now from abc7 live breaking news. >> a federal judge has just overturned california's three decade old ban on assault weapons. the ruling late tonight says the state's definition of illegal military-style rifles violates the right to bear arms. judge roger benitez writing in his decision, "like the swiss army knife, the popular ar-15 rifle is a perfect combination of home defense weapon and homeland defense equipment." >> governor newsom blasting the comparison releasing a statement saying in part, "the fact that this judge compared the ar-15, a weapon of war that's used on the battlefield, to a swiss arm knife, completely undermines the credibility of this decision and is a slap in the face to the families who have lost loved ones to this weapon." from the governor. california attorney general robb bonta is promising to appeal. new at 11:00 a scare in the

sky, delta says an unruly passenger tried to break into the cockpit of a flight from l.a.x. to nashville. this dramatic cell phone video shows crew members and even passengers wrestling him ground. good evening. i'm ama daetz. >> i'm dan ashley. the flight was diverted to albuquerque and tonight an update from the fbi on this scary situation. stop this plane, it was the phrase shouted over and over again by an unruly passenger on a delta airlines flight from l.a.x. to nashville. the man allegedly tried to break into the plane's cockpit midflight but did not succeed. the pilots called into air traffic control moments after it happened. >> yes. there's still a struggle going on. he is restrained now, delta 386. >> cell phone video shows the chaotic scene as passengers and crew held the man down and hauled him to the back of the plane. delta says the flight was

diverted to albuquerque, new mexico, where the fbi took the man into custody. the fbi has released very little information about the incident but says there is no threat to the public at this time. now delta says the plane did eventually leave for nashville and the flight is scheduled to land in less than an hour. governor newsom said today he will not lift california's state of emergency despite being just 11 days from the state's reopening. abc7 news reporter kate larsen spoke to bay area officials about what this means for june 15th. >> reporter: governor newsom was trying to hold a press conference about the state's vaccine police report winners, but the focus shifted when he said california's state of emergency will remain in place beyond the june 15th reopening. >> this disease has not been extinguished. it's not vanished. it's not taking the summer months off. for all of the reasons i just enunciated that's why we are not lifting the state of emergency here in the state. >> reporter: the revelation created confusion about

reopening rules and fueled accusations among many republicans newsom is abusing his power. >> newsom is on a power trip. >> reporter: john cox is a candidate in the newsom recall election. he did say he'd support newsom if he used cal-osha to reject the mask rules. >> i think it's nonsensical that one unvaccinated person in an entire workplace can make everybody wear a mask. >> reporter: some feel newsom is sending a mixed message by upholding the state of emergency, but health officials in marin, san francisco and san mateo counties say the order will not impact their plans to reopen the economy on june 15th. >> until the governor tells us that that's not the case, which he probably won't, we are ready to open on june 15th and we're going to celebrate that day. >> everything about this pandemic has had a political edge. >> reporter: abc7 news contributor phil matier says the state of emergency is not

about rolling back reopenings. >> it's a move that allows gavin newsom and the feds to continue their level of funding and if something unexpected happens, to have the power to do something about it. >> reporter: which is what newsom's press office said in a statement as well as clarifying that the state will lift regulations requiring physical distancing, capacity restrictions and indoors versus outdoors requirements. on june 15th governor newsom is fully reopening the economy. kate larsen, abc7 news. 15 californians who rolled up their sleeves to get vaccinated for covid-19 are now $50,000 richer. they are the first winners of the state's vax for the win incentive program. the winners hailed from nine different counties including six from the bay area. each will be notified in the next couple of days allowing them to remain anonymous. now there will be another $50,000 drawing with 15 winners next week and then 10 people will be selected for a $1.5

million prize each on june 15th. across the bay area slow streets created a vehicle free space for people to shop, dine and enjoy outdoor entertainment, but as the pandemic eases citiesare faced with whether to reopen the roads. as abc7 news reporter luz pena explains, it's a delicate balancing act to please both residents and business owners. >> reporter: it's friday night and both university and california avenues in palo alto are buzzing. >> the community loves it. people are coming from throughout the bay area to come and dine. >> reporter: friends luis and michelle drove from san jose to experience outdoor sitting in a traffic free downtown area. eporter: but as the state is set to reopen on june 15th, the city of palo alto announced a tentative plan that would reopen university avenue to

