good evening and thank you for joining us. you are watching abc 7 news. that alameda county sheriff sergeant is being investigated by internal affairs after paying a taylor swift song from the cell phone and attempt to keeping protesters from posting it to youtube. tonight they are speaking out to our reporter. and we have the story. >> reporter: members of the justice for stephen taylor coalition and anti-police terror project were outside the steps of the courthouse tuesday when they filmed this interaction with sergeant shelby of the alameda county sheriff's office and they were listening over a outdoor speaker to the pretrial hearing of officer fletcher facing voluntary manslaughter charges for killing taylor and walmart last year. they begin filming james with sergeant shelby and bert said shelby took issue with a banner supporters had put on

copyright algorithm or alert. >> reporter: the sergeant said training will go out by weeks end. >> the men will be briefed that this is not the procedure and we don't do this. >> i have not seen anything like this before, but again, we are trained to do our best to expect the unexpected from law enforcement and this is just another instance of that. a date is now set for the governor newsom recall election. this afternoon the lieutenant governor announced that the election will be on tuesday, september 14 and the decision came hours after the secretary of state shirley weber sent notice that a sufficient number of valid petition signatures were collected allowing the election to take place and the groups behind the effort submitted more than 2 million signatures and 2.1 million signatures in fact d 1.7 million were valid. today's announcement also means those interested in running can officially file the paperwork.

the deadline is july 16. a 30-year-old woman and eight-year-old girl are in the hospital after they were shot last night after their car passed by a vallejo church. they said they sprayed the car with gunfire as she drove near sonoma boulevard near chestnut street and some of the rounds hit the fellowship center. the woman is listed in critical condition and police say the child's condition has been upgraded from critical to stable and the police chief called the shooting intolerable act and asked the community to reach out to police with information about who may have done this. healthcare providing for a and the consumer product safety commission released a report saying fireworks related injuries and deaths jumped during the pandemic and we have more on why some healthcare providers are concerned the numbers could go higher. >> reporter: as bay area families prepare to celebrate the fourth of july holiday,

healthcare providers are bracing for a possible uptick in fireworks related injuries. >> there are no safe fireworks. >> reporter: this doctor director of the regional center in san jose said her team is staffed up ahead of the weekend. with more people hosting backyard gatherings, she said some may be tempted the light off illegal fireworks potentially putting friends and loved ones at risk. >> every year we see patients who the parent say i didn't know the sparkler was so dangerous. >> reporter: she is also chief of plastics and reconstructive surgery at sc bmc said she has seen too many people come into the er with preventable injuries. >> there is nothing fun about the stay in a burn unit or the loss of a finger or an eye injury or permanent vision loss or disfigurement. >> reporter: the warning comes as the fire department urges the public to attend professional displays as opposed to putting on their own at home. not only are fireworks illegal in santa clara county, but the states severe drought conditions have many concerned about health and fire danger.

safety precaution. emeryville is not planning any fourth of july activities but the city is planning closures along powell street and frontage road and that is a prime location for viewing fireworks across the bay in san francisco. a new class of recruits with the san jose fire academy got deep into the weeds about how to fight a wildfire. and it kicked off today a training course and they got familiar with the equipment and tactics of fighting brushfires. officials use the opportunity to remind the public to not light fireworks in the coming days. >> there are plenty of other ways we can celebrate the holiday without causing is e danger to our community and putting people's lives and property at risk. >> officials say they hope people listen to these warnings but they will be ready to respond to fires erupted over the july 4 holiday. if you want to see legal fireworks, or want information on other events in the bay area, and those of the really good shows, you can go to our website, abc7news.com. we continue to focus on

it says it shall be the duty of the owners of the lots. and what if they don't do it? section 400.5 says the director of public works shall remove or cause to be removed the rubbish or debris. >> reporter: we contacted the department of public works and they said they run an illegal dumping operation here twice a week, but daniel, a neighbor, said the trash never seems to go away. >> reporter: how long has that been there? >> for months. >> reporter: for now, to that trash has been cleared but the mayor said the city will codumping. >> we will be looking through some of that garbage and looking through some of those things and doing investigations and going after people. >> reporter: the board president represents the district and he said cameras will be instleinhotspots like this one.

and then there is the issue of parking enforcement or in this case the lack of. during the day people park in front of fire hydrants, block the yellow pads used by people with disabilities, and that night, the sidewalks are taken up by parked cars. this supervisor said there is a reason for having so many cars in the area. >> we have a lot of people who live in homes and to drive and because of the lack of transportation options and opportunities. so we have to improve transportation first. >> reporter: speeding is another issue and he said nothing is done. we spent three hours near that intersection and didn't see a single police patrol car. >> i drive around the city a lot and i see this bad in any other neighborhood and that bugs me. >> reporter: it is because of neighbors like him that problems are being addressed and for example residents have long wanted more options when it comes to public transportation. you did hear that. remember, many were front-line workers during this pandemic and in january of this year,

they finally got the 15 bayview hunters point express line and walton said people in the bayview deserve more and better. in the newsroom, abc 7 news. targets that it is closing all six of its san francisco stores early because of crime and specifically theft and shoplifting. all the stores in the city are operating from nine a clock a.m. until six a clock p.m. the company said for more than a month there stores have experienced an alarming rise in theft and security incidents. the san francisco mayor said cutting hours is not the answer. >> we need to make sure again that when these kinds of crimes occur that there is an accountability component. when the police officers make an arrest and some of these cases which they had including the one you saw all over the news in the walgreens with the guy on the bicycle and an arrest has been been been been

>> reporter: as the delta variant spreads rapidly across the u.s., public health officials are concerned certain pockets of california a fourth of july surge. >> as the delta variant comes in, you're at a high risk and this is not a good time to not be vaccinated. >> reporter: this epidemiologist doctor rutherford said the real concern is about unvaccinated people gathering and potentially spreading the strain known to be significantly more transmissible. >> probably 30% or 40% more transmissible than the alpha bear -- variant and uk variant. and you remember the rose garden when there were how many infected it was like 10 out of 75 or something like this and this could be 40 out of 75. >> reporter: the masking guidance recommends even vaccinated people stay masked when attending mega events which include 5000 or more people in doors. or 10,000 people outdoors. >> in the past few days we have seen a director for man unty an she expects the rate will more than holiday.

heightened wildfire risk and heat waves getting worse. we are learning more about the effects of our changing climate on your health. the latest revelation comes from a study at stanford on the links between climate change and allergies. we have a look. >> reporter: if you suffer from allergies, pollen season can be the most uncomfortable time of the year, but what if that season with its explosion of sneezing and watery eyes suddenly stuck around? >> we know with climate change and the increase in temperature, the pollen season is getting longer. >> reporter: in a newly released study, she and her colleagues at stanford set out to measure that change and they found that the pollen season in the bay area has increased about half a week per year over the past few decades driven by differences in heat and rain patterns. >> we are looking at a pollen season now that is about two months longer than it was 20 years ago. >> reporter: to make matters worse, the stanford team also found evidence that the pollens
