consistently. you are not doing that now. that has to change. well, radio and tv stations, we answer to the fcc so if a tv station broadcast hate speech for example it could lose its license. there really is no governing body for social media sites. do we need one?

>> i don't think that actually would be a very good idea. i actually think this situation helps illustrate why. so what we have right now is a situation where a person on facebook has the first amendment protected right to host any speech it wants to or take speech down if it wants to. if someone is not happy about that, especially if they are the former president of the united dates, they can go and create their own website which is exactly what former president trump has done. >> right, but, you know, it is unlikely he is going to have 2 billion followers or whatever facebook is up to at this point. should there be different rules for private citizens as opposed to public once like politicians or presidents? >> well, the concern i have is if we tried to come up with sort of one global set of rules for everyone, all countries because remember, this is an international situation. for all countries and all different contexts, we are going to fill out that x effort

so that is why i'm against coming up with one set of rules for all social media plot one. we certainly cannot do that consistent with the first amendment. what oversight board said is they know that there are some members with more influential -- when you do that you need to take extra care to be consistent and extremely transparent about what you are doing, precisely because they are so influential. that is something facebook has done a terrible job at. pretty much from day one. >> yeah. as private companies, though, facebook and turner twitter and others, they can apply their own rules. in this case, the ban on president trump is indefinite. would you be in favor of something a little more concrete? if you post something objectionable, the first time, whatever kim you get a warning. next time, a slap on the wrist, strike two is you are a four- year, so when something, so do

we really know what the parameters are? >> that is exactly what we need. we need companies that can have 20 of leeway to do as they wish but if they really want to serve users, not just famous users but all users, they need rules that are clear, consistent and transparent. that -- at this point we still don't have that. >> yeah, what happens next in this particular case? in this case, it goes back to facebook and they are going to have the uncomfortable job of actually coming up with solid justifications for a permanent ban or not for this particular user. the other thing they are going to have to do a long way if they want to answer to what the board asked of them is they are going to have teresa visit -- to revisit their practices and fix quite a lot and make them a lot more clear for all users. that would be a real benefit. >> well, facebook is struggling in this area.
