building a better bay area, moving forward, finding solutions, this is abc7news . panic in the south bay after reports of a shooting right near civic buildings and blocks from the vta yard that was the site of a mass shooting last week . good evening, thank you for joining us. you are watching abc7news at five here on abc7news, hulu live, and wherever you stream. the shooting happened near san pedro and heading street. it prompted a huge police response. chris is live on the scene with the latest. >> reporter: police have blocked off several streets in the area as they continue their investigation into this deadly

shooting. if you look behind me, san jose police have set up the incident command post at the intersection of san pedro and heading. the circumstances are unique. police say the started just before 2 pm about a block away from the shooting at the light rail facility on younger avenue which prompted a big response from both sj pd as well as the santa clara county sheriff's office. initially, two officers were stopped at a traffic light on san pedro and noticed two men running by them on the sidewalk. one of those men then collapsed on the ground, which is when one of the officers got out of the car and ran over to provide cpr. those attempts to save the man's life were not successful, and he died at the scene suffering from at least one gunshot wound. >> we do not know where they were running from, if they were

in a car or running away from somebody, whatever it was it was out of the ordinary. it caught their attention. sure enough, one of them was shot. >> reporter: police say the other man who was not shot has been cooperating but at this point it is unclear what connection he has to the victim. from sky seven you can see the quick response from law enforcement. for those of you just joining us, this view is giving us an overhead look tonight. the scene, right next to the santa clara county's sheriff's office. also the lease headquarters in the hall of justice. now back here live, officials do not believe that this shooting is in any way connected to last week's shooting at the vta light rail facility. that is the latest in san jose. thank you very much. today's shooting came as

state assembly members were voting on gun control measures. the state senator who represents san jose echoed the calls for reform in a statement issued after today's shooting that reads in part, this is only another indication that meaningful steps need to be made to strengthen and expand california's laws to prevent this kind of balance. i am committed to taking any action needed to safeguard our community. the first of nine funerals was held today for the victims of the vta shootings. the vta is providing buses to bring family, friends, and employees to each funeral. the first is a go-fund-me page set up to support the family. the vta says they have nine buses, each with a tribute on the side to memorialize the victims. as we work to build a better bay area, as the region recovers, some of our key areas of focus of the changing

workplace, the economy, and education. that is the topic we begin with this evening. today, one dozen help officers across northern california gathered at everett middle school in san francisco, urging students to get back in the classroom by the fall. we are looking into that back to school experience and what it will look like. >> i have to say, it was powerful to see all 12 health officers, many of whom have shared different views on how to handle the pandemic, come together today to agree that enough is enough. students need to get back to the classroom. >> reporter: it is a site we have not seen in nearly 15 months. 12 health officers standing shoulder to shoulder without masks, all sharing the same message. >> kids must return to school.

>> our goal is for reopening. >> on this, we are 100% united. >> reporter: health officers from san mateo, marin, contra costa, and alameda counties including the city of berkeley cited 72 scientific articles explaining why the risk for infection among students and staff is at a record low due to high vaccination rates and declining community transmission. >> in marin county, with now 3 million accumulated students days across 110 open schools we have seen no occasions where a student infected an adult in school. >> reporter: the same story in san francisco. the health department says zero infections reported among 17,000 students and 3000 staff that returned a couple months ago. >> our data show that students who have become infected have done so because there have been vaccinated adults in the household, not from being at school. >> reporter: promising results that prove a full return is safe, but what will it look like? will masks be required? >> we will follow the guidance, the school guidance from the california department of publicu

health. >> reporter: the state will release the guidance within the next week to specify which indoor settings may fire masks for students and teachers. >> we do expect there will be cases that schools, especiallysc until we have a vaccine available for younger students. >> reporter: for middle and high schools, every health officer agrees, it is back to the books and for class sizes by the fall. it is not required for any school in california to verify students vaccination status, but if there is concern about transmission or an outbreak is detected, dr. cody says schools will follow standard procedure with contact tracing and have those involved quarantined. stephanie sierra, abc7news. thank you so much. we are awaiting a decision over new workplace rules for californiato requirements. the cdc says they can go

without face coverings but they are also considering making employers provide masks for those who are not vaccinated. rules could remain in pin pin pp into early next year. a decision is expected in the next couple of hours. in san francisco, a visit by governor newsom today with good news for restaurants and bars across the state and for their customers as well. wayne friedman has more on the future of outdoor dining, and cocktails to go. >> reporter: even in this pandemic it is common to see a large crowd outside tommy's mexican restaurant on geary street but julio says he has never seen a crowd like this. >> well, no. the line is paying customers. these guys are just reporters doing a job. >> they were waiting for the governor to arrive with london breed. they came with good news for restaurants that have shifted to outdoor dining and drin. he wants to keep them around. >> we will figure out the permanency of this but we need to keep these places open.

>> reporter: it will take more than good intentions. the state department of alcohol and beverage control is going to extend regulations. these places will remain open pass to the end of the year. >> every part of this state has been moving in this directio enthusiastically. >> reporter: julio's family restaurant is a regional institution. the margarita he invented up to put this place on the map and sales helped keep it here. >> he supports the bar and restaurant community, which is vital to not just san francisco, but to all of california. >> reporter: both the e e e and mayor see these as an investment return opportunity. >> this employs people. it keeps people working.it makes san francisco more vibrant. >> reporter: now it appears it will make some struggling restaurant owners very happy, by keeping them around. >> family owned and operated since 1965. covid-19 cases have plunged

across the country. the cdc says the seven averages 15,600 per day. that is a 94% decrease from the peak of cases reported in january. in california the first 15 winners of $50,000 in vaccine incentives will be announced tomorrow. if you have been vaccinated you are automatically entered to win. while many californians will be waiting to find out if they one one of the vaccine incentives, tomorrow military members have not been eligible because their vaccine information goes into a federal database. our sister station in los angeles has the story. >> reporter: as california prepares for the rollout of its vaccine incentive program, veterans and some active-duty are realizing there names may not be in the running for the prize money. >> we reached out to the governor's office hoping that maybe they could correct this oversight prior to rolling out this program and it does not appear that will happen.

