guard, benjamin gonzales. he saved the man that patrick thompson stabbed in 2017. thompson went on to commit many more hideous crimes. i asked the da why he did not do more to keep thompson behind bars? >> i saw his face and this is the guy that stabbed that other mail in 2017. >> reporter: benjamin gonzales recognized thompson's face and his body movement the moment that he saw this video i obtained. showing a man violently stabbing two asian women while they were waiting for this bus stop on market street. this was so violently thrust into this 85-year-old it punctured her lung when the knife handle broke off. engine was a security guard at this homeless shelter. along fifth and bryant he witnessed and restrained thompson after he randomly

attacked another man. >> you would just lay on the bed. he came up and stamped him right in the chest with scissors. the look on his face was unbelievable. it was very calm but very violent. he tried to push him out window. >> reporter: he has a long criminal history including multiple assaults with a deadly weapon from 2017 and 2019. he was released on mental health diversion in 2020. >> if something could have been done in 2017? maybe you would not be back on the street causing harm to innocent people. >> reporter: he was scheduled to appear in card but did not show up. i pressed the da on why he did not do more to keep thompson off the streets? you blame to the judge for the mental health diversion of mr. thompson in 2020? as the da, you and members of your office have every right to object. why did you not object? he sidestepped my question. >> the people that suffer from mental illness in ways that get

arrested get treatment that can hopefully prevent future criminal conduct. >> reporter: that prevention did not work. clearly. two seniors are recovering from serious injuries in the hospital. >> the arraignment has been moved to monday. as for benjamin? what happened in 2017 changed his life forever. he is now a school crossing guard because he wants to continue helping others . this time, children. dion lim . >> talk a little bit about whether they can decide if the could delay arraignment indefinitely? if it is just not show up? >> reporter: legal experts tell me that if mr. thompson is refusing to go to court? the arraignment could get pushed back but it is not likely. he could also be arraigned remotely or even without him present if thompson wants his public defender to do so. if he is suffering from a medical issue? the judge could go to the defendant.

is it because of all the publicity surrounding this? because of all the other things that have happened in the past? >> the president, released a statement blasting this involvement. the victims in this case and their families deserve the most experienced violent crime prosecutor in court today. not a criminal defense attorney with zero experience. on our newscast we spoke live with san francisco supervisor. we asked if the city was doing enough to protect its citizens. he was blunt in his response. >> no. i do not think so and i think there is blame to go around. with our criminal justice system they are not responding as well as they should. or the mental health system ouldd be responding as well need the state and local level. to monitor people that are going to the criminal justice

system with mental health issues. >> the contra costa issued a public report that it will not be prosecuting two walnut creek officers for shooting a 21-year- old man in 2019. he said this was a mental health crisis. abc 7 reporter brinkley explains the da's office says that there is insufficient evidence of this man's family but is not giving up. >> this is tragic that there are not quite the for these officers but is not surprising. >> reporter: the family of miles hall and supporters gathered outside of walnut creek after the das report came out. exonerating >> we want justice for my grandson. this should've never happened. >> june 2nd, 2019 is when he was shot and killed in walnut creek. he was meant a mental health crisis. >> reporter: one officer used a >> shotgun. he was armed with a garden tool