cars in july and california avenue in september. >> at a minimum we really love the idea of retaining the parklets and in a maximum maybe there's a way to keep some of the side streets closed. >> reporter: palo alto officials are targeting the upcoming three weeks to survey businesses in these two downtown areas. what's playing a key factor in their decision is parking. some businesses still need it. >> but a lot of the merchandise stores felt passed by and they've been really suffering, in part because the traffic and the pedestrians who walk down the middle of the street and now they can walk on the sidewalk. >> reporter: we did our own quick survey to hear from business owners. >> i think they should close this street for everybody's sake. >> reporter: and university avenue this restaurant owner wants to keep the downtown closed. >> a lot of customers still feel a little bit uncomfortable to come back insireporter: and avenue the owner of this nail salon lost between 20 to 30 parking spots up front, but he

says there's a solution. >> our clients can park in the back and this has actually helped all these businesses around here. >> reporter: palo alto's city manager is set to make a decision in three weeks. in palo alto, luz pena, abc7 news. the san mateo county fair returns tomorrow with the unique offer, get vaccinated on site and get in free. the fair was canceled last year because of the pandemic. attendance will run at 35% capacity with masks required. the fair runs until june 12. we've got a picture of the 84-year-old grandmother who vanished without a trace last week. she was wearing jacket, purple sweater, ugg boots and a red bean

beanie. today volunteers fanned out across the area handing out flyers. in the east bay a pro palestinian protest blocked an israeli container ship from being unpleaded at the port of oakland. this was the group this evening, but earlier in the day there were hundreds. longshoremen refused to cross the picket line to unload the ship. san francisco police are looking for a fedex employee caught on a surveillance camera stealing packages. it happened saturday at a residential building near harrison and fifth streets. you can see the woman entering the building and dropping off packages, but moments later she leaves taking amazon packages with her. she puts them in her truck and then drives off. fedex released a statement saying the individual responsible for this incident is no longer providing service on behalf of fedex and we have reached out to law enforcement to assist as necessary in their investigation. india is seeing a second surge of covid cases and a bay

devastating numbers continue to come out of india in the wake of its latest covid- 19 surge. a bay area teen saw the stats and wanted to help. abc7 news reporter dustin dorsey shows us how her fundraising led to the purchase of life saving equipment. >> reporter: the images coming out of india are difficult to see. more than 130,000 new covid-19 cases, nearly 3,000 deaths yesterday alone, numbers 17-

year-old fremont resident ashwari amo on nga has had her eye on. >> my family and friend's family has been impacted. they got covid. i was so scared and wanted to help any way i could. >> reporter: helping is nothing new for this teen. she's been raising money for other causes for years. so like with her other fundraising efforts in the past, she got to work. in just three weeks she raised more than $17,000 in life saving funds. >> these funds i was able to build three triage centers with the help of power and excel and these funds were going towards beds in the triage centers, air purifiers, oxygen cylinders and medical assistants. >> reporter: she got fundraising help from local nonprofit empower and excel. the group raised $55,000 in total funds to support 15 indian villages. for the ceo it's a proud moment to see the mission of the organization played out on such a scale. >> we involve the kids in the

conservatives say this is a clear example of silicon valley liberals trying to silence a conservative. >> the block is scheduled to be lifted ahead of a possible white house run in 2024. however, trump's account won't be automatically reinstated. facebook will assess whether the risk to public safety has receded. the fda has approved what's being called a game changer weight loss drug. the once a week under the skin injection can help people lose up to 12% of their body weight over about a year and a half. the drug will be sold under the brand name wegovi was approved as a treatment for type 2 diabetes in 2017, but evidence suggests it can help people lose weight by suppressing appetite. fisher-price is recalling 120,000 of its four in one rock and glide scooters after four infants died from suffocation. the consumer product safety commission says incline products such as gliders, soothers, rockers and swings are not safe for babies to

sleep in. parents are told to immediately stop using the recalled products. moving on now, sonoma raceway is welcoming back nascar fans the first time many almost two years. capacity will be reduced for the toyota safe mart 350, but there's still an awful lot of excitement about it, as you can imagine. the raceway is expecting about 15,000 fans to fill the stands at 30% capacity on sunday. today racing enthusiasts got a sneak peek watching practice laps from inside the venue. others sat up outside at the rv campground nearby. no matter what the location fans say they are ready for a weekend filled with socially distanced fun. >> so what's the plan this weekend? what do you do here? >> a whole lot of this. >> yes. all weekend. >> these people instantly feel like the kind of people you can borrow a tomato from. >> if you don't have a ticket for sunday's race, the event is sold out.

