king streets, everyone. >> reporter: it is turning out to be a very active night. this is something that sjpd says it did prepare for even releasing early cinco de mayo declaration plans. >> amanda, thank you. there's some late breaking news out of san jose tonight. a man has been killed in a shooting. you can see bullet holes in the windshield of a car in south 21st street. a second man was also shot but police say his injuries are not life threatening. investigators haven't released any information from the south bay. a group of children seen running from the scene of a grass fire. fireworks materials were found there. flames burned 15 acres in a vacant field. crews say wind helped drive those flames. it ignited two days before officials warned the california's fire season could be extreme this year it could be the

housing crisis. a judge decided the cdc did not have the ability to call the end of a moratorium. >> i've seen a lot of people with the same problem as me. we don't have a job and people like me, we can't find a job. >> ernestina collins lives in redwood city with her husband and son. she lost her janatorial job. and could not hold back the tears. >> my sadness is i spent all the savings i had for my daughters to continue their studies. >> reporter: wednesday a federal judge ruled against the national eviction moratorium saying the cdc had exceeded its

authority to impose the ban. late wednesday that judge agreed to put a hold on her ruling pending appeal. but that still makes tenant rights advocates uneasy. especially since california's eviction moratorium is set to expire in june. >> the bigger concern is this expiration date is coming and families will be in the streets so we will see a massive eviction as probably we haven't seen yet. >> over 40,000 families here in santa clara county alone will be at high risk of not just facing an eviction but the potential of homelessness. >> reporter: the new civil liberties alliance praised the judge's decision against the moratorium saying that housing providers are currently being forced to provide usintheir tenants. j.r. stone, abc 7 news.
