ranch land and a local business. one dale after protesters marched through san jose police are providing new details about the moments officers shot and killed a man on monday. good evening thank you for joining us i'm dan ashley. >> and i'm ama daetz. you're watching abc news at 5:00, the hulu and any you stream. police released new video of the confrontation. >> but some still have questions. >> reporter: tonight questions remain over the police shooting of san jose resident demetrius stanley who died on day after a plain

officer shot him. police chief mata says she feared for his life but also added that he did not identify himself. the first plain officer jogged down the street past stanley's house. you can see a clip of stanley walking past a parked suv that police would later identify as an unmarked vehicle second plain clothed officer inside. stanley sees the the áf officer inside and walks past the vehicle. the video cuts off presumely right before the shooting. >> i think that's something that's dangerous. someone that confronts another with a firearm. >> reporter: family members and community activists say they believe stanley thought he was

being stalked and went outside to protect his family. >> they could have just been anybody. if i had the feeling that there was somebody outside of my house possibly trying to trying to break into my home or my car. i can't say exactly what i would do in that instance. >> reporter: the police department also says its officers did not have their body cameras on because they were only there to perform surveillance in connection with a robbery investigation from march. they also say stanley was barred from carrying a firearm due to a previous domestic violence allegation. local naacp president jeff moore asked for peace throughout the community and expressed his pain. >> hurt for the community. because we're torn. and my young people, our young people are angry. our young people are hurt and we're tired of seeing black kids get kill bid cops. >> reporter: the under cover officer who shot stanley is a 14 year veteran of the department and has been placed

on administrative leave. in san jose, chris nguyen, abc 7 news. more than a dozen oakland police officers all the way up to the rank of deputy chief are facing disciplinary action after allegations of excessive force and other policy allegations during four days of george floyd protests last summer. now all of this is the result of several investigations into what happened. abc 7 news investigator laura ashley has more on the findings. >> i will say clearly that june 4th was a failure. >> reporter: one year after scenes like these in oakland police chief armstrong announced discipline for his own officers. >> the policy is very clear. officers were not authorized to use gas in the manner in which they did and for that the department has held them accountable. >> reporter: this is the result of four different investigations including one by an outside independent expert. and it resulted in disciplining more than 2 dozen officers.

>> reporter: armstrong revealed those disciplined ranged from officer to deputy chief and the discipline itself could include suspension. >> in this instance the crowd control policy which likely the commission will be reviewing, is pretty strong. i think there was some human failure in terms of executing the expectation. >> reporter: opd policy allows the use of tear gas only when there's imminent danger to the officer or a member of the public. >> during these investigative processes they determined that that did not exist. >> reporter: moments after the chief's press conference we talk with the president of the oakland police officers association who told us he and his officers were largely blind sided by armstrong's announcement. >> what i'm devastated with is the chief did not talk to the officers that he's disciplining. common decency and courtesy is to give them the details of what violation they committed

arrested and confirmed. this incident is not tied to nuru in a corruption scheme. there's no sign of a san francisco grandmother who has not been seen or heard from since friday and a lot of people are very worried. today city leaders are weighing in saying there have been missed opportunities to bring her home safely. abc 7 news reporter wade freedman is on the story. >> reporter: in the mystery of 84-year-old phong and her disappearance is deepening. this is more than just a missing grandmother now. >> we do not have any reason to believe that a crime has occurred at this stage. >> reporter: miss phong disappear friday while walking to her home in district. later, a

crossing the tunnel. they dropped off mrs. phong here. that she asked to get out of the car that she may have said something about safeway but there was a language barrier. now critics are trying to make something out of that. >> we have reason to believe the language barrier may have play add role in why she got misplaced and is now lost or missing. >> it seems there were missed opportunities frankly for her to return home safely if it weren't for the lack of language support and

cocompetency. i hope they find her and i hope we find these two as well. in san mateo police are asking for you to help find this 16- year-old girl and her 5 -month-old daughter. the teen claudia ramirez and her daughter abigail were last seen at her mother's house. they last spoke to the teen on saturday night and she expressed the desire to live separately from them. if you spot claudia or her daughter please call san mateo police. a san jose man died monday after falling from a ridge while hiking in secoia national park. he's been identified as yao ming chin. he was hiking with two other people when he fell. a woman from milpitas also fell but was able to stop her slide. a helicopter crew rescued the woman and took her to

welcoming back tourists. the economic impact of tourism is something that we focus on this week as part of our efforts to build a better bay area. in the livermore valley, wineries like the lineage collection has to reimagine their business the last 15 months or so. their head wine maker is a sixth generation vitner and says this is unlike anything they've ever experienced. >> we often deal with fires and trying to mitigate with the fires. you have to close for months on end. >> reporter: the winery has managed to stay afloat by serving outside and doing virtual tastings. in tiburon the tiburon ferry company was forced to shut down for several months last year. they were able to reopen in july but with limitations. >> we're not just doing it to make money or have a company we're doing it because we love

more bears as the years progress. >> reporter: a team is now studying this issue. >> in the urban areas we have 24/7 access to food, water and shelter. >> reporter: here in marin county a bear had not been spotted in years until last month when a black bear was spot up in those trees. spring is when bears start coming out of hibernation and forging for food but there's other factors too. steve surles is known as bear whisperer, he lives in remote area and do and do an internet connection so we spoke to him byersqremile there's a bear. so it's profound. >> reporter: bears are now moving into new area to look for food. but surles says people

shouldn't be so worried about seeing them. >> we celebrate the fact that we live with bears here in mammoth. where in the city they lock down the schools and put up the helicopter and call the s.w.a.t. team. that really needs to change. no person has ever been killed by a black bear in the state of california. >> reporter: safe to say good news. in marin county, liz kreutz. a new regional park will be named after a trail blazing supreme court justice. the east bay regional voted for the name for the park. it will be named thurgood marshall regional park home of the port chicago 50. the port chicago 50 case which was handled by marshall helped lead to the

the military. marshall ended up becoming a a supreme court justice. this will be first national park in california named after an african-american. >> wow. we want to get to the weather. and sandhya patel joins us with that. >> reporter: it's a beautiful forecast today if you stepped out you will notice it's not quite as warm inland. concord livermore from the 90s to the 80s today. you can definitely feel the change in the air. i want to show you doppler 7. it wouldn't be summer without thunderstorms in the sierra. which is what we're seeing right now south of lake tahoe. some may be accompanied with brief down tours and gusty winds so just keep that in mind. but look at this view it's absolutely stunning from our tahoe camera. the temperatures are 57 in san francisco, 62 in oakland. comfortable 72 degrees in san jose and 55 in half-moon bay.

a strong stock market. ally bank is getting rid of overdraft fees because of the negative impact on its customers. ally is the largest digital bank in the united states. a company ceo says nationwide more than 80% of overdraft fees are paid by people living paycheck to paycheck or with consistently low balances. and according to one report sited by ally, a group of people who consistently pay overdraft fees are disproportionally black or latin x. the ceo says these customers need help not penalties. and eliminating overdraft fees helps them from falling further behind. amazon prime day is officially set now. now. june 21st and 22nd. the subscription will set you back $120. this year amazon plans to boost