>> reporter: jeffrey brighton is with the california chapters of the military officers association of america. he says when he and a group of vets heard about the california immunization registry are meant, or care, they worried. the incentive programs website clearly states to be eligible you must get vaccinated at any site in california that reports to care. a spokesperson with the veteran affairs long beach health system confirms va hospitals do not report to care, saying in a statement, vaccine data for veterans who have received at least one dose of the vaccine are transmitted directly to the centers for disease control as required by federal law covering patient privacy. that means the prize giveaway, not a chance for anyone vaccinated in a va hospital. >> they were rightfully angry with it, because they are

so we can be together. let's get to immunity. now's your moment to get vaccinated. are you willing to approve a new tax to approve affordable housing? that is part of a new plan to end the homeless crisis across the region. david louis says civic and business leaders believe the current approach is >> reporter: it is clearly visible in many parts of the region that the number of homeless is growing.

the bay area council says the 6% increase over the past four years is the highest in the country. that is at least 30 thiessen people. >> we have to do more to bring people off the streets because the health impacts of homelessness, however, if you do not create exits, what you end up with is a never ending expansion of a shelter system. >> reporter: in the new study, the bay area council and economic institute project it will take almost $12 billion in ongoing spending to solve the crisis. its approach includes not only shelters but prevention and permanent housing. it is urging approval of $20 billion in the next budget to expand the governor's project home key program, a $10 billion ballot measure in the bay area to finance affordable housing. make new rental housing easier to build, declare a shelter crisis in cities with high homeless numbers to expedite creation of shelters, and an expedition increase in subsidy programs.

this opposition must be overcome to building the family and apartment units and single- family neighborhoods. they can big box stores or strip malls can be converted into a verbal housing and the cost of construction must be addressed. >> allowing modular prefab, allowing more flexibility and new materials to be used, i have seen houses being printed on a 3-d printer the future and our laws need to catch up with it. >> reporter: with an estimated one third of homeless living in vehicles, shelters are needed because it takes so long to build housing. abc7news. there is growing debate in the south bay over development. also, about housing. the city of san jose proposes changing a rope that would allow schools to more easily sell property , a potential win for education budgets and for affordable housing. now, one of the proposed properties is right in the middle of a residential neighborhood. as we find, not everyone is in favor of the change.

>> reporter: empty playgrounds, no students insight. it is not summer vacation in the oak grove school district, but the school is permanently closed, a problem in san jose, a victim of declining enrollment, but this valuable real estate in the heart of silicon valley cannot be easily sold, at least not yet. >> what is the way to allow flexibility for the school districts to monetize some of the value that they have in the land? you know, for their services while also getting at many, getting at some of the cities needs. >> reporter: the proposal, make it easier for schools to sell their land. under current t t only sell properties for public use, such as private schools, churches, or day cares but the new proposal will allow them to sell to private developers that can build housing and other products. this is one of the proposed sites for redevelopment, something that neighbors of the school are not excited about.

>> we are worried about our home values, we are worried about our privacy. >> reporter: one project is high density housing in the middle of the highway traffic area. >> we do not like that. we are worried about the quality of life, the traffic, the parking, all of that plays into the decision. >> reporter: oak grove superintendent said in a statement, the specific the site has not yet been decided. the district has been and will remain transparent through this process. even outside of the development issues for themselves, neighbors say class sizes are already impacted due to closing schools and this could make it worse. >> imagine all along how much chaos is going to create in this neighborhood. even if they so this area, and do the redevelopment with 160 units, where are those kids going to do? >> reporter: dustin dorsey, abc7news. let's move on to talk about the weather. it sounds like we are in for some very nice days ahead. >> yeah. it was nice today.

it was. it was a beautiful today. it was not too hot, and it was not too cold, at least that is what i thought. let me show you the 24 hour temperature change. up a degrees in san jose. livermore, i hope you got a chance to get out and enjoy .9 degrees warmer in santa rosa. i want to show you a live picture from santa rosa where it is right blue skies right now. 90 in livermore and it is a comfortable 83 degrees in the santa rosa. now, contrast that with the golden gate bridge camera. you see the fog rolling in, that is why the coast has not been really that warm. san francisco right now, 59 degrees. it is 55 in half moon bay. we see those summer microclimates. you can see the fog at the beaches and in the sierra we are seeing thunderstorms once again. the good thing with these thunderstorms is right now they are seeing rain accompanying those storms. obviously, that is important from a fire danger perspective.

is going to be a stark change from the weekend. we are going to get out of the 90s. much cooler weather.cooler weat. inland areas only in the 70s and 80s. tuesday, pretty much everyone inland in the 70s with gusty winds and even wednesday those temperatures will struggle to come back up. here's a look at the forecast. it is going to be mild to warm tomorrow, a little cooler or warmer excuse me on saturday, cooler on sunday and then breezy below average temperatures with a gusty cooler pattern on tuesday. we are looking at upper 70s. that is well below average for this time of the year but we have got to look at it from the perspective of this time of year fire danger is a real concern, anytime we can get cooler than average conditions, a little drizzle which we will see early next week, that helps to keep the fire danger reduced, which we like to
