time brought on after the stockton schoolyard shooting that killed five children. in yesterday's 94 page ruling, the judge spoke favorably of weapon saying that they were overwhelmingly used for legalfoa weapons. he wrote quote, like the swiss army knife, the popular ar 15 rifle is a perfect combination of home defense and homeland defense equipment. the ban, challenged by a california resident in the san diego california gun gun gun gu the fact that the dge comparedar 15weonof war that us on the battlefield to a swiss army knife completely undermines the credibility of his decision and is a slap in the face to the families who have lost loved

ones to this weapon. the gun owner also called the ruli public safety. as far as what is next, california attorney general robert bonsai has promised an appeal. we will keep you posted on any developments with that story. new confusion over california's reopening timeline. governor newsom now says he will not lift the state of emergency. abc 7 news reporter kate larson spoke to bay area officials about what this means for that june 15 >> reporter: governor newsom was trying to hold a press conference. but the focus shifted when he said california's state of emergency will remain in place beyond the june 15 reopening. >> this disease has not been extinguished. it's not taking summer months off. for all the reasons i just enunciated, that's why we are not lifting the state of emergency. >> reporter: the revelation created confusion about reopening rules and fueled

accusations that newsom is abusing his power. >> it's unfair, and it's unwise. mr. newsom is on a power trip and that's the only way that i can explain it. >> if he uses his executive power for that, i think i would agree with him on that when. it's nonsensical that one unvaccinated person can make everybody have to wear a mask. >> reporter: summerfield newsom is sending a mixed message by upholding the state of emergency when health officials say the order will not impact their plans to reopen the economy on june 15. >> until the governor tells us that that's not the case, which he probably won't, we are ready to open on june 15 and we are going to celebrate that day. >> everything about this pandemic has had a political

edge. >> reporter: he says the state of emergency is not about rolling back reopening's. >> it's a move that allows gavin newsom and the feds to continue their liberal funding and if something unexpected happens, to have the power to do something about it. >> reporter: which is what they said in a statement as well as clarifying that the state will lift regulations requiring physical distancing, capacity restrictions and indoors versus outdoor requirements. on june 15, governor newsom is fully reopening the economy. kate larson, abc 7 news. this morning, the fbi is looking into the man who allegedly tried hijacking an airplane while it was in the air. the flight was diverted to albuquerque. fortunately, everybody is safe. everybody who was on board is safe. dan ashley takes you through this scary attempt. >> reporter: stop this plane. it was the phrase shouted over and over again by an unruly passenger on a delta airlines

flight. he is restrained. cell phone video shows the chaotic scene as passengers and crew held the man down and hauled him to the back of the plane. delta says the flight had to be diverted to albuquerque, new mexico, where the fbi took the man into custody. he says there's no threat to the public at this time. dan ashley, abc 7 news. delta says the plane did eventually leave for nashville. and it did thevodis 15 californians who got vaccinated are the first winners of the vacs for the win. the winners held from nine

different counties, including 6 from the bay area. each will be no next couple of days. allowing them to remain anonymous if they choose. there will be another $50,000 drawing with 15 winners last week and then, 10 people will be selected for a $1.5 million prize on june 15. we saw the slow streets the pandemic force the new way of doing things. as that eases, cities are debating with whether or not to rebuild the roads. university and avenues. you can see that it's a very delicate balancing act. it's friday night, and both university california avenues and palo alto are buzzing. people are coming from throughout the bay area. they drove from san jose to

experience outdoor sitting in a traffic free, downtown area. as the state is set to reopen on june 15, the city of palo alto announced a tentative plan that would allow university to reopen in july. >> at a minimum, we really love the idea of retaining the ellipse is in at a maximum, maybe there's a way to keep some of the side streets close. serving businesses in these downtown areas. some businesses still need it. >> a lot of the merchandise stores have passed by, and they've been really suffering in part because the traffic and the pedestrians walked down the middle of the street and now, with walking in the sidewalk.

for everybody's sake. a lot of the customers still feel a little bit uncomfortable. in california, the owner of this nail salon lost between 20- 30 parking spots upfront. but he says that he's been in the back. the fair runs through june 12. this morning, we got a new picture of the 84 grandmother.

you can see a purple sweater. brown pants, black ugg boots and a red beanie with an lg logo. this photo was taken at fourth avenue between balboa and -- on the day that she went missing. last seen at the corner of marina and fillmore in the city's marina district. is today, volunteers fanned out. san francisco police are looking for a fedex employee caught on a surveillance camera stealing packages. this happened near harrison and fifth streets. you can see the woman entering the building moments later, she leaves taking amazon packages with her. she puts them in her truck and drives off. fedex said the individual responsible is no longer providing service on behalf of fedex ground and we have reached out to law enforcement to see what's necessary in their investigation. let's check outside,outside,

today marks 40 years since the first cases of aids were officially reported in the us. a memorial will be held at golden gate park. reporter denise door spoke with one of the california doctors who authored the first report on aids and takes a look at the future. on this 27th birthday, ray -- was dying and in denial about having hiv. >> i had progressed all that way to aids. to basically, knocking on deaths door. >> reporter: aids is a rare diagnosis in modern-day los angeles. for 40 years ago, it was a

mysterious disease a striking young men across the country. each case, part of the puzzle. if one could put it together -- >> i saw the first patient who had something unusual. something very different. >> reporter: dr. michael -- and he is ucla colleagues knew that it rarely occurred in people with intact -- the type of blood cell or the cd4 cell had essentially gone missing. dr. fauci at one time called them the conductor of the immunologic -- the immune system does not function very well without it. they documented their findings in this landmark cdc report. the first to describe what would later be called called caa >> we knew what its characteristics were. >> reporter: in 1984, the virus that causes aids was officially named human immunodeficiency

group of homemakers is putting their skills to great use. they are donating theirdonatingi goods to help fight asian hate. >> baking has always been a form of therapy for me. it's just really comforting. business during covid has been surprisingly great. and i think a lot of people are actually striving to find little bits of joy around, so i think that really helps to cheer people up, being able to bring joy to people throughout something just really simple has been really rewarding. i met kat and amanda through instagram. we became friends very quickly.

i was really grateful this past year, we have seen a lot of hate crimes actually occur against asian-american asn communities. and we have seen it locally. we have seen it throughout the country. but really, the last straw was what happened in in in that really made me feel me overwhelmed with just sadness and grief and loss and anger. i wanted to connect with kat and amanda. i did not have the financial resources to do it, but i did have the ability to raise funds for an organization that would help fight what was going on. we are raising money for a san jose based nonprofit organization. it's been really great to find an organization that isthat ists