the first rainbow flag is returning to san francisco after being lost for more than 40 years. it's on display at the glbt historical society museum in the castro district in time for pride month in the bay area. gilbert baker designed it in1978. it was thought to be lost forever after being damaged in storage, but after baker's death in 2017 a small portion he had cut off was among his possessions. >> i called his historian and she said there's a big box in the garage. i think it's the big flag. >> it has more colors than the ones we're used to seeing. it had eight before eventually being redesigned to six . we honored igh school graduates in a rite of passage tonight. the alliance of black school educators partnered with the san francisco unified school district to recognize achievements of the students. organizers say this year's

you will notice, there's some fog over the city. it looks so pretty. we had fog from our east bay hills camera earlier tonight. the stronger marine push helped drive temperatures down. it was cooler today, about 10 degrees, and it's only going to get even cooler. look at monday. most areas are in the 50s to 70s range. heading into tuesday, i'm fast forwarding past the weekend because you'll see how dramatic the change is, 50s to 70s tuesday, well below average and the same pattern pretty much for wednesday. here's what's going to drive our temperatures down. it's an area of low pressure that is going to come out that'swh'sg up the wituesday, wednesday is en we'll see temperatures bottoming out. winds will be primarily on monday and then this gets very interesting. we're talking about the possibility of late season rain, ju as you will it sounds crazy. june is one of our

a rare sighting in contra costa county. look, this bear was captured on security cameras wandering through an oakley neighborhood at 4:30 this morning near cypress road and main street. oakley police are working with wildlife officials to track the animal down. the bear could still be in the area, so they're warning people to stay away. >> don't mess with the bear. we've seen a number of bears out and about in suburbs lately. >> it's

with purpose, fascinating art, recycling right. but first, charms for change. ♪ ♪ >> i always, i think, was crafty as a child, and i loved figuring out how things worked. i have been making jewelry for over 20 years. initially, i went to school at u.c. berkeley for chemical engineering, and i think my parents were a little worried for me, hoping i'd be a doctor or scientist or engineer, and jewelry just sort of happened. and it was really kind of cool, because my culture influences what i do, and is part of my art. and as an artist, you know, you try and think of solutions in the way you know how, and the first instinct is like, "i'm just gonna create a piece that symbolizes what's happening right now." ♪

my name is peggy li, and i am the owner-designer of peggy li creations. my work has been seen on dozens of television shows, from "riverdale," "scandal," "the bachelorette." i grew up in santa rosa. there weren't a lot of other asian families there. it's one of those challenges for first generation, where, you know, my parents came here, and they were doing their best to try and fit in, yet they wanted to be able to share their culture with their kids. we would, you know, take the almost two-hour drive to san francisco from santa rosa and visit chinatown and to eat the food. and i think it really helped them connect with their culture. so it was definitely a special place in my heart, and i wanted to support them. and then, all these hate crimes started springing up, as well, so it became like a dual mission.

here are the two pieces that i've created to raise money for different "stop aapi hate" charities, the first being a sterling silver year of the ox charm. and the second one here is a little fortune-cookie necklace. 'cause i think we all connect chinatown with food. i thought that was a cute, you know, typical symbol of what people think of when they think of chinatown. the profits of the sales of that piece go to save our chinatowns, which is a grassroots organization supporting san francisco chinatown as well as oakland chinatown. the second design is a sterling silver ox symbol, which, of course, we are in the year of the ox. the ox symbolizes sort of honesty, integrity, and perseverance. ♪ i think a lot of us, though, don't know what to do to

support. we want to support and don't know how. in my own way, the way i know how is to create these pieces. so many people were so excited to get their pieces and say, "look, when someone asks me about what i'm wearing, i can tell them, "i'm supporting stop aapi hate, and this is important to me," and it's a great symbol that people can wear to show their support. my parents never imagined one of their kids having sort of a creative career, but i think they'd be really proud that i'm standing up and saying that i'm proud to be an asian-american and that i'm acknowledging my roots and that i'm supporting my culture in this community. ♪ >> coming up, this woman is saving the planet one snack at a time. ♪ ♪ >> welcome back to the show.
